The project will consist of two phases. Phase one includes the 24 unit complex and phase two includes the two 12 unit complexes. The parcel consists of 2.55 acres of residential land and is surrounded by urban residential medium density and public zone districts. Excuse me. Vice Chairman Casey, Sunny Portia, Laramie County Planning and Development. The Laramie County Comprehensive Plan identifies the area as Urban Residential Interface or URI. The URI areas are intended to accommodate a mix of more intensive land uses than other areas. These areas may have public water and sewer services, a higher level of vehicular access, and a greater overall level of community services. Higher density residential, intensive commercial, employment centers, and industrial uses are preferred in these areas. Large lot, low density residential, or intensive agriculture uses are generally less suitable. While some of these areas may include existing agricultural uses, it is anticipated they are more service oriented and may change and develop over time. Adjacent jurisdictions should be involved in decision making in the URI. Large scale, high intensity development may necessitate extension of water and sewer services within these areas. Any extension of services should be encouraged with any development within the URI. Plan Cheyenne considers this area to be parks and open space, which includes existing and planned future parks and open space areas. Public and private open spaces, public and private parks, country clubs and golf courses are appropriate uses. Some public utilities or facilities may also be appropriate. This category may also include a natural cultural resource area. At the time of this report, agency review comments were still being addressed and will be a condition of this report. Public notice was provided and public comments were not received regarding the conditional use permit. A conditional use is given to land use meant to be beneficial to the permitted uses or those similar within a zoning district with conditions, or it requires conditions to mitigate impacts it may have on the surrounding area. Land use or land use proposals similar in nature, intensity, and community impact, which requires a conditional use permit, has probable impacts and is required to meet all LCLUR conditions. It was determined that a Class B conditional use permit would be required and, upon approval, a commercial site plan be submitted. Class B conditional uses are those meant to be beneficial to an area and are permissible in their zoning district. Section 2-3-102 of the Laramie County Land Use Regulations requires that the Laramie County Planning Commission find that the proposed use is permitted and is in conformance with all applicable development standards. Staff find this application is in conformance with the plans and policies of Laramie County. Recommendation and findings. Based on evidence provided, staff finds that A, this application meets the criteria for a Class B conditional use permit pursuant to Section 2-3-102 of the 2025 Laramie County Land Use Regulations, or the LCLUR, And B, this application is in conformance with Section 2-4-101 of the 2025 LCLUR governing the URLD, Urban Residential Low Decency Zone District. And that the Planning Commission may approve the Class B Conditional Use Permit for the Powder River Apartment Complex with the following conditions. One, all agency review comments must be addressed and or corrected prior to recordation. And at this time, I stand for any questions.

martha lang i live at 406 west prosser right across from this um right across the road from it uh it's not that i am opposed to this at all but i can tell you in looking at this they don't have enough dumpsters for starters but um i would like to know more and maybe this is the wrong place to ask but The construction, where are the people going to park? There is not that much road there. And the road is in super bad shape. I don't know if any of you have driven on it. I'll tell you, the motorcycles don't race on it anymore. It's dangerous. So those are the things. You're talking about adding more people. We've got to, I think, look at other things. You know, everybody that lives there needs to know street-wise, garbage-wise, what's the plan? You're talking the bigger unit first and then the small units? So that's the main question for me.

And really what we're here for is to listen to what you have to say, see if they're meeting the requirements of the land use, and then make the recommendation to the commissioners. So that would be another place that you would want to come is when it goes to the commissioners and voice your opinions to them as well. But there's going to be certain criteria that they're going to have to meet county standards and things that are laid out in the land use.

Vice Chairman Casey, through you. So during this phase, it is just the conditional use process, the use of the land. What will come next is the commercial site plan application. And during that process, the roads will get addressed, any type of parking, the trash dumpsters. All of the roads have to go through public works for Laramie County land use regulation and be approved to those standards. So during that process, you'll be able to see more of what's going to happen with the roads.

Okay. I guess my main question at this point would be, there's the draw right there, Allison Draw. Isn't that supposed to be a flood plan? And you're allowing apartments there? I suggest a look at it. And that is a very big one right there. I know I'm probably fairly safe where I am, but those apartments would be gone.

