All right, we have 1 case correct.
And we also have approval of the minutes.
And these would be the minutes from the very last LD&T, which was about Curt's Way, correct? Correct. They're the minutes from June 25th. All right. Has everyone had a chance to review those minutes? I think almost everybody was in attendance. And if you have, I'd like a motion.
I make a motion we accept the minutes from 6-25-26 of the Land Development and Transportation Committee.
Second. Properly made motion and second roll call please.
Yes. Yes. Yes. Yes. Yes.
Yes. Yes. And it's our proof. Thank you. Now, I have a question sitting here from my office. Is the applicant attendance in person?
No, the applicant is in attendance online.
All right. Do we have someone from staff to make a presentation?
We can, this is a continued item and we gave our presentation at the last meeting. Mark can give a quick update for the committee as to what's happened between the two meetings.
All right, very good. That would be terrific if we could get an update.
Yes, uh, this is Mark Pinto office of planning staff. Um, I'm the case manager for this 126 zone 12 for 1600 curves way. Um, the. Proposal was continued to this meeting mainly to give the opportunity to the applicant to provide a letter. That meets the standards of land about land development code section 4.7 for development on steep slopes and unstable soils. However, staff as of now, we have not received that official letter that's stamped and signed from the geo technical engineer. Or firm that has language that meets those standards staff did receive some draft language from the applicant earlier this week, I believe on Tuesday. However, the applicant made it clear that that was not the letter that they wanted. be submitted and to be fully reviewed they just wanted to get our preliminary feedback so that letter has not been submitted yet so that is why staff is requesting a continuance to the next available uh plan developer ld t meeting which i believe is thursday july 23rd to give staff and also the opposition the opportunity to review the final letter
All right, thank you.
Does the applicant want to make a presentation or give us an update on the letter? Will we have the letter in time for staff and the opposition to review before the next scheduled LD&T?
The attorney for the applicant indicated that he was available for questions.
That's a question, so I will bring him over to the panel.
Oh, Nick, pretty good. We have the draft letter. We were just working on some final tweaks to the language and we wanted to make sure by the time we. come to this meeting. It is final. We really have almost had it today, but we still requested the continuance just to make sure it's buttoned up. So the next meeting will work. There'll be no problem for the next meeting.
All right. So a continuance until the next LD&T meeting works on your end. Yes. And we want to get that letter, Nick, in plenty of time for staff to review it and for the opposition to review it as well.
Correct.
I have a question for Mark. Mark, what is the time frame that you would like to receive that letter so that it can be reviewed without a rush by staff and that Mr. Porter and his team can review it?
We discussed either the Monday before the meeting or best would be a week before the meeting, which would be that Thursday before.
Okay. And Nick, that would work on your end. We don't want to get it the morning of LD&T. We want to get it in advance.
Okay. There's no problem. Really, the letter's for LD&T, not necessarily for neighbors because it's really addressing concerns regarding LDC compliance. We have no problem doing so and getting it in early.
Okay. I don't have any other questions of the applicant. Does anyone else? All right, do we need a do we need to just re, upon a continuous. In a motion for a continuance, we'll need a motion.
I have, I got I got 1 thing real quick. As soon as I choked it up and not trying to be a jerk. Sorry, but. I thought we. I guess the question is to Nick that we will definitely have the letter because I thought that's what we agreed to have everything today. And that's why we pushed everything out. So I don't know if there's any reassurances or anything like that we can do. But, you know, Nick, are we definitely going to have it this time?
Yes. Yes. Yeah, well, basically what we received is requested language from our case managers from staff as well as, uh, working with Beth Stuber, uh, additional language. The letter had the language for 1, the other language with the. the geotech engineer did is they just changed it slightly. I mean, the question was, does it say exactly what was requested? It did not, but it was very close. So we're, I mean, basically almost have it right now. So it will not be any problem to have it in advance.
All right. Like I said, I don't want to be a jerk, but I don't want to go through this thing again and push it back again. So perfect. Thank you.
We're ready for a motion.
Yep, ready for a motion.
All right, I'd like to make a motion on case number 26, zone 0012, that we continue this to July 23rd based on recommendations from staff.
Do you want to include the letter will be prepared by July 16th?
That the letter will be provided to staff by July 16 full review.
2nd, properly made motion and 2nd, roll call vote.
Yes.
Yes.
Yes. Yes.
Yes.
Yes.
Yes.
Does that conclude our LD&P? Do we need a motion to adjourn? Make a motion we adjourn. We are adjourned. Thank you, everyone.
