good hey Eddie your mic's off still yeah motion to go back in we need to do a motion to go back I think she's gonna do it how you doing St all right we can do that all right back back we have motion to return back to normal regular meeting move that we return back to regular session second second I move that we um we approve the appeal for the termination Y and second second M Barbera please a second BR yes Edens yes King yes ringer yes Thompson yes Baker yes thank you Council all right so little administrative business here uh got a public hearing on Bond Street think you all have that in your packet right correct we call the public hearing portion of this meeting to order the city Clark has called for a public hearing on the on the abatement of the nuisance the abatement of the nuisance of the property located at Bond Street in parks of Arkansas purpose of this hearing is to condemn the property located at Bond
Street this hearing is being conducted inord with it Arkansas code anit 1456 422 all public comments will be taken into consideration the rules for the meeting are all speakers must sign in plainly and give their names and addresses as well as the business they represent all comments should be addressed to the hearing body comments should be relevant to the topic and should not be of personal nature please avoid repetitive comments if there is a large number of speakers including many who are part of a group organization please ask for representative to speak on behalf of the group unruly Behavior such as fluing or hissing or harassing remarks are prib so at this point we will open up and allow for public comments Miss Linda you want to approach the podium help us address these if Council will turn your turn [Music] give me a second here okay Officer George from Clarksville code enforcement is there anyone in in the public who wishes to comment Miss Linda will you I'm going to pull up the photos here kind go through give us a history of this of this home this home was previously condemned and we're going through the process of bringing it to the city council and in public hearing again I posted the property as of October 19th 2023 as um they were given the opportunity and made notification to Property Owners according to public record that they needed to remove or
repair property it wasn't done in 30 days the property would be declared a nuisance on this property we've had a camper the person that was residing in the camper ended up with charges in Fort Smith dogs were left in the camper um unsanitary conditions we have now where there's children moved on to the the street and they find it to be very attractive place to play there's broken CL glass there's garbage it's just a very uh unsafe environment for children to be in and I believe this property needs to be [Music] remedy so even on the notice there's a there's a water on it we got a large bug about that big is taking up residency on the notice that big so any comments from the public seeing none we will close the public comment period yes sir can you approach the podium please identify yourself yeah just right up there just speak your name clearly sir good evening my name is Palace cotton Jr and um I'm the owner of this property I believe you guys are talking about what I'm just I'm trying to figure out I mean I heard a little bit of what she's talking about um as far as the comments on that particular deal um long story short my brother philli who is uh was the gentleman who took the trailer
down there at the time we didn't know that it could be could not be within City Limits we were notified of that during that time he was incarcerated but the trailer was moved and and uh while he was there he was attempting to clean up the place at the time but again he ended up getting uh incarcerated in Fort Smith and uh I communicated with I believe it was you and told her this and um I'm here today to do whatever uh we need to do and to ask for help in getting it done as far as cleaning up the property Mr cotton I I don't think it's our responsibility to uh to help you tear that down now we can tear it down and you'll have to pay the expenses am I not right we would put a lean against the property yeah right right but as far as just helping I don't think we can well I uh when I first found out about this I uh was told about the fire department Maybe doing a control burn um the house when it was built it wasn't built with a good foundation and that's the reason why I th it out but um after being informed I um went to the fire station trying to talk to this fire chief I never could catch anybody I even got a number called a couple times never
got a return call but um as far as my involvement I think that I've been doing everything that I need to do except for getting the property clean I understand now that it uh has been a nuisance announces maybe October and that uh that's because no one is physically there and hasn't been for several years now my father passed in 92 and um I recently moved back myself here about five or six years ago so it kind of puts me in a buy I'm I um I'm willing to do whatever we need to do to resolve this problem what you say Council can we uh can we extend this Miss Linda so there's been extensions on extensions on this property on previous times that the property's been condemned our normal procedure is is if the council determines that the property is to be condemned the property owner has 30 days to remedy the property if it's not done on in 30 days on day 31 the city has the right to aate the property then that bill is sent to the property owner they have 30 days to pay that the fees and costs of remedying that property if they cannot do it at that time and within the 30-day period the city reserves the right to put a lean on the property is that the question you're asking Patrick asked the question I ask the disension part of it yes it was me I thought we condemned it once