Mr. Chairman, through you, I believe I can address that. So I'm the FEMA floodplain administrator. You're absolutely correct in that the Allison Draw is a FEMA floodway. It is actually one step beyond a special flood hazard area, a.k.a. a 100-year floodplain area. That being said, when they did the flood insurance study and with all the hydrologics, the floodway will not be impacted whatsoever. It is outside of the floodway. It could potentially be within the FEMA 500-year floodplain. We don't regulate that. But again, if it were to be in a FEMA special flood hazard area, we would have certain requirements where the buildings would have to be constructed accordingly. But there's no concern on this front. The floodway handles the flows.

The purpose of the application is to change the zoning of the subject parcel to match the zoning of the owner's adjacent lot to the west. The adjoining lot is currently used for storage. Vice Chairman Casey and members, The subject property is currently assessed as residential vacant land and is boarded by a mixture of residential and commercial properties. The Laramie County Comprehensive Plan designates this area as URI, Urban Rural Interface, intended to accommodate a mix of more intensive land uses than other areas. These areas may have a higher level of vehicular access and a greater overall level of community services. Plan Cheyenne designates this area as rural residential. Individual wells and septic systems provide water and sanitary services to the area. Any commercial development will require a commercial site planning action. Agency reviews have been addressed, public notice was provided and no written comments were received. Section 2-1-103E states that prior to making a recommendation to the county commissioners about any zoning map amendment, the planning commission is required to find one, the zone change request supports and upholds the safety and health of the community, and that it endorses the general welfare of the inhabitants of Laramie County, and that one of the following two is also determined to be declared to be a finding. A, the existing zoning classification of the land does not fit the overall development pattern of the area, or B, there have been changes of a physical, economic, or social nature within the area which have prompted the request and which enabled the zone change to better meet community needs. Criteria 1 and B are met by the type of action proposed and by meeting all of planning's application criteria. Based on application evidence provided, staff recommends A, this application does meet the criteria for a zone map amendment pursuant to section 2-1-103 of the LC-LUR and B, the proposed change in zone district is in conformance with the requirements of section 2-4-105 of the Laramie County land use regulations and that the Planning Commission may recommend approval for the Lot 20, Block 7, All-America Subdivision second filing zone change from land use to community business with no conditions. Palma Land Planning LLC on behalf of landowner Jean Wheeler Revocable Trust has submitted an application for a major subdivision permit in Platte for the above location. The purpose of the application is to subdivide a 319.71 acre lot into 52 single family residential lots. The subject property is located in the land use LU zone district and is currently used for agricultural purposes. The surrounding area is residential to the west, agricultural vacant land to the east and south, and commercial uses and detached residential to and detached residential. The property is located at the intersection of Horse Creek Road, State Highway 211, and Road 215. Given the difficulty of this intersection and access to the proposed subdivision, access will be reconfigured at the intersection to grant access from Road 215 and another access point off Road 116. No direct access will be from Horse Creek Road. Pertinent Laramie County land use regulations or statutory provisions include Wyoming State Statute 18-5-301 through 18-5-306. Wyoming State Statute 34-12-101 through 34-12-115. Section 4-5-100 governing major subdivision permit and plats. Section 2-4-104 governing the LU land use zone district. Good afternoon, Commissioners. Casey Palma, Palma Land Planning Agent for the owner. If you remember, this body approved the preliminary subdivision plan back in June for this project. A few minor changes have been made, but this is generally in conformance with what you saw back then. The engineering plans have been submitted and reviewed, and I'm working with the project engineer to address those comments. We've responded to all the comments on the plat and are just working through the final changes while we wait for the Chapter 23 report to be reviewed and approved by DEQ. I'd be happy to address any questions you might have.

