everyone I'd like to welcome you to our regular city council meeting uh tonight is uh Thursday night February 20th 2025 it is 6:33 p.m. and I'd like to call the meeting to order followed by our pledge of allegiance to both flags and our invocation if you don't mind standing please to the flag with liberty and justice for all let us pray our most gracious Heavenly Father tonight will be for the benefit of our citizens our city Treadwell um as he and lead us to make first major item agenda item moving along uh item number five public comments is Mrs Baron in tonight would you like okay I'll call you forward then okay thank you thank you so much okay normally we would go into our executive session but I'm going to try to keep folks where they're not here so long and then we can go into executive sessions home city council meeting on January 23rd and the special city council meeting that was held on January 30th both of 2025 the accounts pay for
Mike I had a question in the bill we can still call on if we have items that we need to be able to discuss okay she's the have right now we need to be AES as things po up we still be each question if if we need to we also have the opportunity to be able to reach out to another enti that was also the individual help with technology he's kind the same same much I know they call on page seven it was just um monara modeling it said um metalace was that it says door Brian Street and then metalace door sliding to fencing oh okay okay okay all right a water equipment water yes that is a a new water pump that we purchased for the water department and is that they need when they go out of but the old one that was one silver TR the big one and also just so you know our J sewer J I think we can get but we also found out that we had this one is only I believe a couple years old years old the old one that we had was sit in the yard not
used second it A A and C A and I'll second okay we have a motion two business first item up is an update for from Kim Le horn on the best park project at step one Andes great to see you all again we met Parks Board got introduced ourselves and sort of give a little bit of background of kimley horn and then the process moving forward with best park so I think Mike printed out some slides for yall um so real quick I'll go over a little bit of background timy horn which y are familiar with from the RFP our or chart project understandings and design considerations really highlight on and then inated project schedule and any questions that we can help you with so kimn as youall know we're a multidisiplinary firm we've got a little over 8,000 employees we're actually the largest Landy Architecture Firm in the country sove got a lot of LA's behind me to help with this project but excited um to work on this and move forward with it so myself cine I've got Ray and Crystal here who are from Kermit they were here last night to talk to par board and knew some of the pars board members so it was fun to have a little reunion with everyone but again we're excited to get started on this um we did get a little bit of feedback last night from a project design consideration standpoint and that's something too that as we move
forward with the project we'll want to speak with yall about make sure council's on board as well as Parks Board and then the community when we do public engagement piece of it um a lot of the coms are things that you see were some of the feedback that y'all originally gave us when we were met with y'all backing in October of last year some of the highlights that yall wanted to see at bestest Park um a couple of things from last night were looking at potentially some multi-use courts talked about an indoor facility maybe not necessarily at best park didn't maybe make the most sense for this location and also looking from a budget design budget constraint standpoint that may not but looking at potentially other locations throughout the city I really liked the idea of renovating the softball field that was something that they had highlighted last night um and then we just kind of talked about an overall vision for the park so being able the parks SP ons to put all their heads together meet with Mike and other City staff and with y'all to create a vision for best park but then also as a vision for the whole park system as a whole moving on to our go so right now I'm working on proposal to get to Mike that will cover all of our design and what we're doing moving forward with the project so we'll have topographic survey on in our scope we'll do another side inventory analysis piece of that we've Ray and I have already kind of been out there a couple times but we'll come back do another one um this will probably happen after we get the tofo survey because I want to make sure that they've captured everything a lot of times their machines don't the littlest thing and I want to make sure that we've captured everything so we'll come back review the survey make sure we've got everything we'll also do Geotech so I want to make sure we've got a good u a good understanding of what's underground from a soil standpoint with footer with footing structural
components especially if we're looking at paviliion larger structures that have those footings potentially playground improvements I want to make sure we have an understanding of what's underground um and then from there we'll kind of our concep schematic design task so coming up with a master plan with some reference imagery uh perspective renderings um cost estimation with that too and then based on phasing right you know we're going to have to stick to a budget with this so looking at a phasing approach for all so what makes sense from a phase one phase two or phase three just looking at it from a cost perspective and as we develop that conceptual design that's where we'll have a big heavy public engagement piece so that's also going to be in our scope is the community involvement whether that's online surveys a lot of times people aren't um willing to come in person yet so trying to hit people with online survey but then also do some