We have a number of items on the agenda tonight and we will have an appropriative session uh to discuss pending litigations. Um at this time, I'd like to ask Mr. Henry call the role for Mr. present. Uh so the job title is receptionist and the department the revenue commission. It's a non-exempt position grade reports to the revenue commissioner and uh works in contract from all departments and external contracts which include general public legislative office attorneys, mayors, economic development authority, chambers, commerce, news media and others. works under the supervision of the revenue commissioner and the employee performs administrative tasks that aid in the efficient and effective operation of Jackson County Courthouse MX building. Next item on the agenda is a motion to to approve a resolution uh to protect the county's interest uh by intervening in a in a defendant as a defendant in the simplified seller user tax litigation. uh that is going on in Tuscaloosa. Uh this resolution authorized Jackson County to protect the county's interest by intervening as a dependent in SSUT litigation. And I will read the resolution.

It says, "Whereas the Alabama Simplified Seller user tax remittance act upon at section 4023191 code of Alabama 1975 established a process by which the state of Alabama forex use tax from eligible sellers on behalf of the Alabama consumers. Whereas on the 12th of August, 2025, the city of Tuscaloosa, the school district of the city of Tuscaloosa and the city of Mountain Brook filed a lawsuit in the circuit court of Montgomery County, Alabama against Vermont Bent Barnett in his official capacity as commissioner of the Alabama Department of Revenue, asking the court to direct Commissioner Barnett to disqualify particular businesses entities from on the SST program. And whereas on November the 10th, 2025, the cup a court imposed a 30-day deadline for any other interested parties to file motions to intervene in this litigation. And whereas the SSUT program has been an essential source of revenue for Jackson County and the plaintiff's lawsuit, if successful, will jeopardize the county's ability to maintain the current level of government services it provides to the public. Now therefore, be it resolved by the Jackson County Commission that the county is directed to take all necessary actions, whether by itself or as part of a joint undertaking intervene as a defendant in the SSU litigation, and to protect the county's interest in this critical revenue. If witness where whereof, the county commission has caused this resolution to be executed in his name and on his behalf by his chair on this the 24th day of November, 2025.

This resolution is being undertaken because the lawsuit as it currently proposes and stands would have a significant impact on one of the major sources of revenue that we have in this county to help us in the administration of services to residents of Jackson County. SSUT is one of our top four sources of revenue and those top four is 75% of our general fund revenue source. So to take this revenue away from us would have a critical impact on the ability for us to fund a number of those uh critical services that we have. So with that, let me ask, do I have a motion to approve and sign the resolution to protect the county's interest by intervening as a defendant in the simplified seller use tax SSU litigation?

Next in your packet at the last meeting that we had, we had a discussion of change orders for the Jackson County Ford House parking lot. Uh in that discussion, uh we um and in that meeting, we approved uh change orders three and five. Um and the change order number two that had been presented to the commission we rejected. Uh that had to do with repair damaged the line. Um the requirement there is for the contractor to repair that if that they had damaged the line. So we rejected the change order. But we also stated that we had several of the changes that we had under review to make sure that we had uh the correct information regarded regarding the removal of dirt and of the site and that we had the right uh amount listed in the change order and those were change orders one six and seven. Uh and then there was another change order that we needed to take a look at the under review and that was that we need to have the right thing for the sidewalk repair that was being done because we need to make sure the full length of sidewall that we have around the courthouse index is ADA compliant. So those four change orders are in your packet. First is change order proposal 001. It is for rock removal and the French green. Um the cubic yardage of rock has been agreed to by JMR and the contractor. Uh and so that change order is requested to be approved as supported

