Okay. Agenda review. This is a single uh item on the agenda, resolution 106, which we will uh uh get to in just a second. And the reason that we are doing this uh in a special meeting is that um the resolution was approved by the um planning board, but uh our attorneys have uh opined that it is u good to have the um burough council also approved us as part of our uh housing obligations. So there is nothing else on the uh agenda. Correct. All right. I we will move on to uh number seven which is resolution 106 um 2026 resolution of the mayor and council of the bureau of Madison in the county of Mars state of New Jersey endorsing the bureau's fourth round housing element and fair share plan and affirming the bureau's intent to implement same and I have a a motion to move this moved
second and I'll give De second on that uh discussion as I stated in the uh agenda discussion um that um this primarily rests with the planning board but our attorney uh did recommend that the uh burough council uh also adopt this. any uh further questions or Marina, anything you need to add to the legality?
Just to state that the the housing element and fair share plan was already adopted by the planning board. It's their document. It's part of the master plan. Um, but this is just a good way to reiterate that the burough council is also on board and understands that it's going to implement ordinances and resolutions in accordance with this plan that the planning board prepared and adopted. All of which we did at Monday's meeting, right? Yes. And and we were faced with a March 16th deadline to have this all done. Uh, Tom.
Yes, sir. So, so we're not really going to even have to vote when they make changes. If if a if a developer comes to the planning board with a project, they're the ones that are going to give them the direction to say, "Here's the type of project you can get approved with affordable housing element, and it's not even something we have to opine on." Is that the deal? I don't understand it, Bob. Sorry. It depends if if it's a project that um meets um overlay zones or anything. It would be strictly a land use board project
like Kovellos Kovellos wants to develop the garden center finally, right? They come in and they propose 80 unit development that has planning board uh requirements for approval and then they have to do the 2080 rule. Right. So we don't even need to participate, right? Yeah. Supposed to, right? If it if it became a uh area if anything became an area of need of redevelopment, the the council would get involved in that process.
So certain certain projects would also receive some governing body review um if like the mayor said, if it was a redevelopment project that was related to affordable housing. But if it's just a standard development application, then it would just be up to the planning board or they just follow our standards 8020 or they can make exceptions too variances but not to the they wouldn't be able to change the affordable housing requirements. No.
Okay. So, this is not something where like a developer could come in and buy a lot from somebody that's pretty compliant but needs a little planning board approval, but then they could do it. What's it called? The builder's remedy and get in there. This is helping us prevent the builder's remedy. Oh, okay. Okay. Learn more about that. Yeah. If if we failed uh to implement uh the strategy strategies to encourage or allow and and or allow affordable housing, we certainly would be exposed to a builder's revenue. Okay. All right. Thanks.
