HAB-Masyn Moyer- This week.

0:05Speaker 2

HAB-Masyn Moyer- Talk about cameras. HAB-Masyn Moyer- On your ring. HAB-Masyn Moyer- Every house there.

0:14 – 0:36Speaker 5

HAB-Masyn Moyer- Okay. HAB-Masyn Moyer- Tom board workshop number 23 to order. I have to note again that all the council members are present. I think we need to be an executive session again by 7.30. So let's try and run this as quick as we can. Agenda review first up. Anything anybody would like to talk to on the agenda?

0:40Speaker 1

One item from the planning board was tabled, this public hearing, I believe, for Ms. Lima.

0:51 – 1:14Speaker 5

the bakery yes i believe it was table good table good table so so we're gonna not have that tonight well you'll have the public hearing okay just just remain table you can table make a motion to say that that's the only information we want to close the public hearing though right okay sure if you want to okay

1:18Speaker 1

The next time board meeting would be on Tuesday, the day after play break.

1:23Speaker 6

The e-bite thing, I read the planning boards pretty much, they didn't see what was added, so it didn't seem like there was much in there.

1:30 – 1:49Speaker 4

I have no idea why or how that happened, but for some reason they had a version of the law that was older. Extremely old. And some of the stuff that they'd suggested was stuff that was already incorporated in the law, but admittedly they didn't get an opportunity to review the most recent version of the law because they weren't satisfied with it.

1:49Speaker 2

So it's a red line that I put together and we made the changes. So I can send that.

1:53Speaker 4

No, I said, like I said, the one I looked back at, but somehow whoever put it in, however it got to the planning. So what do we do about that?

2:04Speaker 6

I don't know. I heard him. I guess.

2:06Speaker 6

No, they, they, the recommendations they made are incorporated in the, in the, they are. Well, I mean, except for the 15 mile an hour, which.

2:14Speaker 6

That that's a tough one. Cause you can ride a regular bike faster than 15 miles an hour. Some people can't.

2:24 – 2:51Speaker 5

um how do you determine what else was on that it was 15 miles an hour and there was oh i said something about snowmobiles that he could take they wanted to repair snowmobiles from him yeah is that that actually had nothing to do with the e-bike law that was the existing law yeah right put a note in when i first revised that that yeah the uh it seemed to capture snowmobiles and that might be something the board wanted that's one small section of the actual trail but it is a section.

2:51Speaker 6

Yeah, that was in section 386. Yeah. And the town was authorized.

2:57Speaker 4

Authorized use of that area. Use on those portions of town property.

3:02Speaker 5

I certainly wouldn't want to authorize them to run around Vesca Park.

3:05 – 3:39Speaker 6

Right. I get it. And I think, Tom, to your point, you had mentioned that signage in parks controls what you can do in parks, regardless of any law we have, so. they wanted to outlaw it in parks, but there might be a time where you don't want to outlaw it. I have no, did you want to change, you know, when we make a motion to incorporate The snowmobile change, I guess I didn't even know that law existed prior to Peter finding it somewhere.

3:39Speaker 7

The emergency digester, what we did was the bond. For that, the emergency expenditure.

3:45Speaker 6

We banded it, now we're bonding it, right?

3:50 – 4:12Speaker 4

Well, I think the original, but the original was just an emergency. The original was just the pumping and clean up because the original proposal from talking executive center senior operator was basically for the rationale projects. Because of this. So make sure you're not there. I mean, we have the approximate numbers, but whatever reason.

4:17Speaker 5

Okay. Anything else on agenda review?

4:28 – 4:39Speaker 5

Advisory board review. Anything really cooking? Parks and Rec are not leaving this month. which would be tonight anyway.

4:40 – 5:08Speaker 6

Cab is still working on the tree law. They got some feedback from the planning board, and they're going back to the planning board next month. With that feedback, they still have some concerns over Town Tavern. I believe Town Tavern was referred now to the planning board for their comment. I didn't see any notes on that, though. Did they... rule on what they wanted to do, or so that's still pending before them.

5:08Speaker 3

I think I haven't come in to do a lean tours. So they caught him up. They got caught up in some other stuff. That was a different person. Yeah.

5:17Speaker 6

Um, and historic preservation canceled their meeting. They didn't have a quorum.

