Uh, and this year like like the years in the past, they they provided us with blankets for the kids and and this year we got some teddy bears and they also supplies us with the the blankets that we carry in our squad cars that have our patch on it when we have an incident where there's a child involved. We always give that to a child. It always makes them feel a lot better. So, thank y'all very much. [applause] Anybody from One and Done or BO Metal Works? Anybody here?

Okay. Uh, Dr. Pam Sardo, Councilwoman. Uh Pam has always helped us and supported us to this and with many things. So we we appreciate her. [applause] And the last one uh that are here, I'd like for my wife to come up. She's with Abernathy, Rodair, Boyd, and Huelet. Uh that they also I think they do some tax stuff for the city and stuff, but my wife is a parillegal with them. So, thanks him for helping us out. [applause] So, on another note, uh on December the 20th, uh the police department about 8:30 p.m. we received a call of a of of a three-year-old that was missing who had been diagnosed with autism. Uh the officers responded out and uh with their training uh about this kind of stuff, they knew that sometimes that water is uh the children are attracted to water. So they did their search uh in Magnolia Point neighborhood and the officers were able to locate the child in a pond uh the three-year-old and was able to bring the child uh safely out and the medical staff checked on him and everything was fine. Uh the local news covered it pretty good and I've also put them in for a few awards with the state. Uh we have a video real

Yes, sir. The MDD application is officially online as of today. We'll be taking applications for the next 3 weeks and then we'll have council review those at the uh next meeting and after that uh we'll make appointments and we'll get things moving. The application is out there. There is a brochure that tells a little bit about the MDD and what people would be signing up for. And eligibility is anyone living within the district. So, not not just the city limits, but the district, which includes our ETJ. Okay. Thank you. All right. Do we have any uh citizens comments papers? Yes, sir. Um Barbara Joe Strickland.

Hi. Um my husband and I have lived in Josephine over 40 years. And when they did the replacement of the sewer line along Milton Street, there's bad odor coming in our house. They came to our house several times. We called Kurt. We called Garrett. They come in. They said, "Yes, it's something's going on. You know, they had engineers. They worked, dug up, redug it twice, but we're still having odor." And I also our neighbor next door on 103 Milton Street, the Hernandez, there they weren't even hooked up for two weeks when they disconnected them. They didn't rehook them up for two weeks. They were having sewer backed up. And then I also went to um 204 Milton Street. There is uh Jeremy Johnson lives there and Kendy Pal, they also have problems. and 202 Milton Street has problems and we are still getting these smells and we got this letter last week that said, "Oh, they're going to come clean up the street, clean up our yards and pave it." I suggest do not pave this road until you get rid of the smell in our homes cuz something is wrong. They need re-engineered or what? Something's got to be done. We They're saying we've got a sewer problem. No, we don't. We've went there 40 years without the smell. The people that I talked to down the road said they always smelled it outside the house, but now they are getting smell inside the house at their first bathroom towards the front of the house. And it's strange cuz that's where we mainly get it.

The awesome news about animal control is the commissioner's court today voted on the agreement for animal control services. Um, the the question is, is this a shared payment issue for animal control between interlocal? Is it a county city split payment or they just agreed to give us the service and we just pay for it for animal control?

I noticed on the public works report it said they replaced the motor on the ariation wheel at the lagoons. Um, how long was it out? Does it go I mean I know we get odor at our house all the time and I didn't know if it was the lagoon if I thought it was magnolia. So Lagoon system is ma'am. There's [clears throat] an aation wheel in the racetrack and it basically it's an agitator and it was down for I guess a week or two depending on it's been down two times but depending on how long it takes for the machinist to build that machine that piece it varies. Okay, it's back up and running and we're just trying to get by until the new plants online. But we had a temporary variator correct inside of it. So