before if you did I had no knowledge of it seven times property's been condemned seven times no it isn't been that that's what they're telling us back there we condemned it seven times I have seven you mind if I ask who did you extend it to it was they did it at please come up to the podium please come up to the podium Mr Mr C I have one question for you yes sir so you said that you've been you've been attempting so this has been going on for a while right I first found out about it in October when my brother moved the trailer down there yeah uh up until that point have heard nothing so can you articulate what you have done you and your your you know your family your folks to what have y'all done to try to improve this since October well again I stated earlier um my brother was he was down cutting the trees down when he was there that was part of why he was there we didn't know at the time that he could not take a trailer down there and upon taking the trailer down there getting started on cutting everything down and removing some wood you know by whatever means we have yeah uh that is what we done this all right we condemned it um July 9th of 2012 um they came back in March of 2013 and gave them a 60-day whoever the owners were at the time that's been me the whole time not person um and then in May of 13 they
gave him another 30-day extension um looks like in June of 2013 another 30-day extension July of 201 13 30-day extension August 12th of 2013 looks like it's 60 days um March of 2014 had still not been cleaned up and they voted to condemn it at that time um in February of 2014 they granted an additional 30 days to help clean up the property I think that was says on here uh yeah additional 30 days July 14th of 2014 they proceeded with the condemnation I can't say that word I'm sorry condemnation that's it and then that's it that's all I got only ones I can find on it they've had several extensions permission speak yes yes ma'am just step up the poting state your name and sorry I'm short I'm sorry okay um our only issue was our brother showed up to start clearing off the I'm sorry name oh my name I am dear Nyla Harbin cotton I am his wife I'm goofy please forgive me I couldn't find the place so I've been walking around and he drove around he found it first so I'm sorry this is just who I am but this is a situ situation their property belonged to their father when they were children we are all from Clarksville and what happened was it was hidden by all the overgrown shrubs so his little brother uh philli cotton
showed up and started cleaning it off but he was arrested for driving without a license in um Fort Smith but he was starting to clear out the property so the building was exposed so he didn't get to finish what he was trying to do so that put us in a cat22 situation he was away for like six to seven months and him William Phillip javana all of the surviving siblings from his father's tree they pay on the taxes so it it him trying to help and getting caught put us in a situation we have tried for several months almost a year to get a control burn so that way you know at least we keep his father's property you have one father you have one mother so his brother got arrested and ex exposed the property only because his brother was living in a camper and he had three puppies they ain't puppies they were dogs that was that was his children and when he got arrested they were running a muck and the neighbors called like hey these babies looking for water they're the situation so when the um the the what is it the puppy police come in animal control the animal control that's how we got the message they were like hey your brother ain't been here to feed your kids it was in the summertime so they they saw it as you know neglect and pal was like there's an issue then we found out that he was arrested for driving through Fort Smith with no license they they took his kids this a sad part y'all might want to hold your head down when he went to jail all three of his puppies that he had had for six seven years you know how it feels to lose a child they died outside in the freezing cold in the freezing cold and the Freez cold all three of them his best friend got hit by a car he kept in a handkerchief but he kept hopping along he got killed the other one was killed by his other one because they were fed
together by his sister but she didn't know so it's like hit after hit after hit after hit and I don't want him to feel guilty for trying to do a good thing and clear off his father's property and we can't find a good time to get a control burn because I didn't know Johnson County was only a volunteer fire department and when I went to um the gas station up on the hill next to the volunteer fire department I was like sis I want to go honk the horns on the fire department when are they open she said girl they voluntary I said you're kidding me she was like no I said so what happened if the gas station blow up y'all better have a water hose or something CU like really cuz we can't even contact them so we need some help we're trying our best but we keep getting no answers like it it's a great area but that's that's their roote and if what's funny is if you go to the Oak Cemetery Palace cotton singers his tombstone has a tree growing out of it I was like that's a message I'm a peach I'm a peach tree my daddy barried right beneath him I told my mom I was gon to dig up and put a peach tree there because I want a tree too but his grew by Nature so I need some help we don't know what to do like we're between a rock and hard spot and a stray jacket like so we don't know what to do I know it doesn't look pretty but while it was hidden by the trees the truth came out the forest and they're like uh and I agree it does need some help but we're on fixed income and I respect everybody's you know appreciation for the town so we need some help we don't know what to do though we can't afford a construction company we need some help we need some mercy some guidance we need we we need God I yes ma'am maybe I canar things up okay okay so we cannot do a control on the structure yes that's that's because of the carcinogens and all the in there we
