The reason being that Not all property owners within 200 feet received the written notification as required by the Texas local government code. That was brought to my attention unintentionally by a neighbor, and we discovered the error as we were looking for the copy of their letter. We will resend letters, re-advertise on the newspaper, and we will have this public hearing in the month of August. So we can go ahead and skip that item. I don't think anybody here was here to speak on the item anyway, so we can just skip that item and go immediately to item 4.2.

Mr. Chairman, this is a site plan that's been a while, a long time in the making for a strip mall. on FM 6, known as East Cook Street. It is a five-suite strip mall. The project went into construction early last year. It was discovered that a site plan was necessary to continue construction, so work was stopped for a bit. The city allowed some of the work to continue because it wasn't consequential to the project, so that they wouldn't be delayed as much. The project went through 13 rounds of review from our consulting engineers. Two different firms actually reviewed this over time. All drainage comments which were really the primary issues have been addressed. There will be a pond built at the far south side of the property in the very far in the rear to serve this and future development. of this site, of this property. The site plan that was attached to this report shows a projected hardware store in the rear of the property. The drainage pond is expected to accommodate that pond, but further engineering review will be required at the time they want to build something else there. Given that all subdivision and zoning regulations are met by the site plan, we recommend approval.

That's a typo, but this this site plan would only approve what's shown and that's not in the like the hatch on the screen that you're looking at right now. It was just for reference because it was to help inform the engineer that, hey, this pond is being built for more than just the strip mall and the existing gas station. We're planning to do more stuff there to assess the potential capacity of that pond. When that time comes, for any construction that's beyond the current gas station and that current strip mall, they will need to come for another site plan and engineering review.

They will be required to build the pond before getting their certificate of occupancy for those stores. Because technically this building shouldn't have gone vertical until after the pond had been built. Mr. Chairman, members of the commission, Miguel Inclan for the record. This site plan you're probably familiar with. You approved a subdivision waiver last month for the single point of access for this development. The city council approved that waiver at their June meeting, which allowed this to continue to the process. So all subdivision regulations are met by this project except for that one which was waived. Because this project is in the ETJ, there are no zoning regulations. So given that the project meets the subdivision regulations, we recommend approval.

TxDOT is processing the driveway application this week. We submitted that late last week. The city has to be the permit requester on behalf of the developer. So the developer provides the engineering work, we just sign the application, and it's like a joint application that gets sent out to TxDOT. That is being processed by their McKinney office right now.

So this is a unique situation. Given that it's in the ETJ, the parking and stacking are typically part of zoning, so they're not applicable to this project as much as we would like to look at them. I will say that in the design process throughout this project, we asked for things that were not required, like parking, for example, and some of the configuration We asked them to make the, so when you make the right turn onto the property, it's a little bit of a greater distance before you can turn either left or right. That was not. The throat depth, yes. Yeah, the throat depth, you know, so. Okay, I'm still learning here too. We talked about the standards and what we have in place.
