Okay, I'd like to open this month's meeting of the planning and zoning commission for the city of Keen with the invocation given by Caleb Bull and followed by the pledge of allegiance. If fall would rise 6 pm beautiful day here today. I thank you for allowing us all to be here. I pray that you give each one of us to the flag of the United States of America and to the stands nationice for all. All right. I'd like to welcome all those in attendance, Councilman Bob uh Chapman and uh guests. Uh we do have a public hearing schedule which will be conducted here in just a few minutes. I defer any other remarks to the city administration. Good evening everybody. Thank you for showing up. Um just kind of update you on some of the other developments. I did a walkthrough of Tractor Supply today. Um, we accepted the and gave them their CO last week. Um, they're got all their shelving up. They're looking at a soft opening on May 31st. So, things are moving along with that. Ashton Home Place, there's 60 plus homes under construction over there. Uh, the Canyons, there's 15 plus homes under construction over there in phase one. Sunset Ridge is real close to uh the city accepting their phase one and the same with Stonehurst which is right

behind city hall here. So things are looking up and moving along. Okay. Thank you, Don. All right. Um at this time there's opportunity for anybody in the uh attendance uh to speak at this time if they so wish. If not, uh we will be conducting a public hearing. Uh public hearing is uh to uh to hear citizens comments and hold a discussion on a zoning change request from the KD property group regarding the following item. Zoning request change application received for a 24.7308 acre portion in the Hugh McCollum survey abstract 570 track 12 within the city of King, Texas from C2 general commercial district office and light retail to PD plan development based on multi-family zoning. The following variances have also been requested. Allowing for the construction of three-story buildings instead of twotory, furnishing four playgrounds instead of five. So, at this time, uh, at 6:03 p.m., we will, uh, begin our public hearing. Do we have any representatives that would pro care to provide any background information? I'll go ahead and start and then uh Mr. Roer. Okay. Thank you, Don. Yes, we have Mike Roer here from the KD group. But basically, we went through this a couple months back. Uh approved everything. Went through P&Z and it went through uh city council was approved, but then dealing with the the gas company and the easement they have, which is on the east side of the property, um ended up being larger. So, they had to make some modifications. And so they're asking for

a couple more acres. So we have to come back and redo the zoning again. You should have all that stuff in your packets. So this is this is part of their conceptual plan of what the buildings are going to look like. And again, we went through this before in the old one, the line kind of went at the top there, just kind of went straight across. And there was only, I believe, a 40 foot easement. And now it's over a 100 foot easement on on the on the east side. So that's kind of why we're here. We're just had to go through the whole thing again just because we added a little bit more acreage. Okay. Thank you, Don. Mr. Roer, would you like to update us on anything your company is planning? Hi, good evening. Uh, Mike Roer with KD Property Group. Address is 310 East 96 Street, Sweet 400 Indianapolis, Indiana 46240. Um, in a nutshell, uh, Don covered it. Uh we did need to increase the acreage due to um the Atmos gas line on the east side of the property. Uh there's there's a 100 foot buffer now whereas before it was 40 or 50 ft. Um nothing else about the development has changed. Uh number of buildings, number of units, amenities, uh points of ingress, egress, um everything else remains the same as uh when we presented uh last fall. So appreciate uh the city uh Don taking the time to help us with the paperwork and publications and going back through this process. Greatly appreciate it. Still very much looking forward to um wrapping up approvals and starting construction

Um my question just at the moment is is that a 100 foot easement or a 50oot easement on that gas line? Well, they've changed it to it's a little over 100 feet, probably 115 feet or so. Uh, is that just on their property or mine as well? No, no, it it extends into that original 38 acre tract that uh um you're on the carode transportation home owns. Yeah, I'm on the other side of the county the county side of 37. This I'm not sure if that affects you. It should not because this is has nothing to do with your land. This is just on the other side, the north side of 317. Okay, that would be a question for the gas company. Is that a Is that a map that is not public out here? I get a copy of that. You can see the the site plan there. Okay. Um and that inset or the part to the right is the extension out towards Highway 67. name. Charles Lumis. I live in Clebrin. I don't really understand the map. I want to get him to explain where is Highway 67 on this map. Well, if you look at the uh right at the very left upper left corner, um that is where Highway 67 uh intersects that property. It's across the street. We we own the property around Tractor Supply and we sold the Tractor Supply. Yes. Okay. just to the south. So is the whole piece of property across the road being developed or just proportion of the lower portion and then just along the side this front portion is where 67 is. And and so 67's on the left side. It's right here north. Your property is directly across the street. Tractor supplies directly across the street. Correct. So the apartments are going to be down below here. And then you're asking to change the zoning or the zoning is is commercial on this blank part, right? The whole piece is commercial. Okay. We're asking this commercial. Okay. Yeah. I just didn't understand the map where 67 was. So, uh that this blank portion is for general business type stuff, correct? Strip center or whatever. Okay. Uh, it's now 6:09 p.m. We did have another request on our agenda, but it has been pulled. So, there will be no public hearing for that. We can move to uh our general agenda items. Uh if you're following along, uh 6A, we will now discuss and take action on the request for zoning change from C2 general commercial district office and light retail to planned development based on multif family zoning with uh variances from the KD uh as requested from the KD group. Property is generally located at 2632 East US Highway 67 in the city of Keen, Johnson County, Texas. Okay, we have any discussion from the commission members? And so in your packets, you should have the new updated planning application with the updated acreage. So went from 21 to 24 which included, you know, the rightway dedication. Um, you should have the notice that was published in the paper and you should also have the letter copy of the letter which was the same notice that was sent out to the residents. Um, all the civil plans and the actual construction plans have already been approved for this project. It's just kind of got delayed because of the gas company and this easement being wider now. So, everything's ready to go, ready to rock and roll. We just need to approve this preliminary plat final plat which will be the next steps. Anybody has any questions

