Good morning. This is the Friday, July 31st docket, Louisville Metro Code Enforcement Board. My name is Chris Whatlin. I am a member of the board. I will be hearing cases this morning along with fellow board members, Ms. Christine Schneider seated to my right and Ms. Pam Waddell seated to my left. With us in the hearing room today is our coordinator, which is Mr. Devron Abrams, who will be calling cases and recording today's proceedings. I also have Ms. Laken Barnett as Code Enforcement Supervisor who will be presenting case summaries, facts, and findings. Officer Tim Close over here at the far right will be providing security for us here at the Oak Jail facility this morning. I'm also joined by Assistant County Attorney, the Honorable Michael Spinlon. I also have representing the Board, the Honorable Haley Keene. There might be additional individuals participating in your case and we will identify them and swear them in as needed. We are operating today virtually as within the KRS guidelines for open records meetings. At the onset, I want to clarify the role of the board and scope of today's proceedings. The board is an administrative board of limited jurisdiction. We are here only to consider appeals of the specific citations that have been properly docketed for today. We cannot hear matters that are not on today's docket, and we do not address unrelated disputes or complaints. The Board does not interpret the law or provide legal advice. Our function is to act as a fact finder and determine, based on the evidence presented, whether the conditions existed at the time of the inspection to support the issuance of a citation under the applicable Metro ordinances. I will read the following one time and one time only. It will apply to all cases heard here today, whether in person or virtually. All participants must be sworn in before speaking. Please wait to be sworn in by Ms. Keene. and before you do so. Once sworn, you are speaking under oath and your testimony is a part of public record. This is a official proceeding. Any false statement you make can be referred by this board for prosecution for either perjury or for false swearing. While these proceedings are less formal than a court of law, the board will consider relevant and reliable evidence and will continue to determine the credibility and weight to be given to that evidence. Please do not interrupt others while they are speaking. I will ensure that everyone who has something relevant, relevant, relevant to say, you will get a chance to speak. You may not have a chance to say it if someone else is speaking. Just make a note in your mind that once they're finished speaking, you can go ahead and say what you need to say as long as it's respectful. If at any time things get out of hand, I will cease all communications until order is restored. After hearing from both the county and from the appellant, the board will determine whether to uphold the citation and any associated fine. The board also has the discretion based on the evidence to adjust the fine or to conditionally discharge it. Each case is decided on its own facts and merit and prior outcomes do not control the results in any other case. Once again, the board cannot provide legal advice to any party. I'll be hearing cases along with my fellow board members this morning. I'll give you a quick rundown of how things will run. We will call your case by the case number as well as the address. I'll listen for the address once your case is called. If you will come up to the podium where you will be sworn in by Ms. Keene. If any time you need to leave, just let Officer Close know. If you need to go feed the meter, take a phone call, use restroom. That way, if, God forbid, we call your case while you're gone, you're not here, we'll recall your case when you get back in here. Basically, the way it will work, you'll come up, it'll be up to the county, which is Mr. Spinlaw and Ms. Burnett, on behalf of Code Enforcement, to present their case. After that will be your chance to present your case. We'll take everything presented into consideration. After that, we will make a decision. I will let you know, and I say it every week, it's my same speech, I am not here to take your money. I am not here to take your money. I'm here for your compliance. And if I can't get your compliance, I'm going to take your money. And once I get in your pocket, I'm not going to get out of your pocket until I get compliance. So as long as you're working with me, you're making a concerted effort to improve your property and correct these violations, that's on you. You decide if I take your money or not. So as long as you're working with me, I'll work with you. If you need more time, I'll give you more time, as long as you're working on it. If you try to BS me, you try to lie to me, you try to make excuses, or you just sit on your butt and do nothing, guess what? I will take your money, and I'll keep taking money. And at some point in time, you're going to have a massive lien on your property, and it might even get foreclosed. Who knows? So let's not go there. So if you're here with an LLC, if you're here with an estate, if you're here with any business entity, you must, must, must have an attorney with you here today. If you don't, and this is your first trip here, you'll get a one-time 30 days to get an attorney in here with you. If not, I can't hear any testimony from you because the Kentucky Supreme Court has determined you must be represented in any of those, you know, LLCs, estates or something must be, you know, represented by an attorney. On 4-21-2026, the 10th visit to the property, a $700 penalty was placed for no compliance on exterior surfaces originally cited 8-8-2024, no compliance for windows originally cited 8-8-2024, We returned to the property on 7-27-2026 and found no compliance on the exterior surfaces, no compliance on the windows, and I'll get you photos in just a second. Here we have exterior surfaces with rotted wood, chipping, peeling paint. Another photo with rotted wood, dilapidated exposed wood, chipping, peeling paint. Here are broken glass windows. And then missing windows, more dilapidated rotted wood, chipping, peeling paint, and damaged surfaces. That's all we have at this time.
And I will submit that these photographs establish the conditions of the citation as they exist at the time of the citation, as they still exist, and I'll reserve any questions for the appellant.
Thank you very much. So in our initial appearance, the property was still not yet in my client's name. That deed has now been properly recorded. So it is in their name and they are committed to the full rehab. The estimate of the work that they have had quoted and are preparing to start within the next 30 to 45 days has been tendered along with the deed showing that the name has been formally or the ownership has been formally transferred into my client's name. So we would request a brief continuance so that that work can be started.

