Please join me for a word of prayer. Father, we thank you for this year in which we celebrate you as our creator who have given us rights that we cherish deeply. We thank you for the singular grace that you've demonstrated and kindness you've demonstrated in the establishment of our nation and watching over it and those who have defended it down through the years. We also pray, Lord, that you would continue to grant peace and safety to our community. And this evening, as the council gathers and deals with concerns for the residents of our town, we pray that that would be the thing that is foremost in their thinking, how we can do that which is best for our community. So guide us and direct us in this night, we pray in Christ's name. Amen.

Paula Shook. I see on here that there is a possible approval for the splash pad. I would just like to say I am all for it if it does not include the extra concrete and sidewalks to the tune of an extra $400,000 of expenses for two months. project as it is the water alone is probably going to cost 50 000 to residents it's an expensive two-month project i do um feel that with the possibility of our road being done that's very promising however i think um the splash pad there was the original 400 000 left i know you had to make up some money i don't know if you were getting it from parks and rec i'm hoping that the donor came forward and came in but um that would be great if we could do everything but i am against it if we are going to add that additional concrete that was almost 400 000 with the sidewalks so just wanted to mention that thank you thank you anyone else with public comments on any agenda items

I'm Dan Getz. I live on the other side of Trezender. A question we have is the permit was for originally for two horses, had up to eight horses on the property. You know, and that's, and they've been doing really good about getting the smell on rectified, but I don't have as big a problem as transgender does because his property backs up to where else the horses are. I'm Kevin Bitticoff with 4410. Originally we got the permit for special use. We got the Erie County Ag permit. We were told we didn't need the special use permit anymore by the building department. Apparently that was not accurate. So now we're just reapplying. But we did, we're obviously changing how we're doing stuff also. We cleared a little bit more of the property so we can put the horses back past everybody else so they won't be as close to neighbors as they are.

So the Chamber of Commerce is seeking approval to use Tom Commons for the 28th annual Kids Biz Young Entrepreneur Program on Saturday, June 20th, 2026. The application is attached. They're requesting that Whitehaven Road Baseline and Grand Boulevard be closed from 8 a.m. to 10 a.m. Supervisor office has submitted the road closure permit to request to Erie County Department of Public Works, which has been accepted. Chamber is providing strategic insurance. They're requesting barricades, traffic cones, police picket tables, garbage cans, generators if needed, and removal of garbage. They've agreed to have all garbage in bags and tied in neatly placed curbside on Whitehaven for pickup, all of which has been addressed. Discussion. And before you go, before you get rolling, I want to be clear that this is only to authorize the purchase of the splash pad from Vortex in an amount of $708,000.

Right. Again, we can agree to disagree. We only have $477,000 left in the grant. So the rest is coming out of some taxpayers. We've looked at I think we have the possibility of having this funded. Basically, we've identified we don't have to spend this grant money till December. I'm just saying, why are we in a rush to fulfill a contract that puts approximately $300,000 in taxpayers' money in risk if the other side of this amendment doesn't come through? We all know that there's a private donor that's willing to pick up a tab. We do not have a commitment from him. And we still don't have it. And I'm just not one to put taxpayers' money at risk. If we get the commitment, I'm on board. But right now, I would just not. So, okay. That ended me. That's easy to think of.

Understood, but even picking up the difference leaves this project a far cry from me. what I think most of us would consider complete, you know, 708 plus deal with some infrastructure improvements to get it usable. And we're able to do that without, I mean, we have the bond resolution for 1.3 million roughly, which you voted in favor of. And we can bridge that gap without using taxpayer money that was approved from the levy using the uh recreation funds so for the time being we can get a usable splash pad with that and grant money be it to help offset that or to finish the numerous other portions of this project that need to be funded we can continue that but one way or another this

let this walk i think would be a mistake we've got money walking away from grandma saying i voted for it is this one thing but us all four of us in this room didn't even know it got ordered never saw what it looked like this was a complete surprise of this town board and none of us knew it was it was over the bonded or the grant amount of money for 77. We all thought that, I thought we bought some phenomenal brand. Yes, the board before me planned, because I wasn't here when you guys put the bond in this project for the extra $270,000. All I'm saying, Thomas, I'm not against the splash pad. I'm against using taxpayers' money if we don't have to.

We have a guy, we have an individual fund to pick up the tab.

