Bza Meeting - Regular Meeting
The Macedonia Board of Zoning and Building Code Appeals approved an area variance for a covered porch at 998 Berkshire Drive, allowing a 92-foot setback instead of the required 100 feet. The board found that the variance would not negatively impact neighborhood aesthetics.

This hearing of the Board of Zoning and Building Code Appeals is now called to order at 6.32 p.m. on May 20th, 2026. I ask the Recording Secretary to please call the roll for attendance of members of the Board.
Mr. Schalke.
Present.
Mr. Scott.
Present.
Mr. Fosselman. Present. Absent are Mr. Pilato and Mr. Ioffredo.
Thank you. Also present from the building is zoning inspector Chris Hall.
This is Chris. Are you coming? It starts at 630. So we are beginning. Okay. Okay. Okay. All right, thanks.
Well, we're going to probably be closer to the end. And building official?
Chris Hall.
Pardon?
He said building, I'm sorry, building official.
Yeah, all you have to do is read the names. Also present for the building department is zoning inspector Chris Hall. Okay. That's it.
Okay, Chris Hall. All persons, I'm going to read this anyways, even though it might not apply. All persons in the audience are required to sign in on the register sheet. If you have not done so already, please do so now. If you wish to speak at this hearing, you will be required to be sworn in. As in any court hearing, all persons wishing to speak on this issue, please raise your right hand and affirm the oath. We're not going to do the oath because there's nobody to raise their hand. The hearing will be conducted in accordance with the provisions of the Ohio Sunshine Law. The notice of the hearing was duly published in a newspaper of general circulation in the city of Macedonia. The notice is available for review upon request at the building department. The rules of the board require an affirmative vote of three members in the order to pass regardless of the numbers of members present at the hearing. The hearing is conducted in an informal manner to review the evidence and to respond to questions. However, there is an outline of steps that will be taken in order. An appellate does not have to be present for the board to hear the case as publicized. Each case number and appeal request will be announced as a turn arrives. The first case number is 723 and the appeal form is in order. Is there any correspondence from the notified adjacent property owners?
No, there is not.
Is there any unsolicited correspondence regarding this case?
No, there is not.
Thank you.
Will the zoning inspector now please state the city's position? The Board of Zoning and Building Code Appeals will hear a request for an area variance at 998 Berkshire Drive. The variance request is to section 1163.02 C1 regarding the minimum 100 foot setback for any building or structure from the center line of the road. The applicant is requesting a setback of 92 feet for a covered porch, a variance of eight feet.
Does the board have any questions of the city? So the board at this time would hear the presentation from the appellate. Having none here, we can discuss any questions from the board or any discussion on the case.
Yeah, I looked at the information earlier and I didn't really have any questions. Okay. Did you guys have any concerns? I have no concerns personally. My only concern was, you know, any neighbors or? Right.
My only thought to go with you was were the houses next to it exactly the same and you would notice the difference in the one? Yeah.
Looking on Google Maps, it looks like you're pretty much all set at that 100 foot. Yeah. For it just being a covered porch, I'm not too concerned about...
Either am I, especially because it is a covered porch. Standards are put in place to keep those aesthetics for the most part. And on this road, I feel like the aesthetics would still be maintained and that standard is still respected. the spirit of the naturehood is still kind of withheld, you know, even with its bearings, in my opinion.
It's kind of interesting because I would have asked how they came, why they want to do it, you know, what precipitated them wanting to make this part. I have a front area, it's not eight foot wide, and I really like it, but to add it later, but I know you, and myself having done a lot of work at my house, you're doing work at your house to change it now rather than buying another one. Yeah. So I can see it. If you really don't have any questions, the chair would entertain a motion from the board.
I make a motion to approve.
I second that. Okay. Will the recording secretary please do a roll call vote?
Mr. Schalke?
Yes.
Mr. Scott? Yes. Mr. Fossum?
Yes. The motion has passed and the appeal is approved. All right. We have no minutes to go over or anything else. I think that was pretty quick. Is there a motion to adjourn?
I'll make a motion to adjourn.
I'll second. Oh, you second. All right. All those in favor, aye. Aye. Aye. We're done.
Great.
