Item number one is a request by four-star group for final plot approval for Chandler Grove, 11-lot subdivision on about 33.88 acres, an unaddressed property on Franklin Road, zoned office medical, and RS-6 in Ward 3. Consent agenda item number two is a request by SB Barton Village TN sub LLC for final plot approval for Barton Village phase 6A, a 113 lot conservation subdivision on about 27.28 acres at unaddressed property on Yellowstone Road, 689 in unaddressed Pinhook Road, zoned RS6 and Ward 3. Consent agenda item number three is a request by 11 and... Property Partners LLC for preliminary site plan approval for Kia of Lebanon, a non-residential development on about 8.46 acres at 200 South Hartman Drive, zoned interchange commercial in the South Hartman overlay in Ward 5. And consent agenda item number four is a request by Prologis for site plan approval for Mountain View, buildings two, three, and four, a non-residential development on about 133.6 acres at 710, 715, and 720 Bridgestone Parkway. This slide number one is a request by Restaurant Retail Properties LLC for rezoning approval for about 4.01 acres at 1729, 1731, and 1733 West Main Street from Interchange Commercial to West Main Tech Specific Plan in Ward 5. The properties to the north are zoned commercial mixed use to the east and west as interchange commercial, and to the south as RS-20 and rural preservation open space. The properties to the north are indicated as mixed housing and residential eight units per acre, east as public institutional residential, and south as residential two units per acre, and to the west as commercial mixed use on the future land use plan. This property is indicated as commercial mixed use on the future land use plan, which would support this rezoning request. This is a request to rezone the subject property from interchange commercial to a text specific plan based on the commercial mixed use district. The permitted uses have been changed to include self storage and drive thru restaurants, neither of which are permitted in that district. The following uses have been excluded from the permitted uses typically found in the CXU district automotive parking, cultural and recreational services, all residential uses, major and minor entertainment services. The following uses have been expressly prohibited as well, those being check cashing services, gas pumps and gas stations, car washes, kennels, and especially smoke and vapes shops. The phasing plan has been updated to read that lots one or three, the front lots, will be developed prior to or concurrently with the self-storage lot two. A certificate of occupancy for the self-storage building shall not be issued until a certificate of occupancy for one of the following uses is first issued for convenience commercial, general retail, food, or beverage services on one of the frontage lots. The benefits section has also been updated to read that a westbound right turn lane to access this development shall be required to be installed prior to any COs being issued for the development pending Middle Tennessee Electric coordination. There are tables in your report as well going over the standards which are increasing and decreasing. There are three increasing standards. They're adding additional plantings required along rear lot lines, shared access drives, and the front property line. Foundation plantings are being required for the front commercial lots, and self-storage is being put at a 250-foot setback from Lebanon Road. They are decreasing one standard, that being the sidewalk and planting widths have been reduced from 8 to 6 feet and 6 feet to 4 to 4.5 feet, respectively, along with the treatment type being changed from trees and wells to a grass strip. Staff recommends approval of this SP request because the benefits of the commercial development and the SP is closer to the future land use plan than the existing zoning, which is beneficial to the city. This is a recommendation to city council. The expected city council readings for this and all subsequent ordinances on the agenda are as follows. First reading and public hearing, October 6th. Second reading, October 20th.