open house open Forum uh shet stations where people can come and really give them they want to see out there at the park from after we've kind of developed and finalized a master plan for the park and sort of know what our phase one can be were able to capture a lot of what the community wants out there and in total with the budget that we have um we would then just come back to you all and make sure we have a an approved master plan for the park and then start moving into construction documents so usually do about a 60 90 95 final construction document so we'll be submitting plans to Mike and the city for review um and with each of those submittal you will also have opcc which is opinion of probable Construction cost so we'll make sure we submit cost estimates with that too so again making sure as we're developing this design and moving it through the final construction document process that we're still sticking within the budget and a lot of
times we'll get our numbers from recent bids on projects but we'll also reach out to contractors and get their thoughts too on pricing so we're staying within the ballpark of what y'all need to be from a budget standpoint from there we'll move into adver dating so we'll help the city with advertising and then biding F will come to pre- bid meeting the bid opening hopefully we'll get a lot of biders on this um and then part of that we'll do a tdlr inspection once construction uh starts we send that off to get plans reviewed from the Raz inspector and then he'll come out once construction's complete make sure everything's ADA Compliant and he'll send that off to the tdlr for review and approval and we'll also help with Construction contract Administration so again once the contractor is selected uh we will come out have a pre-con meeting howbert Mike needs us to help with that where we'll come to meetings however often we set that schedule with the contractor that's selected so then next page rough anticipative project schedule so right now then we're in the design contract I'm hoping to get Mike that by the end of February so by the end of next week a proposal maybe have some comments here and there so we'll work with him on that and then assuming it'll probably need to come back to council for a ward some hoping that'll be in the March time frame maybe slide into April a little bit but as soon as we're kicked off on that I want to start the public engagement piece of this so working with the Parks Board and y'all on getting public engagement going so we can develop that master plan and start getting some ideas blowing and going from there we'll looking at probably July to September for uh survey Geotech our existing conditions and then a 60% design development uh after that Tred to
account to for review sessions between that so I just gave some rough months and I think as of right now we're not set on a specific schedule of when this needs to be completed but again if Mike comes up with a date or we need to have this built by a certain date we'll work to expedite as much as we can but work through final Construction December to January of 26 and then again advertisement bidding getting the Construction contract award to council around the February to April time frame of 2026 and then I anticipate a 8 to n month construction depending on the elements that we can put out there may dictate that a little bit um to be a little bit longer just depending on what we hear back from the public but no not longer yeah so hopefully either December 6 ribbon cutting or maybe even push into like a new year January 2027 ribbon cutting when will y'all start doing some filing some gr the grant like Grand applications that type of thing so I'll get with Stephen on those dates to see what we can apply for and what can be applicable for the park I know the biggest thing is just figuring out what requirements they're going to need for those applications um I know first off the bat they're going to want to see an overall master plan for the park so once we get past that step is what I can get with Stephen to say okay what grants can we apply for what can we look at I know there's some TB tbw grants for um some large and small Park development so I'll get with him on when those dates are and we'll try to look at so probably in the fall of the year yeah remember one of the things that we mentioned to the part Recreation board last night is an overall Master Park plan as C was mentioning in the grant applications they will look to see if we have a master Park plan and if we have
one it it scores points if we don't have one it doesn't score which could take us out of the running so we talked about yesterday concurrently going through this process in this planning stage with the parks and rest board to try to figure out what we want out there doing that but at the same time working on a master Park plan to be adopted by The Parks and Recreation board I'm sorry be recommended by the parks recreation to the council so the council can adopt and actually pass a master partk plan so then we can take that and submit it in with all of our grant applications that we have so they will be looking for that we want to be able to have something which should include pretty much all the parts that we have in the city not just best park include in any property too that the city owns that y'all Envision to become Park property um it can also include from a trail system trails that are within par like on street bike trails that kind of thing that's what would be included in your parks and right master plan could also include it would include programming too so a lot of the Youth Sports programs that you have we try to highlight that to in all of your in the master plan but yeah we talked about that last night definitely recommend yall do that because it does get you extra points when you start submitting for this grant funding and you and you could start looking at these other parts that umbe years down the road like okay we want to apply for this grant for this part you know in 2027 or 2028 and then you can start preparing those Grant questions ready to start if we have to do a phase plan so like we complete phase one will the residents be able to use phase one and then we can still continue on