Why don't we get that taken care of? and blow it out the next month. I mean, maybe 30 days, we get a commitment. But we all know that $700,000 right now, and you even stated it, this doesn't get a sole project. This is a million dollar project, at the end of the day, if we do it right. I went past the one in Tonawanda today, they have all these white chairs, lounge chairs out, those cost money. I mean, I don't know where we've been. The additional concrete, I don't wanna see it, but they don't have additional concrete. I wouldn't want to see it put in without the fence. So I don't want to put half, I don't want to half this by only spending $700,000. If the other individual commits to the $600,000, we get it all. We get a good split to bed. We get whatever the difference of what we have, what we needed to get it done. I said $600,000, that's a million plus. Because we know this is a million plus project. If you add up all the things that the supervisor mentioned in the meeting, it's a million-plus project. So you're not committing to 700,000 tonight. You're committing to a million. And if the private donor doesn't come in, we have to spend about $600,000 of taxable money.

I don't think that's entirely accurate because we've been through this with the numbers. 700 for this and roughly 100-ish for the infrastructure. With that, we can have a splash pad that will function and will serve this community without having to do any of the other concrete or all the other fancy stuff. Yeah, it would have been nice. We're not debating again how we got here because it would have been nice to have

The total number to make it functional is seven. In those estimates, I was told on the electric, the sanitary and the water was rounded up to 75,000. It wasn't, again... The estimate was said to be a sound estimate that went out to bid from someone that does it. It wasn't a thumb line. I'm just filling in blanks here so everybody understands that it's not just the 708. It's another 75. Right. And the whole project, Dan, you're right. It's like $993,000 because the plan that was drawn up has another $170,000 in concrete. But that's sidewalks connecting. That's not just around the pad.

We're going to do it eventually.

So my question was, my number one concern is getting grant money back. That's my number one concern because we just sat with five different companies to interview for grants. And every single one of those grant writers said the very worst thing you can ever do is to give money back and not fulfill a project because they're counting on your community to do what you're saying you're going to do. So we can't, the end game, whether it's December or now, is not to give that money back. the best way to have the product is cutting everything out until the donor comes in. And I would not want to order it without specifying that there would be no more than X spent to make it operational. And if a donor comes in, then you can add on and grow it. So I hear what you're saying, or another grant. So Elaine is working, our grant writer, our grant opportunity manager, her title, but she is exploring other options for grants to fill the gap if we don't get that.

Well, and especially when we talk about the other concrete, which includes sidewalks connecting the Miracle League profit facility to This facility could be something that should make us extremely competitive to get grants for that portion of the project once this is done. So, Dan, I agree wholeheartedly. Need to leave no stone unturned with respect to trying to get grant money other opportunities for this to get paid like i said the time being we can take what was bonded what was considered when we brought this project and i think this dates back to 2021 when we got the grant from erie county between what was bonded the 1.3 that was bonded then 85 which is going to come out of the recreation fund, which is not money that is contributed to from the left. Your tax dollars that you pay in property taxes doesn't go there. It's a separate fund. So we're bridging that gap to get a functional splash pad without spending anything other than the money that we anticipated spending.

A lot of information has been shared in the last month. Yeah. I agree with your point and premise, but I do understand that this thing is scalable and it's fully functional and scalable. So we can hold tight. So we're going to build this bare bones thing and then hope that it's the catalyst that encourages the donor to follow through and seize the enthusiasm from our town and how they can be helping our community. I think it's important to send that message And after talking with our accountant, if we do take that extra portion of the bond, the carrying costs that would be payable next year, right now it's $6,000. I think it's well worth risk to give us that year to bridge that gap and reimburse the bond portion. The Parks and Rec, we're supposed to use that money for Parks and Rec. I can't think of a better way to do it at this point other than a splash pad that's ready to be integrated that people have been talking about for years. We can all agree that we don't like how we got here and we had to learn from the fire hose in the last month as to how we can do this the right way for the tooth saving. We do have a path forward in our commitments to get it done.

We should just add for the public education, one of the things that drove the cost increase here ended up being placement. So this thing is anticipated, not anticipated, would go where the old ice rink was in Betts Park. One of the issues was that was an ice rink that was filled in with fill, which wasn't stable, which added some significant costs to the installation, this thing, make sure that we didn't put it in and have it cave in because it wasn't placed on a solid base. And we have, we, as well as others have the same, we don't want to have whether or not that was the best place for it. No, but we are where we are, so.

And again, I just think it's premature that we could hold off until we got a commitment from the donor. I'd feel much better knowing that we're not risking a substantial amount of money, especially with, I mean, everyone here in this board knows we have costs increase coming to this town, garbage collection, union contracts. All these things are coming our way. We have to be fiscally responsible with our taxpayers' money, and this is going to happen. People are gonna want the additional concrete. People are gonna want the walkways to the bed. They're gonna want it fenced. and next year we're gonna be talking about it, we'll do it right. I don't mind doing it right. I 100% want to get this donor that got us a check and build it right the first time. And we may get there. We might get lucky, like you said, Tom, that he might come up with a check. I don't know, but I'm not gonna roll that dice. You guys can, you have three votes, move forward. We'll see. Hopefully you guys are right. I want to be wrong.