The properties to the north and south are zoned CXU and IL, to the east as CXU and CS, and to the west as IL. All adjacent properties are indicated as downtown mixed use on the future land use plan. This property is indicated as downtown mixed use on the future land use plan, which would not support this rezoning request. A future land use plan amendment to office medical CMO has been requested. This is a request to rezone the Cedarcroft properties from commercial mixed use and light industrial to this SP proposing a 115 bed drug and alcohol and mental health detox and recovery center. The SP request has a base zoning of office medical as COM and requires the concurrent future land use plan amendment request to the office medical CMO designation. The proposed use and COM standards are not compatible with this location. The intent of the existing future land use downtown mixed use, DXU, describes a walkable mixed use area intended to serve people living in adjacent residential neighborhoods. The permitted uses are listed in the SP as healthcare facilities, medical and professional services, and they have added secure and personal group care, including only the following specific uses of overnight institutional treatment for addiction and overnight institutional detox. The following uses are listed as prohibited uses. Personal and group care facilities, permanent and semi-permanent residential uses, and any use not specifically allowed. The benefits section has been updated to include the complete safe streets for all roadway safety action plan roadway improvement, which includes crosswalks, signage, and pedestrian safety striping within the Spring Street and College Street areas. Intersection. Staff recommends denial of the future land use plan amendment because it's not compatible with this location and staff recommends denial of the SP request because it does not follow the future land use plan. However, the inclusion of the complete safe streets for all roadway improvement project as a proposed ancillary benefit. BOOSTED THE OVERALL PROJECT SCORE FROM 68 TO 78. BY PROVIDING THAT BENEFIT, IMPROVING THE PROPERTY AND REMOVING MANY OF THE UNDESIRABLE USES ON THE PROPERTY, THIS SP CAN BE CONSIDERED BENEFICIAL TO THE COMMUNITY. THIS IS A RECOMMENDATION OF CITY COUNCIL.
NEW SPEAKER I'D LIKE TO SPEAK TO THIS ITEM.
good evening mr chairman and members of the planning commission i appreciate your willingness to serve in this capacity and thank you for your time today my name is john bryan i represent my mother my father as well as bryan brothers partnership owners of the property located at 202 204 and 154 south college street i'm also representing the decillo group the developers who cannot be here today to an unforeseen family situation As you're aware, the developers propose transforming the present use of what's recognized in the community as Cedarcroft Home, a boarding home for mentally ill men serving some 138 clients to a nationally known drug and alcohol detox and treatment facility. Under the proposed new use of the facility, the maximum number of individuals served at any one time will be 115 clients. This new facility will be 100% secured, unlike its present use. And with the additions to the SP that were recently worked out, we've received an improved score of 78 on the zoning and SP scoring sheet. In an effort to meet expectations by planning, two key issues recommended by staff have been addressed and resolved, including the staff's recommendation of adding crosswalks and the deletion of fencing at the property's front. Both of these recommendations will serve to completely enhance the walkability of the sidewalks. Both are deemed to be beneficial to the city of Lebanon. Please know that the two city council members who awards either include the Cedarcroft property or is adjacent to the property are both supporting the new use and the SP. Working with our city council members that represent this ward, there have been two public meetings and efforts made to ensure the immediate neighborhood was informed and willing to support this development. Both meetings were well attended with positive outcomes. Here are some of the main positives that benefit the city and the immediate community this property lies within. As I stated previously, the new clinic is secured. No checking out and walking the streets of Lebanon. The main complaint about Cedarcroft is our guys walk the streets of Lebanon and downtown district. The clients for the new facility will be driven into the clinic through a secured entrance and will not leave until the rehab is complete. The elimination of unnecessary 911 calls. Our city's first responders have been inundated with calls each and every month. The police chief, the fire chief, and the Wilson County Sheriff all were in attendance to our neighborhood meeting in support of this new development. Number three, increase in employment opportunities. Cedarcroft currently employs approximately 38 folks with an average payroll of around $28,000 a head. The new clinic will initially employ 50 with an average per head payroll of over $60,000 and will include RNs, LPNs, and medical doctors on staff. The new facility will undergo a facelift for the capital investment of now over $2.5 million in improvements. Number five, an increase in sales tax revenue will also be realized. Number six, as I stated previously, we had two public meetings and had 100% positive feedback from those attended. All of our immediate neighbors were completely behind this improvement. Number seven, both city councilors who served in this area support this development. Number eight, Cumberland University will benefit as well with their nursing program having an additional outlet for future employment opportunities. And finally, our current administration, Cedarcroft, and Peggy Zide is here with me today, our administrator for 22 years, will be involved in this transition, including myself and others, for a smooth transition during the construction process. To conclude my presentation, I think it's important to remember We understand and respect the fact that the project does not follow the city's future land use plan due to some elements. But even with that, we believe that the proposed project is beneficial to Lebanon and a great improvement over the existing use. If I may, I'd like to refer to what Christie stated on page 17 of the PC staff report. However, the inclusion of the complete Safe Streets for All Roadway Improvement Project as a proposed ancillary benefit boosted the overall project score from 68 to 78. By providing that benefit, improving the property, and removing many undesirable uses on the property, this SP can be considered beneficial to the community. With that and the positives that I presented earlier, we believe that the proposed project is a great benefit to Lebanon and a great improvement over the existing use. I ask you to pass this on to the city council.

We've had frank conversations. I agree. I know that the future land use plan has for something different. This is a very unique building in our, what we call our historic downtown. And what could be there, This eliminates that because there's a lot of undesirable things that could be there with a building of this size and for the use that is being. So I appreciate the working with our staff with me. I know Jerry's here too. We split that street. I have Cedarcroft side. I have the west side. She has the east side. I believe we've come to a plan that will benefit the city along with the walkability and for future to come. So I do ask your support for this and to send it on to the council with a positive recommendation. Thank you.

This is removing some confusion we've had over some of our temporary sign types and also cleaning up our sign maintenance section to align with the state language on that topic. That's a recommendation to City Council.

My name is Joe Perkle, my wife, Linda. We live at 305 West Hill drive. We've lived there for over 40 years. We got a letter last Thursday night and just delivered and it spoke of the Kia development. We'd never heard anything about anything. The letter came from planning commission. So we came last night. We didn't know what to do. So we came last night because we are very concerned about flooding. And I saw the site map from Ms. Gore last night. And I assume that the City of Lebanon or Planning Commission has vetted all the flood requirements because... They assured us there would be no increase in flooding, but we have been flooded severely. The February 14th, 89, 2010, when Nashville got flooded, one, it was 16 inches deep on our garage door. And just by our own action, we wanted to, so their backdoor neighbors, the West hill project was put in. I can't remember the dates of it. Probably sometimes two 22,000. Anyway, I saw the plan, and we're just backdoor neighbors, so I just wanted to speak to the flooding issues there and don't want it to be any worse. I want it to be much better, hopefully. And sorry that I jumped into the meeting like this. That's all right. Thank you.
