ADMINISTRATIVE COMMENTS: These Unified Development Code text amendments add and modify supplemental standards to allow for unmanned aircraft systems, make backyard cottage regulations more flexible, clarify relief procedures for all supplemental standards, add definitions, update the use charts, update standards to comply with state statutes, and clarify engineering site plan requirements. The Planning and Zoning Commission recommended unanimous approval (7-0) on August 18, 2026. RECOMMENDATION: That the City Council approve the ordinance as set forth in the caption above.
Public Hearing: Consideration of an Ordinance of the Lewisville City Council, Amending the Zoning Ordinance by Rezoning Approximately 2.730 Acres of Land out of the Jesse Watkins Survey, Abstract Number 1323, Being a Portion of Lot 1, First Presbyterian Church Addition; Located on the South Side of Fox Avenue Approximately 315 Feet West of Edmonds Lane and on the West Side of Edmonds Lane Approximately 345 Feet South of Fox Avenue; From Office District (OD) Zoning to Planned Development Multi-Family Two (PD-MF-2) District Zoning; Correcting the Official Zoning map and List of Planned Development Districts; Preserving all Other Portions of the Zoning Ordinance; Determining That the Zoning Amendment Herein Made Promotes the Health, Safety, and General Welfare of the City; Providing for a Savings Clause, Repealer, Severability, a Penalty, and an Effective Date; as Requested by Patricia Fant, McAdams, the Applicant and Titanium Housing Partners, LLC, the Developer, on Behalf of First Presbyterian Church, the Property Owner (26-04-2-PZ).
ADMINISTRATIVE COMMENTS: The Planned Development (PD) District is intended to accommodate innovative forms of development by tailoring regulations to better accomplish the City's adopted plans for development, redevelopment and revitalization. A planned development district should mitigate the impacts of development upon the environment, traffic, public services, public facilities, adjacent land uses, and area land uses, as well as protect and enhance the aesthetic and visual quality of the City. Titanium Housing Partners, LLC is requesting a zoning amendment from Office District (OD) to a planned development with a Multi-Family Two (MF-2) base district. The 2.73-acre vacant site is located at the southwest quadrant of Fox Avenue and South Edmonds Lane (currently a portion of the First Presbyterian Church lot). The applicant proposes "Patriot Pointe," a 48-unit veteran-focused, affordable Low Income Housing Tax Credit (LIHTC) multi-family rental community. Staff does not support the requested rezoning due to land-use incompatibility. While the project is well-designed and advances the housing diversity goals of the Lewisville 2025 Vision Plan, it conflicts with the Plan's broader objective for "Diverse and Thriving Neighborhoods" as it removes the potential for neighborhood serving commercial near the corner of two major streets. The Planning and Zoning Commission recommended denial (5-1) of this item on September 1, 2026. The Unified Development Code requires an affirmative vote of at least three-fourths (5) of all members of the City Council to approve this zone change request since the Planning and Zoning Commission recommended denial of the request. RECOMMENDATION: That the City Council deny the ordinance as set forth in the caption above.
Public Hearing: Consideration of an Ordinance Adopting the FY 2026-2027 Tax Rate.
ADMINISTRATIVE COMMENTS: In accordance with state law, a public hearing is being held on the proposed tax rate for the 2026 tax year. Section 26.05(d) of the Texas Property Tax Code requires a governing body to hold a public hearing to adopt a tax rate for the current tax year if the proposed rate exceeds the lower of the voter-approval or no-new-revenue rate. The proposed tax rate was recommended by City Council at the budget workshop held on August 8, 2026. The total tax rate proposed for FY 2026-2027 is $0.436381. This is an increase of $0.017372 from the prior year rate of $0.419009. The proposed tax rate exceeds the no-new-revenue rate of $0.425595 by 2.5 percent but does not exceed the voter-approval rate of $0.436381. Since the proposed rate exceeds the no-new-revenue rate, specific language is required by ordinance, the vote on this ordinance must be a record vote and approved by at least 60 percent of the members of the governing body. For the City of Lewisville, this would equal at least five voting members. The motion to adopt the ordinance must be made using specific language as found in the recommendation below. RECOMMENDATION: That City Council approve the proposed ordinance adopting the FY 2026-2027 tax rate with the following motion: “I move that the property tax rate be increased by the adoption of a tax rate of $0.436381, which is effectively a 2.5 percent increase in the tax rate.”
Public Hearing: Consideration of an Ordinance Amending the Fee Schedule of the City of Lewisville by Amending Fees Related to Community Engagement, Engineering, Finance, Library and Arts, Neighborhood and Inspection Services, Parks and Recreation, Police, and Public Works, and Authorizing All Fees as Presented in the Attached Fee Schedule (“Attachment A”).
ADMINISTRATIVE COMMENTS: A public hearing on the FY 2026-27 fee schedule is being held to provide an opportunity for public comment. As part of the annual budget process, changes to the fee schedule based on an analysis of current charges as compared to cost recovery goals and/or comparison to surrounding entities is conducted. Resulting modifications are proposed by the departments. Actual fee schedule information is located on the City’s website within the Financial Services section. This repository is maintained by the City Manager’s Office. Proposed updates in this year’s fee schedule include changes to Community Engagement, Engineering, Finance, Library and Arts, Neighborhood and Inspection Services, Parks and Recreation, Police, and Public Works. RECOMMENDATION: That the City Council approve the ordinance as set forth in the caption above.
Public Hearing: Consideration of a Resolution of the City Council of the City of Lewisville, Texas, Amending the City’s Economic Incentive (Commercial) Policy to Update Criteria for Certain Incentives, Establish Certain New Grants, Establish Priorities and Guidelines for City Participation in Affordable Housing Projects, and Improve Clarity, Flexibility, and Ensure Alignment With Current Economic Development Priorities; and to Establish and Adopt Guidelines and Criteria for Tax Abatement Agreements and Elect to Participate in Tax Abatement Agreements in Accordance with Chapter 312 of the Texas Tax Code; and Providing an Effective Date.
ADMINISTRATIVE COMMENTS: The City Council adopted its Economic Incentive (Commercial) Policy effective March 21, 2016, and amended the policy on May 20, 2019, and December 4, 2023. The policy establishes guidelines and criteria for the City's commercial economic development incentives, including tax abatements. The proposed policy updates the City’s criteria and programs to better align economic development incentives with current
