We have public hearings, council memo number 368-26, public hearing for a resolution approving an annexation agreement for 0.14 acres at the intersection of Elgin Avenue and Leach Avenue, A-2-26. I have a question about this one Jane I was going over the minutes from the meeting that they had on this property and when I'm reading the minutes the people that had this house and need to annex that property from the county and they wanted a shed so they could put a shed on it. So it's R2, which is single family, but now because it went to the zoning board or planning commission, it's now going to be R2 or R3, which is for multifamily use. So if they wanted that property just to build a shed on it, but now they have to put water on it, that tells me they're going to have another apartment building on that house when it's already single family in that neighborhood.

So, excuse me, I can clarify. So the property in question is a vacant piece of property, as you noted, and it's actually in the county. It's county zoning. So the property owner lives next door and they cannot put up a shed on Now because the county just like the city of Joliet We don't allow sheds or garages to be built on just a vacant piece of land. It has to go as an accessory Structure with a principal land use so in order for them to build a shed on the piece of land that they own next door to their house Which is in the city, which is zoned our three multifamily one to family residential

Excuse me. The house they live in now is R3?

The house next door is one and two family residential. So that way.

When I was reading it, it said it was R2. That's why I was questioning.

Well, the property next door is zoned R3, and that's where the house is.

It's R3 in the county, though, not R3 in the city.

But you said it was in the county. That's why they had an annexation.

The subject lot that is seeking annexation is zoned R3. I don't know if it's R2 county, but it's in the county. That's the whole point of the request is to the city is to consider annexing this vacant lot so that the property next door, which is in the city, can in the end consolidate both the lots into one pin and then move forward with a building permit through the city of Joliet to build a shed.

Yeah, to build a shed, not another housing, not to make it multifamily.

That's what it said. He wanted a shed. He didn't say he wanted to rent it out. But if you do that, and he gets all that, then you're changing it, according to what I was reading, you're going to change it to R23. I never heard that before, single family multi. His house right now, you said, is R3?

The house is R3, which is next door to the vacant lot.

Okay, that's not what I read. But that was a misprint, and you've answered my question.

So is he going to build a garage there, or is he going to have...

He's going to apartment. His plan is to build a shed. OK. Yes.

Well, that's where all the confusion came in. I'm like, wait a minute, R2, R2-3?

I mean, even if with R3 zoning, we don't allow someone just to go and build a two unit. You would have to go through a city council process for a special use permit, which is not at all what this person's asking. So they're just seeking to annex a vacant piece of land so that they can consolidate it with their existing house property To build a shed.

OK. Because it's my understanding that he lives in R2 home, single family. And you're going to annex that to R3. But OK, I understand. But I read it over and over and over again. And I thought, well, I'll just ask you tonight. So single family with a shed. But it'll be R3.

Yes, the property is owned R3. It's already R3.

Okay council memo number 371-26 ordinance accepting a three million five hundred thousand grant from the Illinois Department of Transportation for the Joliet I-80 Displains River Bridge community plan and amendment of the 2026 budget to receive and expend grant funds council number 372 hang on one second Jane can you just kind of talk about the uh what that 3.5 million is going to do

Greg and I will tag team, but I'll start. So the $3.5 million is fulfilling IDOT's, Illinois Department of Transportation's, original letter of intent that the city did sign back in, was it 2022? To they acknowledge that at that time they were going to commit 3.5 million dollars to construct physical improvements that had been previously vetted during the 2020 to 2022 I dot led um planning process for the south end neighborhood and then those neighborhood improvements which are a new walking and biking trail enhanced lighting for safety and aesthetics traffic calming measures along water street and historic plaque for reverend barnado park those were these these items are being further vetted through the i-80 disciplines river bridge community plan project that is about two-thirds of the way um completed so At this point in time, the state is ready to relinquish the $3.5 million to the city, and we need to accept the grant award and then amend the budget at the same time in order to be able to expend it. Greg, did I miss anything? No, okay.

So there will be a rendering or something to show what that property is going to look like once the bridge is constructed and all the changes are made?

So yes, there's renderings being prepared right now through our consultant firm, which is CDM Smith. One of the main renderings, maybe what you're referring to, is the multi-use path that's going to be constructed through this neighborhood. So the images are forthcoming at the next community meeting, which is tentatively planned in September.

