Good evening, John Argadelis. I'm here on the whimsy trucking matter, and this has proceeded through the process and has been supported at the PCC and Planning Commission and staff. We've worked with staff quite a bit on this, and it's It's a adjacent to an existing project that whimsy owns already off hobo There was just one issue that came up. I just want to make you aware of it So for your consideration as we go through tonight and tomorrow night and that was the issue of stacking of containers We had requested to be able to stack three high staff did not support that and it was not supported at any level prior to the board of the council here and And I just wanted to give a little rationale on why we're requesting this and we are still requesting of the council The property if you pay attention or you will pay attention when you see it There's a back third of the property that's cut off by a gas pipeline We tried to get permission from the pipeline to put a asphalt over that so we could use that back portion of the property They were not willing to work with us in that regard. So we cannot access that back triangle And you'll note this, and I'm sure you have already. The other issue was staff had asked for a pretty significant setback on the roadside, which we agreed to. So what that does is with the setback and the loss of that back third, it sort of leaves us with a lot less land to use. And we feel, based on the volume we're going to have, that we'll have Short-term stacking this will not be long-term stacking. It's just a day or two stacked and then things move in and out And there is a history that the city the council has approved stacking three and five high in some other cases There's a case on 3751 Cedar Creek Drive This is from 2016 there's more some more recent cases there was a 22 case for trying an address for you here but in 2022 in November you approved stacking I believe this was a center point one the 3350 Shanahan Road Project so it's not unprecedented what we're asking for Joliet's done it before and we ask you to consider this tonight And tomorrow as we go through the process, so I'll stay for questions, of course later. You all know me. I'm Kathleen Garthus. I used to live on this property at 236-56 South Hobo Road. This was my mother's property where I lived most of my life since I was 8 of 8. I, of course, got taken out of this property because of whimsy. I say you relax. I wasn't allowed to be part of any of the negotiations on a price. I wasn't even allowed to know who the buyer of my mom's property was because they wanted to keep that all a big secret. Even though I had talked to whimsy, tried to find out who was trying to buy my mom's place, I talked to whimsy people and I was told that they had no interest in buying my mom's property. That's what I was told by various people. whimsy workers, but of course, they didn't end up buying it, which was, like I said, a hell of a big secret. I wasn't even part of the game. We had no negotiation. We didn't even get to see the sale contract thing until after it was sold. I don't know who the buyer was until after it was sold and everything, and the attorney that they represented, Mr. Mazardayat, that they had used on the eviction of me to where I wasn't even served an eviction notice, And so I didn't know about the eviction at all, since they didn't serve me right or anything. They figured they just put it in the Herald newspaper, which they knew I didn't get the Herald newspaper either. So I had no idea about the eviction. And they ended up getting their default of judgment on me, because of course I didn't know about it. I didn't get to show up for it to defend myself. but that Mr. Mazar had did that representative whimsy trucking on it. He knew at that time at the eviction that he had the money from the estate. I didn't get my share of my Ma's estate money in my hands till still, you know, so I'm still waiting and everything about getting that settled and everything. And with all that time with him, Keeping the money and keeping me from giving my money and keeping me from getting another place. They of course stole everything on the estate. I have my $20,000 mower that I got from my boss like two months before he died, which I was using to take care of the place, which I think whimsy is using now to mow their lot down there next door to the trucking terminal thing. I took my ATV, all my other vehicles. My Jeep that me and my ma share, my ma's other truck, and they took this 1987 F250 pickup truck, which they hid from me, and lied to the attorneys, and my attorney even said that truck was crushed, and it wasn't until I had the CARFAX report done that they found out that somebody had that truck. A guy named John Byrne had this truck, to which somehow whimsy gave this guy, you know, John Byrne's got this truck from whimsy trucking. And he tore that truck, needless to say, up. It was a mid-condition truck. But I had this whimsy trucking people after I found out it was them that bought it. They're threatening me about getting out. They even came when they tried to do their own eviction on me on January 16th of 2024 when we had the sub-zero weather, when they smashed the back door of the house in. The back door, and they threatened me. They said, you got to get out because we're going to bulldoze this house tomorrow. Well, the poor sheriff were called out, and the sheriff found out they didn't have no permit to do it, and they didn't even have the right to try to do their own fiction on me without using the whole kind of civil processing. The Will County Sheriff told me, you know, what they did was illegal, but I wanted to have charges filed. Of course, I couldn't, you know, they wouldn't do the files, you know, file the charges for me or do a police report for me. But I had to go back in the house with the back door wide open, and there's some zero temperatures coming in the house, and, of course, the pipes burst, and the water got down the furnace. But it's kind of ironic. They wouldn't do storage for me, but I had my 40-foot storage container there. It was loaded, and they busted in it and took everything out of it.