So it's my understanding, and let's clarify this. The splash pad goes down and this additional work and additional amenities can be added to after. Did everyone understand that? It's not going to damage anything done. It's going to add on. I just don't want to approve this without an attachment in the resolution that states that the only monies prior to a donor that we would commit would be to make it workable.

Right now, the only thing that's in front of us right now is this contract, purchasing the other stuff.

It just makes me a little nervous to leave that door open.

And we need to. Water actions based on how much of it to highly department so long to keep this nation. Sorry.

My understanding of this grant, and you were here, Tom, is that the whole spirit of this Miracle League grant was to include a splash pad.

Sure was.

And that's why the bond, the resolution went into play for an extra $200 because they knew then with pricing there would be a gap. And the whole spirit of this was to have a splash pad. And that's why that board approved that. that's correct i just want to make sure i'm yeah and clarifying for everyone else we've had extensive discussions about this by the way um this is more of a discussion normally before we take a vote up here that i've been a part of um but there's been a month long of discussions we we are here in a manner which we didn't um we're not happy about but we have to now make decisions with what we've been given so that's why that's why we're dealing with doing this before we get a donor in place and i'm not trying to push help us there's no rush it's funny we didn't we didn't suspend pause on the order in july

after we get the donor. That's, again, I'm not going to beat this. I'm not going to beat that. I'm just saying that's my position. I actually think I've been very clear. I'm not, I'm just, I'm a no.

So first is Local Law Intro Number 4 of 2026 to amend Chapter 386 of the Town Code for e-bikes and scooters.

Yes. So in concert with the Traffic Safety Advisory Board and the Grand Island Police Department, there was a request to update Well, initially to write its own law, but our town attorney explained to us we had a law that just was old. So we updated it with our new technology. And I make a motion that we send this to our advisory board for comment. And should we set public hearing now? Well, we'll just send it to the advisory board to see where their comments are and then we'll send it back.

All right. Item 11 from Councilwoman Diehl, a resolution for Verigy.

So a little background on this. The town issued a request for proposals for energy solution services related to municipal facilities and infrastructure improvements. Following review of proposals, Verigy Energy Solutions was determined to be the most qualified and responsive firm. the recommendation is to adopt the attached resolution selecting barragee as the town energy source solutions partner and authorize town officials and the town attorney to finalize and execute the attached draft letter of intent following a scoping meeting with barragee's development team to determine projects for inclusion based upon the completed audit of town facilities and operations The process moving forward at this point, there's no financial obligation associated with this. The resolution allows Vergy to engage directly with town stakeholders and department representatives. Vergy and the town will collaboratively determine which projects are best suited to move forward for further development and evaluation. There is a summary. I tried to give a lot of information in this just so we would historically know where we are and where we're going with this. So next, we would select them tonight as our partner. Then we would participate in the scoping meeting, finalize the projects for inclusion. Then we would set up the letter of intent based on those projects. They begin their investment-grade energy audit. They provide us a guaranteed maximum pricing and savings calculation. That means they are responsible if there's any change orders, unless we change the scope for the project, that... They are then responsible for whatever the price is set and we agree on that's what it is for the product. And then we do our construction contract and execute it. So I'm making a motion to adopt the attached resolution as it reads for selecting Vergy as the town's energy solutions partner and and authorizing town officials and the town attorney to finalize and execute the attached draft letter of intent following a scoping meeting with Vergy's development team to determine projects for inclusion based upon the completed audit of town facilities and operations.

Did you? I'll give you the cliff notes. So I think this is gonna be a great move for our town. It will allow us to do projects that we feel we can save both energy, meaning dollars, from energy costs or operation costs. And those savings then should in turn pay for the project over the course of whatever the set time is for it. The thing that I like about it is They have their team of trained professionals to come in and look at a project. When they lay it out, then they become responsible for the completion of it. And for, as I said before, the cost of completion, we will not sit here for a change order over and over again on a project so we can control our budget.

Their presentation was great.

I've been working on this for about two years.

Mr city data is requesting permission to start the bond authorization process for 750,000 dollars for the 2026 paving program. This year's project include the mill and fill of 1.6 miles of town roads and shoulder widening mill and fill 1 mile of staley road with road striping to be determined necessary drainage improvements on staley. To be done by the town of Grand Island, Staley Road will be starting at baseline and heading west towards River Road. I pray sound a $300,000 from 1.6 miles of mill and fill of other town roads and $450,000 for the one mile of Staley. So motion is in order to authorize. Second. Any discussion?