the other phases or does it have to be completely finished before the residents can use it no the way we would we would specifically as we're putting the master plan together make sure that where whatever is built in phase one isn't going to be be caused have to be shut down as you move to phase two or phase three so you know we wouldn't have phase one be around let's just say the perimeter of the whole park and then phase two would be right the middle because then you would have to shut down something so we strategically try to place elements where it makes sense you know from visibility standpoint from you know we've got surrounding neighborhood there so we will look at that with y'all and work with yall on that in the Parks Board on where these things are placed to make sure that if you can't get everything done that we have in the master plan that everyone envisions and ones out there that phase two or phase three isn't going to interfere with ph one question thank you so much thank you our best park Improvement update so we now move on Item B which is discuss and consider RFQ 2502 for qualified Engineering Services list uh for 2025 through 2031 uh and select engineering firms for that thank sir agenda item RQ 22 if you remember last meeting that we had U state law allows us to be able to have an engineering a qualified engineering list again some of these
projects that we have envisioning for the city uh as opposed to Simply uh or as opposed to going through in finding a engineer going out first for the engineering aspect and then from that point once an engineer is selected then we move towards the project this kind of takes out that first step and uh the RFQ that we put out that we put out for I believe three weeks and there was a submit uh we were going to select in the RFQ state that we going to select Engineers to be on the list and this will be good for 2025 to 2031 which essentially allows as the project comes up I can simply contact one of the engineers and saying hey do you mind begin to start working on this project for the city and put bring a proposal so we can begin moving forward and then selecting another engineer for another project that we have so we can have multiple projects going on at one time and and kind of as the stated in the last meeting spread the love a little bit um so the RFQ ended uh last week on the 13th and uh where we had a list of two uh we only had I'm sorry we had a list of Max of three we only had to submit and they were par Smith and Cooper and kimley Horn so those the only two engineering firms that submitted for the RFQ for the qualif engineers list and I've given you this documentation I apologize for not have it in your package but it's justly kind of a qualification of who they are I you already know who they are we've already have one working on a street project for us and we have another one that you just heard working on a bestest Park so we're going to have some other projects coming through that we've talked about as as as example the remodeling of the City Bank building the demolition of the Ning home facility possible remodel of this and adding on to this building for a public safety building so there's a lot of projects we have to do solid in a transfer station water streets so
there's a lot to do if this will give us the opportunity to be select from those two engineering companies would we uh issue a project I have curiosity who was the third one you asked there there was no one submitted but we had a company based out of San Antonio that had um had come in to be seeing me and I submitted him the RFQ because he had said if you ever do it let me know which I did and we never heard back okay I move to approve Park Hill Smith and Cooper and kimley Horn as qualified Engineers selected from the RFQ 2502 for the term years of 2025 to 2031 second motion second approve Park Hill and Kim as our qualified engineer services for 2025 through 2031 all in favor I any opposed that motion carries thank you okay moving on to item C discuss and consider the interlocal agreement between win County in the city of Kermit for tax billing and collection Services Mr Mike Ana contract with wi County Tax Collector and what they do theyare the tax statements they mail them out and then they do the collection of our current taxes and liut taxes and part of that as you can see they actually do it for the City ISD in the hospital District uh our fee will be 1,515 but that it's contract there's no more discussion on he a motion to approve on that one make the motion to
approve under item 10 section the uh the interal agreement count and the city for taxing and tax billing second a motion as second to approve item C which is the inter local agreement between Winford County and the City of CIT for tax billing collection services for 2025 all in favor motion carries moving on to item the uh discussion of the city of Kermit code of ordinances chapter N9 article 9.03 zoning code and request the planning and zoning committee to provide it to provide a comprehensive review Council we've had this discussion um about the need as we begin start Economic Development the need to and review the entire Zoning for the city of as an example we have some sections of the city that are along major THS that are Zone resal as an example I'm asking is that the city council man zoning code article chapter 9 article 9.03 which the entire zoning Cod back to the planning and zoning committee for their review and I believe that myself and our City attorney Slater can take them through that process and we can review every section of that zoning code and kind of go through uh the zoning code was passed in 20120 so normally what cities do is when they pass the zoning code they want it to stay in three to five years and then they through that to see kind of the wrinkles that have come out and then we go back in there and just do a revisit of the zoning code so that's actually what I'm proposing is that now that we've had about a fouryear time frame with this five year actually four year time frame um that we now begin to start going back looking at the zoning Cod again to see where we need to iron out some of the
