HCCPC 2026-2027 FISCAL YEAR BUDGET
The Henderson Fiscal Court hereby proposes and originates the amendment of various portions of the Henderson County Zoning Ordinance Appendix A relating to qualified manufactured homes.
The City of Henderson's Board of Commissioners proposes and originates the amendment of various portions of the City of Henderson Zoning Ordinance relating to single-family dwellings and manufactured housing.
AMENDMENT TO THE CURRENT GOALS AND OBJECTIVES OF THE HENDERSON CITY-COUNTY COMPREHENSIVE PLAN.
a. Balancing Land Use - Goal 1). Wisely Plan for local land uses in appropriate locations to maximize quality design and minimize the adverse impacts of development. New Objective k): Notwithstanding anything to the contrary in this Comprehensive Plan, Goal 1 above is deemed to be inconsistent with additional or new development of large-scale solar energy systems providing offsite capacity ("LSSESOC"), commonly referred to as "solar farms" in Robards and the unincorporated areas of Henderson County. Such new or additional development should be prohibited as contrary to the community's aesthetic values, preservation of agricultural land, encouragement of diverse economic development, preservation of nearby property values, environmental protection, and health, safety and welfare in general. b. Findings of Fact for Rezoning #1182 with a Development Plan
Submitted by Sarah Hutcheson Rev. Liv Trust for the property located in the City of Henderson at 2560 Hwy 60 E (PID# 65-22.5) containing approximately 6.03 acres. Findings of Fact for a zoning change/map amendment with a Development Plan to rezone from Agricultural (AG) to Highway Commercial (HC).
Findings of Fact for the Henderson County Zoning Ordinance by amending the chapter Article XXXII - Battery Energy Storage Systems (BESS) as follows:
ADD §32.06 MORATORIUM: Findings of Fact for remainder of this Zoning Ordinance and all other ordinances notwithstanding, there is hereby imposed a moratorium on the filing, processing, review, and acceptance by the Henderson Fiscal Court; the Henderson City-County Planning Commission (HCCPC); Henderson County Codes Administrator; the Henderson County Board of Zoning Adjustment (HCBOZA); or any other department, subdivision, agency, board, or commission of Henderson County government of any and all applications for rezoning, conditional use permits, or other types of applications for Tier 2 BESS, BESS projects, and BESS installations, moratorium shall remain in effect until December 31, 2026 or until such time as amendments to this Article, if any, are approved by the Henderson County Fiscal Court, whichever comes first, unless repealed or extended.