Okay. Council Member number 372-26, ordinance amending the 2026 annual budget for the final payment for the Joliet Multimodal Transportation Center 1B bus station in the amount of $383,589.39.

Mayor, just clarification that once we pay it, we will be fully reimbursed for that total amount by PACE, by the RTA. Thank you. And we're coming out of city funds. Yep, thank you.

Councilman number 373 dash 26 ordinance authorizing approval and execution of the class action settlement agreement in Musa LV city of Joliet Will County case 22 la 334 consolidated with 22 ch 196 Do we want to have an explanation of this one from Todd he's pretty articulate I did it once today I can do it again

Yeah, this is the class action resolution of a case that's been going on for several years. It's how we administratively adjudicated our overweight and over-length truck violation or vehicle violations. There's a lot going on in this case. They have the intersection of municipal code, the vehicle code, city's ordinances, home rule municipality. But long and short of it, the settlement agreement is for a class action. The fund will be $2,039,786.79. But that's not the true amount. The true amount is $1,700. And the reason why there's a difference there is when you issue a ticket to truck drive anybody, especially if they're coming from across the country, you don't collect every dollar that you get in administrative adjudication. So some of those go to collections, but you don't actually collect it. When we received the lawsuit in this matter, we stopped issuing these violations. And at the resolution of the settlement, we're just not going to collect that extra $300,000. So the real number is 17. We have to pay for an administrator for a class action. And the class action will be from 2017 to current. The long and short of it, I won't go into everything about it, but what we didn't do correctly is our administrative adjudication ordinance indicates that any traffic offense requiring reporting to the Secretary of State shall be returnable to the Will County Courthouse. The traffic code indicates that if you have a CDL, basically anyone with a CDL, it doesn't matter if you're driving a truck or any kind of car, those violations have to be reported to the Secretary of State. That's been in the municipal code for years that I can go back. I've looked at public acts going back. So at the time, back in 2017, those had to be reported. So what we should have done is when we issued those overweight tickets, we should have filed those in circuit court. So this goes back, there was a case a couple years ago, Camacho, where the Illinois Supreme Court, they agreed with Jolietta on a lot of things. They said, Division 2.1 of the Municipal Court doesn't give us the authority to do this. Our home rule does. But we still have to follow our own ordinances. And that's the huge takeaway from Camacho is even home-renewal municipalities have to follow their own ordinances. So the long and short of it is we didn't have jurisdiction administratively to be able to take these people to court. And if I want to be clear, what these violations are is a gross vehicle weight rating. Every car has a vehicle weight rating. This isn't the kind of tickets where the police officers are pulling people over and actually weighing the car. It's just they saw trucks that were overweight and giving them tickets based on that. We prosecuted that administratively when it should have gone to circuit court. So typically what you have is under the Tort Immunity Act, you have to sue the municipality within one year. But because these are more of a refund claims, that one year does not apply. So for those reasons, I'm recommending approval of the settlement agreement.

Thank you. We're basically giving back the money that we collected in Mr. Steff during the whole process, is that correct?

Yeah, that's the long and short of it.

Can I ask John Lukanczyk to come up and talk about this? Because I'm still getting a lot of calls about this. Would you mind just giving a brief explanation for everyone at home suffering through this? Yes. Thank you.

Mayor, council, thank you. Last council meeting, I was called right afterwards by Chief Garrett from the fire department. said we need an emergency plan for this water district. I started working on it that night. The following day, I was in contact with utilities and we started coming up with a plan of how we were going to address the issue. I met with Allison and her team on that Friday. We had the basics of a plan already written. By the following Wednesday, I was in contact with the Joliet Park District to try to get the Bonneau Park facility for showers if they had an extended water main break. By Friday, we had the intergovernmental agreement written and submitted it to legal. Now, we have the basis of a plan of being able to get folks at least emergency water, emergency showers for extended water loss. It's in progress. By the time I think Allison, the meeting is the 30th, we'll be able to enact the plan to start getting people the supplies they need to have potable water stored. So from the moment I got it, we've been working on it. So we do have the basis of a good plan right now. But if you guys have any specific questions, I'll answer them as best I can.

Whose meeting is that on the 30th? That's the city's meeting?

