Good afternoon ladies and gentlemen. At this time we'll call our to order our workshop session and uh thank first one right off the bat Mr. Steven S discussion and update regarding central water supply corporation board of directors meeting held on February 24th 2025.
Good evening mayor and council. Um, first thing I've got for you guys is, uh, Central Texas was planning on building a building, constructing a building at their dock curve plant. Uh, for those of you that don't know, Central Texas has two water plants. One's called Dock Curve, one is the Lake water treatment plant. Lassis gets their water specifically from Lake. Um, the building that they're going to construct is supposed to solve issues at Lake Lift, but they're not building it at that site. They're building it at other sites. Reason being because they're having issues with core of engineers uh in terms of inspections, in terms of any uh site issues. That should be a concern to us. Uh core of engineer issues um obviously apparent uh not spending money at Lake um core of engineers isn't going to let these little things slide. Uh whatever they may be failing their inspections on. uh they have a lease uh land lease for the water plant that expires May 10th, 2029. They're having assumptions currently that they're going to have trouble renewing that lease, which is another cause of alarm. Um little digging a little bit deeper into the contract. Uh for those of you that don't know, there's actually a central Texas uh Ker contract just like L Passes and Kipner have have one. Central Texas and Kipner have one as well. There's an impossibility of performance laws in the contract deeming that if any of the leases or easements cannot get renewed, it could terminate the contract between Kipner and Central Texas, not the 29 passes. So, it's really going to muddy up the waters if we get deep into that and they can't renew a lease. Um, the contract does state that all parties must so extensively make best efforts to renewing the leases. So, they are bound to renew the leases. Just wanted to state that there are some concerns there from staff uh if they're going to have trouble with it or engineers renewing at least when the time comes.
Um they reported a damage to the pumps out of service. Another cause of um none of them are going to hinder water coming this direction. Just uh gives us a brief pause when we start seeing things out to kind of raise some questions. That's really the end of my simple Texas update, but I also wanted to touch base on one other thing. Council member Keel had asked me at the end of the last workshop session that I gave you guys um about the DRA system availability agreements. So, the city of White Pass has two system availability agreements with the Brazil Authority. One expires in 2029 and that's for 2,000 acre feet. After speaking with the DRA, there shouldn't be any uh any issue renewing those system availability agreements. uh they will allow us to renew one year prior in 2028 for a maximum term of 31 years set to expire in60 and when 2028 rolls around we'll get on that and uh we'll get that renewed. Uh all these system availability agreements are new for $50 flat rate. So it's not even a budgetary concern at this point.
That's it. Any questions? What do you with central Texas? What do you think your best recommendation to the council would be to go? Their recommendation to us, what our re your recommendation to come over there and take a look at
Well, first and foremost, fix what you got. Spend capital money where you need to be spending it. But it it's been apparent over the years that they're not really interested in spending capital dollars at Lake Cliff. Um it's not in the best stage. The operators they have are are good at what they do. They're making it work. Um, but the organization as a whole isn't necessarily spending money there. Um, I think at some point we may have to consider a future where central Texas isn't really in it. Um, I don't think we're there yet, but I think we need to start, you know, considering that possibility because that mainland passes to get involved and up and running that plant or taking part ownership in it.
I mean, the possibility is there. It's just it's going to be a huge financial burden for the city.
So when Kentner built their plant they in 2010ish they kind of hurt themselves financially but they also they also hurt central Texas financially. They they don't have any water rights. The organization doesn't on Still House like all of their all of their customers have a water rights or the availability agreements and they just treat the water. So when someone pulls out they just have a lo they have a loss of a revenue stream that they can't acquire from anyone else. So, um just that plant's not in a good state. Don't know that it's in line passive best interest to take it over and try to go in and fix those. Um we have capital contributions that go to them on a monthly basis. They just spend it where they need and if that's not it, they are uh contractually allowed to do that.
And we have several thousand acres of rights. Uh we have a system availability agreement for 2,000 acre feet and then another one for 3,000 acre feet. Okay. So the 3,000 acre feet won't set to expire until 2050. So we have plenty of time and I don't foresee any issues with any of these expires in what? 2050. 2050. Stephen, what's the timeline on Central Texas Water and Corine and them trying to get up to speed? Are they putting them on a clock core of engineers from the central Texas border or are they looking at it first time?