On 4-27-2026, the 36th visit to the property, a $700 penalty was placed for no compliance on electrical distribution panel originally cited 7-6-2022. No compliance for property water supply line originally cited 4-14-2025. I will now read the 35th visit. On 4-23-2026, the 35th visit, a $1,200 penalty was placed for no compliance on electrical lighting fixture originally cited 7-6-2022, no compliance for electrical distribution panel originally cited 7-6-2022, no compliance for interior door originally cited 7-6-2022, no compliance for interior surfaces originally cited 7-6-2022, No compliance for property water supply line originally cited 4-14-2025. No compliance for electrical receptacle outlet originally cited 12-6-2022. No compliance for windows originally cited 7-6-2022. We return to the property on 7-27-2026. and found no entry on everything except for the electrical outlet that was found compliant. So we have no photos as we've not been able to gain entry.
In this case, I'll let you all put on your case if you'd like, but we will probably ask for 30 days to get somebody in there just to confirm that everything is fixed.

On the 49th visit, a $600 penalty was placed for public nuisance originally cited 401-2026 and no compliance for roofing and or gutter materials originally cited 11-11-2025. We returned to the property on 7-27-2026, found compliance on that public nuisance for the trash at the dumpster and no compliance on the roofing gutters or downspout materials. I'll get you photos of what remains in just a second.
Here we have some soffit with holes and dilapidated wood. At the bottom of this photo here you'll see the end of the downspout is disconnected.

These are not part of the citation. This was just a photo of some debris that was laying around.

On 7-1-2026, the fourth visit to the property, a $500 penalty was placed for no compliance on exterior doors originally cited 4-2-2026. No compliance for roofing and or gutter material originally cited 6-11-2026. No compliance for stair or fire escape exterior originally cited 4-21-2026. We returned to the property on 7-28-2026 and found no compliance on the exterior door. No compliance on the stair fire escape. The roofing and gutters was not part of this citation. I'll get you photos in just a moment. So here we have the front door window is removed and there's a board on top of it. Here is some plexiglass that is broken with a board on the door. Here is some more box gutters with chipping peeling paint. It appears there may be some holes in the soffits. More dilapidated box gutters, chipping, peeling paint. More dilapidated soffit with chipping, peeling paint. This is the stair and fire escape in the rear that is dilapidated with rotted wood and missing spindles.
Can I make a quick note to that? That's not our property, that picture.

Yeah. The neighbor boarded the fire escape. I'll get to that.

The two buildings, 1114 and 1116, were built and owned by the same person, and they put the fire escape there. between buildings and they connected them to the building. So the building sold 11, 16, and the owner wants to tear out the fire escape. And he's been boarding up our exit, you know, boarding up the third floor to get out of our tenants apartment. And it's, uh, we've had code enforcement, Kevin, Mr. Dolphin, and, you know, now it's kind of in the, uh, pre-lawsuit stage, but, uh, The repairs have been completed. They were over there yesterday making these repairs. It's kind of a delicate situation because that picture that I said wasn't our property, you have to go on his property to get on the fire escape and get out. So we've told our tenants, don't use the egress on the fire escape as regular use. You can use it as an emergency.
So is yours building the one on the other side of the fence? That is not our property on the right.
So that's boarded there. So the owner, the one on the left is 1114 South 1st. And you have to go on his, it's called a prescriptive easement that we can use to get out if there's an emergency. The owner is boarding up, you know, our door on the third floor so our tenant can't use it. And it's a emailed, you know, back and forth. So I'm just saying that's another issue, but we, we've gone up there and replaced the spindles. I know that's not in the picture and we've made some repair to the fire escape. So it's, it's structurally sound. It's just, we're dealing with this issue with him. As far as the front door, I can get that glass replaced. It was, it just needs to be ordered. If I could get a little more time on that.
we would be fine with 60 days for status and we're going to go 60 days because we want to make sure that that like the door and stuff is getting taken care of. But we understand that that civil matter is probably going to take some time. Yeah.
So maybe we'd go to October 2nd on that one too.

Okay, so the citation was issued for the operation of the home without the required permits. And I see that as of August 2025, you had completed the pre-application for the CUP, but you hadn't yet submitted for the formal filing for the CUP. Correct.
So in August, we were getting ready to have our wedding in Chicago. So we were back and forth quite a bit. As you can imagine, the planning of a wedding took a lot of our time. As of April of this year, we have sent emails and tried to coordinate a hearing, but we hadn't heard anything back yet. So we have every intention of continuing and getting. We were told we had a year or so.

Another inspection was performed yesterday and it was still found to be out of compliance. We did have a supervisor do the inspection and they had requested a copy of the lease which was provided. The lease actually shows that this is still not operating as a single family residence I'm just going to go straight to the photos on the lease showing that this is broken up into common areas and two apartments. As you see here, there are two meters and two unit numbers. This is not operating as a single family dwelling. That's all we have.

You have a – You have several individuals living in this house that's supposed to be used for a duplex, but it's not divided into two units, correct? That is not correct.
So the property is divided. That door there actually has a... as you would call a dead boat, to where only the people that are on property two that can actually go into that actual property. There's two entrances. The main entrance to the one, there's a hallway, which is what you're looking at now, goes up to the stairs to three rooms. That's where you see.