Uh good evening, Mayor Council. Jacob Dupi with Dunaway. Going in on my status report for this month. Starting with development review. Couple things moving with Morningside and Morgan Farms. Uh Morningside phase 1A and phase 1B were at PNZ in December and they'll be on this agenda tonight for y'all's vote. Morgan Farms was also at PNZ in December. Has a couple more things to do uh before it comes to you guys. So we should expect that um next month. Okay. And on the status of engineering design and projects in construction, uh wa both wastewater plants are just rocking along very well. Um still kind of moving forward very slowly with the discharge permits. Uh just kind of check in with them from time to time to make sure things are moving along in the right direction. We had some pretty big milestones for the North Texas meter vault improvements. Um last week they actually tied into the big uh North Texas 24-in pipeline. Uh kind of did an overnight project on that one. So the big hurdle of that project is kind of behind us. They still have some things to do. Um but most of that coordination and kind of the um winteresque version of that project was luckily completed last week. So very good on that one. Um, we just heard a little bit on the Milt Street gravity sewer line which is complete as far as construction and line and service. Uh, just heard today about some of the complaints and so I'll also be following up with Kirk and staff to kind of see what's going on, talk to our inspectors, see what we can do to find out some of these issues are. And then, um, on the heels of that, as we get all that wrapped up, we'll be working with the contractor to repair those roadways, get them back into drivable condition per contract. Um hopefully we'll have all that wrapped up within [clears throat] the next couple weeks kind of keeping in line with the completion of that contract which is the

It looks like it looks like wildflower is getting ready to start back in next month. And then the elevated um tank says it's starting in 2026. So is that all still on track? So, as the new year kicks off, their housing sales could be changing and whatnot. Um, but I should be getting something from them pretty soon here. The last thing that they had mentioned was kind of quarter one of this year. So, we'll see if that continues or not, but it's it's all still in the middle to keep moving forward pretty soon here. Um, IPO number four, the wastewater um, water wastewater and roadway impact fee study assessment. Um, and what have we added? I've tried to go through my mind to see what have we added that we're going to need an amendment to the impact fee study cuz everything we've had it's they've been here since 2022 and we've had all of these developments that we knew were going on. I was trying to rack my brain as to what's been added.

I have not heard from them since then. Um but my understanding is that we're going to place at the very least that portion on hold.

I I think we uh identified early on that we needed an impact fee study, but we also had um you know a dozen other things in between that time period when we signed them on. So they haven't charged us for anything that they have not provided. Um, so at this time we'll probably just kind of keep a hold on that until we're ready to move forward. Okay. There are times when they may bring something to staff, but we'll we'll hold it and we'll not bring it to you until we're ready to move forward with it. It's part of it all kind of works together.

They're all part of one whole project. They they weren't broken apart. Um some cities like doing that all at the same time. And I believe now there's local government code requirements that uh create a very uh lengthy procedure for the adoption of new roadway or or new impact fees for development. Um and the reason we want to hold off is just there's too many projects going on on our end for for planning. We just don't have the bandwidth to work on the master thoroughare plan at the local level at this time. Okay. Um and we want to do it in house. We don't want to go with outside consultants. I believe we can do this in house. We just don't have the bandwidth to do it right now. So, this project is on hold.

And let me just add just for clarification for anyone that might be concerned, impact fees are for new development paid by developers. So, it wouldn't impact any existing residents. Uh we had the sign printed and they did not put the emblem on it that was supposed to be on there. So, that they've been tasked with fixing that. for our update report through [clears throat] December. Uh, in our report, you'll see the health indicator shows uh, at the conclusion of this project, the budget is excellent. Uh we actually had some owner contingency that we were able to bring back in neighborhood of $17,850. Um the schedule was good. Um we'd like to, you know, see it done faster, but but it was done and completed now uh with some of the issues that came up during the project. And the quality is excellent. Uh we're very pleased with the the way the project looks. Um, we [clears throat] did get the certificate of occupancy on January 5th, so the the building can be fully occupied and used at this time. Uh, Speed Fabcree is working on the closeout documents and those include the asbuilt drawings, uh, warranties, manuals, um, operation procedures, and, [snorts] uh, so they will getting that to us. We'll review that and get that signed off and and back into the city when that's all completed. And then that'll bring us to the final action, which will be the release of the retainage. Uh retainage sits at about $52,000 right now. So when all that work is complete, then we'll be able to uh recommend that that be paid. Uh the items that the city's working on, uh there's some furnishings, artwork, monitors, and phones. I don't know if that's complete. I don't know for sure, but but anyway, we we did meet today on the artwork. There's some artwork in the project that we're working to get hung. There's some wall applications, uh displays that we're going to work to get that up in the building. And that leads us to the last general item, uh the uh grand opening. And I know that that's in discussion right now. I don't think the specific time for that has

