Um this agreement is similar to what you've seen on both the fire station and the municipal pool project. Uh, this item comes as it is a subsequent item to the one you heard a while back, the partnership between City of Guthrie and Meridian Technology Center to build a joint multi-use, multi-jurisdictional police and fire training facility on the south campus here in Guthrie. So, uh, as you'll recall, Chief Swagger wrote a grant and received, um, 50/50 matching grant for this facility up to almost a million bucks. Um, we've thrown in half a million dollars in extra funds as they become available over a three-year time frame starting in fiscal year 24. Uh, with that, Meridian Technology Center had a need to build uh, an additional facility on the south campus. They were able to move that up in their capital improvement projects. uh capital projects plan when we approached them and said, "Hey, we've got an awesome idea for a partnership. Um there's classroom space that we already utilize at Meridian Tech for training just like this as it is." So, we'd like to enhance that partnership. Meridian Technology Center. They're just a fantastic partner for the community and they were happy to partner, wanted to see this come to fruition. Uh so the the details of the agreement, the city and Meridian will both contribute up to $1.5 million towards the construction cost of the project. Any overages will be paid by Meridian Technology Center. Meridian will manage design, engineering, construction, and the city will review and approve of the plans. City will have access to the facility for police, fire, and emergency management training. We will coordinate that through Meridian South Campus director. Uh each party will have our own liability insurance. However, the property will be insured by Meridian Technology Center and uh we intend for this to be a perpetual agreement. Um however, as you know, that is something that will have an annual renewal. So, we look forward to this. This is a great opportunity. We're thankful for our friends over at Meridian and I'm happy to answer any questions you may have.

Thanks, Mr. Mayor. Uh city council, uh this item or yeah, this reszone is uh close to the properties that uh were last month. This one is actually off of uh Academy just south of the Lakewood Road Academy intersection. Uh it's a 5 acre parcel that they're looking to go from R1 to A1. Similar reasons as to the last we had last month. They're looking to have more agricultural uh uses especially with livestock uh in that. So the planning commission had recommended approval 3 of the reszone from R1 to A1. Is that the one that's got the the metal barn or is it the nice house?

Ordinance number 3429, amendments to chapter 5, article 9 of the city code regarding food trucks and mobile food vendors. Mr. Casey.

Thank you, Mayor. Uh, city council. uh may some of you may know, some of you may not know, but the state uh recently put in a new law, the food truck freedom food truck freedom act, I think is what it was called. Uh it went into effect November 1st. Also, previous to that, uh last year, the state put forth that food trucks would have to meet the 2018 fire code requirements. That also went uh into effect uh November 1st of this year. So, in order to make sure that our ordinances are clear, but also meet state law, we have the ordinance in front of you. Uh, not a lot of changes, but one of the big changes is state law no longer allows any municipality to put geographical restrictions on food trucks. So, for instance, ours had it to where you couldn't be within 300 ft of another restaurant. You couldn't be within 300 ft of another event that was happening and uh things like that. the state law no longer allows that to happen. Also, state law uh put provisions to make sure that the licensing at the local level does not get out of hand. Uh basically, not to have exorbitant fees uh to it. Basically, you're supposed to have a fee that's just what you need to verify their information. Uh, and then finally, and the fee that it also worked out that the fee we had in there was actually $250 for out of town and $75 for in town. It kind of inadvertently got put in with the solicitors uh part when we redid that. So, it'll help do this. And so, then this will also take it out of the solicitors part and kind of be a part of its own. And then finally, uh, some of the, uh, requirements or standards as far as signage and amplified noise and things like that that they can't do or in the zoning code. So, it has references that they

still uh, have to pertain to or meet the uh, uh, zoning code requirements. Uh, in consultation with our city attorney, there's been some uh, revisions from the uh, ordinance that was put in your packet. So, I'm going to go over those. So, if you do have a motion to uh approve the ordinance, uh we'll have it with the revisions. One revision was that it uh is in B, section B. Instead of calling it a license, it would be a permit. And then also in section B, we eliminated um copy of health department permit, copy of uh Oklahoma state sales tax permit and the state fire marshals because the state will be issuing food truck licenses and they'll be taking care of all that themselves. So it's kind of like our contractors when they come in. They just show us their license, show give us an ID for identity and our application and we go. And so food trucks will work the same. So the one thing we did add then is three will become state of Oklahoma food truck license. And then on D we added under the not operate on any public property we inserted or city sponsored event. So it's similar with the liability insurance. Uh that was another thing that changed is we cannot require somebody that's going to be on pro uh property to have the city as a uh uh

additional additional insured only if they're going to be on our property or an event we sponsor. And then finally the fee. Uh the ordinance says $75. We're going to drop that to $25. So again, there's no issue with uh overcharging or have any complaints with overcharging. So, with that, I'll give it back to the council if you have any questions. I got a question. How's this going to affect 89ers when they set up right up here? They're not going to be allowed to say no. Okay. So, I just want to make sure. Yeah. So, if somebody wants to set on private property across from that event, they can do so. Okay. Dan, question.

