Item 2.1 case number pl number plat 25-003- A final plat morning side phase 1A discuss consider possible action to make a recommendation to the city council on the final plat of the Morningside edition subdivision phase 1A consisting of 110 residential lots and three common areas on 23.587 acres. The proposed subdivision is located in the on the west side of Main Street, which is 5 FM 5487 north of Hubard. Okay, Mr. Miguel, you want to follow up from my last honorable chairman, members of the commission, Miguel Inclan, city planner for the record. Um this uh final plot was conditionally approved by the commission in December of um so basically a month ago at your regular meeting. And typically the the practice had been that plats that are acted on by the commission automatically move forward to the city council for full approval. At the city council meeting on January 12th, the city attorney intervened and did not allow the council to act on the approval of this final plat. Uh, per the Texas local government code, when a plat is approved with conditions, it has to come back to the same body that approved it with conditions

to verify that the conditions have been met. Then you can vote to forward it to the city council for full approval. So the condition at the time was the the acceptance of the improvements. The city engineer has provided a letter walkthrough was completed and u no no further action is needed on behalf of the developer. So given that that condition has been met both the city engineer and myself recommend full approval of this final plot. Okay. So like in the future is this something we need to bring to the attention of developers? We need to basically make sure everything is right before they come.

Yes. And and and moving forward, the city will will work with developers to not accept plats until they know for certain that there's going to be no conditions because this is adding it. This could have added two months to their process. And had we known that this was going to be an issue, um I would have put it on the agenda for your regular meeting. Mhm. And because this was something that was out of the control of the developer, we as as staff proactively asked for a special session to allow this plot to be put on the February city council meeting. So, so that way they don't have to wait over a month because of something that was out of their control.

I hope any developer out there were here that the city did kind of go out of the way and thanks the gentleman who uh participated in this special meeting to you know uh kind of apologize for what has happened so we can move forward and uh uh again it's one of those things go ahead

and and for the record you know this was reviewed concurrently with phase one uh phase 1B however the condition of phase 1B is the approval of a FEMA letter of map revision for for the flood plane and that process takes their ETA is approximately 9 months from now. So when that is done that plot is going to come back to you all for full approval at that time. There is no deadline whenever you approve something with conditions there's no deadline to bring it back. So that's this can take okay as long as it needs to take for the condition to be met then it comes back to you all for full approval. And that's that's it on my end.

What was specifically our condition on this one was just u finalizing the construction of the streets and infrastructure and having our city engineer inspect and accept it which happened it was it happened before the city council meeting. So, right in staff sense, we like we're ready to go. Council can fully approve the plant

and and it was ready to be approved fully, but the city attorney mentioned the provision of the local government code and his interpretation is that it has to come back to the commission then it can go to council for final approval. So, it's it's adding a step in the process. Um we as staff normally don't take plats. I mean we we felt that timing was going to work and unfortunately this was uh something that was not considered by staff and and really not part of the normal practice in in both planning and engineering when it comes to subdivision plat approvals. This is a first for pretty much anybody everybody who's involved in this specific case