5:22Speaker 5

Okay. Yes. I actually walked in on.

5:25Speaker 6

Yeah, you were here.

5:26Speaker 5

Yeah. Bless in a quorum. Right. Yeah. Um, okay.

5:32 – 5:53Speaker 7

EDAB met. They had representatives from the chamber. They had a great meeting. Chamber kind of outlined what their role is and how they saw EDAB's role in our community. Talked about key projects that they do, things they would like to do. So I thought that was a good conversation.

5:53 – 6:05Speaker 5

Okay. The planning board, in essence, is the planning board. They gave recommendations on everything, Tom. And we got to work on some training, right? Yeah.

6:05Speaker 4

So we can talk with Chuck. I know Bob had some suggestions too about. Yeah. Try and get them sorted out on that before the end of the year.

6:14 – 7:05Speaker 5

Something just to note, we were working to put together a informal meeting for one of these best contractors and the advisory board chairs and stuff are not all updated and up to spec. So if you don't mind, get together with, I think Wendy doesn't in the course office and just make sure that the right chair is listed and all that stuff. So we're getting ahold of the right people. All right. I kind of went through and did it by memory. I think mine, she sent me. So the one we struggled with a little bit was eggs. Cause we don't really know what's going on there. Yeah. And there was a couple, there was one economic development. I didn't even really, Damon Joy, I know was a co-chair or something. So it's Sarah. Okay.

7:05Speaker 7

It was too. It's Sarah and Felicia.

7:07Speaker 5

So let's just get them updated, but if you can get in there and just make sure all the right people are on the right list.

7:13Speaker 7

I think traffic safety is different now because.

7:15 – 7:28Speaker 4

That pre-application meeting for those best laws doesn't need to have all the advisory boards. That's. They're all getting an invite and they can say no. But that's... Why do we draft a law that specifies... What is it?

7:28Speaker 7

It's Supervisor, Engineering, and Building, and Planning Board.

7:34Speaker 4

Supervisor, Engineering, Building Department, and Planning Board.

7:37 – 7:59Speaker 5

We don't need everybody in there. We met with them. That's the second one. We had the second meeting of that today at a separate conference. But... Listen, it's the first one. I'm not going to sit there and say you didn't hear. I'm not going to be told that you didn't invite us and we didn't know. So everybody's getting an invite on the first one. It's the first rodeo. And if they say we don't need to sit on these anymore, great. We'll cross you off the list.

8:00Speaker 6

But I'm not going to go rounds with that.

8:07 – 8:24Speaker 5

So I understand too, Tom. I get it. I get it. Paper Road Abandonment. I sent this out to you guys to look at. This is about down on Falls Link in that area. I also have more copies of it.

8:25Speaker 6

I got a... There was correspondence with Westfalen.

8:31Speaker 5

That was a different one. It's a different one. Yeah, they're all over the place, these things.

8:36Speaker 7

Spitzer responded to. Yeah.

8:38 – 9:08Speaker 5

That's different. We did get a response from our assessor that kind of made it a little bit weird, saying that maybe the property had some park destination in the past, and it was a piece of property back there that could be considered park property. So I don't know where the board wants to go on this. HAB-Masyn Moyer- And how they want to proceed on time and you'll be doing a little bit. HAB-Masyn Moyer- Good and i'm trying to refresh.

9:08Speaker 7

HAB-Masyn Moyer- My coffee.

9:10Speaker 5

HAB-Masyn Moyer- Right now, if I got it. HAB-Terry Palmos- We can't dish parkland so. HAB-Terry Palmos- That that's right.

9:17Speaker 4

HAB-Terry Palmos- Thank you.

9:19Speaker 5

HAB-Terry Palmos- yeah. HAB-Terry Palmos- This guy.

9:21Speaker 4

HAB-Terry Palmos- My first read that my. HAB-Terry Palmos- Why are we paying our attorneys. HAB-Terry Palmos- The people. HAB-Terry Palmos- To do Peter.

9:32Speaker 6

Oh, I remember those now.

9:33 – 10:16Speaker 5

Yeah. Yes. Sorry. So he continues to keep asking me what to do with it. I'm a little bit concerned about the park designation on the piece of it. We have in the past offered the paper road to joining residents. I also don't know if it landlocks any property in police fields. So I think I'm going to leave something on this. I'm just going to need to answer the guy. I'm just going to roll the button. At some point.

