The purpose of this meeting is to hear all pertinent testimony of those in support of and in opposition to the applications before the commission. Tonight is the first of two public hearings required to approve a change in zoning. The procedure for public hearing items will be followed tonight will be the public hearing will be opened and testimony will be heard in the following order. First, staff. Second, the applicant. Third, the general public, those in support of and in opposition to the request. If you are part of a large group with a common interest, we ask that you appoint a spokesperson rather than have each individual restate the same information. When addressing the commission, please begin by stating your name. Try to limit your comments to five minutes. When all sides have spoken, the public hearing on the matter will be closed. No further public discussion will be entertained. After each public hearing is closed, the Commission will vote on the request. Zoning requests and the Planning and Zoning Commission's recommendations will go forward to the second public hearing, which will be conducted by the City Council on August 13th, 2026. Public hearing be held to consider application SW26-02, filed by 360 Surveying, for a waiver to the City of Longview UDC Subdivision Regulations Article D, Section 5.02, Subsection A, to allow for a minimum lot width of approximately 78.24 feet Instead of the required 80 foot minimum in single family two zoning district for lot 23 block 1109 Evans Hill Estates located on the north side of Ruthland Drive and east of McCann Road. So the applicant is requesting a subdivision waiver to the UDC regulations to allow for that 78.24% feet lot width instead of the 80 foot that is required for that zoning district which is sf2 a portion of this property was purchased by the adjacent pharmacy that is located at the corner of mccann and ruthlin and it was purchased for a driveway so that that driveway could be further away from the intersection for safety reasons um per the udc the lot width is measured at the front setback line so after selling that portion their lot width is now 78.24 feet the lot does taper out to a hundred feet when you go back towards the existing house staff does recommend approval of this request i'd be happy to answer any questions at this time anybody on the commission have any questions for angela on this item

A public hearing will be held to consider application S26-05, filed by Julian Torres, requesting a specific use permit to allow for a single family home in a heavy commercial zoning district for lot one, new city block 118, Longview Northcutt Acreage, And lots 11 and 12, New City Block 107, Texas Land Co., located on the south side of East Whaley Street, east of 6th Street. So the applicant is requesting a specific use permit to allow for a single family home. uh... in heavy commercial zoning district uh... currently on this property there is a single-family home uh... prior to uh... the u d c single-family homes were allowed in heavy commercial zoning district however with the adoption of the u d c uh... they are no no longer allowed by right uh... therefore this property is considered non-conforming a s u p would alleviate any issues with any future permitting or possible future sales of this property east whaley is classified as a collector roadway and is maintained by the city of longview this type of development is appropriate along this roadway as long as access management is followed i'd be happy to answer any questions at this time thank you angela anybody on the commission have any questions for angela in this item i have a question so it has an existing home yes sir

So it is grandfathered in until they make renovations, significant renovations like additions that Mr. Torres is – requesting permits for and so if it was just if he was doing interior renovations he would be grandfathered in but once it exceeds a certain value then he would need to become compliant whether that's through the sup process yeah or yeah so currently another i'm trying to understand the process here um he cannot someone could not purchase a home and finance it because it's in commercial so that's what we've been told is that people are having trouble getting financing um through it because it's zoned heavy commercial and if it were to burn down they could not rebuild based on the zoning and so unless they get a specific use permit
