Um a request was made for curbing uh along the the areas in the front as well as additional landscaping. And I wanted to let the council know that uh revised plans have been submitted. our architect met with Claudia and that a placard system has been established uh for students to place a a cardboard placard in their cars to make sure that there's no issues with parking in the rightway. And a declaration of restrictions uh was put in place that makes sure that everybody understands that any occurrence of parking in the rideway would be treated as a code enforcement as it relates to the property. And we've got all that in place. I just gave your legal counsel all of our originals and having said that I will respectfully close.

First reading a proposed ordinance granting a variance to allow an existing accessory building with a floor area of 832 ft where the maximum floor area allowed is 500 ft pursuant to high code of ordinance section 98-166 for property located at 72000 West Elu Court. Hay Alia Florida 33014 IIA zon R3 multiple family repealing all ordinances or parts of ordinances in conflict here with providing penalties for violation here providing for a separability clause and providing for an effective date.

43:32 – 44:060

Thank you. Um item 8 C is on uh first reading not open to public discussion but certainly open. Are you the registered lobbyist, sir, for this representative? I have a power of attorney from the uh owner. Yes, my name is Julio Perez. My address is 16160 Southwest 107. Just one moment. Is that is that madam attorney with the power of attorney? It's in the backup.

44:03 – 44:470

Thank you. Yeah. Would you like to speak on the Yeah, sure. Um just um just recently we signed the covenant of restrictions and that was submitted to um Yumi Oliva uh just today and we're in the process of um cleaning up the the site which has some um debris that was part of the uh uh of the agreement uh towards approval. Thank you. Does anybody have any questions for Mr. Julio Perez for the project. No. Is this easy money, sir? Sorry. Is this a building? Yes. Yeah,

44:45 – 45:300

it's a building. And what exactly are we doing here? So, it's um it's a variance to the sun code to allow an accessory building to be larger than 500 square feet. Uh the building as it is right now it's uh roughly 885 square ft. Um it's used by the property owners to store appliances. It's a big uh multif family residential. Uh the owners uh to my understanding they bought it uh like that and they're in the process of build uh bringing it up to code. Um yeah. Okay. Excuse me. Through the chair. Mhm. It's just like a storage room.

45:29 – 46:140

It's just like what do you have in there? Just like appliances, uh, shares, uh, furniture, that kind of stuff. Nothing to cook, nothing, nothing like that. All right. Yeah. And and it's approved through zoning and regulations. I'm I'm fine with that. Motion to approve. Thank you, ma'am. We have a motion to approve from Councilwoman Monica Perez. Item 8 C. Second. Thank you. Second motion from Councilman Willie Maro. Uh, Madame Deputy Clerk, please call the role. Mr. Morero, yes. Miss G Perez, yes. Mr. Gonzalez, yes. Mr. Dega, yes. Miss M. Perez, yes. Mr. Zby, yes.

46:13 – 46:270

Motion carries. The item is approved. Second reading of public hearing is scheduled for April 14th, 2026 at 5:30 p.m. Thank you very much. You then, sir. Have a good night. Item AB. Madame clerk, deputy clerk, please read into the record.

46:26 – 47:110

First reading of proposed ordinance granting variances to allow one north side step back of 0 feet where 5' 1 in is required and two 0 feet landscape buffer facing East 47th Street where a minimum of 7 ft landscape buffer is required. Contract to Halia code of ordinance section 98-1372 98-1706 and the Halia landscape manual updated July 2025 section D for the property located at 4698 East 10th Lane Halia zones M1 Industrial District repealing all ordinances or parts of ordinances in conflict here with providing penalties for violation here of providing for a seability clause and providing for an effective date.

47:05 – 47:490

Thank you. Um zoning item 8. Um are you going to be speaking if necessary? Yes. Is that okay? And you are Marbelia Hernandez? Yes. Yes. Okay. Is that okay? Hernandez and my husband insisted on the moy. So that was our tradeoff. Okay. Yes. Beautiful. Yes. Thank you. Does anyone have any I'll have you identify yourself if anybody has any questions for you. Does anybody have any questions on this? Okay. Yes. Uh you've got it. So for the record, just name and address then so you can answer.