10:19Speaker 2

Well, if it is Parkland.

10:21Speaker 4

You cannot do what he's asking. Correct.

10:22Speaker 2

How is it Parkland if it's a paper road?

10:29Speaker 4

There's two, there's.

10:30Speaker 3

Yeah, I know that the part beyond the paper road is part of it, but if he just, if his line was the paper road and not going down the paper road, how would that be parkless?

10:39Speaker 2

You know what I'm saying?

10:45Speaker 5

Let's ask Pete to abandon something. He was willing to abandon the paper road or even purchase it if that was an option, just to add to his site.

10:56Speaker 3

HAB-Jacques Juilland- Really the robot and it'd be 14 foot off the corner of South, that would be pretty close. HAB-Jacques Juilland- Yeah, I think you're right.

11:02 – 11:14Speaker 5

HAB-Jacques Juilland- I don't know about the backland the road. I'm relatively okay with this awesome physical man like anybody's read HAB-Jacques Juilland- The backland.

11:15Speaker 3

HAB-Jacques Juilland- It's 100% never going to be developed. HAB-Jacques Juilland- Yeah. I think so.

11:20Speaker 2

You own both sides or one?

11:22Speaker 3

The other picture says 10 foot paper.

11:25 – 12:01Speaker 5

So he purchased I think $31.99. So we get to the map section here. $31.99 is his. Now they still like to buy that paper or get the paper or behind him abandoned. But this property zero, I believe that's considered a park. That's the park. It was deemed as designated park area for the neighborhood. Designated where? Somewhere, somehow.

12:04 – 12:19Speaker 3

We can basically know that the road's never going to be built. If you look at the, no one would put that much money into that much road. Only two or three building lots. That's over a million dollars in road for two or three building lots. That's correct.

12:21 – 12:47Speaker 5

but it does look like this property is still accessible from the left side falls link which would be considered the park property um but it's not a public road it's a private road so now more questions so falls link is actually a town property no no i thought you said it was parked right oh it's private it's private roads it's not public room But we have park property there. So where on this is the park?

12:48 – 12:59Speaker 4

We'll get to drawing one from A. Yeah. I'm sorry. B? We'll get B. Yep. The shaded one on the top left. The shaded one is the guy.

13:00Speaker 4

The road one is behind it.

13:03Speaker 6

Oh, that half circle.

13:04 – 13:29Speaker 4

Okay. And the thing... piece behind it that like pie shaped wedge is what it's zero yeah that's this that's like right here it's considered parkland but i could see him i could so paper road is half of falls link on the entrance right so there's two questions but banning the paper road is probably fine that's it's yeah well but then we'd lose access to the ownership interest to the end with

13:30 – 13:49Speaker 2

So a lot of these roads there, they exist by virtue of flats, and we can quit claim whatever rights we have in a flat. If we actually own it and it was dedicated in fee to us, typically we'd split it to each side and half if we abandoned our interest. So we're half. Determining whether we have any interest in it, though, is a different issue.

13:49Speaker 3

We did something like this. This came to the end of the paper road. There you go, Pete. That's what I think. What's that? Yeah, I drew it.

13:58Speaker 3

Instead of going to the parkland, this was at the end of the paper road, which obviously can't be parkland.

14:03Speaker 3

And it gives them a bigger lot.

14:04Speaker 5

So I think you give it to every one of these people.

14:07Speaker 7

That's what I was just going to ask.

14:09Speaker 5

How would we access zero? Because if you don't give it to the other side, there's still access.

14:14Speaker 7

From this one?

14:16Speaker 5

Oh, from back here, too. Yeah. Okay. So I think if you give it to him, you've got to give it to all. Otherwise, it's proper to get landlocked back here. It wouldn't make any sense. You'd have to pretty much give it back to him.

14:26Speaker 3

I mean, I don't know how he got a building permit to build 10 foot off the paper road. I would have hated that they put a road in there.

14:33Speaker 7

And then he has to split that portion with 3161. HAB-Masyn Moyer- Or he gets sounds.