been set yet. So, as we get all these things put together and the project's fine-tuned, then uh you know, it should be ready for that when when you're ready for the grand opening. Uh the November report was revised based on feedback received last month. And um I have my December report. I tried printing everything, but it was going to be several pages and decided to save paper. Uh but I can follow up on those questions and attach that to the report and the minutes if requested. Yes. So, um, we met with a prospective developer who is looking at potentially purchasing a large parcel of property that is adjacent to the railway. Um, at the same time, we had been seeking out the the rail district to have a meeting to understand what their future plans are so that we can align our plans with theirs and ensure that there's no conflicts in development. I did attend the board meeting in November in Sulfur Springs and um from my perspective there they were focused a little bit more on the operations of the rail. However, there were some comments made at that time that they some of the board members would like to see the freight rail extending all the way to WY through this rideway. Um, and al although we have had the understanding that it's not going to get built, it's it's financially prohibitive,

we have to treat it as if they will build it one day cuz you you really don't know if they could one day just out of nowhere get a grant and have all the money to build it.

So, we have to treat it as an active railroad rightway. And that is why we had to deal with our agent to understand the procedures, distancing requirements and spacing between crossings. Um so the the the purpose of this meeting that we had with them was to understand what the process is. They don't have a specific set of guidelines. It seems like it's more based on the proposed development. They'll review the proposed development and then they'll they'll provide feedback before formally submitting the request. and uh and the developer and the city would uh essentially co-sign that application then go to the to the right of way but the any fees that would be paid to the district for those crossings would be borne by the developer not the city.

Thank you. Um December. Um okay. Um could regarding the December plan um could I just ask regarding plat 254 you mentioned that the easements being abandoned. Could you share a little bit about that?

Yes. At the time that uh final plat and Jacob can uh shed some light as well and and help me out. Uh at the time the final plot was under review. Um, Jacob discovered an an easement granted to Colin County. Uh, because the easement is not necessary and actually encroaches on lots that are to be platted and sold. Um, during the review, it was requested that they abandon the easement. They the developer reached out to Colin County. The county said, "Well, because the property was annexed, that easement no longer belongs to the county. Now it belongs to the city. Upon the direction of the city attorney, uh the developer uh put forward the uh was requested to submit an appraisal and the easement of uh meets and bounds for um the city council to review. This will be an executive session item and we'll present the the appraisal and the easement abandonment uh for discussion so that the council could then act on the ordinance and establish the fee that the developer will be required to pay the city for abandoning this easement.

I'll be working with our PIO team to get uh more participation and then uh I will be sending out an email for potential dates, but the intent is to have a joint planning and zoning commission and city council workshop, one in February u to review current progress and then in April to review the actual draft of the of the UDC. Now, I want to clarify that a UDC is not necessarily an entirely new code. is it's simply just bringing together three books and maybe actually four into one and there will be opportunities to address concerns where where maybe the city's not requiring enough and other areas where the city might be requiring too much and we bring those things down. So that it's a matter of finding a balance uh aimed at fulfilling the vision of the comp plan. primarily it's really attracting and preparing for commercial growth that we don't have but it's it's coming in the short term and we want to be prepared for that um that type of development here.

