Yeah. Well, thank you all for being here. Just going to say a couple quick uh quick words about uh E as we all know. So, ever since I've known, ever since he came to the department, I knew one of his goals was to become a K9 officer and he knew he had to wait, you know, by his time. Uh but the opportunity finally presented itself in 2014. Correct. 2014 it presented itself. He was given the opportunity. Um, long story short, at that time he' taken over a program and, you know, it's it's amazing the transformation the program went through. Uh, the the the dog itself, the way it was run, it was it was evident that this was the right guy for the job. So, fast forward a couple years, 2017, uh, Yasa was retiring and, uh, Caesar is the new K9 and he was named as as the continuing handler. So, it since 2017, this man has dedicated himself wholeheartedly to not only the uh department and his service as a K9, but the K9 program in general. As you've seen recently, our K9 program is expanding with Benny. Uh we just uh went through legislation tonight to add another dog, and he's a huge part of that. It's invaluable what he's offered to the new handlers, uh incorporating him into the group, the continued training, uh you know, just just everything. So, you know, in in typical E fashion, he gave me about a uh 10 12 page full color, you know, report with charts and graphs all about canine program and use and and everything. I'm not going to go through all that with you, but uh one of the things that jumped out to me was it looks like you've had over 130 deployments. Pretty impressive. It's not just, you know, our K9 program doesn't doesn't just serve Twinsburg. We're available for mutual aid surrounding communities [clears throat] as they are to us. So, a nice chunk of those are are us assisting other agencies which is we can offer to do that. So, I'll wrap this up.

Tonight's uh you know, bittersweet I'm sure for E. Um I'm sure for Caesar as well. You know, canines want to work. They miss it when they're not at work. I'm sure it's going to be a big adjustment, but uh the time has come. He's dedicated what over eight years of service to the department. And uh you know, tonight's the retirement for NIT. So, at least one honor. Yes. Yeah.

This certificate is presented to officer Emil in Carcion for his outstanding work as K9 handler for both K9 Yaso and K9 Caesar from late 2014 through today. The Twinsburg Police Department along with the administration and city council commends you for your dedication and commitment to the department's K9 program and the city of Twinsburg. The Twinsburg Police Department's K9 program would not be the success it is today without you. and we sincerely thank you so much for um doing what you've done for the last 14 years with our K9 group and um you know continuing this on and we uh we wish you know Caesar a good retirement and uh you know and and I guess you'll you'll take him home and uh it'll be all yours. So uh then you've got protection at home too I guess. So that should be good for you. If I can shake your hand, I will. If he if I don't want to say, no, wait.

I apologize if I steal your entire report. So know what I assumed you would. The environmental commission at our first meeting, I got a lot of notes.

2026 and uh it was a very productive meeting as usual. We talked about our upcoming Earth Day Arbor Day event, April 25th [snorts] uh at 11:00 a.m. to 1:00 p.m. in the Twinsburg Community Center. Hope to see all of you there. It's a it's looking to be a great event this year as it was last year. We also talked about our Good Neighbor Award, the second year we're doing this. Uh thank you to Mark for getting the the form live. I know many of you have shared it, posted. Uh we are accepting nominations till the end of this month. Uh so please continue to share. Consider nominating your constituent if you haven't yet already. Um and then aside from that, we discussed touring the wastewater treatment plant again. Uh I brought up to our commission. We have all seen it at this point, seen the great work Nate does. And so what's the purpose of touring what what is our why? Uh we realize that the why is education. Really understanding why and and what Nate is doing there. all the great and wonderful things. And so our goal is to tour it this time again. We're we're setting a date with Nate, but this time bring a larger group, larger audience. Uh he's done big tours. He loves doing big tours. Um so we're setting that up and we'll we'll sort of advertise that so more community members could come really see the great work uh that he's doing with the wastewater treatment plant. Colleen Rubin, 2259 Sandalwood Drive. Members of council, mayor, and the residents of Twinsburg. I listened carefully to the mayor's February report. It covered salt, sidewalks, dogs, and Easter eggs. The mayor was also asked about a recent settlement regarding a discrimination of three police officers and he stated the officer didn't think the city responded fast enough to records request. The city and the officers came to an agreement and quote that is over now. End quote. What the mayor did not cover is the most serious legal issue the city is facing right now. This is not over. As the city administration would like you to believe, it is not over. A federal civil rights case under section 1983 is coming and the city's own settlement agreement explicitly allows such a case to proceed. This admission is not accidental. This admission is to make this settlement affordable. The facts are Olivia Barloc settlement does not bar a federal 1983 suit. It preserves it. The record settlement preserves a 1983 action. These words were negotiated, reviewed by lawyers, and approved by the city and signed. And yet, the mayor's report to council and the public were told only that the case was settled because it was more costly to keep it settled than to fight. No mention of preserve federal claim. No mention of constitution constitutional liability. This is not over. This is not transparency. This is strategic silence. Based on what has been uncovered, the city is staring at potential liability

