Ladies and gentlemen, it is 7:40 p.m. on Tuesday, February 24th, 2026. We're at the Twinsburg Government Center, and I'm going to call the regular council meeting to order. Mrs. Walker is going to lead us in the invocation of pledge of allegiance.
Oh God from whom all powers come by whose divine will all must abide. We thank you for our civil liberties and freedom for our opportunities and our privileges. We beg of you to bless, assist, and enlighten this council and representatives of the city of Twinsburg. May we prove worthy of the confidence placed in us by our fellow citizens. May we be just and upright in thin thinking, honest in all of our actions, and ever be guided by a true conscience in the legislation we propose or vote upon. In Jesus name we pray. Amen.

yes. All right. Approval of the minutes passes 70 as submitted. Are there any awards and presentations this evening? There are none. Do we have any audience participation this evening? We do. First, we have Colleen Rubin. Good evening, Mrs. Rubin.
Good evening. And again, thank you, Colleen Rubin, 2259 Sandalwood Drive. I spoke at caucus regarding the mayor, but I have concerns regarding the chief of police and council as well. Chief Mason is the foundation of lawsuits and settlements which have cost the taxpayers dearly, yet has seemed to avoid any fallout for his egregious mismanagement of our police department. I was unimpressed about his wife's speeding ticket controversy. However, the continued flagrant abuse of law with his son and daughter changed that. Most kids have made poor choices. That's what teens do. But a parent is supposed to make that a teaching moment. Chief Mason's kids learn that they don't need to obey law or suffer the same consequences as their peers. Then they watched their father, the chief of police, knowingly deceive the residents of Twinsburg over and over on their behalf. Then came the depositions which show a powerful story of failed leadership. In his deposition, Chief Mason had 211 evasive answers, as in I don't recall, I'm not aware, etc. Yet he was the official designate for knowing such things. This is who the city sent to 173 questions. He answered no knowledge, no memory or no awareness. 67 of those 173 fall into the core chief responsibility bucket. 27 times he said he did not know policy. 18 times he admitted to policies not being followed. He admits the police department did not follow policies when running the investigation of the TPD3.
In short, Chief Mason has a credibility crisis, a policy crisis, a records crisis, and a supervisory crisis. By his own testimony, he has demonstrated that he is unfit for command level leadership. Our chief was complicit in a sham set of terminations triggering years long cover up. One must ask, how did this happen? We have a mayor. We have city council. We have a law director. I checked [snorts] records and I found this comment from one of our council members. Council is to be the checks and balances. If the administration was not doing its job, the council would absolutely step up and put a stop to it. Also, we are blessed to have the city leadership that we do. I am not sure who is feeling blessed right now. I have sat here and listened repeatedly from councel unwavering support of Chief Mason despite all the evidence contrary to what was being claimed by he and the mayor. So please explain to the citizens what happened. I came to this podium more times than I care to remember with great concerns asking you please look deep. Then I brought details which were scoffed at as being fantastical tall tales. I have been ridiculed and criticized by council members. Residents were being told that record requests were flying out the doors in record numbers when citizen after citizen would come here and complain that this was not the case. A mandamus action was filed against the city. Did you not think that maybe some
of your constituents were telling the truth? Who were you listening to? And so I ask, did you not understand the scope of what was happening? One minute. Thank you. Were you fearful of retribution? Were you not kept informed? All of Twinsburg wants to know how [clears throat] the mayor and the chief of police were able to deceive and waste our hard-earned dollars when there was supposed to be checks and balances in place to protect us and we were told they were. You either you knowingly or negligently turned a blind eye. And if that was the case, then please resign. However, if you don't think that's the case, we want a full explanation of how this happened under your watchful eye. The people who elected you deserve answers and assurances that this is not going to happen again. No more millions.

