At this time, the council will recess to conduct a public hearing regarding a request for special use permit for outdoor use and outdoor dining at Fox's Finest at 159 West Argon Drive. Miss Graves, do you wish to enter any exhibits into the record?
Yes, Mayor, I do. Excuse me. I would like to enter into the record exhibit one, which is an affidavit of publication showing that an ad was placed in the St. Louis County on March 13, 2026. Exhibit two, which is an affidavit of publication showing that an ad was placed in the Webster Kirkwood Times on March 13, 2026. Exhibit three, which is a list of property owners to whom notice of the public hearing was sent. Exhibit four, which is a viewer map showing the list of property owners of whom notice of the public hearing was sent. Exhibit five is an amended memorandum from city planner 2, Amy Lowry, dated March 4th, 2026. Exhibit six is the report of the planning and zoning commission meeting dated March 5th, 2026. And exhibit 7, which is the Kirkwood Code of Ordinances.

Good evening, Mayor and Council.
So, the um site here is located at the northeast corner of Argon and um Clay. So, it's this building right here. Um it's in the B2 central business district. And just zooming in on that a little bit more. Um this is the area for the outdoor use. This patio in the um rear of the building just off of clay there. And the property is about 7,000 square ft. Um the space for the market is about 3,400 square ft. The request is to have about 20 um outdoor dining seats back in the patio area as well as a gas grill and um just some speakers for um music but no live entertainment. Um according to their cover letter, they're proposing hours of Wednesday through Sunday 10:00 a.m. to 6:00 p.m. Um maybe shorter hours on Sunday and nine employees with six on the maximum shift. just some photos of the area and they've nicely labeled where the speaker might be and where the gas grill might be, but there is um a garden back there and then some space on the concrete for some table and chairs. Planning and zoning did recommend approval. Um and those conditions are there. Um basically a special use per permit for up to 20 seats of dining. the outdoor dining shall comply with section 25450 of the zoning and subdivision code. And that is just um regulations about the uniformity of the seats and the chairs and umbrellas if they use that and space to walk between and trash and that kind of thing. So that's what we um impose on all outdoor seating or outdoor dining. Um, in the original recommendation from staff, we put the hours of operation as what the applicant had requested in their cover letter, but in the PNZ in
consultation with the applicant did amend those hours in case the business wanted to expand later, they wouldn't have to come back and amend the special use permit. So, the hours here from daily from 10 8:00 a.m. to 9:00 p.m. were seen as reasonable for a downtown business. And then um uh other conditions of approval. These are the standard conditions that we put for any special use permit. So in evaluating a special use permit, there's special use um review criteria which consists of these seven plus another 12. And then there's additional criteria that the city council can impose conditions as they deem necessary to protect uh general welfare and individual property rights. Um, so this is a pretty simple request, but I'm here to answer any questions. The applicant is here as well if you would like to um pose any questions to them.
Would the applicant like to speak with us at all? Sure. It's up to you, but we we're happy to hear from you if you'd like to. Get yourself into trouble with speaking, right? You don't have to. So, um, no, but we're very appreciative, um, that earlier the special use permit was was kind of granted and we're here to answer any questions, um, to do so. But we're excited about opening up the business here in Kirkwood. You know, where Kirkwood residents have been for many, many years. And, you know, it's a it's a new venture and we're excited about it. And if you have any questions about the business or what we're planning on doing with the business, I'd be more than happy to answer them for you.
Okay. Well, we'll go ahead and open up for questions. Council member Vinicker. Um, what are you going to do? What business is it besides the dining? All kinds of things. Let's get straight.
Well, we're we're actually a uh a marketplace. And in that marketplace, we will be uh we'll have fresh seafoods, we'll have fresh meats, we'll have poultry, we'll sell some dry goods, sandwiches, cakes, cookies, pastries, pies um out of that facility. And we're really a a marketplace that you can come in and if you want to get anything for a dinner, you know, you can get the fresh meats, the seafoods, etc. We'll have some prepared foods. Um we'll also be selling some sandwiches and in Ergo, this is what we're talking about utilizing the grill for in the back patio. We're not technically a restaurant. Um we don't have a hood, etc. But what we'll be doing is taking steak out of the um out of the um cask and bringing them and putting them in sousvie them in the back and then we'll put them on the grill and we'll serve a steak sandwich. We'll have a pork chetta sandwich and and some other sandwiches.