can't do that um that makes sense where we at right now with the property is it is a nuisance in the community absolutely I agree especially with the children have moved in on the Block wow yes so I haven't lived here since I was eight years old so everything is new to me now okay so that is a wonderful Fort for a child but but comes with a lot of dangers yep nails and shreds and so what do you suggest so like I said previously if the property I'm sorry please forgive me if the property is condemned yes ma'am you have 30 days to try to do it yourself if you cannot do it on day 31 the city can come in and do it it does not take the property away from you really but then you get the bill for removing it if that can be paid a lean's put on the property and if you sell the property that lean can be satisfied is one of the ways that that's done or you can look for possible funding to come up oh we hand to cover to cover that as CO as I am I would take a hammer to it but it's you know it's not my thing okay but if y'all can do it and I mean we got enough family to help us pay off the demolition we just don't want to lose it so the city has to go through their process okay and we have to go through what's in our ordinance according to the process of having a building condemed yes ma'am so if this is the decision of the city council which they will have to to to vote on it they have to make their decision then we can move forward from there so today's hearing as my understanding is to determine whether or not this property is to be condemned okay again and allow the property owners to remedy okay and if you can't then we follow the next step and the next step I like your plan B though yall got it and
we'll pay y'all like CU we be on the fix income I like your plan so if you need to say anything else or this [Music] is since this is uh literally I will say the second time that I'm hearing any of this um I would appreciate and uh well let me make this statement the property is at the it still don't make the situation any better it still looks bad but again the property is at the very end of said Street which means that from a certain point on back should never be entered without permission anyway now I did not have private property owner sign out there but all of that can be remedied if this what I need to do to keep children animals or whatever from down there again it is it is the very last property on the street and uh again that that that to me doesn't really have much because it's condemned or whatever but I'm just saying uh maybe we can maybe rope it off and make it clear that no one's allowed down there I'm just trying to find an answer for a situation that I have just recently since October of 23 found out about now that uh I'm informed and have some type of information as to what to do we will get her done okay are there any other public comments anybody else wishing to speak so keeping people off the property May
address the issue of children getting on the property but it doesn't address the issue that the condition of the property tends to devalue the property of every other piece of property in that area so other people have lost based on the condition of this property so in the best for the community and also to bring value up on your own property in the condition that it's in right now it has less value than if it was in a clean condition to where actually you can go and enjoy it yourself so just roping it off does not solve the issues that also devalue the surrounding property for Miss yes ma'am okay this is just because my brother is D dear Harbin again okay my brother buys uh dilapidated properties he kills them and rebuilds something more beautiful so what looks like it's dead can actually be a flower CU When my brother came in and rebuilt it brought the neighborhood's property back up so if given the opportunity to do it I don't want to do it but it's an opportunity even if we keep it somebody can go build the awesome something awesome you know what I'm saying so even though it looks bad right now just like the flood everybody's like oh we dead oh what did God just that's a rainbow it's so pretty who built that I'm just saying give give us the opportunity but I do respect that because when we were living in Suburban areas in Memphis when people would leave their houses it made everybody look bad just one house everybody else got their yards manicured perfect happy families but one house one Bad Seed was spoil the bunch was like okay ignore the Bad Seed We Got Each Other bump The Bad Seed we got each other so just give us the opportunity
but I do respect that because I've lived through that but it can be knocked down it's a blank slate right now and that's only because my brother does this that's the only reason I can defend it but I respect that because I lived through that as a child but I saw my brother did as an adult so with respect to everybody in the neighborhood please forgive us my bad I mean let us make a rose after grave just give us a chance we got plenty of siblings I'm broke but they got money so just even if we sell it I'm I'm just telling the truth I'mma come in with the truth I'm goofy but I'm going to tell the truth but I don't want them to lose that well I will not calm down at this point I guess I'm asking and I've heard that she's got several of the then slips this that and the other but I'm asking at this point that we be granted these 30 days that I keep hearing that maybe be a possibility if we can get that and then uh I can move forward from there no not the 30 I'm sorry no go ahead I'm L you talking you understood you understand about the 30 days right if you don't get it done in 30 days and the city have to do it right and they're going to charge you for it right so when you s if you sell the land you got to make sure that the city get gets them their money yes that okay well now we can do I'm saying we that's a that's op that that we can do okay okay um okay at this point I think that's about all we can ask for considering everything that uh these guys have been through and the fact that I'm just not hearing about it basically what seven eight nine months ago so uh moving