14:38 – 15:33Speaker 2

HAB-Jacques Juilland- No, he's put it will do all we do is quit claim and abandon any interest that we've got, in which case it goes basically have to either side. HAB-Jacques Juilland- To the extent the town owns it, but we don't do we're not going to do like a title search and go back and see how it was transferred things like that. HAB-Jacques Juilland- So if they want the town to quit claiming thing on this specific semi circle here or his partner was semi circle that sound good. But I don't know. It's only the extent we have an interest in it that we can, that quick claim is worth anything. If it was just quick claiming, it doesn't mean anything. We didn't own it. A quick claim isn't like a warranty of a deed that we're giving something to somebody. We're basically saying we don't have any interest in the property. And we've done that, you know, dozens of times for some of these lettered, a second street, these different streets that are numbered back there over the years, where there's a plat that's filed and, you know, nothing was ever built and probably never will be built.

15:34Speaker 3

So, if this is like that, we can do it.

15:36Speaker 2

Not all that clear that there's even a file.

15:43 – 15:54Speaker 3

Instead of it blacked out of line, just follow the paper road. For this guy, well, how are we going to get this guy? Right? Or a good amount of money. That's exactly what I mean. That's that's not talking to you guys.

15:54Speaker 4

They can pay for their own service all the time. Why would we do it?

16:00Speaker 5

He seems relatively open to doing it, but it's fun to know.

16:04 – 16:21Speaker 2

You can either do nothing with it, or if the town doesn't have any useful engineers okay with it, and we're not creating some landlocked property, we could say, in theory, this is fine. To the extent we have an interest in it, we're willing to abandon it. It's a provision of the highway law where a highway hasn't been used for a certain time period, where we can simply...

16:22 – 16:49Speaker 4

effectively abandon it and you don't issue like a real deed you just put plenty of rights on it well if it doesn't create any new right that somebody might have it just basically is the town walking away from it i guess the response to him is let him figure out what it is like i have no interest but i'm also not going to pay not going to say we should go pay peter to figure out whether or not it was parkland so we can fit like why would the town taxpayers Pay for him to figure out if he wants it. We'll figure it out.

16:49Speaker 5

Come back to us with a proposal. So have him title search it and get back to us. I don't care about the title.

16:54Speaker 4

The parkland issue is a separate issue.

16:56Speaker 2

It's a separate issue, but I'm not sure. He wants that too.

17:01Speaker 4

Just tell me on the paper.

17:03Speaker 5

If there's an existing flat. He'd buy it.

17:06Speaker 7

Then he has to figure that out.

17:08Speaker 5

He'd buy it, but we can't sell parkland.

17:10Speaker 4

But if it's parkland and he finds out that it's parkland, that's the end of the discussion. Yeah.

17:13 – 17:32Speaker 6

And that's just filed in the deed in Erie County? Is that, it would say Parkland? So it comes up in our colons as Parkland. We don't know if that's right or not. That's the question. So how do we find out if it's right? How does he find out? But how does he find out if we have it coded wrong? I don't know how he would do this.

17:32Speaker 2

If it's his own property, he'd do a title search on it, and he can look at town records or county records, whoever might have declared park lands.

17:42Speaker 2

From a town perspective, there's no meaningful cost if we're just abandoning.

17:47Speaker 6

Right, but we can't abandon it if it's parked, so somehow we've got to get it.

17:51 – 18:13Speaker 2

definitive declaration of its we don't know we didn't need to look at it either i need five five minutes tomorrow you give me a list and i will do it yeah abandon okay that's we didn't even have to confirm the parkland we can just say that you know we quit claiming interest in it okay we're not going to convey it we the the parkland prohibition prohibits us from like selling it or transferring all okay all right give me five minute list tomorrow and i will handle that

18:14 – 18:47Speaker 5

Next, I distributed earlier this proposed panel letter to the residents. I have the official copy. I have a blue pen. I'd like to pass it around real quick and have everybody sign that so that I can get that taken care of tomorrow. There's some discussion I'd like to have about the Galapagos Memorial Park. I'd prefer to do that in executive session. It's about property acquisition. Yeah, number seven, that's Dan. Oh, one of the questions. Attorney position.

18:47Speaker 3

Oh, yeah. We got three applicants.

18:50Speaker 5

So is the time update or is the time up? Yes. Is that?