47:46 – 48:210

Marbelli Hernandez Moy 1331 Northwest 5 Street Plantation 33325. Thank you so much. You've got the floor. Thank you. So, um, on this property, I just want to make sure because one of the, um, variances says 0 feet landscape, but then on under the conditions, it says they must revise it to a minimum of 7 ft landscape. Are we I'm sorry, Mr. Living, can you tell me is in number two? Yes. So, I just want to know, are we approving this with landscape? I would think

48:19 – 48:560

it's with seven feet landscape buffer in the front. Claudia Fasborn planning an official. So basically the setback is to one side but they're providing landscaping on the other side. So to the south is with landscaping is to the east that they're not providing any setback because there is an existing wall that it will remain in the property. Okay. Cuz there's a wall and what's on the other side of the wall? Just curious. Um so that wall is one of the four walls of the building. Okay. So that wall is one of the four walls of the building. That wall faces East 47th Street. Um, there is a sidewalk. Is there a sidewalk?

48:55 – 49:340

There's not a sidewalk. So, if you look at number uh C where it says the soil area. So, essentially it's a soil that people from the area use as parking. Um, I know one of the concerns from the zoning was not to use that as parking and that's why where that building is, it's essentially two properties. One's vacant. Um, one's that like it's just land. Um, the other one is where the building is. So, we're doing seven parkings there instead of three. That's required to make sure that there's enough parking for anyone that were to come. And there'll be will we put a sign or something that says no parking on the soil? I believe there is. Yes. Yes. Thank you. If I may through the chair. Yes, ma'am. Are you done? Yes, I am.

49:31 – 50:150

Um, did this did this property get like any fines for like the boats and the RVs and everything that's parked there? Is there some Yes, there are building violations and they're code violations as well for this property. Okay. because it was registered as an unsafe structure and then they were in additional code violations as well. And is that something that they've already brought up to to code? They they are under a code. No, the the objects that are on the property. Do you know if that's been removed? If any of the debris is still the case is still open because it is an unsafe structure. So they're by doing this they're going to be curing those violations.

50:12 – 50:570

Okay. Is is it is the property rented? Um, as far as just because making sure of some concerns because you said boats and I just want to make sure you're looking at a picture of our property because I don't think 4698 East 9th Court East No, it's East 10. East 10th. That's I know there's no boats. Um, and it's it's essentially a warehouse. It's for storage. Um, my parents down the street have a junkyard. Um, and so there they keep some of the parts and that's where some of the storage um, is taken place. If you're looking at an old Google picture, you might see did that. No. Is this right? If you would, if you would like, I could go around. East 10th Court, right? East 10th Lane. Every time I copy,

50:55 – 51:400

so I just know there's no boats there, so that's why I was um But if there any pictures, if maybe you're looking at a Google picture, maybe an older picture in order to get into compliance. Um, we have taken all the cars out and are just currently through the building process and now doing this in order to get in compliance. Everything's been removed. This is the wall. But what's all of this? Vehicles. Stoing. But they were storing vehicles and all of this. No, that is not a problem. It's up to this line. So all of this can't and here they can't park either. No. It looks like there's like vehicles that like are crashed here. Yes. So what is this property being used for? Like what's um what's the business?

51:38 – 52:230

It's a storage. So down the street on starting on East 10 Court 3 Lane were the bridges from like Hyia to Northwest. Um my parents have a junkyard there. So this is one of the separate bays that they have that they'd store um doors, bumpers, and just other parts that that's what's used as storage. Sometimes they had on the other side as well because it was open they had cars but that has been taken out um because we are through code enforcement and through building trying to do everything. Those cars have been removed because we're and we're trying to get into compliance. But in order to finish the building, we need this zoning aspect to get the variance. All right. Perfect. Thank you. No further questions. I don't

52:20 – 53:030

any other questions for the applicant. Otherwise, pleasure of the council on 8D. Motion to approve. Motion from council from councilman Luis Gonzalez and second from councilwoman Jayen Perez. Please call the role. Miss G. Perez. We have one. Mr. Gonzalez. Yes. Mr. De La. Yes. Miss Empere. Yes. Mr. Zagby. Yes. Mr. Morero. Yes. Motion carries. The item is approved. Second reading and public hearing is scheduled for April 14th, 2026 at 5:30 p.m. Thank you. Have a good evening. Thank you. Is that Ratroento? That is Yeah. Okay.

53:020

All right. Thank you. All right. Uh zoning item 8E. Um, Madame Deputy Clerk,

53:10 – 53:590

first reading of proposed ordinance granting variances one to allow an existing accessory building with floor area 881 square ft and two to allow the existing accessory structure to exceed 35% of the building where the maximum floor area allowed for an accessory structure accessory structure is 500 square ft and where the maximum accessory structure size allowed is 35% of the size of the main building pursuant to Hadium code of ordinance. Section 98-1666 for the property located at 640 East 60th Street R1 single family repealing all ordinances or parts of ordinances in conflict tier with providing penalties for violation zero providing for severability clause and providing for an effective date.