Thank you very much. Mayor, City Council, good evening. Item number 313-26 is an application for a Class C liquor license for Love's Travel Center. A Class C liquor license authorizes a sailor's pack of liquor for premise consumption. Love's is a truck stop and is adding a packaged liquor store with a separate entrance in its gas station and truck stop. Liquor commissioners reckon approval of this license. 314-26 is an application of a Class B liquor license for Six Corners Tavern at 753 and 753 and a half Ruby Street. A Class B license authorizes sale of alcohol for premise only. There has been a bar slash restaurant in that location for many, many years. The new owner and owners of the building are planning to open a restaurant similar to their other restaurant, the Happy Cafe in Sherwood. The liquor commissioner is wrecking approval of this license. Item 315-26, an application for a Class D liquor license at El Sabor Latino at 2356 Essington Road. A Class D license authorizes the sale of beer and wine only on premise. The restaurant is currently open and owners would like to add beer and wine consumption to complement their food. The Liquor Commission is recommending approval of this license. Item 316-26 is an application for an issuance of a Class B liquor license for Cork Lounge and Kitchen at 2303 Essington Road. A Class B liquor license allows the sale of alcohol consumption on premise only. The owner replaced the reopening of the Cork wine bar after buying out the previous partner. The Liquor Commissioner is recommending approval of this license. Item 317-26 is a resolution to deny the issuance of a Class E liquor license for Lagos Grill and Lounge at 3109 Theodore Street. A Class E restaurant hotel license authorizes sale of alcohol on premise only. It's not allowed for Peyton to be served at a bar. Liquor Commissioner is recommending the denial of this license. So they changed the ordinance ownership Correct. That's why they yep. Yeah, they changed our seven had to reapply so it's new owner So that's the our normal process is a transfer and then it would change it So it's new ownership and and be a new LLC and then new Information from the state as well. OK, moving on to Council Memo 31926, public hearing for a resolution approving an annexation agreement for 23656 South Hobolt Road. This is Wimsey Trucking. We have public hearing then under ordinances and resolutions ordinance council member with 321 26 ordinances associated with two three six five six South Hobart Road for an annexation and zoning classification to light industrial which is I won. Council Member 32226, ordinance is associated with 23656 South Hobolt Road, approving a special use permit to allow truck parking and compressed natural gas fueling as an accessory component and ordinance approving a variation of use to allow above ground fuel tanks for compressed natural gas fueling in the light industrial district. Council memo 323 26 ordinances associated with two three six five six South Hobo Road an ordinance approving a special use permit to allow container storage and stacking and Ordinance approving a variation of use to allow container storage and stacking up to three high in the I won light industrial district this was voted down by the zoning Board of Appeals five to zero And I should note that light industrial I-1 zoning for us doesn't allow stacking. We're also passing a special use for them to be able to have stacked one high, but we do have residences near there that the staff and Zoning Board of Appeals took into account when thinking about whether or not it could be stacked any higher than one.

The person who spoke tonight was present at the other two meetings, but there were no other residents present. If they received emails or things, if that's, I don't know that. But present at the meeting was just the woman that was here this evening. So we didn't have residents here.
Yeah, at first I was a little cautious about it. I was like, eh. Because I know there is some residents around there. But I took a drive down there today, and you have Con Global down the street from there, G4. Everybody's stacked up to five high. So I think having three stacked may not be, huh?

Yeah, so there's a few locations that are stacked up to five high. I've counted them, and I don't see... This one being three high being a huge problem. So The other stack five higher they approved to stack five high I
So as Mr. Argadel said in the beginning, there are other locations where exceptions have been made for this. They're in areas that are largely industrial with no residential surrounding. But it has happened before. It has.
To be fair, one that he cited in particular, Centerpoint, is completely contained within Centerpoint. So nobody really sees that. We don't want this to look like Detroit, Michigan, in my opinion. And the compressed gas, thank you so much, by the way, the compressed gas sounds so dangerous to me.
From what I understand, that's a pretty routine function. I don't know if you want to answer or Dustin wants to answer, but maybe give the councilwoman a little more information on that.
Yeah, that's kind of something new to me as I was representing the client here. And it's like a small cart that has the tanks on it so they can fuel. the vehicles it's in you know many times you have that like set tanks that are on a site that like a gas tank but that's a that's a compressed gas product and it's you know it's regulated by the epa they have to follow all the safety rules just like any other fuel use but this one it would be a movable cart but it is shown on a site plan as located on one certain portion of the property
Okay, so they can't just go down the street to the gas and wash? It's less than a half a mile?
It's not like gasoline. I don't know what they have at the gas and wash. Is it natural gas? Yeah. So it's like a propane tank on your grill, if you will. A little more sophisticated than that, but it's compressed gas. It's not gasoline or anything like that.