So for example, you mentioned setbacks. Um, one of the things that we will explore is actually less restrictive setbacks. Actually, our current setbacks are pretty relaxed and I believe as a city I have not encountered problems with that where where some cities say no that that's too relaxed. We got to re those in and make tighter setbacks. I am of the opinion that less restrictive setbacks um better allow residents to enjoy their property rights and maximize and use their properties that you know they worked hard for. Uh as far as landscaping um again I think it's about providing more freedom. You know some residents don't want to have a yard to irrigate every week and and spend you know hundreds of dollars in their water bill. Some do. So that the code the intent of the code is just to provide flexibility in design within limits but at the same time providing predictability to developers and the people who are going to use it. Um existing residents will very largely be unaffected by the UDC. They're vested. It will only be affected if there's redevelopment activities within those lots. So for example um say for example landscaping and we decide I'm just throwing this as an example and I put that in my written report. We say hey St. Augustine grass is not allowed because that is just extremely waterthirsty and somebody has bermuda grass and says hey I want to rip it out and put St. Augustine at that point yes the UDC kicks in and says no you can't have that

but that's those are limited instances. We're not going to go property by property, you know, across the street and say, "Hey, your current house doesn't meet UDC standards. You got to do something." That's not the goal here. And there are protections to protect existing properties vested in law. Next page. So vendor booths. This is what we're looking at. These are our six that we're going to highlight on. Local produce when it's seasonal. So, generally Texas season is in the spring and summer, a little bit in the fall, but that's more gourds and things like that. We're looking at doing baked and cottage goods, and I can go into detail about cottage goods and in a couple more slides, crafts and homemade goods, specialty or unique seasonal gifts, pet products, health and beauty products as well. And then we're also dedicating space to community tables. So being a parent here in Josephine, what I've noticed is it's very hard to find resources for my kids and very unless you're constantly searching social media or you just happen to hear somebody else, another parent say something. Um I have no idea about when it came to soccer, football, baseball. uh the only source that I had of knowledge is the YMCA and that's when I used to live in Leavonne. So that was the closest thing for me. And so with

So, if that has to involve vendors that are selling non-cottage foods, so that would be hot foods or foods that have a um time temperature control need, which is your hot foods, your salads, uh desserts, depending on what they are. Uh if they're a cottage food producer, they have to follow food cottage Texas law, which cottage foods include things like baked goods, cookies, breads, nuts, teas, spices, barbecue sauce, and pickled items. And so since all these have a high acidity, you don't have to worry about the possibility of someone getting sick. And then marketing and agreement fees. So vendors would sign the marketing and agreement fee with me. Um they would have the payment of the booth fees and commitment to attend scheduled market dates which I would work with the council to see what dates are available with you guys depending on if you have other events going on like if you have something for Fourth of July or if you have like a Christmas market that you guys are already in charge of. I wouldn't be the one hindering you guys from doing your own thing. Next page. So, how do vendors sign up? They follow the Facebook market book market Facebook page. They fill out the jot form and in the jot form, it has a verified if they're have their LLC, they would have to submit that information, the contact person, and then I would reach out to them, have a meeting with them, and see what items they're selling to make sure

We did not do that in this case. We were kind of Kimly Horn's responsibility ended once that contract was signed. Um, so at this point it's it's up to staff to kind of monitor those expenses. I signed off on a pay app seeing that there were trees involved and knowing that there were trees in the scope. I did not realize the extent of additional trees that were involved until after uh this was paid. The following month it was caught. Uh thank you Melissa. And we withheld uh that amount of money from the next pay app. So the contractors on board with us kind of trying to work this out, but essentially they pulled down trees before they had permission to pull down trees. So they were supposed to do a written change order that should have come to council first before any action happened out in the field. Um we don't have people that just sit there and watch them all day long. So and it happened very very quickly. So, one day they were talking about additional tree removal and then just very shortly after that the trees disappeared and then we're we're getting um um this kind of what we thought was pretty insane amount of trees removed and a price to go with it and they charged us per tree the same price that was in the contract originally. So, I think it was 1,500 a tree. Um so, I think we have some things to work out here. I think one, the contractor has some responsibility because he did not get the proper approvals. And two, I think there are some things that we can work through with our engineer to see if there are some cost savings that maybe the city can do, some things we might be able to alter that would help make up the difference. Um, so we want to work on those for the next month