Right now, I don't believe there's any time frame. It appears they have annual inspections. So, the core of engineers comes in just like TCG would and inspects the facility. Um, not so much the facility, but the grounds because of their close proximity to the lake. Um, I don't know that the board of engineers put them on any time frame. Most of their issues seem to be very basic. Nothing that's not easily fixable. Um it's just that they're having so much issue with the poor and they don't want to deal with the core of engineers, it just it causes some causes some questions to arise when it comes time to remove that lease and they're still obligated to renew that lease by contract. So they have if something needs to be fixed or maintained in a in a better fashion, they are obligated to do it. But if we get stuck in a future where they can't, it's it's going to monkey source.

The area is characterized at downtown traditional, excuse me. The property is surrounded by business district. All notifications and publications are required as required by ordinance and statute has been made. That mail 13 notices to property owners within 200 feet of the applicant's property. As of the date of this report, two letters in favor and none in opposition have been received. Those are up there. You're welcome to pass them around if you'd like to take a look at them. Sure did have them. This request was heard by the planning commission at the March 5th, 2026 meeting and it passed with a 50 vote.
Is there any like more information on like what the planning on indoor? It's supposed to be geared towards uh younger children. It's kind of an imaginative indoor play area. Uh I know that one just opened up in Vernet. Very similar um thing, but it's more geared for younger children. Public hearing to receive citizens comments regarding request for specific use permit property described as 712 acres lot 18 of the Edwards edition more specifically known as 145 East Fourth Street, Lassis, Texas County to allow part community church property owner is asking to consider a request for a specific use permit to allow for a daycare. All notifications and publications as required by ordinance and statute have been made. staff mailed 16 notices to property owners. As of the date of this report, no letters in favor and one in opposition have been received. We have had a few uh pre-construction meetings with our fire marshal and our building inspector. Um, as far as I'm aware, it's very minimal occupations. They are going to convert a what is existing as a garage into two classrooms. So, they'll have to have two exits coming out of both of those classrooms. Um, inside they are putting up a wall to block off the kitchen. Um, doing sort of a renovation to making what was an existing bathroom into a mop sink area. And they're transforming a laundry room area, but aside from that, that's all I'mware. There's no one here.

And it's it's possible that he shows up when we get into the ordinance later on. mayor and council Daryl Finny property owner is asking the commission to consider approval denial or approval of modification and request to reszone the property from retail to retail R with a planned development overlay to allow for a four-story hotel restaurant and retail shops. The applicant is also requesting the following deviations from standard city requirements. To allow the parking lot to encroach into the city of Lasslement rideway. Allow a minimum of 68 parking spaces. Wave the city of Lassle's landscaping requirements. Eliminate setback requirements along Peach Street and Chestnut Street. The area is characterized as retail. The property is surrounded by single family homes and retail properties. All notifications and publications as required by ordinance in statute have been made. Staff mailed 48 notices to property owners within 200 feet. And as of the date of this report, 10 letters in favor and three in opposition have been received. This request was heard by the planning commission at the March 5th, 2026 meeting and passed with 5.
Any questions? You say yeah retail. We talking about strip mall and highend restaurant. That's all I curious about. What are the landscaping requirements? So the city has landscaping requirements that I think it's 30% of street frontage has to be landscaping. We are asking to wave our requirement and he'll be building to the Windom Hotel's requirement. Sorry.
Excuse me. What is Windows? What is Windows in relationship? It will probably be very comparable, but I just don't know what it is right now. I mean, uh, we're going to do probably more zero scaping than with the water situation the way it is, but we will replace whatever trees come down. We'll replace it with a with a like number of trees, at least the number of inches, cuz there is one big tree that's going to come out. We're going to replace it with tree. If you look, if you go on the website, you can look at all the the properties that that have been built by Windom. It's basically they put their own requirements on it. I like the idea. Yeah, would be a lot.
I think we need to water such a big issue for us. So, so the 30% requirement would be difficult to attain.