forward just knowing that we got the 30 days and after 30 days the city can come in and take over or whatever well I wouldn't say take over but uh uh do their part I think is there ready are there any other public comments at this point seeing none Scot I appreciate you we're going to close the public comment period okay thank you thank you very much that'll that that particular item Mr Cot will come up is item number let me show you here G item G so excuse me okay under unfinished business 5A is the ordinance to adopt appendix I of the 2021 international fire code Miss Barber an ordinance adopting appendix of the I of the 2021 international fire code whereas the city council of the City of Clarksville Arkansas is to serious of adopting appendix I of the 2021 international fire code now therefore be it ordained by the city council for the City of Clarksville Arkansas section one the following building codes are hereby adopted pendex I of 2021 international fire code section two all ordinances are parts of ordinances and conflict here withth are hereby repealed section three emergency Clause this ordinance being necessary for the effective operation of the City of Clarksville for the public peace health and safety of the citizens of Clarksville an emergency is hereby declared and this ordinance shall become effective immediately upon its passage okay chief you want to address the council just a little back Jason Weaver fire chief so this a this appendix uh just to give you some background on on the Arkansas fire prevention code which is our fire code some of the appendices are automatically adopted as part of the fire code there's

can I know you gotta go appreciate you uh Miss Hannah I thought I saw you back there I is this Main Street Banner proposal I think the last meeting yall talked about some local vendors and things like that Miss's been doing some hard work on that yes we've updated I ated for you the bids for the job um I did this time also a condensed uh spreadsheet on the front page might just make it a little bit easier to see the numbers side by side by side um and then I attached uh the in-depth quotes um to your packets so basically what we're looking at um for those who were not at the last meeting um the banners on Main Street um are in need of some love love and attention um I'm proposing two designs of banners one for spring and summer one for winter Christmas um I'm proposing 54 banners for each design um this would extend past just the historic district and it would R run from Crawford uh all the way down to Rogers On Main Street so it would extend down and beautify the area for those businesses uh further down as well um and so in total it would be 108 banners purchased um again two two different seasons of banners I'm happy to answer any questions that you might have did you send us renderings what those would look like um I did in the last meeting um I'm not sure if I I can't remember if I attached it with this one um but for the the last city council meeting I had it attached um it is a a baby blue Banner with mountain ranges at the bottom um in the middle says welcome back um which goes in touch with uh everything that we've been uh working towards to make
this a great place for people to be to feel like home um and to really um encourage that culture here miss Barber where we take those funds so each quote um they quoted two different types of material one is a vinyl one is Sunbrella um the vinyl will be able to give more color um gradations it can kind of go from one color to the other the sun umbrella is going to be more a stark transition it's not going to blend the same because of how they have to print on those um the lifespan of a Sunbrella is expected 8 to 10 years the vinyl um anywhere four to six um so the longevity is there but again the design has to be slightly modified uh for each material um and either one they're they're pretty close on two of the quotes and then as you go down um it changes between the two different types of materials um and so I'm whichever one we go with um we can do the same material for both designs we can do one for one one for the other um but in total uh we're just asking for approximately up to $113,000 to be able to complete this project so a question you said the vinyl banders which are the more expensive will only be about a four to fouryear lifespan and the other Sunbrella you said was a longer lifespan yes they're less expensive correct uh
the Sunbrella is more expensive except for for downtown decorations I'm not sure where they get you know the price difference there but across the board every other company this umbrella is more expensive um for printing on that fabric so um the Sunbrella is generally more expensive and then the vinyl is generally cheaper except for in that that first quote is it because there's only one ink design M yeah the US signs and the Arkansas flag and banner you've got a double it doubles in cost and more than purples for the other one yes so that's with uh that that was uh for those three the the different companies it did double for the 13,000 up to 13,000 yes for motion we approve 13,000 I'll second it Miss bar Community Pro Iden yes King yes Ry singer yes Thompson yes Baker yes Bradley yes thank you Hannah thank you thank for your work uh new business 6 a naming of the trail head I think I handed out a kind of a flyer some reason I've lost mine pull up a picture here show you so just just for orientation if you can see the the screen that is the bottom of the hill east of the University of Ozark sign and where the start of the levy trail head begins we are requesting that we we build this and name it after leavon Bean who tragically died at that intersection uh um there's a little