by JMR supporting contract. Change order number four has revision number two. Um that is a change order that uh removed existing sidewalk from the south end of the building uh to be ADA compliant. And uh the city of Scottsboro when they reviewed the the sidewalk work that we were doing requested not requested but directed that we placed all the sidewalk around the the north side and east side of the courthouse in that increased the length of sidewalk that that we had to replace. So that leap has been agreed and so that change order has been uh has been revised. That increased leap increased the cost of sidewalk replacement by $4,485. Change order number six. We have a revision to that. Uh this is dirt removal. And so that we've had we wanted to do a very good review of the student yardage of dirt that was removed. Uh that change order has been reviewed and we have uh reduced the cost of that change order and reduced the amount of cubic footage removed and that was reduced by $7,617 as a cost for the change order. Change order number seven of the revision. That change order was to repair existing storm sewer and that was excavating the sides of the existing storm sewer that was under the parking lot and replacing the se suitable soil and gravel. A review of that was done

and the amount of uh civic yardage that was involved in that was significantly reduced reduced and so that change order was reduced from $9,883 to $1,541 for a reduced price of $8,342. Um let me open for any questions or comments regarding the change orders. These change orders complete the change request for completion of the uh the parking lot and the sidewalk of the courthouse. Uh so let me give our our director uh Josh Whitman a moment to explain uh this resolution. I'm sorry.

We're in the middle of our hazard mitigation update right now. Um done a considerable amount of research and starting to hold the meetings we're supposed to have. We're following all the the new guidelines that seem to be changing very rapidly. So, we've had to adjust and pivot a couple of times with hazard mitigation. We're asking for approval of this contract to get assistance meets a deadline by December 31st. Not sure we're going to be able to do it without the extra help right now.

This agreement is between Jackson County Commission and CPD Design Solutions LLC and the uh the fixed fee uh for this agreement is $17,000. Uh, and that's a six-month period of performance of $2,400 a month and then a remaining balance of $2,600. Um, and as I said, we had placed these funds in the budget whenever we established the 20 budget. So, this has been received by the county attorney is for approval by the commission. We do not have that yet, but for the purpose of making sure our employees know what days will be available over the holiday period, um we want to um make since the January the

Uh last meeting and work session we had a discussion from solid waste about the surplus of a rolloff truck and purchase of the new roll off truck. So, it's not had any major repairs. Since 2024, they did not keep uh documentation of what they put in the trucks where I come along. But since 2024, we've spent $5,221 on this truck. It's been very low low maintenance on this truck. That is again, we spent a little over $5,000 on this truck since 2024. I I don't know what we spent before. That's just in general maintenance like no major repair. Yeah.

if I remember right, that was somewhere in the neighborhood of $80,000 that would be an increased cost uh to our solid waste uh for use of the Scottsboro solid waste landfill. Um, we're going to have to and we're in the process of taking a look at options uh regarding uh what landfield use for our for our solid place. So, we've not yet settled that and uh and we're still looking at various options to do that. Where are we and the funds available to cover that? One of the options certainly is to consider not raising the rates on our our customer.

This is a 2019 M grant that is currently in massive The reason I asked that question, I'm only going to make sure that we can we can handle the truck purchase in and try to improve this issue of solid waste without increasing. We have a 2% annual rate which goes beyond that. This is a 2019 truck. It's a plane truck. I mean, y'all can see the picture up here. This truck's four years newer than what we've got. Rear end. But if you just want to go through a few pictures. Uh, it's in Madison now getting rebuilt. And you can see the estimate in front of you what it cost to fix this. $23,000. So I talked to the mechanic in Masson and I said, "Hey man, what what is the cause of this? What is he said?" This is the cause of keeping your truck too long and poor conditions, roads, landfill. So the question is if I can't answer that, you know, if this new roll off or this roll off that I'm asking to sell, if this is going to happen to it next week, I don't know. But what I do know is if we buy a brand new truck for 5 years, if this happens, it don't cost us $23,000. They pay it.