for retaliation for protected speech and petitioning activity, abuse of process, misuse of investigations, denial and delay of public records as a total of punishment, selective enforcement, and unequal treatment. And most importantly, in a landmark case from the United States Supreme Court, Monell versus New York Department of Social Services whereby the city itself, not just individuals, can be held liable for the violation of civil rights. The city can be made to compensate the agreed parties if the evidence shows a pattern of using power to unlawfully punish critics and suppress scrutiny. What is the financial liability exposure tied to a 1983 Monell case? Even before trial, defending a civil rights case is extremely expensive. Cities routinely spend $250 to $500,000 in legal fees just getting through motions, discovery, depositions, experts, and summary judgement. If the case goes to trial, the costs escalate quickly. It is not unusual for a city to spend 750,000 to well over 1 million to defend a Monell case through verdict. And that is before damages are paid. On top of that, under a 1983 civil rights violation, the city can be responsible not just for damages, but also for the plaintiff's attorney's fees and costs if they prevail. That alone can rival the city's own defense cost. Cities often resolve these cases through settlement because it caps financial exposure. It avoids adverse

findings about city practices. It avoids sworn testimony from leadership at trial. It prevents public airing of document handling and credibility issues given the facts. Here are the facts. And I'll speak more to these another day. Early termination before peer review of polygraph examination. This was when the mayor stated as fact that the polygraph showed deception. In fact, this was never true for expert witnesses under oath during deposition. conflicting expert opinions, missing and selectively produced peer reviews for polygraphs, sworn testimony that such peer reviews did not exist, and later disclosures by the law director of said documents. After one and a half years of saying no such thing exist, they appeared only a month ago. This is the exact type of case that becomes very expensive, very risky for a municipality. This is why transparency, credibility, and correcting course early matters. This isn't political. This is about real legal and financial exposure tied to how the process in the city is handled. And here's the part that council time really needs to think about. I'm done.

Would you like to hear what you need to think about? Please wrap up. In the mayor's own words in his February mayoral talk, the city can move fast, [clears throat and cough] coordinate agencies, deploy drones, and mobilize resources whenever it needs. So when records are delayed, timelines are botched or processes suddenly become too complicated, that is not incapacity. That is a choice. You can't claim competence only when it is convenient. Council has a responsibility here not to make things go away, not to manage optics. Thank you, Mrs. Rubin. I appreciate it.

Parks and Recck is going to be meeting on February 26th at 6:30. Uh, school board relations, I believe, uh, we have a date of March 12th uh, uh, for that. Good evening. Since our last meeting, I attended the architectural review board meeting that was on Thursday. At that meeting there were two cases scheduled only one of which was heard. Uh the uh party involved in one of the cases was not present. So the board did not move forward with that request. But uh case number 260102 for 28 2086 Meadowwood Drive. It's a facade change uh changing the color of stone on that house. Uh the architectural review board voted to approve that change contingent upon the HOA approval. Uh that hasn't has yet to be received. Basically, this house is one of the homes that caught fire and uh the construction and other things are are kind of have things backwards. Um, also would like to thank Dennis and his team for the clear roads and all the good work they did and to thank Rebecca for a prompt response to questions that residents had. So, I appreciate you. Uh there was a U CIC meeting on Thursday the 29th. We talked about the downtown uh development. We talked about uh uh an election of officers uh the Aurora parals as well as the facade improvement grants that we're working on with the res with the buildings around the square. Uh the next CIC meeting is tentatively scheduled for March 12th at 4 p.m. That's all I have this evening. Thank you very much.

Um, the next meeting of the public works committee will be on Tuesday, April 14th at 6 p.m. here in council chambers. Mr. Fury mentioned the next meeting of the finance committee will be on Tuesday, February 24th at 6:30 p.m. here in chambers. And the next meeting of the safety committee will be on Tuesday, March 10th at 6 PM here in Chambers. Mrs. Collins sent out an email the other day. We have several boards and commissions that have available. Um, we have not gotten I don't think the a full slate of people that have applied. Mrs. Collins, is that a fair statement?