Yeah. Because one of the things that uh way back when I forgot what year it was, it's been a while since when they did the food truck ordinance, there was concerns when there was events like 89ers in that that some of the vendors would not be part of 89ers. They'll just sit, you know, outside literally just right outside from them and be able to um have the same benefits without being part of the 89ers. And so there was some of those geographical uh limitations put in our um in our ordinance and like I said now state law says you can't do that for any of you know type of event. So that type of limitation will no longer exist.

That's a lot. There was this had something to also in this to do with how long a food truck can sit in a certain location. Yes. Because some cities, not us, but some cities had limitations that they could only be there for an hour or maybe two hours. So now that again is another restriction that can't be put on them. Again, we didn't have that, so we didn't have to amend it. But you're right, other cities had similar and and all of that was addressed in the state law. Yeah, exactly. So whether it was another city or or even in an unincorporated area, you know, there were some regulations through the Department of Health, if you had a food food truck at a permanent location, you would have to move that food truck if you weren't actively serving food.

Thank you, Mayor, City Council. Uh yeah, this is a special use permit. Uh, as stated, uh, there's a request to have a metal building in our overlay, uh, building overlay area that, uh, obviously does not, uh, allow metal. Uh, in our zoning code, there's a provision in there. It's kind of a catch-all because not everything is going to be perfectly aligned uh, in that. So, some areas kind of get blanketed with um you know, restrictions like this, but in uh kind of the reality is it's not going to have a major impact. So, there's kind of a catchall in our code that now says if in that area there's similar type development and um there and it was in your staff report, there's some provisions in there, they can get a special use permit. In this case, it's a larger property. It's outside the uh Guthrie proper overlay district and it backs up to Highland Park and so he's looking to have a all metal garage, detached garage in the uh very back of the property. There's a church there that already has a couple metal buildings and so it's an area that doesn't already have a concentration of, if you want to say non-metal. Uh so with the approval of the special use permit, it would allow for it to be built within that area. Uh the planning commission had recommended 300 to allow for the building to be uh built.

Anybody called to complain or send a letter or anything like that? No. Uh it was interesting. The only call I got was from one of the neighbors thinking that he was going to be able to put a storage building to rent out and he wanted to do the same thing. And so I told him that he couldn't do that and it was for personal use. But that was the only call and at the public hearing there wasn't any objection. Is this metal building going to be visible from the park? No. It's like uh no because of all the tree line that's back there. That's one of the other things. There's that large tree line that runs at the back of the property or the very south part of Highland. So, it's not going to be uh visible. During the uh winter time when the leaves are gone, you might be able to see it some, but generally it's not.

Thank you, Mayor City Council. Uh, as indicated, this is a special use permit. uh they want to put a modular home or a a manufactured home on the property which requires a special use permit. The property is uh a very narrow uh and goes kind of northeasterly. It's right at the corner of Coal Train and Lake Road. There's a p it's a total of a 3 acre parcel, but there's a power line easement that runs literally through the middle. uh the site plan that was submitted with the uh um with the council communication showed uh there's a 60- foot par or easement in the middle and then there's 20 ft on each side that is non-easement. They're looking to build it on the 20ft portion that is on the east part of the property which would not be within the easement. Uh, I verified from OG& through Spencer Brown and Mark Harrison they didn't have any issue as long as it wasn't within the 60 ft portion of the easement. Uh, the applicants are here. So, if you do have any questions of them and that uh there would be available to answer any questions, but I'll get back to council if you have any other questions of myself.

Oh yeah, that's why we lied because there was it's trees on both sides of the property and the only part that's that's being cleared is underneath the power lines and so that that we can set it right right on this side of it. Thank you guys for coming. Okay. Item number 12, city manager report. Yes, mayor and council. It's uh as I say every meeting, it's busy season. Uh there's a lot going on. Um so you've received lots of emails from me about all the events going on this week alone. I want to give you a quick recap of those just to keep those top of mind. Uh you should have received something from me on the state of the county lunchon which will take place on Thursday uh at 11:30 at Meridian Tech. Um I didn't hear back. I've got the mayor confirmed.