Yeah, that's the joint meeting with the city and the county that we're hosting at Knoll Park at 6 o'clock. okay and the residents that are suffering through this are welcome to come oh of course that's the intent is to update them on the plan that that John has worked on and then other information about the the water system and the plans we have for the improvements so we'll be handing out door tags later this week to provide notice to the residents I also was in contact with one of the residents who utilizes the Preston Heights Facebook page and he'll be posting it there also

Just for the record, we did have a meeting at City Hall last week with the county to try and make sure we can move this along, make sure that it's as user-friendly as it can be for the situation that we're all in with those folks. So we are definitely working hard to make sure that we can accommodate anything that comes up. Thank you.

Hello, my name is Carol Gates. Up here to the front of our nonprofit organization that was an event that was supposed to take place on Friday that was canceled less than 24 hours citing some type of alert from health issues, but I never heard of anything being canceled in Joliet otherwise than her event. And I'm trying to see what can be done to allocate that she return the funds to the people, because she's holding the money. And I feel that it is theft by deception. And that's what I'm here asking questions about. If I was here long enough, I'd file a civil complaint in court. But I am here from Atlanta, Georgia. So she cannot dictate when, you know, I can come back to an event that she's giving. I would like my money returned. I want a number for the people that have contacted me to have their funds returned to them.

This is a non-agenda. We just want to do a presentation that I just wanted to give for someone here that was very special to our community. And Susanna Alvera. And it's going to take less than five minutes. So I want to go ahead today. Speak up. I'd like to present something to you today.

All right. We are presenting a Certificate of Achievement and the Margaret Grades Humanitarian Award, the Community Servant Award, to Councilwoman Susanna Ibarra. The Servant Award is presented to someone who serves this community with love, purpose, and without bias. To someone who stands strong even when standing alone. To someone who speaks up when others do not have the courage to speak. To someone who answers every call and text no matter the time of day. to someone who rarely misses attending events, not only in our own district, but across all districts, without prejudice. Most of all, this award honors someone who stands firm in hearing the voices of victims' families of Break the Silence, Awake the Truth. Although no one can replace the pain of losing a loved one, We focus on working with those loved ones who are found in the river, and we know that Susanna helped secure safety cameras along the bridge. We applaud you for never turning a blind eye. This speak-up award proudly recognizes Susanna Evada for her humanitarian service, community outreach, and unwavering commitment as a servant leader.

And in reference to that, we wanted to say... We just wanted to read off the names of the parents that lost their loved ones in the river because they are not forgotten, especially what happened to Nolan Wells. So we're just going to read off the names, Lonnie Jones, Michael Hollins, Akeem Kimball, Diego Santiago, William Morita, Eric Cotter, Cesar Rose, Anthony Dunn, Doreen Smith, Robert Britton, Quentin Fahey, Kevontae Williams, and Jason Bigham and Robert Long. And in reference to that, we know that you lost your daughter. You had a lot of things happen. So while you're sitting at the table, Cesarine, I would like to give this to you.

And then, you know, one more last thing. We want to introduce our new Southside chairman while we're here to help with District 5, which is Dr. Glenn McCullough.

Good evening, Mayor and Council. We are so excited. My team and I are here, part of my team, to announce the launch of the Southside Community Impact Council, an initiative of Arise Community Development Corporation. SCIC is designed to bring residents, community leaders, organizations, businesses, and stakeholders together to strengthen and transform our community. The SCIC is established with a simple but powerful belief, and that is those who live in the community should have a voice in bringing together the legacy of the past as well as take part in shaping its future. Our purpose is to create a collaborative platform where residents not only can identify challenges, but also be instrumental in developing solutions and work together to improve the quality of life for everyone on the South Side. The Council will focus on key areas including community engagement and resident leadership, neighborhood revitalization and beautification, youth development and mentoring, housing and economic opportunities, health, wellness, and public safety, education and community resources, just to name a few. As an initiative operating under the umbrella of Arise Community Development Corporation, the SCIC will serve as a resident-driven advisory and action council dedicated to promoting positive change, strengthening partnerships, and ensuring that the voices of the community are heard. Today marks more than the launch of a council. It marks the beginning of a movement. A movement where residents move from being observers to becoming active participants in creating the future they desire to see for their neighborhoods. We invite each of you to become involved and to attend and share your ideas. We call upon the council for your support. And we recognize that the future of our community is not something that happens to us. It is something that we create together. So we thank you for your anticipated support as we develop this council. On another note, I'd like to respond to or address ordinance number 37126, where the $3.5 million is being allocated toward the Des Plaines River Bridge project. And I would ask that Some of those dollars could be allocated to repair sidewalks in that area of where the Southside Council is going to be meeting. As you all know, I am developing a community center at the corner of Des Plaines and McDonough Street, and the sidewalks are in terrible condition. And they provide a safety hazard for individuals that are walking the sidewalks. I was told that we would have to develop our own repair for the sidewalks. So I'm asking if that part of that money for the three and a half million dollars for that project that's going to go all around where we are situated, if some of those dollars could be allocated to repair the sidewalks that are in that area that will service the residents greatly. Thank you so much.

