Yeah, I would say most likely we were looking at some sort of structural degradation. I don't believe we've had... We don't have anything listed for structural degradation, but this is definitely something that, if not dealt with, could absolutely turn into something.

No, we do have this listed as a possible hazard. It's been a little ongoing, so we've been monitoring this.

Yes. And so the reason they appealed is it's the wrong party. So this dispute, this is a condo, and this dispute is between the unit owner and the HOA. As you all know... all the common space here is owned by the condo association. And then, so there's a dispute and there's an ongoing litigation between the unit owner and the HOA. Lee and his group, they're just a condo unit owner in the building. And so the notice is going to the wrong party. And so that's why the appeal here is here. Now, I also have... the address for the condo association, this is where these notices should be going.
I did note in your appeal that you mentioned that the address was previously the same, but it's under new management. When did that happen?

We're now in 2026, so this has not been addressed, and it's not getting any better, so... Is this inside of a unit or is this in a common area?
This is inside of an owner's unit.
And, yeah, their dispute is who's responsible for the repair, too, and is it a roof or is it a window? And so that's ongoing litigation to correct it.
We've had two structural engineers look at the structure. It's an 11-inch reinforced concrete slab. That is a surface crack, and the structure for the property is still robust, more than enough to carry residential loads.
I just want to clarify for the record here. You mentioned being a condo owner. Are you the owner of this interior condo or the outside building?
Well, the condo association owns the shell structure. Right. I do not own this unit, and the structure is owned by the association. I represent an owner of other units within the building.

Yeah, so last information we had was that the still operating as a transitional house without the required permits And we had requested that have an internal inspection To check to see if the house was in fact still being used as transitional housing or not Is that correction yes, and then I think you have a scheduled interior inspection and
I've been dealing with this for a while and she came, I was out of town when they called me, I allowed them to go in. I have a lease with the two gentlemen that stay there, they're on the same lease. And it was, the way the house was set up is, it was set up the way when I bought it, it's a, apartment upstairs, apartment downstairs, but you could come through. It got two doors in the front. One door was sealed off where you could come through the front door, the left door. And once you come through the left door, it was an opening right here. So she was saying that they occupied the whole building. And I was telling her it was upstairs. She said, need to be sealed off. And I have the picture showing that we sealed it off, put a wall up. So it's a separate entrance for, uh, upstairs and downstairs both of them on the same lease uh so uh i'm trying to figure out what more would y'all like me to do to rectify the situation Because the problem was the downstairs that's empty and the electricity is off. Nobody's down there right now. And I was telling her it's not occupied. She said since that doorway was open right there that they could get the electricity turned on and they put people down there. But I had that sealed off. The electricity is still off downstairs. I haven't leased it out to anyone yet. And I got the lease. I emailed that to... Mr. Devin Abrams, that was Ms. Sylvia Zoning emailed a copy of the lease for the two gentlemen that are staying upstairs. She emailed that to him yesterday evening because I was trying to get... get in touch with Ms. Foree, but she no longer works here, I think. I don't know because I tried to get in contact with her because I wanted to do it virtual because I had to go out of town, so I had to cancel that meeting to make sure that I was here. Owners are staring repairs too little, too late, ma'am. Today we're on for total compliance. We've, we've redacted this too many times. We're on our what? 52nd visit at least. 64th visit on this. Those pictures were from the 24th of last month, one month ago. You can't just cut it once and think we're done. This has to be maintained. It is not being maintained. It's being neglected. So you're either going to have to get on the ball or you're going to have to sell it.

And it's going to keep going up and up and up. So it either needs to be sold or it needs to be maintained. So today was supposed to be an update on the filing of the formal rezoning application for the property. However, that has not occurred yet.
The issue on this, and this is when we have been proactive. We've had multiple meetings. I didn't bring the file. You all I drop a kid off and rush from soccer. We met with somebody else from zoning in May. They told us to go get the building permits, then come in. I'm co-counsel on this. Mr. Darren Wolf's the other attorney. He did apply for the Building permits this week, I showed Mr wheelchair the email we got last night that it was incomplete because Darren didn't put the maps in with it. So we got to resubmit those. Mr wheelchair believes from there, and we'll still need to redo the zoning application, which we've talked and we've even shown him the 1 we previously prepare where the other guys to get the building. Permits well, we're, we're working towards it. This is just 1 that's going to be. A while.