One more thing. Oh, sorry. Yeah, do you know how big is that warehouse that they just built right in front of that property? I completely forgot about it, so right now. It's either 600 square feet or a million. I don't know, maybe staff can help you with that. Does anybody know by any chance? I'm not sure the answer to your question.

So the reason that the Planning Commission voted it down was it solely because of the stacking issue The Zoning Board of Appeals voted 5 to 0 to not allow stacking But the rest of it they were good with And please correct me if I'm wrong here.
That's accurate. So the Zoning Board of Appeals, there's layers to the onion, right? They voted to approve the annexation. They voted to approve the classification of zoning to the I-1. They voted to approve the compressed natural gas they voted to approve the special use for Container storage they did not vote to approve the request for container storage up to three high A few
Councilman Marino, you know if he's seen him five high, you know I think we need to go look and see if they have a legitimate I don't recall ever having We fought this a long time ago I do regularly remember approving a couple times way in the heart of Centerpoint the three high stacking
And I did discuss this with staff earlier to make sure he gets someone to go out did you get any answers we do have Regulations that do allow five high in some locations. We have gone out there and we did talk We did find some people not complying with zoning and they will get notices of violation. I

Thank you I took it right out there Sunday and There are two large residential homes on either side of this project. One just contiguous to the north, and one down a little bit south and west of it. And I think that might have been the reason, the optics of that, for the lack of stacking. think there has to be some consideration for the people have been out there long before whimsy trucking so that's why I took a ride out because I did see three high and five high but in places that were completely surrounded by other industrial users so these have and if we threw a Google map up there you could see one of them is probably a 20 acre with a pond in the nice house and the other ones tucked in the back I didn't drive back there but I think And I could talk to a few of the people on zoning and get their thoughts. I'm going to take a look at the meeting, but that might have been the premise in which they decided one high was fair.
I just have one question, and I think that I'm correct in this. We are voting separately on the stacking. Okay. Yes. I just wanted to make sure.