Okay. So if if you'd like to attend Councilwoman Gibbs is on it. she she reserved herself. So, if you'd like to attend, let us know. Uh myself or Jessica will get you in RSVPd for that event. Tomorrow evening, the Pocket Park um will host a ribbon cutting at 5:00 p.m. So, we'll have representatives from Crossland Construction, Department of Commerce, uh shops, vendors, mayor and council as well, um out to celebrate that pocket park. And as a reminder, that was a 50/50 matching grant through the Department of Commerce, Main Street. Um, so we've got lots of folks who will come out for that and look forward to that event. Not only will it be the ribbon cutting for the pocket park, but we also have four new vendors at the shops who will be celebrating their grand opening. So, believe uh Shondaanda is going to be hosting some bingo. So, if you want to play some free bingo out at the shops in the pocket park tomorrow evening at five o'clock, that's where we'll be. Uh, the ADA intersection upgrade at Harrison and First is currently under construction. The crews are moving along really nicely. They've had some good weather aside from the rain we had last Friday. Excuse me. Aside from the rain, they've they've moved along really really well. uh once they complete the intersection at Harrison and first, they will pull off of the job. They they'll like one intersection at Oklahoma and first and I've said you cannot touch that until after Christmas. So, they're going to pull off the job. They'll come back in January and get that wrapped up for us. Last thing we would want is Oklahoma and first be under construction during the walks and the Christmas parade and all of that good stuff. So, appreciate the the project there. Uh the the crews are again really making good work, good good headway. The taxiway project out at the airport, again, another project that is moving right along. We've had fair

weather that has been on our side. I hope we can continue that all the way through. Uh but that taxi way taxiway is coming along really well. Uh contact does plan to close the runway. They were anticipating doing that in December. uh we've asked them to push it out to January. So we do have a hard date January 15th. Uh the runway at the airport will close. We and it will be closed for approximately 6 weeks assuming that we have great weather. So as long as there are no weather delays um should get the rest of that parallel taxi way complete and get the runway back open. Until that taxiway is complete, the runway will be uh closed for the final leg of the taxi way. Westside booster pump station. Uh it's got crews have got that set in place and we're looking to uh start having some testing and getting transitioned over from the existing booster pump. We hope to have a ribbon cutting for that in January. So again, it's another CIP number two project that tied in with the water towers and replacing that booster pump station that sits just underneath the west side uh water tower. So, we look forward to that ribbon cutting and as soon as we get that date scheduled and everything's up and operational, I will make sure that you have a copy of that invitation. City offices non-emergency will be closed for Veterans Day on November 11th. Um, as usual, the American Legion will have the Veterans Day parade. Um, that will start down on Oklahoma and come down, finish up on Honor Park at Honor Park. Uh, where the ceremony will take place every year. That parade will start at 10:30 and the ceremony usually follows the parade. Thanksgiving lunchon for city employees, council, and uh their family members will take place on Friday, November 21st out of the public works complex and will

begin at 11:00. And then also a bit of exciting news. If you'll remember, back in 2023, the city council authorized the remount um order of a new ambulance for Guthrie Fire and EMS. We're proud to say that that ambulance is finally here. So, it arrived two two years later. The lead time on on those units is it's getting longer, unfortunately. And on Saturday, they do something special called a blackout where it's the same um haunted house run that you do, but they turn out all the lights and it's pitch black. Item number four, take pay water purchase agreement with Langston University. Mr. Faulner. Yes, mayor and council. Uh if you'll recall, the original agreement with Langston University and the between Langston University and the Guthri Public Works Authority was executed in 2004. In 2004, the the Guthrie public works authority, sorry, the city of Guthri, unan we're synonymous in this in this term, uh constructed and financed a waterline project to deliver treated water to the Langston campus. Since that time, GPWA has supplied water to the university under a contractual take-forpay arrangement that guaranteed a minimum monthly purchase amount. The prior 20-year agreement expired on June 30th, 2025 was extended. The terms of that agreement were extended via anou until now until the terms could be reached of a new agreement. Um, the new this new five-year agreement uh continues a long-standing water supply partnership between the city and the Langston University ensuring a reliable source of potable water for the campus. Uh, previously we had a 20-year agreement and that coincided with the financing of the project to supply water to the university. So, what you have before you is a much shorter term, five-year term, and it is renewed annually. So similar to what we discussed the partnership with Meridian uh this partnership would require an annual renewal as well. Uh the rate for the water which increases annually with the CPI adjustment or is adjusted annually on the CPI. Uh this rate is proposed $6.35 per thousand gallons. Anything over their minimum 6 million gallons a month

is build at 6.69 69 per thousand gallons. So, their takeer pay minimum is 38,100 per month, which is equivalent to the minimum of 6 million gallons. Um, we did have a maintenance provision that was included. So given that the water line and the stand pipe were constructed to serve the university uh any future maintenance that may be required at least through the term of this agreement uh the university has agreed to fund up to 30% of the infrastructure. So we just wrapped up the water towers and the booster pump station finishing up the booster pump station. want to be ahead of the curve on that standpipe and that was top of mind for us as we went in there to talk about this contract to make sure that we were exploring all possible funding mechanisms uh on the front end for the infrastructure when that time comes. We're not there yet. We may not be there in 5 years, but at least we've got this provision included in the agreement. So, with that, um that is what I've got for you on this item. I did send this out to the council uh for your review a couple weeks back. Received a couple of questions which I've addressed tonight in my staff report. Be happy to answer any other questions.