So there's a parking violation. And for this third citation, is that still for the non-permitted use?

The operation of a recreational vehicle park is prohibited here. So that was on the third. As well as parking in the grass dirt is prohibited. And it lists the numerous vehicles parked on the property and citation that was issued.
So I'm understanding correctly and we've you've mentioned the two vehicle rule. It appears that there are multiple vehicles as well as a boat and an RV and that would exceed the vehicle rule because that is the boat in the RV would count as well. Yes.
Does that make sense? None of it's making sense.
So essentially, there is a requirement on the residential zoning that you can only store so many medium-sized vehicles, and there are too many there. So you can only have up to two, and the two that you are allowed to have do have to be parked on a hard, durable surface, and they have to be behind the front of the house completely.

Okay. The lady gave me a thing to tell me who to get in contact with. And I've gotten in contact with her. On the paper she gave me, it said it was $950. When I called her, they said it was $1,300. And I said, well, I couldn't get your money all the same. So I wrote them two checks. I wrote one, July the 6th, he gave us 650. And I wrote another one, July the 24th, he gave us 650, $1,300. Okay, they have never got back with the people down there and never got back to me. They took the money, the lady up the apartment, I showed her the checks. He said, okay, it's okay. That's when I was just scared of me like a week, a month ago or so. She said, okay, everything's okay. Then I got another thing that said, come back to court again. And so that's where I'm at now. The money has been paid. They didn't have to show up.

I guess she's got some mental issues that I didn't, wouldn't aware of either. And, uh, she attacked me. She fought me. I went downtown to take a warrant out on her. And, um, Even the police was there. She tried to attack me, even while the police were there. And they arrested her. She got arrested for it. She was charged with assault four. She was charged with menacing. She was charged with... She had four charges.

And it appears the exterior retaining wall was found compliant on a subsequent inspection. Let me get you photos of what remains. So here we have a missing downspout here is exterior surfaces, um, on the garage and the siding and chipping, peeling paint. There's also a downed gutter in the bottom of this photo, which is part of the X 50 violation that is on today. Uh, here is more exterior surfaces. This is showing the cornice that is failing more exterior surfaces. This is more exterior surfaces, exterior surface, and then this is exterior surface and the missing downspout. as well as the missing gutter, missing downspout, and the roofing has a small bow to the front left corner there. We plan to do the rest of it, but right now we're at a standstill because of the fence. So they're telling us we can't do any more work. They're saying that the fence is too high. So once they said that, because the fence is really not finished, they told us don't do nothing else. So once they said the fence is okay to stay where it's at the height that it is, then we're going to go on and put the gutters, because really it's just the gutters, the aluminum side, and that's the only thing we got left to do, thank the Lord. But then we're going to finish everything else. So that's why we haven't.
So why does the fence hold you up from doing the other work?
Because they said it's supposed to be three feet. It's a little bit over three feet because I got a pit bull. So when I went downtown, the lady gave me papers and stuff to fill out to bring back. And then I got to, I think she said some of my neighbors got to say it's okay for the fence to stay the way it is. So that's what's going on.
I understand the fence issue, but how does the fence stop you from working on the other items?
Well, they told us don't do no more work. So I just figured it was for everything.

So the case has been open for the structure since 2023. However, this violation we are on for today has not been cited that entire time. It had been condensed.

Okay, so I was here a month ago and I explained how I had a contractor lined up and the building got broken into and People were pilfering it for a couple of weeks before I found out that they were entering through a window unit that they had pushed in and were replacing, so I couldn't tell from the outside. It's not occupied. The building's not occupied. I just go over there to maintain. It's like a storage building about a mile from my house. I go there to cut and clean at the moment. Eventually, I have more plans to deal with the building. But these people looted the property and they took all of the electrical wiring out and scrapped it. And they probably got $100,000 worth of stuff from me. And so last time I was here, I had a contractor there working on it and they stole the contractor's tools. So that was a major setback. And so last time I was here a month ago, we talked about pushing it out six months, provided I acquire a demolition permit in the last month. Well, there's been a hang up with that, too. So I got my contractor to go get a demolition permit and according to IPL, the people that he talked to, he came back to me and he said, you don't need a permit to do a partial demolition. And so I was like, well, they asked me to get one. So I went about trying to get one myself. And I made an account online and started the process. And the technical name, I believe, is a wrecking permit. And that's submitted the application part of it was like I needed to prove how old the building was so we ended up in the deed room doing deed research finding the you know when when this building was built which was 1946 and I did everything that I could to try to get this permit and it's it says it's pending all these different other things that I'm supposed to submit and the more I look at it it's it's this is a permit for demolishing the entire building so As far as I know, there does not exist a permit for partial demolition.