No. Um, and I'm just wondering, do you are you taking up that entire space there on Argon as well as along South Clay, all of the courtyard? Um,
well, we'll be in a we'll be in a courtyard there. And the purpose of the courtyard and the seating is somebody's they come in and they get a sandwich and they can go into the back and sit in a courtyard if they'd like to as well as just a space for people in Kirkwood if they're walking and they want to sit down and nice evening. Uh we're going to do some upgrade on the landscaping uh back there and have some tables for people to sit down and and relax and enjoy it. But the market itself is just going to be that corner property. Yes, it's the corner property. Not the little shop, not the entire No, no, it's it's a 3200 square ft. The bottom floor, we don't occupy any of the spaces on the second floor. Okay. Okay. Um, and then as far as the prepared grab and go, food to go, whatever,
how are you going to handle like keeping an eye on the courtyard tables and all that kind of stuff? You have staff that are going to go out there and because it's not going to be weight service. It'll be um customers who buy their food and just go That's correct. And we'll go and we'll go out back and we have we have we have nine people that are hired currently and we'll make sure that the back is taken care of and kept up to a standard. So that's actually I think we've issued a building permit. They're working on that. Any signs will have to go to landmarks, but the use of the courtyard does not need to go because I know several meetings ago you mentioned some potential business going in there. The doors the doors they're not doing anything to the exterior so except signage. Okay, great. And the um PNZ subcommittee did not meet on site on this one.
We did not have a PNZ subcommittee. I wrote a memo to the PNZ. They always have the option of having a subcommittee, but because of the simple nature of this, they just approved it. Okay, great. This is an ordinance amending chapter 24 tree code by deleting it in its entirety and inserting a new chapter 24 tree code. Thank you. Are there any is there any discussion or comments other than thank you to the urban forestry commission and their wonderful leazison from city council
for bringing this to us and I'm hopeful that this will help improve the square footage of the tree canopy in the city of Kirkwood. Most of us love trees to death. Mark and I just planted a brand new yellowwood. But thank you. Thank you very much. Yes. And just a comment and I told Brandon and his group over there, I said when this is passes, I'm going to write you all a a email that says about everything they did right to get us to this point. Yes. And it is a lengthy list which really is reflective of Brandon's work and the work with the urban. Why don't you tell everybody Brandon who Brandon is and who the chair is?
You know, he's so shy. So Brandon is sitting there and he's our uh forester and has been with us two years, just a little under two, year and a half. And um he's done a phenomenal job getting his feet wet, jumping in and really um showing exemplary leadership. And Shane and Joanne sitting with them are um very dedicated urban forestry commission members and um they've done a remarkable job. I I've worked with a lot of boards and I tell you this board does the nitty-gritty and gets really involved. And I said I told them I said the thing the way I'm going to start off what you did right is the first thing on the list is you didn't hire a consultant. And uh and they used their expertise, their experience, those within the community and they didn't do it overnight. They spent a year working on it, getting feedback, bringing it back. um involving a lot of different people and groups and tonight is the culmination of some really dedicated work um and again people who've used their experience and expertise and leadership skills. Remarkable.

You know, I know Councilman Schaefer is not here to kind of walk through um what some of you met with um representatives and I just wondered if you can kind of tell us what all transpired. I know this was one of those that the um PNZ subcommittee did not, you know, do an on-site um and so we delayed it for because there are some questions. So those that
well you know what I was there so I'm happy to speak about it and we've got a lot of folks here with the Would the folks with Lonus Lily Eats just stand up and see who all is here from
Thank you all. Appreciate you being here again and um meeting with us yesterday too. So, um, so yesterday we walked the site and, um, you know, it it's hard because since I remember being in that building in about 1968. Um, and and since then, I don't think anyone's ever cut back anything, ever, you know, worked on the parking lot, nothing. So, what they have purchased um and turning into a a diamond in the rough now out of the rough. Um they're going to be putting in an entire new parking lot with three new curb cuts. And I think if I'm not mistaken, Craig, you said that's going to be about $84,000 um to get that done. About $100,000 to get that done. Okay. Oh, okay. Um, and when they're doing that, they are going to be going to the um property line, which where it is, what you see right now, it's about three feet, and council member Mlan was there with me, too. So, you can help, but three feet, three to three and a half, four feet back. Yeah. And all of that's going to get cut away. So, it's it looks so horrible right now, but what they're going to do is And then it'll There's stairs. There's secret sidewalks over there. I didn't know that. We have secret sidewalks all over Kirkwood. There's secret stairs that go to the neighborhood behind. There's also another secret walkway that goes to the neighborhood behind. That's all going to be maintain left there. Um, so it's going to be it's going to be very nice. Very nice.