Aye. all right and so from department of engineering and wastewater resources item number one we have a change order to our veterans park access improvements bob rides additional work requested on-site conditions and error and estimated quantities from the bid for the project have resolved the need to add scope and funds to the awarded project So he's got another $6,267.50 in survey services and then extra quantities for piping and surface drainage in the amount of $12,055 and a pathway sub-pace stone was incorrectly estimated requiring an additional $25,930 in materials. So he's looking for at least $67,000.

Student advisor's not here, huh? Student advisor's not here. Is this $67,000? I don't know. I don't know. That's pretty good. Percentage-wise, it's pretty good. I don't know what some said about this. You know how much I love Chain Warriors.

No, I mean, some of it was. Some of it was. There was, like, with the stone, they ran into issues with depths and draining.

We're starting to borrow what we needed. The fact of the matter is, this is a $67,000 mistake. I'm more than frustrated that these things keep happening because we're going to end up paying for this long haul because we're going to pay the bond. I keep thinking about it. I keep thinking about it. I don't know. That's why I'm leading into that. That's why we just passed this other motion. Change orders won't cost us anything.

Unless we change the project.

We didn't change this project. This was engineered by anything else. Frustration continues to grow.

She'd truly appreciate it if the town board would set them on the agenda for Monday night, June 1st.

Oh, Daniels, once again, I'm asking the board for a resolution for a public, yeah, for highway safety design. As you know, my granddaughter was killed September 11, 2024, my granddad, on her way back from the playground at Caglebine. I need that in order to get any further movement with the state. I don't know if I gave you a copy of the police report, but I'll give you one tonight, okay? So I've been told informally that there's litigation pending and that's why no one's doing anything. That is not a good reason not to do the right thing. The right thing is to try to prevent future injuries or fatalities, okay? Complete Streets was a study that is a law that's passed, Chapter 398, Laws of New York, signed into law August 15, 2011, requires state, local agencies consider the convenience and mobility of users when developing traffic projects that receive state and federal aid. The town of Grand Island has yet to do anything. And this was established in 2011. Little research, very little research. There's two that were done, one by the city of North Tonawanda. and one by the town of Town of Wanda, which basically gets things moving together. One of the problems is that the State Department of Transportation is responsible for the expressway and is owned by the parks, and there's a town road in between, Broadway. It's sort of being a loggerhead, nothing's getting done, and someone else can get hurt any time or killed any time. So again, I request the board for resolution for highway design study. Where Leo was killed, the road arcs. If you drive wide at night, you'll notice your headlights go up. The road needs repair. Hopefully someday it'll get fixed. I've been to the Traffic Safety Advisory Board meeting twice. They put their comments on YouTube. One of their comments was, this guy's been here too many times. Okay. I knew four times I was only actually twice. So and prior to the vote, Mr. Herman mentioned to the members of the Traffic Safety Advisory Board that there's litigation pending. That may impress people's votes. They did nothing. Nothing whatsoever. Bad things happen when good people don't get to do their job. So Any comments? I'd like some kind of resolution, please, for the state for a highway design study, also known as an impact study.

No, I want to be first. I got nothing. I just want to tell people Mr. Garcia just created a law for these e-bikes. The other day I was just driving down, and there was two kids on the road on those munchies standing up. They were flying right at me. And they're in the row that time so they're i'm telling the adults and look out for these kids because they think they think they think they're invincible so as adults, we have to make sure that work our eyes feel for their their kids will be kids so. Have a heightened sense of summer and kids and that's it.

I go the same thing. They're everywhere. They're going. There's good things. They're going to parks. They're going fishing. They're going to do things that they should be doing. They need to do it safely. Also, I'm just thrilled for its daily road. So happy that things are moving forward. Hoping to continue the momentum. It's bad to say same here, but I know Staley has been a concern for a long time. I've been here six years. I have tried to push it for money and funding. It didn't go anywhere, unfortunately. But Jim, yes, hats off. Kudos to Jim. We're excited to have him and this as i said last time it's a part but at least it's a start and if you get started then you can do next phase he has a plan for that so excited to see that all right um first summer as you saw with our special implementations good stuff been around until all great towns hope you enjoy that and

I know we're frustrated with the change order and I speak a bit about some feedback we've received about that. That's part project because unfortunately having the wettest spring basically forever has made a drag on, but fortunately we were able to get Little League back to Veterans Park this weekend. So thanks to all the volunteers at Little League, to Tom Ciceri in the Parks Department, to McLeod Leon, they're doing a great job. It'll be awesome when we have those paths. Everybody can access. It's been frustrating, but a lot of people have worked really, really hard to try and make sure that kids got their little league season. So I wanted to say thanks to everybody for that.
