I'd like to call the July 13, 2026 Planning and Zoning Commission meeting to order. Please stand and say a pledge of allegiance with me.

Item three, the consent agenda. Approval of minutes from the June 8th meeting. Any comments, questions, concerns?

All in favor? Aye. All opposed? Motion carries. New business. So 4A, the pilot travel centers rezoning to C, General Commercial District public hearing.
Yes, we have two applications that are related for pilot travel centers. First one is a request to rezone. So pilot travel centers located 600 West 92 Highway proposes to rezone approximately 12.42 acres from C, General Commercial District and M, Industrial District to sea general commercial district in its entirety actually it's about eight and a half acres of zone industrial the reason for the request to rezone is that our code allows truck stops as a conditional use in only the sea commercial district so we want to you know get the property compliant with the zoning ordinance and rezone the entirety to the sea general commercial As I mentioned, there is a conditional use permit application is the associated application with this related to truck stop. There's a public notice posted in the Kearney Courier last Wednesday and then again this coming Wednesday in preparation for the Board of Aldermen meeting. And then we sent notices to property owners within 185 feet of the property. Staff recommends approval of the rezoning. with following conditions one develop the project in compliance with all codes conditions requirements approved plans and payment of fees and or taxes as our standard condition that we attach to applications and then this will be forwarded forward at their meeting next week caitlyn moriarty a representative with pilot is in the audience today if anybody has a question any questions and it's public hearing so you want to move forward a public hearing great i guess we do have matt cross with claw valley engineering Also here, I'm a consultant. So it's easier on behalf of them online.

I move that this Planning and Zoning Commission recommend the Board of Aldermen approve the rezoning to see General Commercial District with conditions recommended by staff. Second.

Yeah, so second item is a request for condition use permit. So pilot travel centers request a condition use permit for a truck stop in the Sea General Commercial District. Truck stops are allowed by condition use permit in that district. We don't have a condition use permit on file. Basically, the code changed in the last 20 years since they located here in the city. And so because we don't have a condition use permit on file, then, of course, we filed that. And this will accommodate them doing a building addition and some other related improvements. As part of the project, we've asked that they construct a sidewalk along 92 Highway and along the east side of Shanks up to the building, which is what we require of really all development. And then that connection up to the building is part of the building code up to which they have shown on, they submitted a site plan that's in the back and it shows those sidewalk improvements. The staff recommends approving the condition use permit with the following conditions. One, construct sidewalks along 92 Highway Frontage and Shanks Avenue, including a pedestrian connection to the front of the building. two other conditions if required by planning zoning commission and then three develop the project in compliance with all city codes conditions requirements plans and payment of fees and or taxes the commission can recommend that the board approve deny or approve with conditions including any limits to limiting to a specific property owner or for a period of time i just add that because there's a code section related to condition use permits in the code and so we want to point in the meeting. This application will also be forwarded to the board of owner at their meeting next week. Probably notice was posted in the courier last week and again this week, and property owners within 185 feet were also sent a mailers notification. David, I would just have one question for you. Should we put something in stating that This is for this owner, and if the ownership changes, that they would have to come back for?

I think they do a great job and all of that. I don't want to poo-poo the project, but I also, you don't know who the next guy is. So giving them a conditional use permit, I think I would
i would maybe be in favor of adding that it's for this ownership yeah i think that makes a lot of sense and then that way if i don't travel center sold it to somebody else then that new owner would need to come in and renew yeah is that okay with that yeah that's okay I don't think you guys are going to leave anytime soon.
I'm sure it is, but the proposed sidewalk will come down and allow to cross 92?
They will just do a sidewalk along the front edge. We're not requesting that they do a crossing to the south side. We at least would get Almost there. Sidewalk along the frontage, yeah. And it would be safer for somebody. They could follow that sidewalk all the way to, like, let's say they want to go to McDonald's or Price Chopper. Let's say they want to go to Price Chopper and get something to take away with them rather than fast food. They could walk along there, cross the westbound of the island, cross the island over to the south side, and then make a cross. And then at some point, maybe there'll be another project where we do more of a
There's a lot of people that just make that run, you know? So if we could make it a little safer, it'd be great.

I move that the Planning and Zoning Commission recommend the Board of Aldermen approve the request for conditional use permit for a truck stop at 600 West 92 Highway with the conditions recommended by staff with the addition of the length of the conditional use permit would be for the current ownership.

Our last item today is the Thornell site plan. So Thornell Corporation, you've seen them in before with Innovation Fifth Platte a month or two ago, proposes to construct a 40,800 square foot building on lot two of Innovation Fifth Platte at the east end of Innovation Drive. So that is in the Fifth Platte, the newest section that they're finishing up. It's a last phase in Innovation. plan shows a 30,000 square foot warehouse and a 5,400 square foot office space on the first floor and then above the above the office that front area there's been an unfinished second level so that at some point in the future they could do an expansion if they wanted to do that building includes white metal siding with white gray roof and light gray stone veneer wainscot around the front of the building and by front of the building the park facing west but then left and right sides of the office so that office area kind of sticks out from the warehouse and wind around that frontage so the north side and the south side of the office portion the innovation board of trustees has approved the proposed project revisions to the site plan are needed though they show a monument sign out at the front of the property and the front utility easement so they need to scoot that back a couple of feet and then they need to update the landscaping down additional landscaping to meet requirements. Outside of that, staff recommends approval of the site plan with the following conditions. One, submit revised site plan drawings addressing the following. Updated landscape plan, relocate the monument sign to outside of the utility easement and other revisions if necessary. Two, innovation board of trustees approval, which we have received. Three, city engineer approval of site plan revisions and any changes, modifications, or alterations required by the same to the site plan revisions. Four, submit a DNR land disturbance permit if required. Five, submit a city grading permit as part of the building permit. That's something new that's come out recently where we're having to do a city grading permit for land disturbance. That's part of our MS4 requirements that we're having to implement. Six, install and maintain sediment and erosion controls during construction. Seven, install a key box as required by the current Fire and Rescue Protection District. 8. Submit a building permit application prior to construction. 9. Submit a sign permit prior to installation of signs. And 10. Develop a project in compliance with all codes, conditions, requirements, plans, and payment of fees and taxes. This application will be afforded to the Board of Aldermen at their meeting next week. Ron Cadra is in the audience representing Thornell and Mike McGuire is also here in the audience if there are questions. This is a site plan, so there's no need to open for public hearing.
So Innovation Drive will be extended down to the site. If you look at page 16, I just want to make sure I'm picturing it positioned in the right direction. I think I am. Yeah.

It's a little bit outdated, but that's the best we had. And this page represents, so on that aerial map, The end of Innovation Drive is about this location, so they've extended that road further. As part of the Innovation Fed, it's a three lot subdivision, so there'll be a lot on the north side and another lot on the south side.
