Approval of a Professional Services Agreement with Tanko Streetlighting, Inc. for Streetlight Purchase, Conversion to LED, & Maintenance Support in an Amount not to Exceed $825,528; and Authorization for the City Manager, or Her Designee, to Execute the Agreement.

Municipal ownership would allow Lewisville to manage streetlights as a public right-of-way asset rather than a bundled utility service, shifting from utility-owned tariffs (with embedded maintenance and other charges) to a customer-owned rate structure that drives long-term savings and better service. Paired with systemwide conversion to Light Emitting Diode (LED) lamps, the City can reduce monthly energy costs and secure predictable, unit-priced maintenance through independent contracting. City control also strengthens accountability through accurate inventory and billing, defined maintenance standards, and faster response times, reducing payments for lights that are out, removed, or inventoried incorrectly. Tanko Lighting's Streetlight Ownership Feasibility Study, presented to City Council on August 4, 2025, evaluated three options and supports staff's recommended Option 1: acquire lights from Texas New Mexico Power (TNMP) and Denton County Electric Cooperative, Inc. (CoServ), convert to LED, and provide ongoing maintenance. With approximately 5.5% of lights currently converted (most are High Pressure Sodium (HPS), the study estimates an investment of $2,701,941 upfront for ownership transfer will yield over $7M in savings over 20 years and a 5.3-year payback. The proposed not-to-exceed contract amount is $825,528 for Phases 1-3 and one year of Phase 4, with two optional 12-month Phase 4 renewals; funding is available in the Streetlight Replacement and Ownership Capital Project.

Approval of a Resolution of the City of Lewisville, Texas Finding That Texas-New Mexico Power Company’s Application to Change Rates Within the City Should be Denied; Finding That the City’s Reasonable Rate Case Expenses Shall be Reimbursed by the Company; Finding That the Meeting at Which This Resolution is Passed is Open to the Public as Required by Law; Requiring Notice of This Resolution to the Company and Legal Counsel.

Texas-New Mexico Power Company (TNMP or the Company) filed an application with cities retaining original jurisdiction on November 14, 2025, seeking to increase system-wide transmission and distribution rates by $34 million. The Company is asking the City to approve a 6.4% increase in residential rates and an overall increase of 5% in rates. The Company is also proposing a 6.6% decrease for streetlighting customers, but significant increases for commercial customers. Monthly rates would increase by approximately $5.20 for an average residential customer. The City of Lewisville is a member of a coalition of cities known alternatively as the Cities Served by TNMP and the Gulf Coast Coalition of Cities (TNMP Cities). On December 1, 2025, the Council approved a resolution suspending TNMP’s rate request from taking effect for 90 days. This time period has permitted the City, through its participation with the Cities Served by Texas-New Mexico Power Company (“Cities”), to determine that the proposed rate increase is unreasonable. The purpose of the proposed resolution is to deny the rate change application proposed by TNMP.

Approval of a Resolution Authorizing Contracts for Joint Election Services with Denton and Dallas Counties; and Authorizing the Mayor, City Manager, or Her Designee, to Execute Said Contracts.

The proposed resolution authorizes the Mayor, City Manager, or her designee, to execute Joint Election Services Contract with the Dallas County Elections Administrator and a Joint Election Agreement and Contract for Election Services with the Denton County Elections Administrator for the May 2, 2026, City of Lewisville General election.

Consideration of a Resolution of the City Council of the City of Lewisville, Texas, Nominating a Candidate to Fill a Vacancy on the Denton Central Appraisal District Board of Directors, Place 4; and Providing an Effective Date.

The Denton Central Appraisal District (DCAD) notified eligible taxing units of a vacancy on its Board of Directors following the passing of Ann Pomykal, Place 4, whose term expires December 31, 2029. The City of Lewisville may submit one nomination to fill this vacancy. Pursuant to Section 6.0301(f) of the Texas Property Tax Code, nominations must be made by resolution and submitted to the DCAD Chief Appraiser by March 30, 2026. The DCAD Board will appoint one nominee by majority vote to serve the remainder of the unexpired term. For this vacancy, City Council is asked to nominate an individual to serve on the Denton Central Appraisal District Board of Directors for the remainder of the unexpired term ending December 31, 2029.

Consideration of an Ordinance of the City Council of the City of Lewisville, Texas, Amending the Fee Schedule to Add Credit Card Convenience Fees to Electronically Processed Credit Card Payments Made for City Water, Sewer, Stormwater, and Refuse Collection Services; Providing for a Repealer, a Savings Clause, Severability, and an Effective Date.

The City contracts with Paymentus and Pace Merchant Services to process electronic payments for a variety of City services. Historically, the City has absorbed credit card processing fees for these transactions, with the exception of Municipal Court payments. The significant growth in electronic payments, particularly for utility services, has made it financially unsustainable to continue covering these fees. City staff presented this proposed change to the City Council during the FY2025-26 Budget Workshop. Council authorized staff to move forward with implementation as part of the FY2026 budget. Customers may continue to pay by credit or debit card and cover the associated convenience fee, or they may choose to pay with cash, check or automatic bank draft, which remain available at no cost. The proposed effective date for this change is April 1, 2026.