It's it's difficult because of the parking situation. I mean, between between the the end of our parking and the back of the curb, that's not an issue. But within the actual property lines itself, you know, if like in Bush's Chicken, all of our big trees and everything, that's actually in the state of Texas right away. So our a lot of our landscaping will be in the city's rightway but behind the curb between and encroachment is basically just for parking only and act and ingress and egress. It' be like the front ends of the cars or like if we do a solid curb uh across the front. It's it's ingress and egress is probably it's just the the front of the cars or maybe the back of the pickups when they back up to the curb. The internal curve that's going to encroach on almost any rideway and I think we've all everybody there's like 25 ft on chest between my property line and the back of curve and I think on ch on peach street itself it's almost 20 ft between the back of curve and my property line
one of the concerns expressed about the runoff the runoff that all has to be addressed internally that that's just an engineering issue uh we talked about the uh uh the detention pond that that we've already discussed that we have to maintain. We have to retain the water on our property just like any other and that was the issue that that we ran into. So we're going to have to detain all that water on the property. So the work that Oh yeah, our our engineer that's required. That's the issue of traffic in the area.
Uh concern. Well, we already got a center turn lane. Text dots, uh, they're very particular about center turn lanes. There's already a center turn lane and acceleration, deceleration lane right there on Peace Street. That's why we decided to move it to the south end. I mean, the north side of rather than the south side because there's already a center turn right there. So, as far as traffic, we'll have we'll have access off of 190 off of Chestnut and off of 183 off of Peach. And then uh chestnut is probably going to be the primary and each will be the primary entrance.
Because I haven't memorized every city or what's the deviation on purp.
So our requirement and building code requirement is that it's one space per room for the hotel. uh we are just removing our requirement and asking that it falls back on the developer and zero their cost for inspection. So this 85
yeah it's it's actually 84 units um and we will probably we will definitely sign a crossex cross marketing agreement with Bush's chicken. So if there is a short right now that the initial plan it shows 86 parking spaces so it's not going to be a problem because Windham actually requires one per road but that may we may have to achieve that through a cross parking access agreement which the entire oh chestnut property uh bushes use anyway from our dumpster back there's very rarely any cars we're not going to affect the traffic flow it's already there uh most everything will be off the chest And as far as windows are very clear on how many parking spaces you have to have, we're going to meet that. But we want to go with the medium, the minimum, and then they can dictate to us what we have to do on cross party. Thank you.
At this time, I'd like any any com. Go ahead. Why uh can you come to the if uh there's 70 80 rooms? Uh isn't not supposed to have 80 rooms a parking space? Because right now as I'm owner of the West Hotel so we have 55 parking there's 55 of them and it's still contested. So I think they will need enough parking.
And you said you have 55. Which hotel do you own? Best restaurant. Best restaurant. And how many rooms is in best restaurant? 51. 51. And with the 55 is that sufficient or you're saying it's not sufficient because of the size of the vehicle or it's a lot of customer will have a trailer bigger truck construction people comes in. So parking is always a issue there. So I think minimum requirement city requirement it's it's really good. I don't think they need to wait.

Um I would like to request that when I pass this through a market visibility study as well um including the hotels that are here currently as well as the motel to see how this will impact us as a whole. Do we know who would do that or would y'all do that? Would y'all who would be entitled to do the study?
It it would be the city's responsibility to do the feasibility study for the property owner. That's a risk that the property owner is taking when he develops the property. Okay. And so what about a traffic impact study? Would y'all are y'all responsible for doing that? The developer typically does the traffic. start the city passes responsible for these settings. All right. Any other questions on the traffic study? Seeing that it's we have both a mix of safe highway access for two safe highways and local streets. Is there any concern on our end of the city to um need to require that and the approvals that we want to give today? Not that I can think of. It's a unique combination of
I'm not familiar enough if there is an issue with text up is another issue cuz there are 183, 19, 281 right there. The text stop may I don't know for a fact, but the text stop may be the one that would handle something like typically when we ask for a traffic impact analysis, it's when it's going to affect residential areas substantially. With the majority of this area being zoned retail and a very small amount being single family residential, it's not typically something that we would request from the developer. Thank you. So on the I heard they already doing some renovations on on the house itself to get it ready for a day facility which I love the idea of deck here obviously with area shutting down huge need in the in the city. Oh yeah waiting stuff. My concern though is uh with community not still being on a temporary um permit for the church. There's still stuff that needs to be done.