18:55 – 19:08Speaker 3

Yeah. It came up with a Friday. So if you guys want to set up interviews, who wants to be part of it, then I'll set it up.

19:10Speaker 7

And there'll be like a... Could you do an executive session workshop that everyone could just do it all together?

19:20Speaker 1

I used to do that all the time with interview.

19:22Speaker 3

So I'll send his availability stuff, the three of, and availability, and then we'll try to set up a work session for everybody.

19:32Speaker 7

That's just a thought. If you wanted to keep two and two, that's fine. It just seemed easier.

19:37Speaker 3

No, I just assumed I wouldn't be there for that. Thank you, everybody, for just taking care of themselves.

19:41Speaker 1

Don't forget your picture.

19:43Speaker 3

That's the decision. I got more pictures.

19:44Speaker 5

They didn't already put on that.

19:59Speaker 4

Yeah, it will ask meeting to have him contact.

20:03Speaker 7

It's the, it's the public reach part for the grant.

20:05Speaker 4

You authorized me to write a letter. Okay. Yeah. The last meeting. I got somebody asked for it. I think because it came up during.

20:12Speaker 1

Oh, you did authorize it the last week.

20:14Speaker 5

I thought I had more credence that the whole board signed it. Yeah. So.

20:18Speaker 1

Sorry, I wasn't trying to pin anybody down.

20:28 – 20:42Speaker 3

The next one, Pete, was something we discussed. We had a good heartfelt discussion about having the department heads at their next department meeting. And then explain to them how we are. Remember we said expectations. I'll try to be there.

20:43 – 20:54Speaker 5

So tomorrow is my next thing. So we could set it. I would prefer we set it up and we schedule it and an announcement for the next one. It doesn't even have to be on your monthly department. You're right.

20:54Speaker 3

Just say this is a mandatory department.

20:56Speaker 5

We'd like to have a meeting with the department head and the town board.

20:59Speaker 3

I just want to make sure we stay on that because I think we had a great meeting about things that we have and expectations for our departments. Yeah. And we need to let them know what our expectations are.

21:09Speaker 5

So I think that's right. Do you want me to work on some dates sometime in the near future? Sure.

21:15 – 21:37Speaker 3

I just want to make sure we stay on it because sometimes we get so much going on, we forget. And this was one of the ones I thought was a good idea is to tell department heads our expectations and, you know, what – So you're going to discuss the that people are going to start doing annual evaluations again. I mean, this is all stuff.

21:37Speaker 5

I did put that on the department had meeting for tomorrow to start talking about it. And I'm going to work with everybody, work with Kellyanne to come up with how that's going to look. So then I also put the.

21:50 – 22:02Speaker 3

The boots on there. Yeah. So, I mean, we can schedule it as a workshop and then have the department show up. We could all have our expectations.

22:03 – 22:16Speaker 5

No problem. If you guys want to give me a date, I'll work around it for a time frame. Obviously, we don't want to do it before Labor Day. I probably got some time on the 9th.

22:18Speaker 6

I've been out of pocket until the second half of September. Okay.

22:25Speaker 7

Like the 14th or later.

22:27Speaker 5

I'm coming back the 16th. Okay. Let's not rush you back to it. 23rd?

22:34Speaker 4

I won't be available the rest of September after that. October. It's not until the 28th. About the first week of October.

22:42Speaker 7

If you're looking at, if you're looking there, like the 23rd, you might as well go with the scheduled, already scheduled department head meeting of the 29th.

22:50Speaker 5

I got on the 22nd. Oh, because there's four weeks. Yes.

22:57Speaker 5

So we could do it. What day do you come back, Jose?

23:01Speaker 6

Wednesday. 22nd. September. Yeah.

23:09Speaker 7

Oh, but Tom can't be there till...

23:11 – 23:27Speaker 4

I can pick a jury on the 17th, and the trial is going to go through probably the 29th or 30th. Okay. I would prefer we're all there. How about the first week of October? I'm taking a different jury on October 1st, but I think that one's going to kick us by the new judge, so...

23:31Speaker 5

I'm picking a lot of juries. Okay, my next department meeting is October 27th.

23:35Speaker 1

What's the last one in September? 22nd.

23:40Speaker 7

And then the last Tuesday in September is the 29th. Is that what you're asking?

