We ready? Welcome to today's police fatality public fact-finding review concerning the death of Fabian Leon. Good afternoon. My name is Todd Leventhal and I'll be the presiding over today's proceedings. This review is being held because the Clark County District Attorney's Office has made a preliminary determination that no criminal prosecution of the officers involved in the death of Fabian Leon is appropriate. Clark County Ordinance Chapter 2.12 requires a public review following such a determination. This is not a trial. The purpose of today's present the public with essential facts surrounding the death of Fabian Leon. Chief Deputy District Attorney Haley Wilming will present today's fact-finding review on behalf of the District Attorney's Office. She will determine the witness or witnesses to be called. The ordinance does not provide subpoena powers on my behalf and does not allow for any other party to call any other witnesses. Monique McNeil has been appointed to be the Ombudsman. She represents both the public and the Leon family. She will have the opportunity to ask questions of the witness or witnesses. The procedure for questioning witnesses shall be informal with a view to providing the public with relevant information regarding the use of force, the rules of evidence shall not be strictly enforced today. Members of the public observing this review may submit proposed written questions on forms located in the back of this room and present it to one of the officers. I will ask the questions unless I determine that it is irrelevant, redundant, or an abuse of the review process. At the conclusion of the review, no formal determination regarding the manner or cause of death shall be rendered. Do either parties have anything to add?

Can you tell us generally what the protocol is when an officer-involved shooting occurs?

Typically, it's obviously patrol that it's involved in an officer-involved shooting. After the scene is rendered safe and secured, notifications are made to our supervisor chain of command, and then detectives are called out to the scene where we assume the investigation.

And so is your role to investigate essentially all the facts of the officer-involved shooting and render a report and PowerPoint summary as a result of that investigation?

So in this case, were you assigned to investigate the officer involved shooting involving the death of Fabian Leon?

OK. I'd like to go through that PowerPoint with you. If you could just start by giving us the general details of the shooting. where you began your investigation.

OK. So the location was at 233 Scott Grove Street in Henderson. At this time, it was our second officer-involved shooting of the year, and it was our first fatal. The report number is 26-02748. And again, it occurred on February 19, 2026 at approximately 830 hours in the morning, Detective Vega. So at approximately 745 in the morning, Yvonne Alvarado called Henderson Dispatch, stating that her ex-boyfriend Fabian Leon was at the location, and she had a temporary protection order, otherwise known as a TPO, against him, but he would not let her leave the residence today to renew it. At approximately 7.46 in the morning, Officer Giorgi, badge number 3039, who her call sign was 2NOR31 for the day, was dispatched to the location. Yvonne Alvarado additionally advised dispatch he was going to get into a shootout. He, who was Fabian Leon, was going to get into a shootout with police if they came to the location and he would kill her. Officers arrived on the scene and established a perimeter around the residence. Officers made continuous announcements at the location, directing both occupants to exit the residence. Officers heard yelling from inside the residence. Alvarado and Leon each briefly came out several times, and officers stated that Fabian Leon had a firearm in his right hand. Eventually, throughout the course of the investigation, or the call for service, Yvonne Alvarado came running out of the residence, and she was closely followed by Fabian Leon, and she could be heard on body cameras screaming that he has a gun, saying he has a knife. I apologize. At that point, officers directed Fabian Leon to put his hands up, and then instead of following commands, Fabian drew a black object, from his right hip area and aimed it at Yvonne as if it were a firearm. Fabian Leon did not follow the commands and four officers fired at him. In total, 24 rounds were fired and Leon was struck approximately 11 times. Leon was treated at the scene by the Henderson Fire Department and was declared deceased.

Yeah, so in this image, where the black SUV's in the garage, or in the driveway, that's the house. And this depicts the overall conditions at the time of the officer-involved shooting. So the patrol cars are to the south. There's others that are outside the frame on the east as well, or on the north side of it.

And this just indicates the yellow boxes are where the four officers that discharged their firearms, where they were positioned at the time of the shooting. Additionally, the red star indicates the position where Fabian Leon was shot at.

Excuse me. So at 7.45, as stated before, the initial call for service was made to Henderson Dispatch, and then approximately seven minutes later, the first officer arrived on scene. At 7.56, patrol officers that were on scene requested that the Henderson Fire Department stage at 8.02 a.m., fire department stage, so medics and engines staged in that time. And then at 8.04, so two minutes after they staged, an officer sees the male, which is Fabian Leon, pulling a gun out of his waistband, which he notifies other officers about that. At 8.06 a.m., SWAT and then our crisis negotiation team were notified. At 8.11 a.m., female, which is Yvonne Alvarado, telling officers to come inside. She was near the front door at this time. At 8.13, officers observed Fabian Leon dragging Yvonne back into the residence. And after continuous announcements throughout that time, at 8.30 is when the officer-involved shooting occurred. And then approximately 11 minutes later, as medical was rendering aid, Fabian Leon was declared deceased.