Next item on the agenda is discussion of architectural engineering firms for house. Just want to give you an update of discussions. Uh we contacted uh uh invest in Alabama counties uh which has worked with ACCA and they have been providing uh support for us through our ARPA and work with the courthouse and with the Liberty Lane and they had established and gone out for establish a number of architectural continuums that could be used for the counties. um without having to go back out and deal separately. We asked them to make a recommendation of companies that we talk to. They gave us four that they recommended we talk to. One was the Bill Whitaker Architecture Architect. One was JMR, which we're currently using for the county courthouse MX and the courthouse renovations. Another was CH Architect and the fourth was GMC. You have in front of you, you have some brochures on those. I will say that we only have I think two brochures on U JMR. So give you a chance to look at those. Uh what I'd like to do is we had uh uh these companies each of them come in and give us a rundown and the purpose of that discussion was uh to brief us on their architectural design experiences focused on the kind of work that we would want with the sport house design and to um also have them discuss what

would be their processes that they would use and um and would they been compliant with the rate agreement that's already been established by ACCA and IEC and uh so I would like to just open up for discussion. We have several members that were here as a part of those reviews. Uh county uh sheriff is the member probate judge sat in on a couple of the reviews. District said in a couple reviews, account administrator said in Misty set in on reviews as well. So just sort of start off with Bill Picker. Uh they are a a company uh the small company, the smallest company that uh that we we talked to. Mr. Whitaker himself uh came uh we spent about an hour and a half with them discussing their capability. They have been involved for quite a while in their business and they have uh I think it's about six over 20 years. Um they have done and they are in the process of doing work very similar to what we're asking them to do would ask them to do with the courthouse uh renovation of the first floor. What we're looking at for here is to do some renovation the first floor of the co courthouse given we'll have a number of offices that will move out and then we will be moving some offices into the courthouse and and that change will require some adjustment to the floor plan for the first floor. Um so let me open comments of those that uh participated in the in

I just enjoyed there was presentation we were given uh all of them had their pros and some cons at times seem to think that uh one or two were just in line a little bit better than about our needs inside the But they all were very capable of getting the job done. I feel like especially I I had to walk around and show them the building. Uh I was uh I was impressed with Bill Whitaker architecture. I feel like, you know, they're a much smaller firm and and you know, they they they continue to stress, you know, that, you know, because they're like that that it's a much more personalized experience. You know, you're not just you're not just you don't just see them there and then they put you off on somebody and it's somebody every week. You get to work with with them and they stay really close on the projects. I was also impressed with CH as well. uh they they've worked on a lot of stuff and and as we were going through and looking at uh you know some of the spaces that we have in here uh they had some pretty good ideas just uh just just you know spitballing on on things and trying to make it work how we need it to be. I think even all the I agree with both Missy and Kobe. All four firms presented uh different work that they've been on working on different projects, but the two that stood out to me were both CH and Bill Whitaker. Um CH being a larger firm, uh more more staff involved and then Bill Whitaker being a smaller firm. um you know being based out of I think aniston. So I but I think all four that we we met with

some of the questions we asked and just sort of some commonalities clearly all of them have done this kind of work uh particularly in courouses and most all of them are in the process of of doing work for counties redesigning courtrooms and and courthouse. Some some are involved with multifloors in courouses that are doing renovations. They all agree to the uh B structure that was established and with J with ACCA uh for their work. Um, they all talked about one of the first things that they would have to do is is to do a survey of of of the new residents of the courthouse to make sure they understand what the what their wants and what their needs are. But they all also made the point that uh sometimes if you try to fit too too much into a space, there becomes a need that you're going to have to get down to what is really needed to be able to accommodate what we need to bring into the courthouse. And they would make hard recommendations regarding regarding that part of their their business. The other was put together a cost estimate. They all believed that they could be in a position. I think it was mid January that most that they could have a a reasonable cost estimate that we could use to try and find sources of fun to do and we will need sources of funding to be able to do work that we will have to do on the first floor. So that um any other comments from anybody? Okay. So, we just wanted to give that to you. But they're all good firms. Some are big, much bigger than others, but they all could clearly do the work. JMR plus