write up in that if you all have it about him there is there is also a fundraising account set up help fund some of this but what we need is a motion to approve the name naming Convention of that trail head make a motion we approve it second second Barbara King yeah Ry singer yes Thompson yes Baker yes Bradley yes Edens yes thank you C um the resolution Miss Barber could you read that the SRO want me to read this PO no just resol just a resolution resolution reestablishing the school resource officer salary split between the City of Clarksville and the Clarksville School District whereas the safety and Welfare of our school children will always be a top priority for the city of children City of Clarksville and whereas the City of Clarksville appreciates the need of having a police officer assigned to the school resource officer whereas at present the school resource officer Works approximately nine months of the year for the Clarksville School District in the remainder of the time for the Clarksville Police Department whereas it is the desire of the city council to recommend a more Equitable pay structure to cover the expenses of this officer now therefore be it resolved by the city council of Clarksville Arkansas that section one the school resource officer will be assigned to the Clarksville School District during the portion of the school year when students are present approximately September through May however the city retains the right to call this officer to duty should occasion dictate section two the school resource officer's work schedule during this time will be determined by the school district with all compensable overtime acred during the school year being taken during the school year section three the City of Clarksville will continue to furnish a vehicle for this officer with the school Furnishing the gas during the school year section four the total cost for this officer will be divided as follows Clarksville School District 50% City of Clarksville 50%
okay make a motion we pass resolution second well this also you have the the mou in here that we need to authorize Chief Ross to sign in that same motion okay so we need to approve the resolution and then approve the signing of the mou with the school so I make a motion we approve the resolution and approve uh Chief Ross to sign the mo okay second second M Bar r singer yes Thompson yes Baker yes Bradley yes Edens yes King yes thank you Council 6C is construction manager for the Monroe Building Morgan I may call on you just to help me walk through this a little bit so um by by permitting Van Horn to shift over and pick up the Monroe Building it would save us what 3% just like we did with the baseball field so there's a tremendous amount of savings in there um for going that route and it just needs a motion and approval by the council to do that how much would that cost us uh Stephen we you want to talk just a little bit about I think the council approved 300,000 in improvements and then State the state has another amount um that they're going to contribute to it so yep so this would be broke there's two ways we can approach it it could be broken down into two contracts one would address the 300,000 that was allotted by the city the rest would be allotted by the cdbg mechanism that's partially federally and state funded um those contracts would have to be signed separately um but um they're looking at Van Horn to do the the project overall to save cost but you don't have a cost three no more than 300,000 from the city okay that's
C so so what you're being asked for now is just approve the process uh once the project is Bid Amendment to the contract will come back with the actual cost and it'll be Amendment to the guaranteed maximum price of the previous contract so you'll see the actual cost once it's bid you just need us to approve the construction management I make a motion we approve uh Van Horn construction second second Thon yes Baker yes Bradley yes Edens yes King yes bringer yes thank you Council these bar could you read that ordinance please the it enacted by the city council of Clarksville state of Arkansas an ordinance to be entitled appointment of Clarksville City attorney whereas ACA 1443 319 provides that cities which have a mayor council form of government have less than 5,000 residents may decide to appoint or contract their City attorney rather than the City attorney be elected whereas the city council believes that appointing a City attorney will promote it it appears the continuity in the office and best promote familiarity with the issues in the city as well as assures a good working relationship between legal counsil and the city Administration and city council whereas appointing a City attorney allows the city council to use a qualification based methology of selection for filling the position of City attorney now therefore be it enacted by the city council of City of Clarksville Arkansas section one appointment the mayor with the advice and consent of a majority vote of the city council will appoint a licensed Arkansas attorney to fulfill the position of City attorney for so long as the city qualifies to appoint a
City attorney under ACA 1443 319 section two term of office the term of office for the city the attorney shall be two years and shall begin and end as the term of aler persons in the City of Clarksville nothing herein shall prohibit the mayor with consent of a majority vote of the council from terminating a City attorney and nothing herein shall prohibit a City attorney from resigning however in either event and accepting the event of an emergency the giving of 30 days Advance written notice shall be required section three contract for services the City attorney will perform such duties as are here and after described and delineated and such other duties as from time to time may be assigned by the mayor of the city council a contract for services prescribing the salary other fees expenses and non-statutory benefits to be paid such appointment City attorneys shall be entered into for each term of service unless otherwise required on a more frequent basis due to a change of job duties or other reasons section three duties of City attorney for the compensation benefits and consideration set forth in the contract for services with the appointment of City attorney he or she shall perform the following a attend City Council meetings and advis the city on Municipal matters B communicate with the and advise City officials and their employees regarding Municipal matters C timely prepare and or review ordinances and resolutions as are needed for normal operations of the city D prosecute City cases in the Clarksville City division of Johnson County District Court e for compensation to be delineated in the contract for services the City attorney may be requested or assigned by the mayor and the city council to perform services or assume special responsibilities Beyond those anticipated by the foregoing such projects may include but are not necessarily limited to Criminal Appeals legal efforts consultation and or litigation of City matters Bond issues special meetings reviewing consultation involving financing issues condemnation and rideway matters tax ordinances and the purchase sell or lease of property the City attorney shall be compensated