So at approximately 7.51, the additional call was placed at 9.11, and this is where she stated that Fabian was going to get into a shootout with the police.

This is just indicating the time that Officer Giorgi was dispatched to the residence in reference to the 911 call placed by Yvonne where she was reporting her ex-boyfriend was in the location in violation of the temporary protection order.

She says that she has a TPO, but didn't advise that he wouldn't let her leave the residence today to go renew it, so unknown if it's expired or not, right? Control continuing. She's stating that the male subject's going to be an HMA, 44 years old, no shirt with jeans. Okay, I'll have you pause it now.

Okay. Next, I want to move on to the involved officers. Can you take us through each of those involved officers and explain their role as well as the weapons that they were armed with?

Yeah, so the first officer involved in the shooting was Officer Lucas Braun. He was hired September 3, 2024. He's 29 years old, and he's a patrol officer assigned at this time to the North Area Command. On the day of the officer-involved shooting, his call sign was 2NORRA11, 2N11, and he was working day shift hours. He completed a walkthrough of the crime scene after the shooting. He did not provide a statement to detectives, and his body-worn camera was activated. This is Officer Braun's firearm used in the shooting. It was a Cole M4 carbine, 5.56 millimeter, equipped with a tactical light optic and suppressor. And then throughout the investigation, it was revealed that he fired two shots at a distance about 93.5 feet, 93 feet, 5 inches. The second officer involved was Officer Joseph De La Cruz. His hire date was April 23, 2023. He was 36 years old at the time, and he was a patrol officer also assigned to our North Area Command, operating as his call sign was 2NORA21. He worked day shift as well, which is the 6th to 7th. 4 p.m. He did complete a walkthrough. He did not provide a statement to investigators, and his body-worn camera was not activated. Officer De La Cruz was also equipped with the same Colt M4. His was equipped with a tactical light optic antisuppressor, and the investigation revealed that he fired seven rounds at a distance of approximately 99 feet, 6 inches. Third officer was Officer Omar Teran. His hire date was November 2nd of 2020. He's 34 years old, a patrol officer in our North Area Command, and his call sign for the day was 2-NOR-41. He was working day shift as well. He completed a walkthrough. He did not provide investigations a statement, and his body-worn camera was activated. He was equipped with the same firearm, equipped with a tactical light, optic, and a suppressor. The investigation revealed he fired one round at a distance at approximately 62 feet. Fourth officer was Officer Shane Weber. He was hired in April 20, 2020. He's 31 years old, a patrol officer assigned to our North Area Command, and his call sign for the day was 2-NOR-61. He worked day shift. He completed a walkthrough. He did not provide investigators a statement, and his body-worn camera was activated. He was also equipped with a Cole M4 carbine, equipped with a tactical light optic and a suppressor. Investigation revealed he fired 14 rounds at a distance of 97 feet. was our final officer and then were there also officers that were simply listed as witnesses yes so there's several officers uh officer marquis cooper who's a traffic officer there's officer philip duffy who's also assigned to our traffic which is our motors unit officer christian garland he was assigned to a north area command patrol officer omar taran or sorry omar sanchez he was assigned to our central area command Officer Ricky Stevens, who was assigned to our East Area Command, and Sergeant David Woolman, he was assigned as a supervisor for the North Area Command.

Through your investigation, did you learn that Yvonne's adult son was also present in the residence at the time?

To further your investigation, did you have an opportunity to speak with both Yvonne and her son?

Was there also an interview conducted with a neighbor who perhaps had provided some video?

Okay. Why don't you take us through the summaries that you completed of all three of those interviews?

