I'm a member of the board and will be hearing cases today along with Ms. Christine Snyder, who is seated to my far right. Ms. Pam Waddell is out today, as is Ms. Anaya Folau. With me in the hearing room today from Code Enforcement staff, I have Mr. Devrod Abrams, who is our coordinator, and he will be calling cases and recording today's proceedings. I have Officer Tim Close seated to my left, who will be providing security here at the jail building today. I'm also joined by Assisted County Attorney, the Honorable Michael Spinlaw, representing the board as counsel, as the Honorable Haley Keene. Additional individuals may participate in a case. If they have relevant information, those individuals will be sworn in and introduced as needed. We are operating virtually today, as defined within the KRS guidelines for Oprah Rekker's meeting. At the onset, I want to clarify the role of the Board and the scope of today's proceedings. This Board is an administrative body of limited jurisdiction. We are here only to consider appeals of the specific citations that have been properly docketed for today. We cannot hear matters that are not on today's docket, and we do not address unrelated disputes or complaints. The Board does not interpret the law or provide legal advice. Our function is to act as a fact finder, determine based on the evidence presented whether the conditions existed at the time of inspection to support the issuance of a citation or applicable metro ordinances. I will read the following one time and one time only. It will apply to all cases we hear today. All participants must be sworn in before speaking. Please wait to be sworn in by Ms. Keene before you do so. Once sworn, you're testifying under oath and your testimony is a matter of public record. This is an official proceeding. Any false statement you made could be referred by this board for persecution, for perjury, and for false swearing. While these proceedings are far less formal than a court of law, the board will consider relevant and reliable evidence and will determine the credibility and weight to be given to that evidence. Then we have a public nuisance. The back door is leaking every time it rains hard. The original date was 6-16, 2026. And then we have exterior door. And the rear door frame was leaking during last rainstorm. Rear doors damaged. Then we come back on August the 4th and we see that the interior surface, we had no interior. We didn't go inside. There's no entry. Same with the public nuisance. And same with the exterior door. We was not able to get inside to see the leak. And Only pictures I have is what they were able to take from outside. So it's hard to say.

We would recommend that we go ahead and push this out to that same date because there's similar violations for the zoning and for the property maintenance. So if we're giving them time on the zoning, we would be fine to also give them time on the property maintenance to get that taken care of.

We have consistently been cleaning. I have photographs to show the progress that we have made. One of my main issues is the citation itself was issued on June 26th, but I didn't get the citation in the mail until July 16th. And then one of the violations was ordered to be in compliance by June 28th before I even received the citation. Two other alleged violations have an August 25th compliance date, which has not yet passed. The vehicle allegations do not identify which specific vehicle was unlicensed, inoperable, abandoned, or improperly parked. The non-permitted use section lists general vehicle rules, but it doesn't identify which vehicle was Metro was talking about. We have consistently acted in good faith. On April 16th, 71 days before I even received this citation, Nugent Sand delivered 9.8 tons of dense grade aggregate so we can park our vehicles on that. I have the delivery ticket and I have photographs showing the work. Let's see. I'm just requesting dismissal because we are consistently complying, but the citations that you all are giving are not showing the status of the work that we have completed.

If I can say something real quick, on the vehicles, from the notes that we have, I mean, they've talked to you, but it doesn't matter, any vehicle, they all need to be licensed on hard, durable surface. Right. So you can have a red Chevy there one day, and if we come back and see a white Chevy, and if it's not licensed, we're still using that as a noncompliance because you brought, it's still a vehicle.

I have a receipt here that we paid $857 to the same company that did the exterior. That was CMEC. And they also gave us a report on the 29th after we paid that that amount. They told me they were going to send that into the code enforcement officer that had cited us and with the health department. And I'm assuming they didn't because we're still on the case.
