Good evening. This is a special Londonderry Town Council meeting on Monday, March 30th, 2025. Everyone please stand for the pledge. I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. First off, we have a special presentation to the Londonderry High School girls basketball state championship team. Mr. Combs. Thank you. If you would all folks come up here if you would right over here. Great. Yeah. Okay. So, whereas Londonderry High School's girls basketball team has demonstrated extraordinary talent, dedication, and perseverance throughout the 2025-2026 basketball season. And whereas through countless hours of practice, teamwork, discipline, and sportsmanship, the team achieved an outstanding record and earned the opportunity to compete at the highest level of interscholastic athletics in the state of New Hampshire. And whereas the Londonderry High School girls basketball team captured the Division 1 New Hampshire state championship bringing great pride and recognition to their school, families, and the entire Londonderry community. And whereas this championship reflects
not only athletic excellence, but also the commitment and leadership of the student athletes, coaches, school administrators, and families who supported them throughout the season. And whereas the team's success serves as an inspiration to younger students and exemplifies the values of hard work, resilience, teamwork, and community spirit that define Londonderry. Now, therefore, be it proclaimed that the town joins in celebrating this accomplishment and extends its best wishes to the team for continued success both on and off the court. Um up next discuss and approve the Saint-Gobain settlement agreement. And then Megan. Hey.
Megan, you're muted. There you go. Yes, hello. Hey. Hello everyone. So we have Megan Carrier and and Tom. They are attorneys for us who represent us on this matter and Megan if you just want to give a brief summary of where we're at with this. Yeah, I think Tom has our our settlement so I'll let him take the lead on that. Sure. Uh good afternoon or evening everyone. Again, my name is Tom Burack. I'm an attorney with Sheehan Phinney and along with Megan Carrier you have have the privilege of representing the town in negotiating a a proposed settlement with Saint-Gobain Performance Plastics in connection with contamination of our drinking water and ground water in the town. Uh just uh by way of background the settlement proposal is necessarily structured around the original 2018 settlement agreement represent the decree entered into between the state of New Hampshire and Saint-Gobain as it was then subsequently uh amended or updated in in 2022. And I think it's fair to say that what could have resulted based on the terms of of of those original agreements what could have resulted in nothing more than perhaps a few hundred point of views or point of entry treatment systems in individual homes instead the document that you have before you for approval this evening is part of an overall resolution with Saint-Gobain that will help to extend public water to numerous Londonderry neighborhoods within the next few years and also provide a a vital public water supply backbone along the west side of Londonderry. Specifically what this settlement agreement will under the settlement agreement Saint-Gobain will pay 40% of the cost of installing the water main
extending up High Range Road from Royal Lane at the south to Alexander Road at the north. The town will cover the other 60% with grant funds already awarded for this purpose by the state of New Hampshire and the town will also cover uh certain engineering and other costs. Once it is been installed this High Range Road North project will complete the backbone which is already uh largely constructed uh from which additional water mains can then be extended both into the consent decree area to the west of High Range Road uh as well as in the neighborhoods to the east of High Range Road. Saint-Gobain's financial contribution to the High Range Road North project will help free up state grant dollars that otherwise would have been spent on High Range Road North and the town can now request to reallocate for other priority water supply extensions in the town. So this is freeing up money that the town again can can uh reallocate uh with the support of the state for other purposes. By moving quickly and getting the settlement approved tonight the town with the cooperation of Pennichuck Water Works and American Excavating Company will be able to extend the contract under which American Excavating successfully completed phase one of the High Range Road project in 2025 and just as a reminder that included stretches of Nashua and Mammoth Road as well as High Range Road as far north as Royal Lane. The goal is to be able to start phase two of this this project construction in April this coming month uh and to have it largely completed by the end of the 2026 construction season. So that's a very quick summary of the
the overall components of the settlement agreement that is proposed for our approval this evening. Megan and I would be happy to answer any questions. Does the council have any questions? I just want to thank you guys for getting this finally done. It's been a long long process to get this here so I read it over and I I feel like it's good and I'm I'm happy that we're finally here. We finally have something. So thank you guys for your work on this. You're you're you're most welcome. It's been a pleasure working with with with the town staff and and with the town council uh on on all of this. So and obviously also with the folks at Pennichuck Water Works on behalf of the Department of Environmental Services uh the New Hampshire Department of Justice and certainly obviously negotiated with the with the folks who represent Saint-Gobain Performance Plastics. So I only have a couple but I have a couple of clarifications on some of them too so I just want to make sure we got everything covered. So the first one is for Zoll AED defibrillators. Remember we had a Yep. money for that. It's 575 579,190 dollars and 40 cents. That'll come out of the capital reserve fund. And they have agreed to allow us to make payments over a 5-year period without interest. Mhm.

Say that again? That's spraying at the common area and stuff. Uh yeah I got a whole That's also be for the ball fields so I assume.

Um the one they have is outdated can't be updated anymore and that comes out of their uh capital reserve fund police technology equipment capital reserve fund which they'll be a request to to remove that from there but need authorization on that one.

Uh 73,978. It's a grant for SOU equipment, but that would have presumably been approved back then. Okay. Yeah. So, I don't think you need to worry about that one. Motorola portable radios, this is new. This is 17,744 dollars and 16 cents uh from the police technology equipment capital reserve fund.