So, one one suggestion that I've talked with a couple of you about is potentially extending the timeline for this. um we already have posted them for long enough so we have fulfilled our obligation in terms of you know public um advertising these I'm suggesting maybe we extend them for 30 days that would then give an an additional 30 days that still gives us time to interview the people and as long as we are appointing them no later than the March 24th meeting we would still be within the charter and you know we're all good. Yeah. And we're still looking for in ARB also. Yes. Um so Okay. Yeah. And it's 60 days for the full vacancies which we started advertising in December and then the vacancies are 30 days. Perfect. In the application setup on the city's website, it requires an it appears to require an affirmative check to the interested board or commission parties pursuing. Uh would council have the flexibility should we have a number of applicants for one board that would put us over that board's capacity but still a vacancy on another board? Would we be able to apply that application that was not selected for a vacant board to to a person? I hope we've done that. We've done that. We've done that before. Yes. As long as the person is willing, of course. Standard procedure. Okay.

Last night, I attended the Jedi meeting with Dr. Walker. Several Black History Month activities will be attended by the group, including programs at the library, which is tomorrow, the Unity Church on the 21st at 2 p.m., and Twinsburg High School's Black History program on the evening of February 25th. Our next meeting is March 9th at 6:00. The next planning meeting will be next Tuesday, February 17th at 6:30. And the next finance meeting will be 20 February 24th at 6:30. Um, I also wanted to give a shout out to Christina Conway and her crew for the Otter of State Award with distinction for their 2024 audit. And I wanted to just um give a little quote from Keith Faber, the audit, the auditor of state. and his quote was, "By keeping accurate financial records, governing bodies demonstrate their commitment to efficient, effective, and transparent service." Good evening. I also attended the special committee for justice, equity, diversity, and inclusion uh on yesterday. We had a great turnout of people. Uh Mrs. Latty was there and uh we just had a great time talking to the people asking them exactly what they wanted and uh they want to talk to the high school uh superintendent, you know, regarding this special committee because they want the schools to be a part of this Jedi committee also. And then uh the historical society contacted me. They want to have this same group of people to come to the historical society. They will show us around all the antique things that they have in in the barn. And I'm sure I [clears throat] have people out here who knows how to uh who knows what's in the barn. So, uh we're trying to work on that uh you know during this month and um that's all I have. Thank you.

Good evening. [snorts] Thank you. Uh since our last board meeting uh I had the opportunity to attend the uh building and zoning of appeals. Uh this was the rescheduled meeting due to the weather. We met on February 5th and the board reviewed an appeal 01-2026. The request involved a rear setback variance on Chamberlain Trail. The homeowner requested a six-foot variance from the section. Um it was approved by the uh board unanimously and was asked to uh extend a waiver for the 30 days. So uh at this time I'd like to ask um for a motion to wave the 30-day waiting period on BCA appeal number 012026.

Uh Mr. Bell had already mentioned that the public works committee was uh cancelled or postponed this evening and no other committees that I serve on at this time met since our last council meeting. Uh tonight, I'd just like to take an opportunity to put a community highlight out there. Um, I had the opportunity to go to a few of the community meal programs that some of our churches put together and found that it's a an interesting unique take on community. It's not just for people who are in need, but just building a community overall. Um, and it was fun to volunteer and see kids who were in high school and then, you know, my age running around cleaning up and bringing out food and stuff like that. So, it was very interesting. I'd encourage everybody to kind of attend that if you can. there's one every month uh that comes up and I believe they serve between 120 to 200 meals each Sunday. So it shows that there is a need here in our community. Um the other thing I was encouraged I was able to meet with uh the United Methodist Church and I toured their food pantry and their clothing ministry and that was kind of interesting to me too how that operates. But again, a lot of great works happening in our community here. Um I just wanted to highlight those two groups in particular.

And then I just wanted to also about our community. We have so many great things that are taking place. I would be remiss if I didn't just highlight a few if I if I could. Perfect. Uh tomorrow for our seniors, I'll be calling bingo at the senior center. So come on out. Uh it's a fun time. I call it a spirited time because the seniors give me a good ribbing when I'm there. Uh but we'll have some Valentine's Day treats and we start at 12:30. Um I'd also like to highlight and this was not necessarily because we have people here from the historical society, but um the historical society on February 12th is hosting the great grandson of President Garfield and at 7 p.m. they're going to have a chat with him. So I think that's kind of unique and exciting for our community. Uh and likewise uh tomorrow I think something's important that's happening at the community center as well. It's a the scam. What is it? Be scams smart. And it's a program to kind of help our residents avoid hitting and opening attachments that they shouldn't. So, anyhow, lots of great activities happening. Encourage everybody to go to my twinsburg.com for more events. Uh, it's heavily populated with lots of things to do here. So, thank you.

We visit businesses and you know ribbon cutings and we had another ribbon cutting last week that I'm proud to say uh of a building that's been vacant. I'm sorry I start over.

