And uh and so anyway, so the intent tonight is was to just make a motion to table it and then we just call it a night. So anyway, Dave, if you want to just open the public hearing, make a motion to table it for somebody to second it, then just make it faster.

No, the only thing I have is February 10th is your next meeting. Um and uh um you have two items on the agenda. So you're going to have this one and then we'll have housing code amendments that have been kind of in the works for the last couple years that uh I think public notice went out this week for that. So all of you should get a postcard in the mail from Kendra probably in the next couple days. But but anyway,

yeah, and it just depends on how much we want to talk about it. So, I um cuz they're just most of them are just simple housekeeping. Uh I call them housekeeping. There's a couple items that I'll I'll highlight that uh that are changes, but most of them are um things we had a consultant go through and look for areas where we might have deficiencies with uh with state law. Uh one of, you know, one of the biggies is, you know, like subdivisions. the state law requires those to be processed administratively and has required that for a number of years and just didn't know it anyway. And so that's one that's going to be kind of a surprise because regardless of the size subdivision, um those are supposed to be done at the administrative level just like a regular minor petition unless they have variances and exceptions then it would come to you or then it would come to you on an appeal.

And so, um, I don't think I have concerns over a small subdivision taking that on, but I think for my comfort level, you know, we've been, um, for a couple years looking at a project on the east side of Lrand, you know, where it's potentially a couple hundred lots and, uh, I think a development of that size rises to the level that it should go before a body like this. it's not we have a we actually have a clause in in our code which I'm using for the public hearing that we we're going to consider tonight because uh we have a clause currently in our code that we're required to remove where I have the discretion uh to take something that might be controversial and just kick it up to the planning commission for a public hearing. And uh and so a number of the housing code amendments are areas where there's a subjective, you know, standard like that where it's at based on somebody's opinion that either meets or doesn't meet a certain standard. Uh you know, or the standard is subjective and and it's just kind of based on, you know, your opinion on whether you like it or not. And so we have a number of standards in there that are kind of like that where you talk about uh where the code talks about uh is compatible with and you know it's like what does compatible mean to you versus what does compatible mean to me or to a neighbor and so so anyway so a number of the code amendments you'll you'll see when you get the packet uh for next month uh has a lot of changes like that. We have some terminology changes like the word single family is old language now and so Kendra and I are going to have to get used to not saying single family homes and it's now single house

yeah so anyway yeah so there's just interesting terminology like that times are changing and so language is shifting a little bit and so we have there's a bunch of amendments like that throughout the whole code and so you'll see there's a lot of changes but a lot of them are little things. Uh so anyway, uh but I'll try to do the best I can to summarize those. Uh the packets pretty pretty thorough when you get it so you'll be able to skim through and see for yourself. But I'm going to try to keep my presentation, you know, fairly fairly simple. So if we do have audience that they won't be uh too confused, but but anyway, so that's that's what's coming next month is uh is is our public hearing from tonight and then the housing code changes. So um that means that like the applicant who is postponing till next month has seen your recommendations or findings to us about the places where they did didn't meet the standard or the experiences that they were looking for. Right. Yeah. So they actually they have an opportunity to go away and come back with something different knowing.

And in fact, I had not that we shouldn't be having this conversation, you know, in much detail, but I did present uh or share all of these issues with the applicant in December when we're going through the uh review process, you know, for public comment. There's usually a couple weeks in advance of preparing for for our meeting. And so, so before Christmas, I sent out a kind of just a letter that says, "Here's issues that came up in the review process." And then uh so they got that letter and then they got it in a little bit more detail. They actually got the staff report. So they have that whole packet that says here's the actual standard and in my opinion it either meets it or doesn't meet it. And so anyway, so they they got that as well. And then I chatted with uh the applicant yesterday and recommended that he go through that because what I asked him to do in December, which I was hoping he would have done, is to submit something to say like the wetlands for example. I was hoping that he would say, "Hey, I'm" because he's had it delineated. So he's he's got a wetland specialist doing stuff, but it's like did you submit for permits to the state? because if so, then we could probably address that with a condition of approval and it would no longer be a, you know, a ding on the on do you meet it or not meet it. So, it's things like that. There's things that are probably deal breakers you might not be able to address, but I was at least hoping that he would go through that and say, "Oh, I can scale my project back. I could do thus and so to try to address this and then we could have a conversation as opposed to just coming in and saying, "It is what it is. Make a decision." So, um, so I guess we'll see in February if he follows my advice and and if you get