for these services at an hourly rate as set forth in the contract for services the City attorney May recommend that additional legal council be hired by the city as matter requires or if the City attorney has a conflict of interest however the city council shall make the final determination of hiring additional or special counsil in every case and such other Council shall be compensated as set forth in a separate contract for services section five special conditions recognizing a City attorney should be a member of the Arkansas City attorneys Association and attend continuing education classes for City attorneys the city agrees to pay a prate a share of such membership and education cost as determined by the contract for service section six all ordinances resolutions and parts thereof in Conflict herewith are hereby repealed to the extent of such conflict section seven emergency Clause this ordinance being necessary for the effective operation of the City of Clarksville and for public peace health and safety of the citizens of Clarksville and emergency is hereby declaring this ordinance shall become effective immediately upon passage so the so first thing is we need a table list uh D just found some things in here and it's very for number one we'd have more than 5,000 residents first PR so that's got to be revised this one it was initially drafted quite some time ago when clay still represented the city yeah and I don't know that it was brought to the council back then so I was going through what he had drafted and then I caught that sitting here rather than the other day asked David I said how many people do we have so just under 10 so yeah so um we need to redraft that with that in mind because the statute delineates or the statutes delineate different processes based on population so and so just you know the the City attorney has two hats they do I be honest with you majority prosecution
and little bit of Municipal should kind of be the other way around um Dedra granted she's she's filled her own plate up by her own doings but it's it's hard to it's hard to get her to help us because she's you know she's got to pull plate so you can have an a popular elected prosecutor or a qualified Municipal attorney and by doing the position that way you make sure you get a qualified individual you know someone who's got experience in Municipal business and not just a tax attorney or something like that so that's the idea behind it but it needs to be cleaned up so two years there should be four shouldn't it I think it's term of office shall be two years as the terms of La person if if they're elected it's for this was for a total complete appointment is what we were looking at rather than any portion of it being elected I don't think anybody's run the last eight years no they haven't if no one's run can't you just appoint them anyway yeah so that's what you've been doing that's what you've been doing um and what I was talking to David a little bit about on email is I mean you don't have a large pool of attorneys in Johnson County so that's why you've ended up appointing anyway over the past number of years but um I think there's been some concern that an attorney might run um you know obviously motivated by the fact that it's it's a decent paying job and um but you may not but that's a political office then and it may not necessarily be someone that's the most qualified to give advice to the city on civil matters they may be qu you know plenty qualified enough to handle the court side of it so should the office be split um to where perhaps it

from the revenues derived from such facilities and whereas as defined in the ACT industry includes manufacturing facilities warehouses distribution facilities repair and maintenance facilities and corporate management offices for industry whereas spadra Holdings 1.0 LLC and our spadra Holdings 2.0 LLC each are limited liability companies their Affiliates and are their assignes are Arkansas solar Holdings one LLC collectively the companies have evidenced interest in developing constructing and equipping approximately 26 mwdc of solar generation facilities divided into two separate phases collectively the project to be located the city approximately 105 aces of City owned land parcel point2 02423 e and parcel 022 4931 if permanent financing for the project can be provided through the issuance of revenue bonds under the authority of act whereas in order to secure and develop industry within the city in accordance with the provisions of the act the city desires to assist the companies in the financing of the project through the issuance of the city's not to exceed 44 million taxable Industrial Development revenue bonds now therefore be it resolved by the city council of the City of Clarksville Arkansas that section one it is the city's present intention to assist the companies in the financing of the proposed project through through the issuance of Industrial Development revenue bonds under the authority of the act it is presently estimated by the companies that Bonds in the aggregate principal amount of not to exceed 44 billion could be required for this purpose however the city's intent is to issue the bonds from time to time pursuant to the terms of the act and such amount as shall be requested by the companies for accomplishing all or any part of the project whether or not such money is more or less than the above estimating whether or not the facilities improvements finally acquired construct and equipped or indust identical to are a different from the facilities presently expected to constitute the project section two in conjunction with any issuance of bonds to assist in the financing of the project the city states
