And items one and two are requests by prologus for preliminary and final plat approval for Mountain View, a two lot subdivision on about 135.08 acres at 700 Bridgestone Parkway zone prologous Haskell Evans SP in Ward 4. Consent agenda item number three is a request by SB Barton Village Sub LLC for final plat approval for Barton Village phase 4A and four in 5A of 115 lot conservation subdivision on about 34.9 acres at 1139 and unadressed property on Pinhook Road zoned RS6 and RS9 in Ward 3. Consent agenda item number four is a request by SB Barton Village Sub LLC for final plat approval for Barton Village phase 4B and 5B, a 28 lot subconservation subdivision on about 28.24 acres at 1139 and 1409 Pinhook Road zoned RS6 and RS9 and Ward 3. It is a request by Lenot Moore for site plan approval for Moors Landing, a non-residential development about 1.09 09 acres at 1790 West Old Murphy'sboro Road Zone Interchange Commercial in the South Hartman overlay in Ward 3. There are some minor corrections that are needed. This application was deferred by planning commission last month to allow the applicant a chance to work with staff on bringing the project closer to the intent of the South Hartman overlay. Staff and the applicant have met and have continued to work towards this goal. The applicant has revised their plans, removed two variance requests, and staff believes it now meets the intent of the South Hartman overlay with the remaining variances. Those variances are as follows. The limited parking frontage type is not allowed along the West Oldenboro Road frontage. They have designed a pocket park uh to go between the parking and the road to make this a pedestrian friendly uh frontage type. So staff supports this variance with the inclusion of that pocket park open space. Variance number two, buildings need to be placed within 10 to 20 ft of the front property line along Old Murphy'sboro Road. Similar to the last one, they've created an open space along that frontage. So staff now supports this variance with the inclusion of the pocket park open space. Foundations need to be raised a minimum of one and a half feet from crown or curb of the road. Uh raising the height of the foundation planting a minimum of one and a half ft creates a visual transition from public to private spaces. This is important for residential uses and some commercial uses, but for this commercial use they're intending here is not that important. So this transition um can be helpful but in this case staff supports the request because of the proposed building design and use variance number four is buildings excluding town homes and multif family are limited to 25 ft tall in height up to the parapit

residential buildings may extend up to 35 ft tall and this building is still remaining less than that so it does still fit into the area. We do think this additional height actually aids the architectural articulation and design of the building. So staff supports this request with the proposed building design. And finally, variance number five, buildings in the subdist need to be one of the listed types. It is none of them. Uh however, we do think the design of the building. They've made a good effort to make it fit in with those building types. So staff supports this request with the proposed building design. Staff recommends approval of the site plan with all variances because the design meets the intent of the South Hartman overlay. to speak.

The legislative intent of separating secure personal group and regular group care has been clear for a few years now. The formatting of the new code makes that a little less clear. So, we're just trying to make that more clear for everyone who reads it moving forward, but we're not trying to change anything else. This is a recommendation to city council.