The Laramie County Comprehensive Plan identifies the area as a Rural Ag Interface, or RAI, which anticipates these areas to primarily be used for rural residential uses. Development should be located on existing right of way where possible. A new development in this area shall address water availability, public lands access, cultural resource preservation, and roads and connectivity. Future development in the REI area should take into consideration minimizing impacts to view sheds and wildlife, especially in western portions of Laramie County. This proposed project is in conformance with this plan. According to the adopted Amec memo dated January 31, 2014, The property lies within Zone 2 of the study area. The memo states that lots within this zone shall be a minimum of 5 acres to sufficiently recharge groundwater after withdrawal from a pumping well. Development design standards contained within Section 2-1-104 of the land use regulations dictate that minimum acreage within Zone 2 be 5.25 acres to accommodate for the impervious surface of residential structures and driveways. The proposed action does meet these requirements. A subdivision of more than 5 lots requires a submittal of a Chapter 23 study to the Wyoming Department of Environmental Quality . A DEQ Chapter 23 application will be submitted and a letter of non-adverse recommendation will be required prior to recordation. Water and sanitary sewers will be provided by individual wells and septic systems. The Environmental and Services Impact Report provides a general outline of the project and its impact on schools, stormwater runoff, and county services. Portions of these parcels lie within the FEMA 100-year floodplain. The Land Analysis Map provides information regarding the buildable area for the proposed subdivision. At the time of this report, agency reviewer comments are still being addressed. Public notice was provided and no public comments were received on this project. The Planning Commission met on June 25th, 2026 for the preliminary subdivision plan for R&R Heights and approved the project with a vote of 4 to 0. Section 2-3-102A of the Laramie County Land Use Regulations Requires that the Laramie County Planning Commission find that the proposed use is permitted and is in conformance with all applicable development standards. Staff find this application is in conformance with the plans and policies of Laramie County. And based on evidence provided, staff finds that A, this application meets the criteria for a major subdivision permit in Platte pursuant to section 4-5-100 of the 2025 Laramie County Land Use Regulations. And B, this application is in conformance with sections 2-4-104 of the 2025 Laramie County Land Use Regulation governing the LU, the Land Use Zone District. And that the Planning Commission may recommend to the board for approval of the major subdivision permit in Platt for R&R Heights subdivision with the following conditions. One, all agency comments must be addressed and or corrected prior to recordation. Two, a Chapter 23 non-adverse action letter must be received from DEQ prior to recordation. Located in portions of section one, two, three, and 11, township 12, range 67 west, and a portion of section 35, township 13 north, range 67 west, Laramie County, Wyoming. Vice Chairman Casey and members of the Commission, Kate Kendall, Associate Planner. Palma Land Planning LLC, on behalf of Vantage Data Centers, has submitted an application for approval of a zone change for the Project Latigo from land use zone district to a planned unit development zone district. This zone change will establish a framework for the development of a data center campus and supporting infrastructure. an on-site workforce accommodation component to house construction phase personnel is included. This PUD comprises approximately 1,835 acres and is located south of State Highway 223, also known as the Terry Ranch Road. The subject property is currently assessed as agricultural. The surrounding area consists of rangeland and commercial uses. This PUD district is intended for industrial uses requiring buffering, secure operations, and associated accessory uses that cannot readily fit into general commercial or mixed-use districts. Pertinent regulations include Section 2-1-103 of the 2025 LCLUR governing the criteria for a zone map amendment and Section 2-4-111 of the 2025 LCLUR governing the PUD zone district. With us today is Casey Palma, the agent for the applicant. To answer any questions you may have.

Good afternoon, Commissioners. Casey Palma, Palma Land Planning Agent for the applicant. So I think staff covered it pretty well. This is approximately 1,800 acres south of Terry Ranch Road. What you have before you today is just to PUD zoning to provide a framework for data center development. Phase one includes four buildings and then cooling facilities and on-site power generation down in Section 11. You may have noticed kind of the weird checkerboard here with the state land. So we are currently talking to the state about the best way to coordinate access and collaborating with them on the land uses. So I don't have anything specific for you unless you have any questions for me. You may have noticed we have a few advantage design operations folks here today. And so I'll introduce Matt with the Government Affairs Department. Representative with Vantage, and I'd like to just present a few slides to you.