Uh no I'm I'm so sorry to interrupt. Uh to my knowledge, there is nothing to be done. Uh it's at this point, I think, a pencil whip. We were in the middle of it when the last city secretary left. Uh Kay and I have had conversations, Miss Stanley and I have had conversations. Your old Veraritoss has been through the church. Uh at this point, I think we're just down to a pencil whip. U we we haven't stood in the way and we welcome anytime we can get a permanent CO. Yeah. As far as I know, but the CFO on this on this particular building, I apologize to you, but the the CFO on this one is standalone. Yes, sir. No, I understand. But I know I know you all do a lot of awesome work.
We do. So, I know I know you all. Yeah. But I what I'd like to see because there's two retention plans that supposedly that the engineer had approved on those plans for for community church facility for the runoff issues. Yes. And so to me, just I'd like to see that taken care of as a priority before y'all start like I'm all for the daycare. I just would like to see that as a priority to get that done before we just jump fullheartedly in this other project. And to my knowledge, we were signed off on both detention ponds. As ugly as they are, uh to my knowledge, both of them were signed off on the previous city manager and the what do we call him? Uh Ryan,
the assistant. assistant city man ACM. They were both signed off on as far as I knew. I don't think that's right though. Okay. I check I was just curious to know and and does it have any impact whatsoever on the day? That just a question. No, I mean well except for if y'all are doing the work then it does have an impact because y'all are going to prioritize the the daycare over finishing what y'all need to do there.
Okay. If if there is work that needs to be done there that I'm unaware of, I would be like wide open. That's all I'm asking is that we prioritize finalizing that, you know, to get that that fully certified done deal and then jump into this. Like I'm all for be done. I just want to see a idea priority into the finishing page. Okay. You have everything done, but you know, I'm sorry.
We have everything done signed off on the No, it it was my understanding and I had a conversation with Mr. Ward today that um staff would not sign off on the detention funds as they were built. We needed to get the engineer record which is engineering to have him review the detention ponds and either say that they were built to their design specifications or not. So, we'll be reaching out to tomorrow. May I have just such good luck with that? I tried for two years of them. So
I tried for two years, but yes, it is two design. Uh to my knowledge, it is two design, but we need to wait on on Bryce Martin. would have been ahead of my few minutes early. Good afternoon. Uh if you remember back in December, I came and talked to you about the drainage council.
Uh we talked to the city representative of streets, Russ, and uh he said that they were not going to do my part because they ran out of money. And that's doesn't seem like fiscal responsibility on somebody's part. to plan a project not have money for. Anyway, they cleaned out the ditch halfway up the road. They said they're not going to clean up the rest of the H or repair the culvert underneath Spring Street, North Spring Street, which is the problem. I've been there 30 years. That's the problem. It fills up from the sledge coming down from summer and above down and plugged up the drain goes over the road tears up the road and we're damages my house which is done twice already. And when I was here early I believe December I had pictures for you to look at it and they did come up through the eastern side of of race and north side of race, but they didn't come up. The other half the block did rain it out. They marked the trees, said they were going to do it, but they didn't do it. And I'm sorry to come ill prepared, but I just found out about this night. And so I came to see what's happening. And I know you don't know what's happening. So staff can respond with factor policy. So the drainage project that he is speaking about was a CBG drainage project that had specific funds allocated from the state. The state funds did not stretch to his portion of
the roadway. It covers what was originally planned for the project. And so it's simply the funds that were allocated for that project from the state did not stretch to reach his portion of the roadway. It's a half block, literally a half block from where the problem is that causes all the problem downstream. They've seened it and it looks nice. They've done a good job. Your address again. I've been there for about 30 years. But the problem of the of the flooding doing the damages right on spring gets a culvert underneath there gets filled up with debris every time it's a serious rain. It floods over the top of the street. It tears up the road. It tears up my driveway. And it has actually, as I said before, moved my house enough that I had to have it resettled back. That's happened twice. And uh I'm not real thrilled about Well, we know we know weather is weather. It's eventually going to rain. And how many homes are around you?