Next, we have Lorie Facina. This takes courage. Yes. Good evening. Good evening again.
Here we stand. [clears throat] I'm going to abbreviate some of what I spoke about earlier because it's redundant and it's on record already. Uh, but I think I want to concentrate on this little board over here that I brought up because I guess it's very interesting. I'm another one of these people that's a victim of not getting records that I wanted to get. And I've not asked for a lot of records. I think I could count on one hand, maybe two, the records I've asked for in in a period of 10 years. But when I ask, they're important things. They're not trivial. They're not frivolous. They are things that matter to every one of us in this room if we live in this town. None more so than this. None more so than this. This was built under cover of darkness. It was given a conditional use of 50 ft in 2010. And and we don't have to quibble about this in here. It'll be quibbled about in more important places when the code in that part of town was not 50 ft. If you went if you drive up to Highland Road and you look at this, you'll just be stunned because it used to be Brownberry Ovens for those of us who have lived here for a way bit of time. Used to be Brownberry Ovens and it was graded strangely. So, you don't necessarily see that the building behind the original building is 50 foot tall. The smoke that you see there, that's condensation. That's when it was very cold two weeks ago and my husband and I were heading to an event and we went down Highland Road and I said, "My god, is there a fire on Highland Road?" And he said, "No, that's the AI data center. That's what comes out that you don't see on a sunny day." On a daily basis, that one facility uses 243,000
gallons of water. That would equate to 124,000 showers a day in this community. We don't have enough people to have that many showers. But imagine, should you, not one of these, but a hundred of these in your town. And I can tell you that if you drove 4 hours south to Ashurn, Virginia, you would see the delletterious effects of this kind of menace in our town. But somebody had a reason for bringing this into town and they endangered everybody in this town by bringing this in and then covering it up. There is no business name at 2000 Highland Road. Verizon is gone from there. Uh I found a great article that says Verizon was very clever. they went and turned a lot of their nonuseful properties into AI data centers that they own the building and then they lease out everything to one of the five big hyperdata center companies. So when I tell you that a it is an imperative that you listen to your citizens in this room and outside of this room and put this on the ballot because killing it I don't see a dead body. I see a working data center at 2000 Highland Road. Killing it is permanently codifying it. No AI data centers in town. And I can tell you that I've perused the new code and I found a get get out of jail free card to get rid of this. And if I have to pursue that, I probably will. It's in the code. I'm not going to tell you where it is. You could you could find it if you're clever, but but this is this is an existential
crisis above everything else. We're talking about this glorious downtown redevelopment, but we're not talking about something so dangerous that it could change your property values on your homes. It could change whether or not you can take a shower.
One minute. It will take over our electric bills. Our electric bills will go up. That's happened in other communities. Thank you for the one minute. This can't go on. This can't go on. I I I'm so ashamed when I come in here because I used to come here when my uncle was mayor. I know that's a long time ago, but it was robust. There was dynamic conversations, often difficult but productive. What I see up here is a solid ball of mass that says, "You don't matter. We matter. You don't matter." And that has to stop. It cannot go on.

Good evening again, council. Um, again with the whole police department dispatch thing. Um, I'm going to read something to you and this is in reference to the uh lawsuit that was filed and that everybody's talking about that has been settled and actually it was the records mandamus action. Um, I'll try to blow through this quickly. Uh, officers Fedau and Barlovak also wish to alert the court to the evidence indicating that the Twinsburg Police Department incident reports and other records which the court and its officers routinely rely on are susceptible to tampering with normal effort. as the case of Chief Chief Mason's son goes through the depositions. It talks about everything, you know, we already know about. Um, I'm going to try to save time here, but it goes through all of it and and at the end here it says that uh, moreover, despite knowing tampering with records is a criminal offense, Chief Mason testified uh, that he not taken any steps to investigate it or to discipline Lieutenant Trinowski, who was responsible for um, altering that report. Well, we have a problem because I we did speak Sam we and he's also not only our mayor but our safety director and we talked and I had asked for a complete investigation. Well, the problem is Lieutenant Trinowski did my [clears throat] investigation. So, yeah, how do I rely on this? How do I how do I and it was supposed to be a complete comprehensive investigation. I got what I got. Not good enough. Sam, I reached out to the Summit County
prosecutor. Um, reached out to his office, Brian, uh, Lereny, I think is his name, and I'm also, um, contacting the detectives. Um, and I want you to know I I'm asking you as our safety director to reach out to BCI, get somebody into that police department to do a complete and comprehensive investigation because that's what we need. That's the only way you're going to save face in this town, sir. That's what needs to be done. It's a hot mess in there and again, it needs to be fixed. We're not going to stand down. They've done everything they can possibly do to me. And I'm not going away. I want my records. I want everybody that was involved at what they did to me held accountable. And whatever else you find, those people need to be held accountable. This doesn't go away. Doesn't get covered up. Everybody's aware of it. Please do something. Do the right thing. Get the right people in here to investigate it because it hasn't been done. It hasn't been done. How can anybody rely on Lieutenant Trinowski if he tampered with police reports? Is it is is the investigation tampered with? Is everything that he's touched tampered with? How do we rely upon these people? Now, this is what I'm faced with. God forbid something jump off at my house. Who do I call, Sam? Who do I call? The Twins Police Department. How do I trust them? I'm going to call the sheriff's department. It's pretty sad. Thank you.

