So ordered. Okay. We do have one item. It is a public hearing for a conditional use permit number 2508. And, Ryan, I guess this is yours.

This item before you this evening is a proposal for a conditional use permit to allow a place of worship to be located at 16537 Highway 33, which is located south of Sperry and Poppy. And the project site is located on approximately 11,500 square foot piece of property, which is a portion of a four acre site, a greater larger parcel, and specifically the the worship center would be contained within an existing 1,850 square foot building. The proposal includes worship times would span from approximately as early as 05:30AM until approximately an hour after sunset. And the proposal is for, they estimate approximately 34 church members or visitors. But the maximum occupancy load for the building would be 45 people.
And then additionally, these types of uses for worship centers are allowed with a conditional use permit within the general commercial district. And so that's the purpose of this meeting, this use permit request. The property is located I'm sorry, is surrounded by existing parcels that include building and landscaping materials, which is right to the north, single family dwelling immediately to the west, agricultural uses immediately to the east, and vehicle storage immediately to the south. Based on the occupancy load of 34 the proposed 34 people that would attend, that would require nine required spaces. However, there are 15 spaces provided based on the existing layout of the parking lot.
The project, as in form, is exempt under the California Environmental Quality Act. And as any use permit requires of the commission, there required findings that I've provided to you within our staff report. There are two of these findings. And, finally, that in the event the Planning Commission is able to make the required findings, staff recommends approval of this conditional use permit number 2508 with a number of conditions which are provided and attached at the end of the report. They total approximately 24. And I'll be happy to answer any questions at this time.

That is an excellent question. And that is something that was not listed on the application. And that is a fair concern. And I'm looking quickly in here for any existing conditions or proposed conditions that would deal with that. And there are no conditions that would prohibit that.
So we don't know the answer to that question at the moment. I've got a question about the number of people. I thought you said 45 a minute and then you said 34.
They're proposing the congregation, for lack of a better term, to be 34, but the maximum occupancy load that the square footage the building allows is greater.
So the building can handle 45?

I think they were, in their application, counting the little area that's not striped at the very, very top end of the property. But we don't need to rely on that since they're already over the minimum required number of spaces with at least the 14 that I count.
Okay. But Brian, those spaces go right up to the edge of the building. And that car is that car gonna pull right up in to that building? There's something missing in
there. There there the building would be at risk of being bumped into. But there are bumpers that stop. And if you there's some there's a photo there. The one photo of the building that I put in the staff report, if you look at those spaces, I'll point to you there. See those little white strips. Those are the bumpers that will stop the vehicle tires from rolling into the building.
And there's still long enough enough space behind it for the for the car?
Not for a limousine, but for a standard car, yes. And this is the same parking striping pattern that accompanied the original and former use of the property.

Since since we're talking about this parking area on the south side of the building, I got a concern here because that distance between the neighbor's chain link fence and the striped area for parking, that's a truck drive area for all the trucks that are on the backside of this. And there's a whole lot of equipment that comes in and out of there all the time. So that's that's a real tight corridor there.

It's the parking layout is reviewed by a planning staff. And while it's not ideal, we and because it's the timing is we don't expect crowds to be coming all at one time. Staff did not have a significant concern that that would be problematic. We also know that that's fenced off. And one option available is to prohibit the use of that part of the property for parking.
And they would still meet the minimum parking requirement with the other striped areas that are away from the building. I feel like, I mean, that is an option. The striping and the bumpers are still there. I think that practically speaking, people that visit there will still be inclined to use that area. And so we look at that as extra parking, even though it'll probably be some of the most popular parking spaces for that property.
Because the building is there.

Right? So the building is there. What what comes up to it? What's in front of it now? I didn't get a chance to see what's right in front of it now. What are they doing with that space now?

They were notified. I sent them an email, they responded that they received the staff report, but they never said if they were gonna show up or not.
Because we may have questions that we need answers for before we can take action on this. So people need to show up to these meetings. And I have some questions on the the timing. You were gonna give them five years to put in landscaping and this and the other thing. I I I feel more comfortable with some kind of a schedule that says, you know, they got five years to plant a tree or two years to do this or two years to fix parking. I didn't see enough in there to to feel comfortable just saying somewhere in the next five years, all these conditions would apply.

Well, well, we all you would do is is is continue. One
one item to consider is condition number 21 is is kind of a potential solution to any of the concerns that the commission may have. Condition number 21 is the type of condition that allows us to bring the project back. It reads that the permit shall at the discretion of the city be reviewed approximately one year after completion of the project for compliance with the listed conditions of approval. Based on any record of complaints as well as observations made by planning commissioners and or staff, the commission may alter or add to the condition the existing conditions of approval or find that the use is in compliance with all conditions of approval. Further, the commission may rescind the requirement for further review or schedule further review.
So in other words, the commission would have an opportunity approximately a year from now to review the the the use, and that would give the city, the applicant, the commission a year to see how it's absorbed into the property. And then if there are issues, items that that collectively we have determined to be problematic, we could then further condition the project at that time. So the city is not really selling its soul by granting a potential use permit approval at this time because we can always rescind it if we determined a year from now that it it would warrant that.
Well, that's all fine and dandy except for the fact that there's plenty of these items here that just need to be answered now. I mean, there's enough fire department issues here that we should have somebody from the fire department here.
Well, if you would like some additional time, you can certainly make a make a motion to continue and ask the the the applicants to attend, which I think they need to do. People need to take this seriously. And if there's a problem where they can't attend, they need to let us know.

Speaking of November 13, the reason why I brought up November 13 on a separate matter now, keep in mind this is not an agendized item, but this is merely me giving the Planning Commission a heads up as to what is in our immediate pipeline. We are working to bring forth the Zacharias Master Plan Development Agreement for review by the Planning Commission prior to it going to the City Council. We're trying to get it acted upon by the end of the year. And to do that, we are considering holding a special meeting of the Planning Commission on September 13.
No. I'm sorry, November 13. Did I say September? Yeah. Always burgers. Yes. November 13. And so that would enable us to safely get the DA to the planet to the city council in December before the holiday break. And so please, if you can, if you are able to mark your calendars tentatively to participate on November 13, same time, 7PM, that's a a possible hearing item.
And explain again that you said Zacharias master plan,