Um, I would I would prefer to change the wording uh on the last line where it says an allowing to acknowledging the two variances requested. If if somebody would like to make a motion uh using that verbiage, as I say, this was originally uh discussed, was it September 30th? We originally held a hearing and uh it it passed. They just had to add two acres uh to include the rightway easement for the Atmas gas line. Um does that verbiage change anything for you or is that fine? Okay. Just want to make sure it's okay. You want to say acknowledging? Yes, because we don't actually grant variances. So, allowing it would just be All right. I move that PNZ commission approve the reszone request made by the KD group KD property group from C2 general commercial district to PD plan development based on multif family zoning and acknowledge the two variances requested. Uh, next item up for discussion will be um approval of the preliminary plat for the Coington Acres development, which is the uh development name for this uh KD property group uh as submitted by the KD property group. Again, the property is generally located at 2632 East US Highway 67 in the city of Keen, Johnson County, Texas. So in your packets you should have the preliminary plat and the final plat. Um we did make two minor changes and that was just uh the signature block. They had Johnson County on there. We had the new ones you represent city of Keen Planning Zoning Commission and City Council. But what you have in front of you is like I said it's been through our engineers already. It's been through the third party inspectors. It's all been approved. fire department, everybody down the line on where everything is and the way things are located. Anybody has any questions about the preliminary plat more than happy to answer them for you or try to. I do have one question. Um, for the drainage over there, I've seen that road flood just as is, you know, no concrete over there for the runoff coming off that hill. adding that much concrete over there. What's the drainage going to look like over there on that back? If you look at the very bottom down there where it says rightway dedication on the preliminary plat, that whole area is going to be a retention pond or detention pond. So, all of the drainage and like it shows on the preliminary plat, all this stuff, there's going to be storm drains throughout. Again, this has been approved by our engineers, the civil side of it. It all drains into that and it should not allow any more water than currently exits that

property. That's the purpose of the detention pond. Okay. Um and we do need to we do approve the preliminary plat as well as the final plat. Okay. Correct. So um if anyone would care to make a motion uh approving or denying the revised primary flat submitted by the KD property group for the Cington acres development. Please do so now. The normal procedure is bring the preliminary plat and then it goes you know the city council and that's when all the the civils and the and the plans and everything get submitted and then uh get approved. We might make some tweaks to the plat but in this case there's no

reason it's already been approved. We've been through that step already. So this is just kind of a formality of going through. Right. Okay. All right. So, um, again, I'll entertain a motion, uh, from a commission member to approve or deny the final plat submitted by the KD property group for the Coington Acre Development. We do have a vacancy on our um PNZ commission and we do have one application submitted by Jimmy Alcala for appointment to the planning and zoning commission to fill a vacancy for a two-year term that would end in March of 2027. Um has everybody had a chance to review his application? I think I've seen him once, but I haven't really met him, so I'm not sure. I don't think he's in attendance, but uh Mr. Aala could not make it this evening with a sick family member, but and sends his regards. Um but he is very eager to serve on a board and and provide his expertise. Okay. All right. and he does have a a history of uh being on some

church boards as well as a president of HOA and also leader in a golf club, men's senior men's golf club. Again, entertain a motion to uh recommend to the council appointment of Mr. Jimmy Akala. If one would so like to make that motion. I'll make the mot the motion to approve them. Okay. I have a motion by Caleb B uh to recommend uh to the city council appointment of Mr. Akala to the PNZ commission for a term of two years ending in March of 2027. Is there a second? Okay. Uh we do have minutes to approve from our meeting in March. There was no meeting in April. So uh if everyone's had a chance to review those minutes from our March 10th meeting, I will entertain a motion to accept or revise the minutes. I move the minutes of the regularly scheduled planning and zoning commission meeting held on January 13, 2025 be approved as presented.

Um is there anything planned in the way of a I don't know workshop or anything that we need to be aware of? Um not at this time. We're looking into that and yes, we'll definitely will have some town hall meetings because we are um in the running still or waiting to receive the funds from a grant to redo our whole comprehensive plan and and all that and which also help with our ordinances and our zoning and future land development. So, soon as we get all that those ducks in a row and everything starts rocking and rolling, then yes, we'll schedule some meetings. Okay. All right.