So, I had a co a conversation with FEMA a couple of years back about um updating the flood maps and they they confirmed this past week that they're not on their own accord on their initiative going to redo all of the city's flood maps. Um what typically happens is um a development wants to come in. If it's going to have impact, a flood study will be done. Um that will be passed on to the city. Um and Jacob, if I get it wrong, let me know. Um once that's approved, you know, we've looked at it here, our engineers, our flood plane administrator. Once something is built, then those asbuilt plans get put uh sent back to FEMA once we've approved them. And then that will create like a letter of map revision and it'll alter one little piece of the flood plane map. So if you look on our the flood plane maps, you can see areas where um their numbers, you know, when things have changed. So typically these just get done in pieces rather than an entire city. Um I did get some information. FEMA directed me to the Texas Water Development Board and they work with the flood insurance people and they do have a cooperating technical partnership. Um I'm still trying to set up a call to see what's um can be done there, but so far they've just sent me some documents that are about 45 pages long and they're just to their suggestion was to make sure that our flood plane ordinance was as tight as it could be, which could be part of the UDC as we update it. Um I need to compare side by side what we currently have on the books as far as flood plane ordinance and what they've sent me. It may be exactly the same thing. Um, but that would be the next step. So, I can continue to do a little bit of research and I do want to talk to these individuals they recommended me to talk to. Um, but FEMA is not going to do it

It's taken on more water since we've added development in the city.

It's been very busy uh on the transition and we wanted to give you a little update. Um we are regulated under the Texas Commission on Fire Protection, uh which lays out a lot of stuff that we have to do. So, some of it is, uh makes it easy because it lays out a map. some of it is uh tedious because there's just tremendous amount of uh policies that we have to catch up on and regulations. So, we've done uh quite a bit of stuff already. Um as far as compliance, uh we have uh tested our hose, we have inspected our gear, we have cleaned the gear, um we have done our fit testing with SCBA. uh just a lot of things like that that uh bring us into compliance uh with the Texas Commission. And then they have about several pages I it's about six pages worth of uh things that they will regularly routinely inspect us on. So we're going through that. We're in the process of going through that and trying to get those type of things lined up uh as we speak. So um all on the personnel side, all our volunteer members have completed city applications. They have done their physicals. They've done drug screening and background checks. So, we've been able to everyone who wanted to come over with us has come over with us, which is fantastic. Uh we have uh hired the initial four full-time employees and we are now uh have at least one person on 24 hours a day. So, we're excited about that.

He have so far as far as equipment and, you know, heavy equipment. Um, I think, you know, we have enough to satisfy what we're doing. I think we're going to have some needs in the future, but I don't think I'm going to address them this quickly. Probably not even in the next budget to be honest with you. We do have an issue with a brush truck uh because we have a grant and we have to decide whether we have to get a pickup truck to resolve that. And I think we'll work that issue out. Um I think we're going to have to um on the long term, you know, my concern will be um training. Um my concern will be proper uniforms, bunker gear. Uh some of the state regulations. Uh some of these things time out. Um because that's the way the laws are written now. Like our SCPA, you can only there's just a fixed amount a year. gets 10 uh and then you have to replace it. So I think our biggest issue is going to be the long-term uh how do we face with all these things these constant costs that come at us. Uh and that's really what's going to be my next concentration is to try to work with Melissa on some of these long-term um you know expenses that we're just going to have that are built in that we have no control over.
