As I have already indicated, this is an amendment to the regulations of the Chesapeake Bay Act. If you remember those of you who were in the Planning Commission last August, I have presented a report on the Chesapeake Bay program in general and some preceding changes. The employees have been working on these changes all last year and I will now give you another background on the Chesapeake Bay program and explain the changes in detail. The Chesapeake Bay Act was approved in 1988 by the Virginia General Assembly and serves as a feasible program to avoid non-punctual pollution. And you can see some of the goals and procedures of the Chesapeake Bay Act here. And you can see the area of entry there. It extends from New York to Pennsylvania, Maryland, Virginia, D.C. to West Virginia. In the Virginia law, the requirements for RPA permits, i.e. for areas for the protection of resources, are the following uses and activities. The permissible uses are water-based facilities that are specially defined. This is the construction of already built-in property as well as construction or renovation within intensively used areas and main buildings on property that were registered before October 1, 1989 by the Chesapeake Bay Act. The permissible interventions in the buffer area include crossings through roads and access roads as well as regional flood protection or rainwater management systems that serve as several closure projects. The permissible buffer changes include general tree stock management for the preservation of sight axes, the removal of dead, dying or sick trees or shrubs, weed control, access routes and projects for coastal erosion control. There may be exceptions, depending on the fulfillment of the regulations for land and forestry, water wells, passive recreation facilities such as wooden steps, hiking trails, trails, monument maintenance, archaeological activities, public roads, public supply lines and railways. And the reason for that is that the coastal strip, i.e. the grown area along the waters, offers many advantages. It reduces erosion, reduces depletion, does not filter punctual pollution, offers carbon binding and protects these sensitive environmental characteristics. So that's the reason why we do this, to protect these areas. How does the Bay Act protect water quality? Within the Chesapeake Bay, in the areas that have been designated locally by the city council, the Bay Act limits these activities and is the most restrictive in the areas that are closest to these sensitive features. It states that projects must be planned and that during the planning phase the impenetrable surfaces and soil disturbances should be minimized. And again, all these things help with the irrigation of rainwater to limit the amount of diffuse pollutants. These are sediments, fertilizers and other things that flow into the waters. Within the Chesapeake Bay area and the waterways, you can see that there is a large amount of overlapping conditions. It is one of the more complicated areas of administrative responsibility. In most cases, there are two or more authorities whose responsibilities are different. But what we are talking about today is the resource protection area that falls under the Chesapeake Bay Act program. And you see a map on the right that shows the area within the city of Suffolk that falls under the Chesapeake Bay protection area, i.e. those areas that develop into the Chesapeake Bay and its riverbanks. As you can see, it is not the whole. New and extended water-based uses are permissible within the RPA of the resource protection area, if the non-water-based components are outside the RPA. So the state has been working since 2020 and that is why we are here today at the creation of guidelines for the municipalities and these were only published last year when we started working on it. These requirements are already anchored in the state law. The changes we propose today will be in accordance with our regulations in accordance with the changes of the state law of 2020. This will therefore include coastal resilience, including the resilience assessment that must be achieved, the preservation of old trees, as well as some new definitions that go hand in hand with these points. For the resilience assessment, these must be applied together with the development plan, whereby models must be taken into account that have been used by the Commonwealth or have been developed on its behalf. These include the Virginia Flood Risk Information System, also known as VFRES, as well as Adapt4IR. In the resilience assessment, the sea level rise must be considered under the use of the middle NOAA curve. This includes the storm flood, modeled by the NOAS LOSH model, as well as floods according to VFRI. The state has created guidelines that we will make available to the applicant after the signing of these regulations. They contain resources and steps to carry out this resilience assessment. A commissioned company has developed model scenarios that can be used and include examples and illustrations. As soon as the resilience assessment is made with these results, the potential effects of the planned development on the buffer function must be evaluated. Conditions, project changes or adaptation measures must be identified that can be implemented in the project and these can be included in the evaluation of the effects on water quality. On the basis of these assessments, we as employees have adhered to it, if appropriate, whatever the case may be, to demand conditions, changes or the installation of adjustment measures for the construction project. Fortunately for Suffolk, most of the urban area has a considerable ground height. The sea level rise is therefore not such a big problem in Suffolk, as in other regions of Hampton Roads such as Portsmouth, Norfolk or Hampton, which have a lower terrain altitude. This does not exist anymore since the Chesapeake Bay regulations under the DEQ fall. Originally, they submitted to the Ministry of Natural Resources and Restoration on a state level. So the Cablet was part of the DCR, but it has not existed for a long time. We add the requirement to implement a resilience assessment.
