Item 23, consideration of comments on two amendments to the plan Cheyenne future land use map. Number one, hitching post district from agricultural rural mixed use employment and open space and parks to community business for approximately 652.67 acres southeast of Odoe Road, south of Interstate 80 and west of Interstate 25. And number two, Orchard Hills, from mixed-use residential to mixed-use employment for approximately 162.42 acres, west of South Greeley Highway, south of West College Drive, and southwest of and adjacent to the intersection of Apple Street and York Avenue. And this is for public comment only, for commissioner's comments only. No action is required. Thank you, Mr. White.

Again, I know you've seen these a few times the past couple months for future land use map amendments to plan Cheyenne. The first one is for where the Rodeo Hall of Fame is planning to go. So that is the community business. And then the other is Orchard Hills changing to mixed use employment. Both of these are currently going through the annexation process in front of City Council, so that's why they're before you for just comment only. They won't have final consideration by City Council until the land is annexed. So with that, I am available for questions, and I'm available for any comments that you may have.

Before we use an agreement between the county and Silktide Inc. for a three-year term to help with our ADA compliance for the website with the new federal requirements, it's been a lot easier to go out and work with the company to help make sure that we're compliant and accessible for all of our citizens. Laramie County Planning and Development, in accordance with Wyoming State Statute, hereby wishes to amend the 2025 Laramie County Land Use Regulations based upon additional public feedback to add language concerning the Planning Commission appeal processes. Adoption, amendment, or repeal of any regulation must occur under the rulemaking requirements of Wyoming State Statute 16-3-103. And we will take a look at incorporating or discussing potential incorporation in future rule changes, but not as part of this one because of the 45-day notice requirement. AVIPC on behalf of the Elson Stoutflug Revocable Trust has submitted a modest plot application for Sunset Tracks 4th filing and the vacation of tracks 7 and 8, Sunset Tracks 3rd filing, Laramie County, Wyoming. The subject property is located at 8908 Yellowstone Road, Cheyenne, Wyoming. The purpose of the application is to modify the lot line between the existing tracks 7 and 8. Only the internal lot lines are impacted. This adjustment separates the nursery business from the storage facility. The subject property is currently assessed as commercial land located in a community business zone district. The surrounding areas zoned land use, or LU. Pertinent statutes and regulations, Wyoming statute 18.5.304 through 34.12.106. Section 2-4-105 governing the CB, Community Business Zone District. Section 4-2-103 governing modest plats with a lot line adjustment within recorded subdivision. And with that, we have Brad from ADI in the room to answer any questions.

There is one item that staff has brought up that they missed. On the last map we turned in, it still says proposed easement. We're fine with that. the staffs that that needs to be dedicated on this plat because we need to provide access to that back lot so as they move forward we're fine with that condition okay any other questions that was going to be mine

And so what I would suggest is that currently the motion as proposed basically has no conditions. And I would simply ask that the motion include a condition of the installation or note of an easement for access to the rear lot being essentially created here today. Essentially that a condition for an easement be imposed as directed by the planning department.

The Laramie County Comprehensive Plan identifies the area as urban-rural interface that is intended to accommodate a mix of more intensive land uses than other areas. The parcel lies in the Plancheyenne Rural Residential District. Agency review comments were addressed and the plot updated. Public notice was provided per Section 1-3-100 of the 2025 LCLUR. No comments were received. Based on evidence provided as included in the Sunset Tracks fourth filing modest plot file, staff states that this application meets the criteria for a modest plot with lot line adjustments within recorded subdivisions pursuant to section 4-2-103 of the 2025 Laramie County Land Use Regulations. This application is in conformance with section 2-4-105 governing the CB, Community Business Zone District. And the Board of County Commissioners may approve vacation of tracks seven and eight, sunset tracks third filing, and the modest plot known as sunset tracks fourth filing with no conditions and adopt the findings of Act A and B of the staff report.