There's two on both sides, all four members of that where Avenue D would be where street there are four houses on that street on that corner. Okay. And they're all kind of in perilous position as well, too, when it rains. I did not hear you, sir. They're they're all in in perilous. Uh the two that are on the east side of Spring Street are two that are on the north side, they sustain the flooding when it backs up water, it backs up to their house. Okay.
And they were not able to come tonight. It was short suspense. I got in at 4:30 and found out about it.
There's this went all the way down to that brought it to North Summer Street where it stopped off at I can't recall off the top of my head where it stops. But as a reminder, drainage projects have to start downstream because it doesn't help to start upstream. This project was engineered to the point that it stopped at if it if it continues. Any public works expenditure over $20,000 has to be engineered. So it's not as simple as just extending the project up another block, half block, two blocks. It will have to go through the engineering process to make sure the drainage is being handled properly. And that was not in the scope of this project as approved by CBD.
When I talked to the construction individuals, the civilians were contracted to do that. uh in January when they were working actively working on the waterway, they said yes, the plan is to go on up the summer and put new culprit in there. And they went and marked the trees. They actually piled some dirt on the west side of Spring up in across the street from me. And that has in the significant rain had since it has washed down into the ditch and it's goes to filling it up. So they they actually came on that side of the street and started destruction of the trees and stuff and have them all marked. So obviously they were planning on doing. So I kind of feel like I'm getting a short end of the sticker a little bit. not the fact is I don't like having to re resell my house after every major rain.
Understood. Any other other questions? I think that's something that that needs to be brought up to council and thank you for for reminding us of that and we'll go from here. Okay. 44 is coming to tell us what this is all about community events here we go mayor council every year we come together about this time with what we know potentially may happen in the city throughout the year. Not everything that happens, but uh mainly it's things that might involve our parks, might involve the street shutdown, might involve some type of security. So, uh give credit to Lieutenant Chuck McGomery who heads this up for us every year and contacts all these individuals. And so, uh I could touch on each and every one of these 20 if you'd like. It's pretty self-explanatory. All of these on here are things that have reoccurred since last year and there's not any major changes. Just bring your attention to number four. The square association was uh going to had an event that as of this morning they decided to nyx number four and that won't occur. And then also related number 16 coming up in October. The square association would like to have an October fest and that will be on the square. They're still building that. So we'll come back with y'all with some more information since that's new. But it will be a daytime event. Uh possibly food vendors and such celebrating the fall. So, they're working on that now and we'll have some more information. The rest of everything uh is stuff that we have every year. So, again, it's a possibly a street shutdown, maybe some security uh maybe in the parks, but does involve street shutdown. Some a little all partial. Uh anything involving the parks, it'll go before the parks board at the next meeting and any changes there, they'll bring to them as it comes up. And 4.6 6 discussion of possible action regarding awarding a bid to Quality Landscape for the installation of two gates at the 580 Sports Complex for the amount of $7,171. Right, Mayor and Council. Uh this was funded in the 2016 CO issue. There's currently a remaining balance in that account for $34,77.71 and uh it was budgeted in that issue for repairs to the 58 complex. Is that right?
No. It wasn't budgeted as part of that, but um part of the 2016 CO issue was for improvements at the 580 complex. There is in excess of $30,000 remaining in that fund. As you guys are aware, we've had issues with people accessing the athletic fields with particularly after bad weather. And so this will allow um staff to secure that facility after weather events um in a a little more permanent manner than the temporary fencing that we might cost there. So it wasn't budgeted for this fiscal year, but we do have sufficient funds from the CO issue that was dedicated for improvements at 58. That's what I meant.
So, this is the the fencing, but there's actually two items that are in our correct the $1,810. Correct. So, the $1,810 is for the purchase of the limestone blocks. That'll make it visually appealing. And that's for the delivery of those blocks. And then the other bid um for the 5361 is for setting the blocks and building the pipe gates for the facility. I make a motion to award bid to quality landscape for the installation of two gates at the 580 sports complex for the amount of $7,17.