wrinkles of Zing code that passed back in 2020 so that's what the request is here to this to the uh P zon committee and ask that they U review it make recommendations back to the council part of it also that slat wanted me to make sure we put in there is that we put a timeline in there so that the plan zoning commission know exactly when we expect them to finish and bring it back to council so that the council can take a look at it and and have it done because it's kind of expedited it's it's also being push to the Forefront because of the EC development election and election that we having iness I've given you a copy of the entire zoning code so you had that that I pass to along with that I would add which is best reason for M to be here is that it will also take a look at that rvin SP would you like to speak on that's know what the is I'm I'm G to step out and just say I don't know how long it's going to take to be honest a perfectly clear answer because we've got to fix if you've seen just with with the RV ordinance we've got to get this fixed and to where it makes sense for everybody going forward so that there's no ambiguity or anything that may have got missed or misplaced or anything like that in addition of that also the Planning and Zoning the zoning code so we might can break it up if Council can
direct it to do ordinances first then zoning something of that nature that's that's what I was going to ask can we focus like on a specific area and kind of decide on that it'll most likely be the code instead of it being like a four to six month process you know and leaving some residents having to still make accommodations for for their RPS not all residents just some resents so you know maybe we could do not take four to six months on that or let me ask my a quick question get clarification we approve for yit to review and that's going to be been used later and then the board it'll be presented to the to the the zoning board and then to us to planning zoning okay yes so they will they will go through the entire zoning code and if you take a look at the zoning code it includes ass regulations it includes f it includes housing the land property itself how it's zoned correctly I can tell you the majority of what we have to go through much go blocked by blocked in the city to take a look to say okay yeah this is correct to be residential but this over here needs to be commercial it needs to be industrial uh in the event that the Patty zoning committee recommends new zoning plat which could be say for RV parks uh you know those type of things that could happen uh revising some of the definitions which could happen so it is an overall scope of the zoning know most because you're also working with individuals that have daytime jobs and um you know I I anticipate that we'll probably meeting once a month and that once a month the introduction to
get started on it you know six months is only six meons and so it's just it's just going to take a while because they've got jobs and they're not going to be here 40 hours a week try to get it done do that that's but the resch will be being done in the background those meetings will be and then is there to answer I think Mrs Baron's question is there a way to split out the zoning code and ordinances into two separate processes or are they going to overlap uh it's potential that we could we have to get direction from the council to what you want to review first or how we want to do that because a l just depends you know how we the thought process was just the overall zoning code and start from there and from the beginning to the end and back we just have had so many zoning issues too I just with the stuff on 18 and so many properties around town being coded residential or manufactured housing so I that's a priority to just so you're aware we that's also priority we had the issue recently of course with Dollar Tree you know the new company that's coming in we had to do some variance request on the zonings Z we had go ad so this will take care of that that's what we we move away from to do those okay and on the RV issue at hand is that an ordinance issue or a zoning issue or both the way that the Z code was created it created the RV definition and requirements of the RVs within the Zone code I've always seen it simply
ordinance that's been put in place but it's now in code so anything has to be done has to be changing that later mention a realistic timeline said done in different cities it you know takes six to n months very similar to whenever we get as an example a charter committee City it took it took a full year just to to to hash out the Planning and Zoning thing when we did it back in 2000 I mean it was over we started it in um 2020 I think we started 2018 and um I know it was a long tedious process very uous process so think go ahead no no goad goe so um now I lost my train of thought are the planning com zoning commission meetings there open for anybody to come yes it is a fullblown government uh municipal government committee so it's open to the public we will post the meetings anyone can come in they'll have a public comment period as we go through that proc so that's where Miss Baron really needs to go to be able to talk to them and then because they're going to make the changes and then they're going to bring them to us for us to change right they will make Rec so that's really where you need to start with with them and Z we can get you we have meetings and stuff like that I mean we really don't have a very good notification system I guess we could put it in the