Yeah, I mean, I'm a little torn on I agree with the Councilman Marino, you know, there are other Locations that have stacking what you bring up a good port mayor. There's two residential homes that that are there But you know, that's what that's what this area's has become I mean Now we're going to hit the brakes. But you bring up a great point. You've got Marcio and the other family that live out there. Maybe I think they're for sale or one of them's for sale. Maybe down the road we could revisit this again. But I think it is fair that if others are doing it, I hate to say no to this gentleman and this company, but you do bring up good points with the two residentials there. OK, moving on. Council Memo 32426, ordinance repealing a previously approved variation of use to allow the reduction of a five-unit to a four-unit residence, an R4 multifamily use in an R3 one and two-family residential zoning district. So the petitioner has stated in their application that they're planning to convert the existing but vacant four-unit building into two larger buildings, which will match the neighborhood around it a little bit better. Council Member 325, 26. Excuse me. Sure. Sorry.
I have a question. Yeah, no problem. This is a little bit confusing to me because I read it over and over and over again, and I did read the minutes. So they want to reduce the five unit, which was previously... The four unit. The four unit. So you're repealing, because the way I read it, you're repealing the five unit to be down to a four unit. So you want to make the four unit so they can make it a bigger place. Okay.
No, so what they'll be doing is apparently it's a five unit and they were gonna reduce it to a four unit Residence it for the zoning purpose, but what their ultimate purpose is to turn it into two Units to make bigger the two bigger instead of five so I was reading too much into this because it didn't make sense the way it was worded And that's why I wanted to make sure they weren't gonna make it bigger again I wanted to make sure they're gonna make it down zoning yeah no they stated that by having two units instead of four they'll be able to make the individual units larger and the building would be more in character with the neighborhood gotcha thanks for clarification sure no problem council memo 325 26 ordinance amending the 2026 annual budget for the city of joliet i believe everybody talked to todd i don't know if anyone has any questions on that one Council memo 326 26 ordinance authorizing the execution of an intergovernmental loan agreement with the Will County Exposition and Auditorium Authority the Rialto Square Theatre Any questions there Yeah You know they're two and a half million dollar loan Why are they not going to or two million dollar loan?
Why are they going to an outside source?
So we did talk to them. We actually tried to assist them to find outside financing. A number of banks wanted a guarantor or additional collateral. So the market didn't support them getting a loan.
So we're going to risk our money on that?
Wouldn't say we're risking our money what we're doing here is so They started all these capital improvement projects and then they got caught up with the whole asbestos thing last summer that shut them down for a while so they did have the money to cover all of that but for the asbestos which now they're in the middle of a lawsuit with the asbestos company that they anticipate to soon resolve, but what I'm saying is they may not need it at some point. But for now, it allows them to continue with their HVAC Replacement that they're doing now it'll allow them to continue to do that So we don't lose any more time with them shut down. They are like the economic direct driver of downtown and we're just essentially giving them loans into the future that we get usually given like five hundred thousand dollars a year four hundred and fifty four or something and so that we just be advancing those grants that we usually give them year for year into the future and they be using some of the money they received before but as soon as they right yeah
So it's an advance on the grants, not a loan. Correct.
That's right. But also, more importantly, they're seeking legal remedies for their asbestos remediation costs. So to the extent they receive those, the loan either has to be paid off or it will reduce the outstanding balance if the loan hasn't been drawn on yet. So first will come from any proceeds they get from the remediation that they're able to recoup. And then if they do need the loan, then there will be draws on it based on eligible construction costs. The repayment is basically $475,000 in balance forgiveness, recognizing that those would replace future capital grants that we would give to the Rialto.
And that's assuming over the next six years that a new council, even beyond us, doesn't vote to not fund them anymore.
Correct.
So, again, we're back to we're giving a loan to an entity, okay, that the banks rejected as not a good risk.
Well, I don't know if it's a good risk. The Rialto is a unique unit of local government that does not have taxing authority. And so because of that and the historic nature of the building that a bank is not going to foreclose on the Rialto Square Theater, that it just, and I want to speak for the banks, but they couldn't get it through the credit committee. They were looking for someone to get, whether it was us or the county, to guarantee repayment.
Well, and the credit committee for any bank, they have a sole purpose, and that is to weigh the risk. Credit risk, that's it. And you're saying they couldn't get it through the credit.
Well, I'm saying, I don't know exactly why, whether it was credit risk or just not familiar with the entity and how it operates.
Thank you question I've got Kevin on the bottom of this it says the rail to a seeking reimbursement from the contractor I believe they're asking for two million is what they spent So whatever they get is paid back to us immediately, correct? He actually says within 15 days of receipt it comes to us a so then the balance would be reimbursed to the city based on the grants that we've agreed to at 475 I'm sure they're going to get something. I don't think they're going to eat $2 million on this thing. But I agree, Larry, that a bank wouldn't lend them the money, but I've been in banking, and I understand that their scrutiny is a lot tighter, but this is an entity of the city of Joliet that we'd all hate to lose. So what do we tell the patrons of the city of Joliet if we don't help them with this bridge to get across to get this HVAC done and in place? It wasn't their fault. They budgeted for this the right way, and they got thrown under the bus with this doggone asbestos mess that they had nothing to do with.
And the Rialto will be here tomorrow as well. But some additional context related to this. Their HVAC was basically hanging on by a thread and at risk of failure at any point heading into the summer. They had scheduled this and lost a lot of shows due to the asbestos. And so when this window came up, they needed to maintain the window or risk actually closure because they didn't have air conditioning. And so because of that, they wanted to keep on schedule. They are a major driver. And when they were closed last time, we felt it downtown. And so that's where the request came in. They wanted to keep the project on schedule so that they didn't risk losing shows because they couldn't keep the building temperature controlled.
And this is an interest-paying loan, correct?
Correct.
Okay. They're coming in tomorrow to talk a little bit about it?
So they'll be available tomorrow at Finance Committee and at Council. Okay.
Under resolutions council memo 328 26 a resolution approving a new grant and previous grant extension to the Will County Metropolitan Exposition and Auditorium Authority Rialto Square Theatre so I was I was talking about before that The grants that they received in 2024 and 2025 are going towards the HVAC Now there's shut down from now until September and then Approval this resolution would extend the 2024 capital grant with an expiration date of December 31st of the end of this year Which they'll have the work done by then so essentially we loan them money earlier But because of this delay with the asbestos etc. Now we're just they didn't use the money So now we're extending the timeline so they can use it for this project. I
mayor let me clarify um either your beth or kevin sure so the 2024 we gave him 475 right of course we switched several years ago and that was uh you had a big hand in doing that kevin so that they had to do it based on actually doing capital improvements so how much of the 2024 475 is left
$475,000. That was the first capital grant. They allocated that for their HVAC project internally, and to their credit, instead of spending it somewhere else, they maintained that and said, no, we want to save that for this HVAC project that got delayed. It was supposed to have happened, was it last year? Last summer. Last summer. So we wouldn't have had to come to you to extend it, but because it got delayed, that's why we're asking. But all of that $475,000 will be applied to this HVAC project.
So it's money that we already approved. I got that. That's correct. And they didn't, because of a comedy of errors on the contractor side, didn't use. And if we don't approve the extension, then it just gets absorbed by our, you know, what do you call it, our... Can't think of the word. Reserves? Thank you. It's become part of the reserves. The money's there already.
That makes sense.
