Moving to new business. Um, this is a general announcement. The uh planning commission meetings are generally quasi judicial in nature. All decisions of the commission will be based on competent substantial evidence including testimony provided in the meeting. Any person who is not an applicant or agent that wishes to speak will need to fill out a speaker card act located on the side table by the door and turn him into the city clerk. Each member of the public will be given three minutes to speak on each item. Please refrain from speaking from the audience, although I don't think that will be a problem today. Um, and applause or cheering will not be allowed. And please silence your cell phones. Can you please read the application by title? Can we please have the report for PC14-25?

Yes, you may through the chair. This is PC14-25. It's a conditional use application uh for a property located at 500 South 3rd Street. Um the conditional use application uh is to allow for automotive sales to be conducted in an office space in the C1 commercial limited zoning district pursuant to section 34617 D2 of Jacksonville Beach Land Development Code. The subject property is located in the commercial limited C1 zoning district and the subject property is currently in use as an office building. The request is to use one of the suites uh as an office for the buying and selling of cars at auction. The LDC does not distinguish between car dealerships with on-site inventory like car lot and auto sales do not include on-site parking of vehicles and sales. This is due to the fact that the state licensing for automobile sales is the same regardless. So they are regulated the same under RPC. Therefore, even though the applicant will be using the office space for buying and selling cars, it will all be conducted over the phone and virtual activity and no cars will be stored on site. From a practical perspective, uh the use is substantially similar to other office uses within the same property, but due to the nature of the product, they are uh treated as auto sales under the code and required to get conditional use approval. The subject property itself was constructed in 1987 as an office building and has been operating continuously as such. Uh it is not anticipated that the use will increase the traffic to the site uh as it will simply be an office space for the applicant and any staff they may have. Um although technically a change in use because of the classification is auto sales practically it will not change the nature of the site no changes to the structures exterior exterior are planned and any alterations inside of the le space will be minimal. Uh this will not be an intensification of the use of the property. Surrounding uses are as follows. To the south and adjacent is an existing multif family structure. To the east across the parking lot and adjacent is a vacant

commercial lot. To the north across Fifth Avenue South uh is an office building and to the east across Third Street South is a large multif family structure which we have here. So that is our uh subject property there with their existing parking and then um this would be third street here. So right on the main drag. Uh based on the information included in the application as well as the reasons outlined in the staff memo, planning department recommends approval of PC 1425 for automotive sales with the condition that there be no on-site storage vehicles. Uh, I just need to records there. If I need to operate out of there in terms of finding cars, I can do that. Um, every vehicle is going to be bought and sold exclusively through auctions, dealer to dealer sales. No public sales will take place per the license. I can't sell to the public. Okay. Thank you. Um the first one uh the clerk's office is going through basically a a records purge reorganization and in the process they discovered uh the October 22nd 2018 planning commission meeting minutes were never voted on or signed and so they are asking that we bring that to you guys at your next meeting so you can officially certify those minutes. Um you are the acting body even though I imagine none of you are here. Maybe maybe Mr. But um

um so we'll have that on your uh next item for or next meeting for business which will be possibly yeah uh so that that will come back to you in um October. And then the second item, uh the second meeting this month will be a training workshop uh conducted by myself and the city attorney. Um the planning director may come, not sure about her schedule, but um we're going to be covering a lot of the basic stuff with regards to sunshine law and um Robert's water, you know, proper disclosures, exparte, all that kind of stuff. So, um I have not uh done training with this city attorney, but I he's very confident and probably talks a little slower than Sandy Richmond did for those of you that were here.