newspaper yeah that's what I'm saying we don't we don't have a newspaper everything should be posted to the city's website we post it to the Citys social media a lot of people don't look at that you know and even if they do they don't understand it because it's all legal terms agenda was well a bunch of it really is like I looked 2020 and I probably would have been part of like that conversation and been involved but I didn't know what that organ was about you know and just said Z you know and I didn't have a clue what that was about it was just a whole bunch of what would be a good form what would be a good form of communication in your in your mind see saying like I don't we just and I mean even if you do get it out there like a lot of people aren't going to show up because how their comfort zone yeah we understand I mean so y'all can't y' can't like look at this particular one in general at first instead of leaving us waiting like however long I assume unless Council tells different it's going to be an overview of all of them we've got to get it right so that there's no more misconceptions I mean I understand the point of wor I don't have a problem with that I mean I've looked at other towns ordinances they don't have a problem with an RV being on your private property um they have restrictions on it that I understand you know you don't want somebody liveing and they're already in their front yard um a lot of them want them on an approved surface just appearance wise you know so it's not sitting there in your front yard with grass gr around you know there are things that are understandable this this just it just doesn't seem to be a purpose so I think our commitment as a council will be to ask that this is is moved along as as quickly as possible
but until it all starts the process we can't give you a time frame I'm sorry just I mean I know it's inconvenience myself my husband I know a few people in we take that under consideration not everyone all right want to let the council and all the people that are listening especially for M Bar if you go to our website there's the ability up for notifications and so as an example if you say I want to be I want to sign up notifications for the planning zoning every time that there's a meeting schedule it'll send you an email or a text message and I I do that because I want to test the system and I get a text message I get an email every single time that there an agenda posted a meeting posted it'll let you know through your phone or through email whatever you tell it to do so there's that opportunity to do that to know that that happens okay and that's a new function in our code red is that right no no it's actually it's a part of our part of City okay my last question was can we just adopt one section or are we going to have to overview all of this to adopt it all at once that's going to be uh the role of the council how you want to do that understanding that when you look at 9.03 there are sections in there but they they're pretty fluid together on how they laid right if the council said we want you to take these section first and bring it back to us we can do that also we can just direct the plan zoning committee to do that okay or we say take a look at the over thing and bring it back to us that's kind of the plan that that I had brought forth but we will do whatever the council direct consider okay just request yes ma'am thank you we appre appreciate you coming in again and go to the website
get signed up so that we'll make sure you're alerted to those it's kit. and Zing SE if you go to the bottom it'll say notify me and it'll tell you there how how you sign up on there oh if you want to come in Monday we can get you a list of all the P thank you ma'am we appreciate it any further discussion by Council there anyone else in the audience for that item it's an agenda item so you're more than welcome to come up you you have to come up and introduce yourself they're just taking one section of the whole city and carrying through with that and there's this other part that hasn't been touched you know and nothing's done to it I don't know I can't see you're saying that everybody can go to the website I'm sorry I'm still back in the 80s I've got a flip I don't do that I've gone to the website where when you pay the bill you know to go and there's never anything on there the most I get is there's the third meeting of every third Thursday of every month y meet at 6:30 and I got that from the billboard the new Cemetery you know so I'm not on the end of everything so I don't know how you put out there without a newer it's it's really sad that we don't have one and my children aren't here to put me let me know about all this stuff you know about the zoning and what have you there's a lot of property around here that looks awful but y'all know that I'm not here to put down other people's stuff but why just this section of the
city you have to move your stuff and do this and why not this one it's a Citywide ordinance it's not a specific the whole city already what is that we we were we were working we were working on the issue and then then this came up so we put that on hold until we could get this situated so why I don't understand why they still have to carry through with it you know it started right there why was it in our it's it's the whole city it's Citywide mine's not at my house mine's not at my house I mean we we've all taken ours and our paying places for ours to stay so and it did pass in 202 yes I think the point that she was trying to make is not not everyone has had to move their that's the point she's making well they were they were in the proc going around code enforcement was in the process of going around to everyone it's going to take a little while to to get to everyone in town so there's a lot of there is and and we we address it on a daily basis I mean we're on the lookout we're sending things in well thank you we appreciate it well I think I think that M Baron has brought up the point we're moving the right she's pushing us to move the right direction we want not just to fix this issue but the issues in this whole zoning area we don't want to wait and and then have this issue in another area and then we just if we're going to do it let's just do it and do it all they they can give you that information but like like they they can