I would I need to tell you that 75% of the venom that comes out of that woman is false. False. Believe what you want. I'm telling you it's false. Stop. Please. Please. Thank you. All right. Um, Mr. Yes. Um, I just want to say that in regards to the data center, I will just speak um for myself that I didn't I did not realize personally that Verizon was no longer in there. Um, I don't want to pretend like I did know that because I did not know that I was under the impression that Verizon was still in there and that it was a small data center that was part of that. So, um I guess Well,
no, I I believe you. I believe you. So, I I guess my question is, um I don't know who else knew that or didn't know that. Um but I guess the question is what I I think we should look into that. And I do agree and I thank you for bringing that to our attention because I did not know that and I don't know what I don't know. And so, um I do agree that you know if there is a data center there um it shouldn't be and I agree with you. So, for what it's worth, um, Miss Ziggler, if you could, you know, find out some more information about that, um, and maybe find out how it got in there. If Verizon tried to find a loophole, maybe um, to put that in there and if if that shouldn't be there and it's not allowed, how do we get rid of it? So, if we could figure out all those answers, that would be awesome sauce. All right. Thanks.

Uh, since our last meeting, I attended the February 19th architectural review board meeting and three cases were heard. Uh Chamberlain Road, there's a new single family dwelling that architectural rendering was approved. On Daryl Road, Primrose Schools signage was approved. On Revena Road, Absolute Auto, new sign approved. Architectural Review Board meeting scheduled for March 5th is canled due to a lack of agenda items. Next regularly scheduled meeting will be March 19th. Um residents in Tickers Woods and Heritage Estates may have seen uh some utility markers. Those utility markers are most likely connected to an infrastructure improvement by uh Windstream Kinetic to improve high-speed internet in that neighborhood expanding their network in Twinsburg. They've been in other community or other parts of the town. They're coming to a good chunk of Ward One. Earlier this month, a resident emailed us.
Is that fiber? Yep. Highspeed fiber. Um earlier this month, a resident emailed all of us about a citywide framework that Avon Lake is using aiming to align city plans, growth, uh finances, a whole bunch of stuff, uh together. It basically sounded like Avon Lake has developed a strategic plan. Some of what we deal with up here sometimes feels like u we would benefit as a community if we had a strategic plan. So maybe that's something we could discuss in the future specifically for five years. Different than the comprehensive plan, different comprehensive plan.
It was the strategy it, you know, you could check out the if you didn't get it, it popped into my junk mailbox, so it took a little bit of effort to find it. Uh I randomly found it. I'll forward it out to everyone again. Um so, you know, I want to start this with remembering that uh the way the code is written, there's no mention of data centers. So, effectively, they're told I'm told they're not allowed. So last week, uh, I attended the Ohio Municipal League's program on data centers. Again, data centers, as far as we knew, up until earlier today, not allowed, not part of our community, right? Uh, since that topic came before us several months ago, it's been something I try I've tried to lean into and learn a little bit about. So, it was nice to be able to attend this uh this program. And uh basically um you know I think it's important to re report back to our residents that talked about a topic to let them know that while we might not see legislative action people are looking into it and I'm I'm looking into it. So for Lori, Nora, Michael, Chris, Casey, Lawrence, Susan, Richard, Lynn, and Jimmy. I heard you and I'm looking into it. So, OLM had uh Ohio municipally had the Montros group and Amazon come in and they talked about uh the market of data centers. Ohio's number four um in the country right there four we're the fourth largest state with data centers and it's growing quickly. It's going to grow at about 18.5% for the next five years targeting mostly agricultural land and brownfield so former industrial land and agricultural land. And you know, I know it's the likelihood of it impacting Twinsburg in a significant way is pretty slim. Uh, but it impacts our region in general. So, I think as an elected official, it's important to be aware of what's happening and to be able to communicate when needed. So, Amazon represents lots
of jobs in Ohio and they're a big player in it. So, here's the deal. Uh, this whole thing, lots of information was shared, including that Amazon has 15 acoustical engineers on staff. There's times where I see more than 15 Amazon trucks in my neighborhood. So if they're taking this problem seriously of noise, I'm not really seeing it from what they shared. Uh our legislative bodies, the state legislator, uh Casey Weinstein has introduced and is working with colleagues on a number of issues related to data centers. Our current state representative Steve Demitrio is working on that. The Ohio Municipal League just sent out a memo on a uh what do they call it? It's a a legislative update to communities. And that legislative update to communities included information about home rule and changes to put the rules and the growth out of the state legislative body and back to the local neighborhoods. Okay, that's just what's coming down from Columbus. So, we have both sides of the aisle working on an issue that they may have created themselves, but they're working to fix it. Um, you know, I just wanted to share this to kind of close the loop and let residents know that that we're working on it and, you know, I appreciate the opportunity to report on it. It's maybe not the way I wanted to, but that's okay. I know in the past when we've had similar things that were under consideration at the state level, we've put a pause on things through a moratorum. Maybe that's something that we're willing to discuss in upcoming meetings. That concludes my report.