23:45Speaker 1

It's five Tuesdays, right?

23:49 – 24:09Speaker 4

Yeah, the 22nd. 29th. Actually, no. I mean, I was scheduled this one in October is going to get it. I know we have a new judge, so. I could do the first, the second.

24:09Speaker 3

I'm not going to be there the first week of October.

24:16Speaker 4

Could you do the first or second or a Thursday, Friday of the last week of September? Is it that week or the week after?

24:23Speaker 3

I leave the 30th and I don't come back until the 6th in Colorado. But listen, I don't got to be here for it.

24:29Speaker 5

I think that everybody's going to be there.

24:31Speaker 3

I think the floor you guys can handle, I'll zoom in.

24:35Speaker 5

I would prefer everybody went second.

24:36Speaker 6

Okay. That way, if everyone's angry, we can take it out on you.

24:39Speaker 4

When do you leave, Jose?

24:40Speaker 6

The second. During the 16th.

24:46Speaker 5

We're in September. September 16th. Yeah.

24:49Speaker 3

So I'm going to the 7th of October, and then leave again the 16th of October for another week.

24:54Speaker 6

Your jury's 17th. That's a Thursday. So then the 18th is Friday, and you start out on Monday. Maybe go on the 18th.

25:06Speaker 5

Is this something we just can't figure out today?

25:07Speaker 1

The 29th doesn't work for time, right?

25:13 – 25:30Speaker 4

It may, but I'm not going to know until that week. Like, however long the trial takes, the trial takes. And it's going to go at least... October 27th. Anybody got a problem with that one? What about, I mean, do we want to do the 7th, 8th when Dan comes back? I can do...

25:31Speaker 1

The 8th is open enrollment in the courtroom, so that's going to be open. The 8th and the 9th.

25:38Speaker 4

I can do the 9th.

25:39Speaker 1

You can? It would have to be down here in this room because the courtroom is being used for open enrollment. The 9th too?

25:47Speaker 7

The 8th and 9th.

25:50Speaker 6

But, I mean, we don't have that many department heads. Yeah. I'm good either one of those days.

25:55Speaker 7

Which is better. I'll tell you what.

25:57Speaker 5

We have Monday, October 5th, we have another town board meeting. Dan's going to be gone still. Dan was back the 7th, I think.

26:04Speaker 3

I'll miss the first meeting in October.

26:08Speaker 7

So Thursday or Friday looks like we could do that.

26:14 – 26:26Speaker 6

Yep. Mm-hmm. Yeah, see how that flies. I'm okay during the day. I don't know about anybody else. If something changes with the trial, like you guys know, but I'm pretty sure that one's going to happen.

26:26Speaker 4

What are we talking?

26:27Speaker 5

10 o'clock? 9 o'clock? 8 o'clock? Whatever's good for the beginning of the day so they can get back to 10.

26:34Speaker 4

Probably 9. What time?

26:38Speaker 7

The apartment hits normally at 9. It was 8.30. It moved to 9, right?

26:44Speaker 4

9 o'clock is fine then.

26:49Speaker 1

9 at 9. 10-9 at 9. Down here.

26:58Speaker 5

Down here? In this room. The courtroom has open enrollment. Okay.

27:05Speaker 7

That gives a whole month if something opened up with your trial. We can discuss doing it sooner.

27:09 – 27:28Speaker 5

Okay. We'll work on setting the meeting up now. We won't advertise it, obviously, until we have to. Okay. Anything else before we go out of open session again? Second executive.

27:28Speaker 3

Should we go to executive session?

27:31Speaker 5

Second. Second. All in favor? Aye. Opposed? Carries. Thanks.

27:42Speaker 6

Thank you, Highway. Did you have something that you wanted to add?

27:44 – 27:56Speaker 4

I just wanted to add something real quick. about concrete streets. I'm going to hand out these pamphlets and this resolution you guys should do it.

27:56Speaker 5

28:07Speaker 2

I love that. Consensus, figure it out.

28:13Speaker 3

Move forward.

28:16Speaker 1

28:18Speaker 2

It would be nice to have something in place.

28:24Speaker 4

I got one. I got one.

28:29Speaker 5

Justin's very excited.

28:31Speaker 7

Justin's very excited about this.

28:34Speaker 3