53:56 – 54:410

All right. Um item zoning item ad is on first reading, not open for public discussion, but certainly open to questions from the council for the applicant or or zoning director. Does anybody have any questions for the applicant? Who's going to be speaking? Do you want to just um say your name and address for the record in case there are any questions? Nerv Lopez, 11450 Southwest 59 Terrace, Miami, Florida 33173. Okay, give me one second. Um, Madam Attorney, the property owner. He's the owner. I'm my brother.

54:40 – 55:190

I'm just translating. Elsa, are you Elsa? Yes, I'm Orlando right now. Okay. Is that okay if she speaks for her? She's with in her company. Thank you. Okay. Um, does anyone have any questions for the applicant or for our zoning director? I guess it's a storage shed in the yard, right? Yeah. Okay. You're trying to get it legalized. Okay. Yes. No. Through the chair. Yes, ma'am. Just making sure. No efficiency. No. Just storage. Yes.

55:17 – 55:540

Okay. Motion. Motion from council vice president Melinda de Laa, second from councilwoman Jayen Perez. Please call the role. Mr. Dega? Yes. Miss M Perez? Yes. Mr. Zagby? Yes. Mr. Morero? Yes. Miss G. Perez. Mr. Gonzalez. Motion carries. The item is approved. Second reading of public hearing is scheduled for April 14th, 2026 at 5:30. See you then. You're halfway there. Thank you. Okay, let's see what we got. Item 8F, zoning item 8F. Madame Deputy Clerk,

55:53 – 56:540

first reading of proposed ordinance granting variances to allow one six parking spaces where 11 park 11 spaces are required. Two, one parking space to back out onto the right ofway where backing out is not permitted. Three, 0% pvious area where 10% pvious area is required. And four, 0 feet landscape buffer between off- streetet parking and West 8th Avenue and where a minimum of 7 ft landscape buffer is required. Contract to Halia code of ordinance section 982189 section 98 98-2190 and the Hilia landscape manual updated July 2025 sections DNE granting a partial waiver of the minimum landscape requirements to the landscape mitigation pursuant to section 98-2235 for the property located at 2440 West 8th Avenue Hay zone M1 Industrial District repealing all ordinances or parts of ordinances in conflict here with providing penalties for violation here of providing for a recipability clause and providing for an effective date.

56:50 – 57:350

Thank you. Item um nine, zoning item 9F is on first reading, not open for public discussion. It's certainly open for our discussion if intended. Just to get something clear, you are who ma'am is my daughter. I have an Nelly. Nelly, you said Nelly is the owner. We sent every the paperwork today to be hearing and or and you're supposed to speak on their behalf. Are they registered authorized? He's a tenant. He's a tenant. Okay. One moment. I'm not sure if the applicant, the property owner has submitted a power of attorney. We did document uh to the city.

57:32 – 58:170

Do you know of anything? Oh, okay. Is that in the initial backup? No. Oh, that's what you meant. Okay. And and you're you're Nelly Deas. No, Nelly is the owner. And Okay. Who Who's shouldn't What name is the is authorized? Yeah. So, Nelly Deas um is um this is there a corporation under her name? uh that she is uh the president of the corporation Monell Investment LLC. Her Okay.

58:14 – 58:470

And he's authorizing their student figured. Is that the person before the city council today? Okay. Um however, this document that's being provided that is signed by Nelly Deaz is legally insufficient in that it is not notorized. uh by a notary registered in the state of Florida. So that's what I have here. Is there another one?

58:56 – 59:410

Okay. Okay. So I have an additional document that's been presented that is in fact legally sufficient and um the granting to speak on behalf of the applicant is being granted is being given only to OLA. Okay. Does that mean are does are you speaking for him because he's the only one authorized. Does he speak English? No. Okay. Can she speak? She could just translate for whatever it is. Thank you. You're welcome. And and oh, give me tell me your name again. My name is Anali. Go ahead. I'm sorry. And go ahead. And Figeredo.

59:35 – 1:00:200

Anali. Okay. Anali Figeredo. Okay. And you you live there at 7 uh No, at the uh 2400. No, that's that's a business. Okay. Oh, this is a business. Excellent. Does anybody have any questions for the applicant for Claudia on nine on 8F through the chair? Yes, ma'am. Um I just wanted to know is is uh what business is going here? Uh an adult daycare. An adult daycare. Okay. And um so looking at it now, I see that there is 10 parking spaces right now. What What are you eliminating? How how cuz I see there's only going to be six parking spaces.

