Rezoning #1182 with a Development Plan
Submitted by Sarah Hutcheson Rev. Liv Trust for the property located in the City of Henderson at 2560 Hwy 60 E (PID# 65-22.5) containing approximately 6.03 acres. The applicant has requested a zoning change/map amendment with a Development Plan to rezone from Agricultural (AG) to Highway Commercial (HC).
The Henderson Fiscal Court hereby proposes and originates the amendment of the Henderson County Zoning Ordinance by amending the chapter Article XXXII - Battery Energy Storage Systems (BESS)
ADD §32.06 MORATORIUM: The remainder of this Zoning Ordinance and all other ordinances notwithstanding, there is hereby imposed a moratorium on the filing, processing, review, and acceptance by the Henderson Fiscal Court; the Henderson City-County Planning Commission (HCCPC); Henderson County Codes Administrator; the Henderson County Board of Zoning Adjustment (HCBOZA); or any other department, subdivision, agency, board, or commission of Henderson County government of any and all applications for rezoning, conditional use permits, or other types of applications for Tier 2 BESS, BESS projects, and BESS installations, moratorium shall remain in effect until December 31, 2026 or until such time as amendments to this Article, if any, are approved by the Henderson County Fiscal Court, whichever comes first, unless repealed or extended.