Thank you and good evening. The uh next finance committee meeting will be on March 24th at 6:30. The next CIC meeting will be on March 12th at 4:00. Also, I uh would encourage our residents to go on our website and take the uh survey for the Twinsburg streetscape improvement program that Rebecca has put forward. It's an easy five question multiplechoice rating kind of a uh of a uh survey. And so they partnered with an environmental design group to develop downtown streetscape for state route 82 and 91. And these standards will help guide us for the look and feel of our main thoroughares creating public space safety, welcoming, walkable, and distinctively Twitt. The survey will be available till March 5th. Please take a look at our website mytwinsburg.com and uh take the survey. We'll take you about five minutes. The Cleveland Guardians are are hosting a summer camp in Twinsburg uh hosted by the high school uh school forum July 13th through the 17th. The camps are for boys and girls ages 6 through 14 and all skill levels from beginners to travel baseball players are welcome. It's supposedly high energy, highly instructional uh to build confidence, teamwork, and a love of the game. The uh camp is five days and then there's a VIP experience on at Progressive Field. Um, if you're interested, the, uh, Twinsburg High School has a website and also there's a Major League Baseball website, mlb.com/guardians/fans/summeramps. Uh I'm sure that they'll have this more
information going out through um our multiple media and ways to uh uh to get information to residents, but uh uh you know, when my son was very young, we did a a day camp at Guardians Field. It was really cool. It was fun. I And uh this is much more instructional. And uh they're they're basically doing a a round through major high schools in the greater Cleveland area to put these on. So anyway, if you're interested and your children are between 6 and 14, please look into the Guardians fan uh appreciation summer camp. That's all I have. Thank you.
Thank you, Mr. Fury. On February 17th, I attended the planning commission meeting. There was one case on the agenda that evening. The applicant, Ignite Volleyball, was looking for a conditional use permit for a volleyball training facility located at 2242 Pinnacle Parkway. Public notice was made, adjacent property owners were notified and there were no public comments. It was unanimously approved by the planning commission and later this meeting we made a motion to approve that conditional use permit. That me meeting also marked the last meeting for Michael Walker. He is a member of the Coast Guard and he was mobilized to Arizona for a year. I would like to thank Mr. Walker for his support and service not only to the country but to the city of Twinsbury and the planning commission and wish him the best of luck in his in his uh travels. Additionally, that evening I had the honor of recognizing outgoing chair of the planning commission, Mr. Mark Cohen, and we recognized his 21 years of service to the planning commission. He will be sorely missed. Next planning commission meeting will be on Monday, March 16th at 6:30 p.m. here in council chambers. As Mr. Mr. Fury said the next finance committee will be on Tuesday, March 24th. And the next meeting of the safety committee will be on Tuesday, March 10th at 6:00 p.m. here in Chambers. Thank you. Um, Mr. Bellon attended the planning commission meeting for me last week, which I thank you for going and reporting. Um, excellent job. The next meeting, as he said, is scheduled for March 16th at 6:30. Um, the Jedi Committee will set up at the Black Business Vendors Fair tomorrow at Twinsburg High School from 5:00 to 7:00. The next Jedi Committee meeting will be March 9th at 6:00 p.m. And Lori, I just wanted to say just today I had a conversation. I was in the building with Lynn Mutter and we talked about getting that on the ballot. So, sooner rather than later, Thank you.