provide her they're going to provide her with those names is it change every year I no every two years one there was there was five and to my understanding correct me if I'm wrong so did y'all have um an attorney involved as well yes with this because we hired a um a firm that came in and and did the planning and zoning and everything was really a mess before they did and um it took them about two years we started it in 18 and um hired the firm they came in they we had a public meeting at the community center the old Community Center I think three different Community meetings where people could come in they set up tables and you could go around with a sticky note and put it and it was like you know for RV RV parks RV orces da d d d da and then um things for the parks and res enjoy it was you know there was about a dozen tables set up down there and they did it three different times the last meeting we had real good turnout at you know and participation then they took all that compiled it and then started the legal part of it and um it took like I said until 2020 it was it was a long process to try to straighten the mess up that we had and then there's still been issues since we've had I mean we all know what what's come up well I just I want to avoid the mess and go with our legal counsel and do it right and get input I mean you know you're going to have input on the whole if y'all attend the meeting spread the word people the C the citizens will have you know a say so and input at this time so it's like we're
starting you know kind of starting from scratch again starting from scratch but we are all committed we we really want to get this fixed so that there's no we don't know honestly do not know yet as it progresses we should be able to give you a better time frame but I don't know does this need a motion no this is just discussion okay we can't compare because that was the beginning of now we have a Playbook so it might not take us that back we don't know they didn't have a Playbook back then they started from scratch and an outside company's not going to know Kermit that's right the way any of us know Kermit so hopefully this will be moved along more quickly I said they didn't have any kind of like Karina said they didn't have a game plan to start with they had to start from scratch compile everything what we did have was one thing contended something else and this contradicted this and this contradicted this and we were just going in circles a lot of time a decision couldn't be made until we had something presented to us what we had a format to go by and there's been some issues come up almost monthly since this was you know um about fences or something that was a residence that was um supposed to be commercial and it was H it was um put in as residential and we've had to change that there's there's been some things that have had to be adapted so it just needs it's time for it to be revised today it's been four five years been five years since it mayor council I can tell you that um while this is not a action item I did want to kind of just get a consensus being to go backens back happen that we begin to reach out to them start organizing a meeting the
initial meeting of kind of what we're wanting to do what's happening overall view of it because is correct it's been ourv been issue but there's another thing that been happenings businesses coming in town that want to be in a particular location but they can't because of the zoning on we got to go through all those it is an overarching review that we want to do I think you're found to start but now it's kind to come and kind of revisit it just TW maybe it'll be where this committee might be able to meet twice a month I mean that we don't know until we meet them because they think a lot of them do have full-time jobs Monday through Saturday you know you know throughout the month and so they're going to have to meet in the evenings but it might be where they can meet twice a month that will speed it up it'll just depend on what the committee can work out TimeWise and meet with our our attorney as well but we will definitely stress the urgency yes as far as Council goes as expedient as possible it's not I know the original deal took about two years but like I said they had nothing to start with this shouldn't take anywhere near anything like that so I think it's consensus of the council mik to push this back to zoning code and and let's get some process started on okay all right and I think we're ready for executive sessions I right 720 okay was it 74 okay okay sorry okay uh moving on to item e discuss and consider appointing Texas Regional Bank as the investment advisor for the city of Kermit counil this agenda item is to appoint Texas Regional Bank to be the
investment advisor for the city uh I I would I had a question brought up to me earlier I just kind of want to clarify we currently have BOS advisor he is our financial advisor state law prohibits fin to also serve as our investment advisor so bosy advisor helped us create the investment policy he kind of tells us we're at he tells us when do we want to go to bond let me tell you from a financial standpoint this is a better deal but once we get to the point that we either want to invest the money or issue bonds then we'll go through an investment advisor who will help us go through that process and take it where it needs to go doting fors currently our investment advisor has been a longstanding I think partner with the city talk Securities but through a relationship that I've had with the individual from Texas Regional Bank his name is Alex and I saw him over at tml and we began to start talking and I mentioned to he was still taking on clients and he said that they were and so the we met with Mr me I'm sorry the met with Mr me back couple weeks ago and he's excited about coming on board he's giv you kind of a sheet know who Texas Regional Bank is it's a Regional Bank but they also have a government Finance government investment division canity they we actually had a conversation with them we actually um withas reg Bank City ATT and then Comm M so they