I did used to work as a contractor. I used it to work out of. It was kind of put on the back burner of having... My seventh child on the way and got my eight-year-old with me here today. He was helping me with the deed research. We got to learn how to use a microfiche. Yeah, their phono. Yeah, that was incidentally, he got to visit the mayor's office. He might be the only kid to ever get to do that. Cause we just happened to run into somebody who was leaving and I got a picture of him behind the podiums. Pretty good. But the long-term plan is there've been a few different iterations of it, but now that there's absolutely no electricity, that means probably like a total overhaul. Um, You know, at one point, I thought about maybe it's urban neighborhood zoning. It was grandfathered C three, but it's there's really no industrial use for the building. but it's a fortress the front of it is it's all it's two stories and concrete place cinder block quarry tile used to be a dairy a dairy it was sort of like the stockyards is uh but for milk you know you people bring their milk here to get it pasteurized and turn into chocolate milk And so it passed a few hands since I think I'm like the fourth owner.
I do have one question. It looks like there may be some other structures on the sides of these. Are those occupied homes that are next to this or are those other like commercial?
So this is on the corner of Clay and Kentucky. And there is a residence immediately to the right and she does own the home. And she's a... never complained about anything and as far as like the condition of the roof getting worse it hasn't really changed in many years it's it's settled and it's sitting on the top of a box truck that i have inside the building
So all right. I think we've got a recommendation ready. We're gonna we're gonna recommend we push this out for 30 days. And the reason we're gonna go with 30 days is because there is a residential property nearby. And this this is somewhat of a safety issue. So we want to make sure that we're staying on top of it. And we know what's going on. But we understand there's gonna be more time to figure out how we even deal with this part of the property. So that's we're gonna recommend to push this out for 30 days for status.

And I understand that there's photos that are being shown of items that are remaining outstanding. But about six feet to the right of that photo, what I don't see is... one of the items that was the original cause of going out to the property which was a hole which has been fixed that was about you know six feet long approximately that required some repairs up in the box gutter areas when i was here last time one of the things i mentioned too is that a roofer had stated that there was um Repairs to the gutters that needed to be made because that was actually what was causing those holes. So we had actually had all of that work done on the roof, which I don't see any photographs related to that. You did discuss that with me. I did mention that that was all done. That is my representation to you that that was all done and that needed to be done preceding this work. There are some holes. There's a couple of spots. I will tell you that I feel like some of that stuff hasn't gone as fast as I would like it to go. I actually terminated the contractor about a month ago because it's not going at the speed at which that I would like it to be going. And I am hiring a new contractor to go ahead and finish those items up. However, they're all also other areas of the property where some work has been done. So when we say that there hasn't been anything along the front, I was going to point out, I don't know if you can see it in this photo, but you can actually see some of the blue tape around the windows where there's been painting that's been going on around the exterior.

All of that is approximately 40 feet up in the air and I'm sure you can appreciate just the hazardous nature of the work and also weather taking that into consideration as well. So it has been a little bit of a challenge considering the height of the work and also the weather. Those items that you pointed out down below, I don't see any reason why the next time we come back here that we can't have those done like stairs those areas, that's that's looks like they're fairly simple to resolve.
Okay, we've we've had at this point, there's been there's been five redockets, we're all right with one more. And we're going to suggest we put this out for 60 more days for total compliance to get these issues taken care of.
I would ask if it's okay that it's not a total compliance, that we do come back in 60 days and see what we can do. We've gone through great expense. We had the stairway rebuilt and back, which that in itself was quite an enormous amount to go through between landmarks. The light fixture has since been removed, so that is marked compliant. Here we still have some exterior surfaces that are dilapidated. This piece of siding here, this wood was painted but it is still rotted. Again, the wood is painted but it was still rotted. And then here is more unpainted rotted wood. And then the corner of the structure there by the downspout, there is some dilapidated siding there. There is, it looks to be a repair that was made under the window. However, that is not an approved repair. That is still rotted, dilapidated wood that's been painted over top of. And then here is still some more siding that is broken, chipping, and missing.