Thank you. The uh regularly scheduled meeting for BCA was uh cancelled this month and our next scheduled meeting is Monday, March 23rd here in council chambers. Uh no other committees that I serve on have met since this uh last meeting. I had the opportunity to meet with some of our department heads and leadership within uh the building department, police department, service department, and the water department, our wastewater department, and they are exceptional. A lot of great uh people within those departments that keep our city functioning and moving. And uh I appreciate them taking time out of their day to uh walk me around and talk me through some of the projects that they were working on. Um let's see. I wanted to um talk about a program that I learned about uh this is the mailbox replacement program. So, a few residents had reached out to me about uh you know the the snow that we've had over the past couple months or excuse me, past couple weeks, feels like months. Uh and our service department replaces mailboxes. So, if your uh mailbox was hit by a plow, uh they encourage you to call the service department. somebody will come out and inspect that and they go a step further of replacing it and uh you know taking care of it for you. So I found that to be a great asset. The phone number is 3309636212. Um again I think it's a step two mailbox that they have that they'll replace you with. Uh community engagement since our last meeting. I attended the Twinsburg Garden Club uh with my daughter and we were able to get our seed packet for our future uh garden that we'll be building out. So that was exciting. And uh we attended the Twinsburg Historical Society featuring the great great grandson of uh James Garfield who is a resident of Twinsburg and he is the executive director of the Garfield Trail. It was a fascinating uh conversation and um he had his great great grandmother with him uh was a great character player uh in that she plays a role I guess within the historical parks. But anyway, that was
uh fascinating. I'm glad that he's a member of our community and uh I encourage everybody to reach out to the Garfield Trail. Uh this Saturday I attended the soft opening of the Juice Club on Church Street and I had the opportunity to meet with the owner. I learned a little bit more about her goals and what she was looking to accomplish there as she opens and expands. Uh I think there's going to be adjacent to the juice bar a little bit of a I want to call it like a workout center or something along those lines. So it's being built out and I'm excited for her to open fully for us. The juice was great. um freshly squeezed and thankful for that to be in our community. And then I just want to say congratulations to Twin Mass Performing Arts Center. Uh their season kicked off in February and they were sold out for their first performance, remember for a lifetime. Uh their next performance is Vanities. It's scheduled for uh May and you can find more information on twin masks.org. I also too want to encourage people to uh fill out the survey. I know that we have in our home and um I had asked if we could get a QR code or something along those lines where we can put it up. Uh it may already be up, I don't know, uh like in a poster setting um in the rec center library and stuff along those lines to encourage people. And I had uh wanted to kind of get out to the library myself. was there talking to people about doing it, encouraging them to sign up and to fill it out this past weekend. So anyway, I'm looking forward to those results and uh thank you very much.