1:00:18 – 1:00:540

I think eight. You have four on this side, four on the other side, and then two in front of the doors. I think that's just Yeah, kind of. Um, and then the other question was I thought we did not permit back like back out parking. Um, and then the other question is the landscape buffer kind of I wanted to address those three. Okay. I'm sorry. What was the what was the first issue? I'm sorry. The first question was the parking spaces.

1:00:51 – 1:01:340

Okay. So they're a they're eliminating because they are leaving only one parking space to back out into the street. So the other five parking spaces are basically doing the right movement. So that's why it's the request is to include a variance for that one parking space backing out into the street. But by doing that, they're reducing to six parking spaces instead of the 10. Why? Why do they need a backout parking space? Just looking at what I see now, what why do you need a backup? Because if not they will be eliminated even one more parking space. So instead of having six they will have five. If we if we don't allow them to back out that parking spaces they will lose it.

1:01:31 – 1:01:580

Is a backout sorry is a backout parking space a different Yes. It's a different layout. Can I can I ask you this? I guess cuz one of the parking spaces taken up by the dumpster. That's what I'm Yeah. Yep. I see that. What's here?

1:01:55 – 1:02:380

Oh, parallel. Sorry guys. And it's even regard to answering council question since this is a judicial endanger. All council members must be privy to the conversation.

1:02:36 – 1:03:210

Sorry, my question I was just looking it up on Google Earth and there's four parking spaces. So I guess they're removing those four to make one parking. I guess that's why I didn't understand why. Right. So instead of having four parking spaces backing out into the street, now they're going to have only one parking space backing out and the other ones are going to be arranged. So they can back out in a correct way facing the street whenever the they're coming out of the property. Okay. And the buffer basically um since they're um adding those parking spaces, there is not a space for the landscaping buffer. So they will elimmit well they don't have it. So they will So they're extending this way cuz right cuz right now there's trees and grass there not in the other property. Not in this property.

1:03:190

That's the other property now. Not in this property. Right front here.

1:03:30 – 1:04:120

So they have no buffer right now. No. Okay. So it is what it is. That is what they have now. Okay. That's fine. And the other question was just um Yep. That's it. That was my questions. And there's no grass. So there'll be no grass, right? Is what she said. I think that's they have no grass right now. They have nothing. And now that is the other variance. Uh basically it's a it's a zero pvious area where 10 is the minimum required. So there is nothing right now. But they never granted a variance for that. And do I'm sorry through the chair. Yes.

1:04:10 – 1:04:520

Do they have like an adult daycare van that's going to be driving people in and out? See? Yes. So, yes. In and out. Let's see. Then they're they're looking to park somewhere else. He said they have more parking. Yeah, we're parking somewhere else, but somewhere else in another we have business. Yeah, we have two different um two other locations so all the buses stay at one location at the main one.

1:04:47 – 1:05:130

Okay, thank you. Claudia, is this recommendation for us to eliminate more of their parking spaces just to accommodate the dump the dumpster or is it more just for the backup parking? Because we're we're taking away more of their parking spaces. I'm seeing four and four which one of them has the dumpster plus the two in the front. So, it's like 10.

1:05:10 – 1:05:540

It's a com it's a combination of things. Correct. So, it's not only just to accommodate the dumpster um but as you can see over here. See, I don't know if by doing this we're making it harder for them and then and what's going to end up happening is they're going to start parking their cars other places. No, because they they have we're we're giving them less parking. We're making it more difficult. My understanding of the application is that they don't have as many parking because there is adult daycare. So, they don't drive to the location. Right. That is my understanding. But they have employees. Right. Exactly. But is with the five parking spaces is more than sufficient for the for the size of the um how many participants are there?

1:05:52 – 1:06:300

Um none right now. None right now. So we What's the capacity? 50. 50. And you only need five employees for 50 adult daycarees. Uh we need six per Right. So you need a lot more employees than that. Uh most of them they don't even drive to be honest because the employees Yeah. How do they get to their job? Uh they Uber. Okay. That's what they're doing now. Yeah. Okay. I don't know. Yes, ma'am.

1:06:28 – 1:07:110

And Claudia, just after this cuz I know you know it whatever our or what we have now in place is what we have now in place. I just kind of maybe off um maybe one of these days we can just sit to understand especially like this is a good example why we get rid of four parking spaces to do one parallel one or one back one. I just want to understand that I'm okay because we're going through what we allow now that's fine but moving forward I just kind of want to understand because you know parking is a issue. Okay.