Rebecca Ziggler and I we like to uh go around and visit our community businesses as well as go to ribbon cutings and we had a ribbon cutting last week and I'm proud to say that it was a building that had been vacant for about a decade here. So, we had um Rafa Orthodontics open up and that was on Monday, February 2nd. Uh the city and the chamber celebrated the ribbon cutting for Rafa Orthodontics, a new specialty dental practice in Twinsburg that focuses on treatments like root canals, etc. Um fun fact about the name Rafa in Hebrew, it means to heal or to restore. Um, reflecting on the practice's mission of compassion, patient focused care, the business is owned and led by Dr. Jane Ra Rachel James, a board-certified orthodontist. She cares for patients of all ages, including pediatrics. Uh, the project reinvested in a building, as I said, uh, that been vacant for, uh, more than a a decade, which is the old Donado pizza shop, as everybody knows, on Willox Drive. So, we went there. They did a a beautiful it's a beautiful facility and I think that uh it's going to be a nice addition to our community. The the doctor there herself is the most gracious very nice person that I've met uh and when in one of our businesses and and we have a lot of those here but she really was a nice woman and welcomed us with open arms. So it was nice to go there and Rebecca and I had uh and she had some really good treats there too. So it was it was a nice uh nice little afternoon.

So, what I wanted to mention though and and uh Councilman Labby almost uh Councilwoman Labby touched on a little bit, but we got two proclam two uh certificates this week from the state um audit auditor of state uh an award with distinction and one was presented to um to Christina uh to the city of Twinsburg, Christina Conway, finance director. Um this award is presented for excellence in financial reporting related to your annual comprehensive financial report and compliance with applicable laws for the fiscal year ended 2024. Um just a heads up uh this morning uh roughly 2900 non- filer mailings went out from Rita. So we had about 2900 non filers within the city of Twinsburg. Um it's kind of like a compliance notice just saying hey you didn't file taxes for 2024. Um you know they give them a certain amount of time to make good on that. Um, information on that can be found at Rita's website, which is Rita Ohio.com, and Mark and I will work to get something put on the city's website about that. Um, we participate in two programs. The non-filer program is every year, and then the subpoena program is every other year. So, people who are non-filers and habitual non-filers get a subpoena from uh prosecutor's office just saying, "You have until this date to bring in all of your information, Arita. Otherwise, you might face a judgment lean from the city. So, that's every other year. Um, the other thing that I wanted to touch on, I know there's some talk out in the community. At the school board's finance committee meeting in January, it was brought up about the school board seeking a school district income tax. Um, I'm not thoroughly um aware of all the intricacies of that, but it is separate from your city income tax and your property tax. Um, the school is looking, it is a levy levy based, so it will go out to a vote of the residents. It's only for those who are residents in the Twinsburg school district. Um, it's based on where you live. It's the same procedures as when you file your Ohio income tax return as when you'd fi file your school income tax return. And the school is looking for a 1.25% earn income tax levy. So on your income within the city of Twinsburg, if that passes, a resident will in essence be paying 3.25%. So I know that's they're looking for

And he was just such a wealth of information. And it's it's not identical, but there was this guy when I was little on TV called Yel Gibbons. He was like the naturalist. He teach you how to eat anything out there. Stanley could do that. He did that. He could tell me what we could eat in the woods and do all kinds of cool things. I I I loved watching Stanley. He worked at the Stonehouse out on uh Liberty Road and through the years he maintained that meadow and he cut that meadow with like a 40inch John Deere. I mean, it was just a regular lawn mower. He'd be out there for hours and stuff, but he he knew everything about that. We had we had EPA brown bats and Stanley was on top of that. He showed me where the uh dinosaur bones were and and we you know before we had established trails. You could just go back there. He showed me where the waterfalls were and stuff with my son when Michael was four and five and he's going to be 29 next week. But uh one of my favorite memories with Stanley is the the salamander crossing. was supposed to say that

Mr. Dr. Thomas Davis Senior moved to Twinsburg Ward 1 in 1972 and he and his late wife Janice became involved in youth sports and I'm told that together they coached little league baseball for over 20 years in our community and his wife took over one of the boys teams and won the championship. he stopped coaching and then for a half dozen more years he umpireed from behind the plate. There's a lot of people that were battered by his actions in our community. So on January 30th, unfortunately he passed away and he joined his wife Jan and their son Todd. Those roots in Ward One continue on. Their daughter Kathy bought a house there. Her daughter lives in Twinsburg with her kids. four generations of one family, but really somebody that was involved in our community and maybe um uh I hope this moment adds comfort to her family and to his family and friends.