is doing work for us. Now, uh GMC U did not leave any information. They came and talked. Um their project manager will be Kevin Ball. If you remember, Kevin was the project manager for JMR. uh with the uh HVAC system that that we did two years ago and we're still working on it and u and he also led the the design work uh for the work that we're doing on the courthouse and the courthouse index. Uh his assistant would be Jay Perky U and he has a lot of experience with it with this kind of work. Uh so what I propose to us is take this is not a vote of the commission but just just a thought. I would propose that we would frame two of these firms into the courthouse for the next meeting in the work session and let them brief the commission and let the commission then decide of the two which you would prefer to have this work done comments I hear and I would agree with the comments. Bill Whitford laid out a very good approach to us from what we've heard. Um, some of their experience was that when I guess the tornadoes of 2011 that went through Jacksonville State, they were the architectural firm that did all the redesign of the repairs to everything there. And that was rather extensively that cleaned up quite well. Um, so

Yeah. Oh, I let me uh let me leave that. Uh just so everybody know remember that we have appointed a four authority board. Um and that board is has is working with EDA and EDA is working with the state docs uh association uh to use as an interim dock for board uh the state dock at Bridgeport. There's about 14 acres there. There's some cleanup need that needs to to happen. Um they have asked if we can help with that. I got a little more work to do, but I just want to let everybody know that they have asked you if work can do that. I think Jonathan, your estimation was about in personnel cost and use of our equipment about $36,000. My question to uh is the person, do they have a cost to do this? can do it but so I just want to let you know that I've got some work to do to get back with my dad let you okay

thank you chairman thank you commissioners I appreciate the time the the first item that that was request to be added was the SS4A consultant selection and so in front of you you can Um request for qualifications. Um after FHWA plan review or FHWA review of this document, it was advertised for three consecutive weeks in the Birmingham primes medicine record and the lanyard daily which is the Mobile Circular. Um, it was requested to be on the website of American Council of Engineering Companies, ACEC, on the county's website, and we received full responses. So, I'll just walk through this quickly. Um, they request a proposal and at the last part, we'll work to the recommendation that we are putting in front of you and and talk through the next steps of what we're proposing. The qualification um highlights the project, the phases, uh the scope of services that we are seeking. Uh the scope of work to be completed by the projects. You'll see uh on page three the clearing grubbing within the rightway, utility relocation, covert extension, pave shoulder, rubble strips, guard rail, pavement stropping, and then servicing. Ultimately, we are requesting uh full engineering services for this, including planning, preliminary design, and the final design. And as you probably recall, when we built these budgets in the grant, we allocated funding for this activity. So, all of the budgets and the amounts included in our request were anticipation of having a consultant on board to perform these activities. As it notes, the uh Jackson County

Department of Public Works will be responsible for construction in during the the process of this project. And u it goes on to define the scope of services that we are requesting to be the preliminary engineering and design services. I'm reading on page four in the breakdown of what more particular what that is the leting process support. So um you know not only the plan preparation and the preliminary work for the plans but also getting to contract the laying process the estimate support and then uh FHWA reimbursement preparation. So there's multiple steps that that we proceed in this not only the compliance with the FHBA regulations but the reimbursement request the supporting documentation that's required for that as well as uh reimbursement submitt and then um we ask for participation in audit reviews if necessary. So on the sub submittal material section page five that is in detail what we are requesting from interested consultants. So when we talk about the request for qualification qualifications and experience is a component of this but there are other criteria um in which we are requesting to be evaluated. This this breakdown on page five is essentially uh the same criteria in which the scoring sequence will be and this will this is the criteria which we evaluated the um qualifications on it. Page six lists that criteria. It's a it's a simplified versioning of that along with the rating. So it's not a scholastic necessarily because 4160 is still considered good. So when you see our chores, please please keep that in mind.

There's other language about this process. So it it you know it is a two-step process and our solicitation for qualifications is just step one of that process.