Council members, administrative staff, fellow community members, on behalf of the steering committee for the Pan-African Alliance and Collective, I extend to you all our greetings of peace and friendship. For those who already know and for those who don't know, I've been an active observant participant in these proceedings dating back to 1990 through to about 2017, so that you all know that I'm not new to this, I'm true to this. I'm here today for two reasons, but for the record, before I proceed, I would like to know by a show of hands how many members of this council are standing on their public oath of office, with the exception of me, for the public record. Can we get a show of hands? I ask that question because I want to make sure that The council members who have taken that public oath of office are here to protect the constitutional rights and the U.S. constitutional rights, Illinois Constitution and the U.S. constitutional rights of the people. Some time ago, I attended a gathering at the museum down the street where the attorney general presented this report that they had conducted. concerning the behavior of various members of the department of the local union of the fraternal or the police council. Some people call them police. I call them local enforcement, ordinance enforcement officers. And it took me a while to read this entire much better manual. But they have some recommendations in here concerning what should be done to correct past acts of constitutional abuse, police misconduct, things like that. Though they didn't provide a remedy for the people who had been victimized by the One of the individuals who decided to become a participant in our program came to me. He's a manager at one of the bars on the east side. And he informed me that some of the local ordinance enforcement officers, AKA police, had been stalking the place where he works at. And that they subsequently pulled him over after he was leaving, tried to get him for a traffic violation. Then they asked him could he search his vehicle, granted them the right to search his vehicle. And they claimed that, you know, they found some cocaine in his vehicle, subsequently had ship and thrived upon the land practically maritime long, called the Will County Courthouse. Anyway, they issued him a citation for a couple of offenses. And as we know, or at least we ought to know, that the Will County Courthouse is county state courthouse. So it seems like the only people that could bring cases over there is the sheriff, via the Will County State's Attorney's Office, or the state Now, these citations, and I sit in this room and watch the various administrative hearings when the local ordinance enforcement office has written people up with citations. And they write them up with citations, yet... Sir, your four minutes is up.

Please...

Yet they send this information over to the state's attorney's office to have them prosecuted in the Will County Courthouse. And I said, okay, if this is... local ordinance enforcement officer writing a citation, and they have administrative hearings in this room, then why is those very same individuals shooting complaints over to the state's attorney's office to have them prosecuted for an offense under the name of the city of Joliet? Now, the city has an anti-discrimination ordinance on the books, been there for years. develop faith and confidence in the partiality and the fairness of the council. Well, that's not being practiced. So, as a recommendation, I suggest that you all thoroughly read this book, this manual.

It's thick.

It's going to take you about a good year to read it word for word. Alright? And when you think about being subjected to a form of police misconduct and take the appropriate action to provide the remedy to prevent the people from, again, filing a class action lawsuit that will hurt the pockets of the city. It might even bankrupt the city. So I want you to take that into consideration. Pass that information on to the county government. about what I've shared here. And let's keep in mind that everything changes all of the time. Nothing stays the same.

Is there anyone else who would like to address the council this evening?