So I'm just going to provide a little bit of the overview of Vantage. As you can see, we were founded in 2010. We're headquartered in Denver, Colorado. We are the largest private data center. builder in the United States. We have campuses throughout the U.S. and worldwide. We do build to suit and offer flexible designs that meet many standards. We are currently serving many of the world's leading technology brands, but I think most important for the commission and for the community is that our goal and our commitment is to work with the local community as much as we can to make sure that we limit the impact while we're building and as we're here long term. Next slide. Thank you so much. So what we envision in this project is bringing in about 2,000 skilled jobs, starting with about $4 billion in investment with the goal of building it up to about $20 billion. When it comes to resource management, this is one of the things that we work very diligently on to make sure that we leave more than we take. So our commitment is to make sure that we replenish any water that we use at 110% to 100%. We are committed, again, to the governor and the county's focus on workforce development as we continue to build. And as I mentioned before, our goal is to be hyperlocal with the community to make sure that we're addressing all of the concerns and limit the impact as we're continuing to build and operate. And with that, I'll turn it over to my partner, Tim, who will talk through the project.

Staff had gone over the location, but just to highlight again, Project Latiko is located about 12 miles from the center of Cheyenne. We're near the Colorado and Wyoming border, east of I-25, south of Terry Ranch Boulevard. We are believing that this location is ideally situated for the investment and the growth in critical essential services such as this data center plan unit development. If you go to the next one. So again, just to highlight, the plan unit development would cover just about over three sections of land. It would allow for the investment and the growth through data center buildings, admin and office, onsite generation. We do utilize a closed-loop chiller systems on all of our campuses. So from an operational standpoint, we do not use any water for cooling other than restrooms and sinks for the employees that will be working there on a full-time basis. So water use is very intentionally minimally low. And as Matt mentioned, we do plan to invest back in local resources for Laramie County so that we're being water positive. We do intend to have provisions for on-site workforce housing, understanding that the growth in the industry in Laramie County is bringing a lot of people to help build these jobs and they need places to live. So something we're being very intentional about and understand that. impacts with traffic, light, air quality, noise are very important. And we've already been working with staff, the county, groups like YDOT to ensure that our plans are very thoughtful and intentionally working with the community. We want to make sure that we're obtaining feedback and incorporating that into our plans and being transparent about what the benefits of this project are and how, while it's getting built, we're mitigating those impacts. Vice Chairman Casey and members, the Laramie County Comprehensive Plan designates this area as Gateway Corridor and Ag and Range Land. Appropriate uses in GC area may include a mix of commercial, industrial, office, and public facilities. Plan Cheyenne designates this area as AR. All access to Project Latigo is intended to be directly from Terry Ranch Road, either via I-25 or State Highway 85. Access to public roadways will be constructed to YDOT standards. Water service will be provided by on-site wells or a connection to the City of Cheyenne BOPU system via an outside user agreement. Hulled water may be used during initial phases prior to establishment of a permanent source. Sanitary sewer service will be provided by engineered on-site treatment or connection to the City of Cheyenne BOPU system. Storage tank or vault and hall may be used during initial phases prior to establishment of a permanent solution. Temporary solution operations may include contracts, manifests, and disposal receipts maintained on-site for inspections. At the time of this report, the project was still going through agency reviews. As of today, all comments have been addressed and no further concerns by the reviewing agencies. Public notice was provided in accordance with Section 1-3-104. Notices were sent to 19 surrounding property owners within 500 feet of the subject property. One public comment has been received and is attached to this report and was addressed by the applicant. Section 2-1-103E states that prior to making a recommendation to the County Commissioners about zoning map amendments, the Planning Commission is required to find the one the zone change request supports and upholds the safety and health of the community, and that it endorses the general welfare of the inhabitants of Laramie County, and that one of the following two is also determined and declared to be a finding. A, the existing zoning classification of the land does not fit the overall development pattern of the area. or B there have been changes of a physical, economic, or social nature within the area which has prompted the request and which enabled the zone change to better meet community needs. Criteria 1, A, and B are met by the type of action proposed and by meeting all of planning's application criteria. Based on evidence provided, staff recommends that a this application does meet the criteria for a zone map amendment pursuant to section 2-1-103 of the LCLUR and b the proposed change in zone district is in conformance with the requirements of section 2-4-111 of the Laramie County Land Use Regulations and that the Planning Commission may recommend approval for the project Latigo zone change from land use to planned use development with one condition.