The victim interview was conducted by somebody in my unit, another detective, one of my partners, and this was with Yvonne Alvarado. Basically, throughout the investigation, it was determined she had a complicated personal life. She had a history of being a victim of domestic violence by multiple men. She allowed Fabian Leon to stay at her residence after being released from jail, despite that there was an active protection order against Fabian. On the day of the incident, an argument began after Alvarado appeared virtually in a court hearing in Colorado. During this encounter, Fabian grabbed her hair, threw her to the ground, and kicked her. And then Fabian also stated, it's either going to be you, me, or both of us, but one of us is going to die today. Fabian also threatened to boil the month-old puppies and burn the house down with them inside. Yvonne's dog had multiple puppies that were, I believe, in the kitchen area, and that's what he was threatening to boil. The interview continued with Yvonne. So Fabian was... angry that she called the police. Fabian told her he was going to pretend that he had a firearm and walk outside so police would shoot and kill him. Fabian forcibly took her cell phone to cut off communication with Henderson Dispatch. So Fabian tucked a bent piece of a metal angled object that is similar to a firearm in his waistband. He grabbed the knife and began walking toward her, causing her to run outside in fear of her life. Yvonne stated that Leon was walking towards the officers with a knife in his hand, and she did not have any visible injuries at the time of the interview. The second interview conducted was with Yvonne's son, who was also present during the call for service, and he lives inside the residence at 233 Scott Grove Street. His name is Anthony Manguel. So he was awakened by text messages from his mother telling him to grab his dog and get out of the house immediately. He personally did not witness any altercations but has seen violent incidents previously involving his mother and Fabian. He witnessed Fabian previously pull a knife on his mother. He described Fabian Leon as a violent and unpredictable person along with hating law enforcement. Last night, he heard Fabian making threats to kill his mother, but he did not intervene or call police, which is the night before the shooting. And while outside, he heard verbal commands such as get down and put your hands up, which he believed were directed at his mother and Fabian. So this is indicating that he heard the police commands. The third witness in this investigation that was interviewed was a neighbor. His name was Nicholas Inguez. He lived directly next door, so if you're facing the residence, to the left of the residence at 231 Scott Grove Street. He was awakened by his brother after hearing what sounded like a megaphone outside. He went outside and was immediately directed back inside by police. He described disturbances occurring next door as usual with police previously responding to the residents. Heard officers continually instructing someone to come out and he saw Yvonne Alvarado ran outside, followed by a male, which was Fabian Leon. Nicholas believed that the male was holding something in his hand, possibly a knife, which was dropped after being shot by police. Per Nicholas, the officer shot the man after he failed to comply with very clear commands. After the shooting, he observed officers administer medical aid.

Yes. This is a picture of Fabian Leon. So he was 44 years old, 6'2 and 190 pounds, and he was registered as a transient. He was not living anywhere at the time. The charges, if he had survived, were coercion with force, assault with a deadly weapon, resist public officer with a deadly weapon, domestic battery, fail to update address as a convicted sex offender, violation of a suspended sentence, and violation of a temporary protection order.

So a record check of Fabian Leon's criminal history revealed that he was a six-time registered felon. And for the following charges, it was assault with a deadly weapon in 2002, take vehicle without owner's consent, California 2008, grand theft, California 2008, receiving stolen property, California 2008, possession of a stolen vehicle in Nevada in 2016, and child abuse in Nevada in 2019. In total, Fabian had 27 arrests in Clark County over the last 12 years. Most recently, prior to this event, he was arrested on January 5, 2026, under Henderson Report No. 26-00251, and the charges were domestic battery with a deadly weapon and domestic battery by strangulation.

Just some additional information about Fabian. So under this event number 26-00251, he pled guilty to misdemeanor domestic battery on January 27, 2026, and was given a suspended sentence with conditions. And then the second report, number 26-00673, he got arrested for violating the TPO while in custody at the Henderson Detention Center. So he was in custody on January 12, 2026, and he violated his protection order there. And he also pled guilty to this charge on February 9th and was given a suspended sentence with conditions. He was also released from the Henderson Detention Center on February 9th at approximately 9.43 p.m.

So this will just show the moments leading up to the involution and the shooting itself.

Initially, when you hear Yvonne screaming, you could hear them issuing commands to both Yvonne and Fabian. And at that time, officers observed that Fabian's carrying a knife in his hand. So at that time, Officer Woolman directs the person with the 40 millimeter less lethal munitions launcher and shoots a foam round. He directs that officer that's equipped with that 40 millimeter less than lethal round to come to the front But then at that point that you could hear the officers state that he has a gun and that's when shots ring out Okay, you can continue with the next video This is a surveillance video from 230 Scott Grove. So this just gives the overall depiction of what took place and on the right side where the black SUV is is the house that Yvonne and Fabian exit and

So I did, we slowed down the video, or zoomed in on the video, and what it depicts is Fabian initially has a knife in his right hand, and he transitions that knife to his left hand, and then he reaches on his right side, on his hip side, and produces a black metal object, which later was determined to be an L-shaped bracket that, from a distance, could resemble a firearm. So that's just what this is showing.

And then the next picture this depicts at the top of the screen is that L-shaped metal bracket. And then on the bottom of the screen, you can see the knife that he was carrying in his hand. So he transitioned that silver knife to his left hand and then produced that black object and pointed it at Yvonne. And that's when officers yelled that there's a gun. And this is just a close-up of that knife that he had in his possession. And then this is a close-up of that metal L-shaped bracket that he had in his possession as well.

Preliminary information is Fabian Leon had four penetrating wounds and seven perforating wounds. There was two wounds to the head and eight projectiles were recovered in total. Four in clothing and four in his body during the autopsy. This is just a picture provided as to where he was struck by gunfire.