Even all of you, mayor, council members, all of the community workers. I am Dr. Curtis Bryant. I'm the senior pastor of Mount Zion Baptist Church here in Joliet, located on the east side of 402 Singleton Place. I mentioned that first by saying I extend my gratefulness for the city's partnership in helping us, but we've had some water issues, especially with draining. I'm glad those things have been added to the agenda going forward. However, the water issue is bigger than just our building. I'm staying here to represent some voices and asking some questions that have been alerted to me and my attention in regards to the plan that's been in place to help with emergency or contingencies for those who have been gone without water for some time. I want to stand and ask the question and also make myself available on record to know details of the plan, For instance, how soon would we have access to emergency shelters, excuse me, emergency facilities? Secondly, what's to happen in the meantime for anything that may happen between now and the 30th, as I understand, that's when the next meeting is scheduled to know what's the next step. So what happens with our community members in the event that things go without? Again, I want to be standing here as an interested person not just member of the community, but someone who wants to have resolution, and our hands have been tied. Our building has been suffering. Our church building has been suffering with water issues. For our water pressure to drop ever since things have been switched over to City of Joliet. So even when we want to open our doors, when other people have no running water, unfortunately we can't open our doors because we don't have any running water as well because the water pressure drops. The community is, I think the issue may be bigger than what we may have thought or imagined it to be. So I certainly want to go on record to say this is something that I hope will have some kind of fast track in terms of all the water main repairs, the breaking, whatever the case is. But people really are suffering. And at this point, I represent not just our building, but the block. And that is not building our church, but our community. Not just our congregations, but everyone's constituents. So please, again, I make myself available. I will be hanging around after the meeting is over. So someone could please fill me in some details. How soon will these things be replaced, repaired, and in the immediate moments where we're trying to determine what the next step is with the plan will help me let my people know exactly what are they supposed to do when they're waking up in the morning and supposed to be reporting to the work and they can't even wash up. So I want to go on record to share those comments, those concerns. I make myself available. Thank you.

Is there anyone else who would like to address the council this evening on a non-agenda item?

I got questions here. You know, I just cannot get over this thing. I keep on stewing on it because I'm the one who goes in and victimizes everything. You know, I ask this question, how does anybody get away with tearing apart a vehicle that's not in their name? If the car belonged to Mayor Terry Darcy, if it was in his name and somebody else tears this vehicle apart, how would Mayor Terry Darcy feel if his vehicle got taken and got stolen and then torn apart and then lied to about where it was at and everything and got tore apart? And then when he gets it back, he finds it all tore apart and he hasn't paid any storage fee and everything like I had to do. I'm trying to get back my mother's pickup truck that was in my mother's name that's was taken from the estate, and somebody named John Byrne had it and tore it apart. I had to hunt that truck down. I was lied to about that truck and everything. And when I got back, of course, and it was to say after the CARFAX report was finally done on it, and we found out that that guy did have this truck and tore it apart. But I still stuck with the storage fee I had to pay and everything on it and everything. And as far as trying to do civil action about it, I tried to get attorneys, because of the Julia Papps and everything, not just Julia Papps, but all of this, the Wilkeye sheriff and even the state's attorney got bad reps on me with my life record, you know, bad reps. I found out from my one doctor, Brenda Jones, when she told me she had all this rap sheet about all the police departments saying bad things about me, you know, in their little police reports. So I got this bad rap sheet, yet I'm not the bad person. I'm not the one doing all this illegal stuff. But yet, I got the bad rap sheet put on my record by them all, because they each put their little notes in and whatever they want on me. They even got me, like, Will County Sheriff told me that I'm a metal case. When I got yelled at by hierarchies from the high-ranking officials from Wilkie Sheriff saying that, oh, I've got a mental issue and I'm not going to get medical treatment for them. It's like I had to tell them and yell at them that I have been under my doctor's care since 1997, since my auto accident. Regular medical assistance for my injuries from my auto accident. So I haven't seen a doctor ever since 1997, since my auto accident. So that crap and bad rap of me being in a mental case is not false. I mean, it's not true. They make all this stuff up. But my rights just keep on getting violated and everything. I have my car stolen. What do state's attorneys say? State's attorneys say that ain't no crime. Yet Craig Martin was just arrested for stealing a car. You know, he's going to be prosecuted. And they had Robert Hernandez got arrested for violating that stalking order. And I don't care what Julia Brown says, oh, but they had a warrant out for his arrest. The feds had a warrant out for his arrest. Well, he was already arrested before. Why didn't they just keep him in jail then for his previous drug violation? But still, he didn't do anything different than my attacker did to me. And I violate my alert protection I got against my attacker. I stew on this because I still ain't get no action on it. Yet other people get arrested for the same thing. And there's another case with two of my McDonald's friends, my longtime McDonald's friends, one attacking the other one. And he'd been charged with domestic battery and everything by state's attorney and everything. But me, when I got attacked, I didn't get domestic battery charges. It's just my rights keep getting violated. And it's all because of all this bad rep everybody keeps putting on me, all because of the abuse that I've been suffering because of industrial development it's done to me. And I'm tired of the abuse. And it's taking a toll on my health.