Thank you. Good evening, Council President. Uh I have one item. Um last week I had the honor of swearing in Miles Berdick to our police department. He's our newest member of the police department. Just went through the academy. And um what's really exciting about having Miles on board now is with him on board our police department and it's been a work in in progress, but is now up to full capacity that we haven't been up to full capacity in many many years. And I think that this is the time that um it should be up to full capacity with just the way the world is working today. Um so I'm proud of that and I'm proud of everybody in our police department. We have a very functional police department that works very well together. They work well with our community and um I'm just proud of them and I'm proud of Miles and congratulations to him and that's all I have to

Good evening. Just one item. Um we have started our 2025 audit with the auditor of state. So every council person should have received a fraud risk assessment. Um they send out different ones. Obviously, mine is probably a little bit more comprehensive than yours. Um, so if anyone had any questions, um, Jackie, who is our head auditor for this year, has said please feel free to reach out to her. She can explain what any of the questions mean or just give you some examples. Um, those are due back. I think she said March 6th is the due date to return those to her. So, email's best. She said if for whatever reason you can't access it by email, you can call her over the phone and she can go through everything with you.

Yeah, it's uh it's an increase of $144,000. I I do not like at all that the company was off by almost 50%. you know, it's a 50% increase, which I think when you go in and make a bid. I mean, it's nobody's fault obviously, but it's just frustrating that, you know, a 50% increase of needing more. You know, I just um it's disappointing to me that the company would be off by that much and our hands are tied on that. We have to get it done. But that's very disappointing to me. That's all. Mayor, now I can tell you part of the reason for the the increase is I know that they took out much more material.
I'm sorry. Part of the reason for the increase is because they took out much more material than they had planned on. Once they got in there, they emptied that pond and they they started digging it. It needed to be. And actually, there's still more that they would like to do, but it it's not necessary at this point. Yeah. So, that that's part of the reason. I mean, it wasn't that they were just off on their their uh quote or their bid. It's that once they got in there, and that happens, you know, change orders happen. None of us like them, right? We could have always said no and and had them stop. But I think that the right thing to do is to have them dig deeper and clean that out. Look at what the project's for because that was never dredged ever.

I truly appreciate your help getting the mailbox replaced. They replaced it with the same exact model which was I was not expecting. We were absolutely blown about away by the lengths everyone involved went to to replace our mailbox. They even put numbers on the mailbox. They fixed the landscaping around it after they installed it. Thanks again. So, massive props to to our service department. That's an outstanding program. Um, let's see. But we are going to talk as you mentioned before and with Mr. Gatowski um about different places that have come in. Um but I'm excited for fiber optic lines to go all around Twinsburg and give us all the the best internet and everything that we can uh we can all get. That's that's um that's that's the second thing. And the uh third thing I I do want to address um some of the comments tonight um about the police, not not a lot. Um I know that uh I was quoted in saying that we are the checks and balances and that was my quote and I'm glad I said that we are the checks and balances. Uh the problem I have is as the checks and balances, yes, we city council, we are up here to represent the people and I think that we do an awesome job representing the people. The problem I have is when the people are wrong. And when the people are wrong and saying lots of facts that are wrong, it's hard to represent them. And

Alleged facts. Thank you. I appreciate that. But I hear a lot of the stuff going on as well and we don't comment back. And why is that? Because we have said time and time again, you can talk to us, but we will not respond while there is any pending litigation going on. You come up here every week and berate us about facts. We're not going to respond and we will continue to not respond while we are advised by our legal to not respond during litigation. That's why the mayor doesn't respond. That's why nobody responds here. But I will tell you this. I have encouraged the administration that when this is all over to say our side because there are two sides to every story. I have heard so many blatant lies for months and months and months and I sit here and I listen to it and I don't respond. No response is a response. We are giving you exactly what that speech deserves. No response. And we're not going to respond because we are told we are not supposed to. But there will be statements, I'm hoping, coming from this city, from the admin and defending the truth that will come out. And I think a lot of people will be shocked because lies are easy to believe. Everything on social media is easy to believe. Lawyers on one side that say everything to the public can say anything they want. It's easy when the other side is saying nothing. So I implore all of you listening to everything you hear on newscasts, on
radio stations, on social media to recognize you are hearing one side and one side only. and will continue until everything is all done. And only then will you hear a second side and only then I hope you make your opinions on it because I agree with what the mayor said before.