Great. Great. And then I know there was a residual who owns the the sidewalk in front. Did that get resolved because that was part of the outdoor dining and the this that and so I I didn't know what you have found out about. Um we did not get a survey but they had expressed that they did not necessarily want the speakers out there. So that was taken out of the ordinance. Okay. But the sidewalk in where they put outdoor dining. We allow that on city sidewalks. It's just the speakers would not be allowed. Okay. So, so you're there's no followup left on that. No. Okay. Great. All right. Uh, yes. So, um the sit the city of Kirkwood acquired uh the property off of Leingwell uh in a transaction here. Um as part of that purchase, we utilized um proceeds from certificates of participation series 2024B. Um, we are looking actually to refinance that p that piece. And then uh there is an additional $8 million in this um uh in this uh offering in order to upfit that property. And what that will allow is it will allow for the movement of our current public works after completion to be moved over to the Leingwell property from the current uh 345 South Filillmore location which is our our portable our public works uh facility currently. Um it will also allow for us to uh move multiple different departments to that property um which includes our procurement department, facilities department, electric department and water department from their respective properties as well. Um this would also move um um our recycling center um salt storage everything along those lines used for the majority of city services to that property. uh open up those properties as well for continued development or uh whatever the city would deem necessary for those properties into the future.
Very good, David. Thank you very much. Um the that property was purchased um for $12.5 million back in 24. Um so after the city having looked for how many years for another location to move 10 years inside outside the city and it was determined that purchasing this and retrofitting it was less than building a new building. So um the the city owns this property currently and if we don't move forward it'll it'll be sitting vacant. So, um, I think it's important to go ahead and move forward with this. Are there questions? You know, this is again, the prior administration is putting us in the situation, and I'm voting in favor of it. I don't like it, but I'm voting in favor of it. It's the better of two evils. I'm looking at this at that way. We paid $12.5 million for a piece of property that was appraised at, I think, $6 million. that wasn't the well that wasn't really a financial financially good move. Um, you know, I like the idea we're moving it and consolidating it over there. Um, again, I I weighed both the issues of if we don't refinance this, if we don't do the move, what do we have over in the public works versus in versus trying to sell the Morzic building? Um, and it's a lose-lose situation and in my mind either way. Um, but this is by going forward with this hopefully 30 or 40 years from now. Um, it will be a good decision. It kind of reminds me of the old Target site across the street plaza station when city hall administration decided to do that way back when I can't remember recall the number of households that got so upset with Kirkwood for moving target down to closer to 44. They're never going to shop Target again. They're never going to talk to people at city hall. And five years later, 10 years later, it was turned out to be a really good deal. Um, so I'm hoping that this turns out to be good deal, too.
Yeah. And the and the public works, the current public works site, which is a very desirable location as far as closess to the Kpack and all those kinds of things, needs a significant amount of investment to keep going. It's It's literally limping right now. I think at least $2 million worth of work, if not more. So, any other comments or question? I guess we I guess we've never had anything for you. I'm sorry. But again, I have the same concerns that these two have and I think the city needs to maintain watching it very closely and I've had conversations with David and he assures me that he's going to be watching it very closely and watching the numbers and the cash. And I I just think that's a really nice gesture and I just really wanted everybody to know about that. Is it Mayor this is a like a payment in lie of taxes kind of thing?
Yes, I agree. Um yeah, I think it's that's nice. Yeah, a very very nice gesture. I mean the cost of public services, police and fire, street lights, sidewalks, roads. Um, it's greatly appreciated that they actually do that and thank you for mentioning them. Okay. Any additional console reports? I'll just make one more comment about the Urban Forestry Commission. Even though they've got through this big project, they are not resting on their laurels and their future agendas. Um, there's no rest for the weary on that group. Oh, great.
So, good. We'll continue to plow ahead. They've got great agendas um set for the future. Wonderful. Good. Counciloman Rinicker, I went to the Green Tree Festival Committee. They kicked off for September and I mean those people are amazing. I say this every year, but they in 20 minutes they can just run through their whole agenda and everybody knows what they're doing and what they're going to do at the end of the year. So, what's their theme? Um boy, I don't know. Something about 250 years. Yeah, that makes sense. But I don't know tagline exactly. I think they're debating it still actually to the next 250.

The city received a liquor license application to sell intoxicating liquor by the drink excluding Sundays from Lona's Little Eats at 612 West Woodbine Avenue. Um we'll have discussion. I just um I just want to address you again that um we're sorry that there you're here again. Um and I look forward to voting yes on your liquor license. Um I think everyone in Kirkwood and we've said that this before is very very excited that you're coming here. We hear so many good things about South Grand. You know, us Kirkwoodians don't venture too far. Um, so I have to admit I've not been to the South Grand location, but I've heard nothing but rave reviews, including from our city attorney who has been there numerous times. So we are we hired a search firm who has um presented us with six candidates. uh those candidates. We will be we will be narrowing those down um in the next few days and we will bring in the final candidates on uh April
13th and 14th and we will have a public meeting on the 13th um from I think we said 5:30 to 7. Um do we know where that's going to be yet though? here. Oh, okay. We will have information out on our social media here in the next uh day to two days and we'll get the word out, but we will have that meeting on the 13th
