Item A is consideration to ratify contract number CS20260140 with action automotive towing executed under the City of Rose Emergency Declaration Resolution 1921 for the use of heavy equipment support to remove hundreds of large propane tanks washed down Upper Canal Creek caused by the September 26, 2025 flood event for a total contractual amount of $35,600.00. 75% of this cost will be reimbursed by DEMA contingent on eligibility requirements to account 208008008 DEMA 2025 flood. The remaining 25% will be funded from account 1055. 5-1-2-9-6, DEMA 2025 flood match. Travis.

Thank you, Mayor and members of the council. So this is one of those looming invoices that we still had to process from early October when the work was done to remove those propane tanks, so our late September, early October. So we finally got the invoice in, and so we're just here to ratify it so we can ask for reimbursement under DEMA.

Do we have a total amount that we've reimbursed Action Towing, and is there any remaining amount left that we're still waiting on paperwork?

There are some additional amounts supposed to be coming in. We're still waiting on some of his clarification as to where the vehicles came from or who the if the insurance paid or not. We issued a check of 40-something thousand, I'm not sure, 45,000 roughly, I think, about two months ago, and then this check here, and that's everything that we've gotten all of the information for from him at this time.

So we have a total of about 80,000 that we paid action to.

And this is just a portion of the 80,000 that we own?

Yes, because the other was on the vehicles, We received several, I think it was like 17 invoices on separate vehicles, and they all had various prices depending upon the equipment that was used and the people that were used to move those vehicles. And that's already been paid. It was paid a couple of months back. And then this is just for his time for sitting there waiting to remove the propane tanks and the VARIOUS VEHICLES, BUT MAINLY PROPANE TANKS OUT OF THE CREEKS FOR SEARCH AND RESCUE.

THIS SATISFIES OUR REIMBURSEMENT REQUIREMENTS FROM DEMA THEN TO HOPEFULLY GET 75.

MR. MAYOR, MEMBERS OF COUNCIL AND DAN, IT'S A DIFFICULT PROCESS BECAUSE WE CALLED OUT THE TOWING BECAUSE IT WAS AN EMERGENCY ACTION, BUT IN ORDER FOR THE CITY TAXPAYERS TO GET REIMBURSED, Deema requires that that we'd be the last payer and and some of some of these cars had insurance. Some didn't. It's very hard. Police knew how hard it was tracked down ownership. And so the vendor had extremely difficult time trying to track down where they insured where they not and get the. get the paperwork that they needed so they could submit so we could get paid. And not paid, get reimbursed. So we're very thankful to the vendor for doing their legwork and complying. We both suffered under the DEMA process. Great. Good deal.

Item B is consideration to approve the guaranteed maximum amount price not to exceed $5,000. $5,632,888.79 for contract number CA20260107 with Tiffany Construction for the Upper Pinal Creek Remediation Project based on 90% design plan and authorize the mayor or designee to sign all documents. 75% of the cost will be reimbursed through account 2080 08009 NRCS Sediment Removal. The other 25% of costs are to be funded through account 105551297 NRCS Matching Fund with a possibility of a waiver of the matching requirement. Should the waiver be approved, 100% will be funded through account 208008009. Travis.

Thank you, Mayor, members of the council. So this is for rip rap, bank and stabilization in certain areas of the creek. So in order to get that going, we have a set of resolutions that are gonna follow this item to allow us to get into the private property. But this is the next phase of the construction with an Upper Pernod Creek to mitigate flood control.

So Mr. Mayor, members of council, just to kind of give the 10,000 foot view on this, again, NRCS funding, we were allocated 24 million total, 21 in construction. We knew from our partnership with the county That that 220 days is tight. Now, if we, if we are in the middle of a project, they will, they will extend that out, but there won't be time to start any additional projects. So, so we jumped on getting the lighter flights, getting the engineering done. The county had the advantages. They had engineering on their 2 projects and that's when they got so much done and we were still waiting for engineering and construction all within that 220 days. The first phase was the sediment removal. And we were heavy to get that done before the monsoons came. And I think we got it done about a week before. I mean, everybody knows monsoons are here. I saw it on Saturday. I saw it last week. We got that sediment done. Now, that price came forward about $3.6 million. Yeah.

That was originally three, almost $4 million, and I think they were under.

Yeah, I think they'd come under. So that's good. Well under, yeah. And as you recall, we always talked about the 21 million. We weren't sure where we can get the match. Well, now we know, so that's good. But so we had the sediment removal. While they're doing, while Tiffany's doing sediment removal, CivTech is doing the design for this riprap. That they're doing now now, they're 90% plans we've negotiated. We have the price and with the signing of this Tiffany can stop start tomorrow with doing that that rip rap, which is set in place. It's not the super super banked ones that Tiffany's doing in other areas. But it is the most expedient to get the most linear foot of bank stabilization at the lowest price and the quickest install that will work. And it's still because we have the luxury of wider channels. So the angling of the banks is a lot easier. easier to do rather than what you saw the super steep stuff that they were doing some other places. And that's what we're approving here. Once Tiffany starts on this, CivTech will now work on the heavy duty walls, the vertical wall designs. And that would be the primarily for behind for priority street. Those need to be designed, but even though we're probably not going to go over our 10 of the other 21Million, we won't be able to start that 3rd phase by the time they get the engineering and everything done. We're going to be, we're going to be pushing up against that September 17th. September 11th deadline and so so this this bank stabilization will probably be all that we're able to get done under under that those those funds. But those were our 2 goals. We knew from the beginning that it just wasn't possible to get the vertical walls under this 220 days. And so, but we do have. Connie, what's the name of the program? We were looking at EWP money to do the second series of funding and then we have a much longer timeframe to operate. We won't be under the clock. But it was good that we're under the clock. It was good that we got this money fast and we got the bank stable, the sediment removal because, I mean, they came in on Saturday on the Miami side. We were worried here, you know, there's gonna be a long monsoon season, but everything that we've seen is the creek is handling passing the water. The goal of the creek is to get it from one end of town to the other end of town safely and within the confines of the creek, and that seems to be working. So this is that middle portion. We still will have... Engineering plans, which that's going to be great because that'll save us time when we go to the vertical walls. But but this is this has played out. Well, and because we're probably not going to go over the 10Million where we didn't get the FEMA, but we so we're at 25% requirement for match, which, if it was totally if we spent every money that we every penny that we. Approved we would have a 2.5Million dollar match and thank you to state of Arizona, both the governor Hobbs and the Republican House and Senate for coming together and agreeing that this region needed some money. And so that's how we will pay that 2.5Million when we get to that. That's where we'll put that money is towards this match for this program. Question.

So we're gonna finish this part of the project. And then after the deadline goes by, We're waiting on more funding in order to complete the rest of it.

We'll start the application process for the 2nd, round of funding for the vertical walls that we need to put in.

That's mostly Rudy, right?

There's most of well, I think and are the 2 that are the are probably the most. Critical, I would say, and the intentions and Travis correct me if what I heard their intention is not to take the old ones down and put new ones up. Their intentions are to just leave the old ones in and then put another layer of wall. So you'll have kind of double protection and do that. And that's the design that we're doing. And and then we'll, we'll get, we'll have hopefully have a match fund. You know, there'll be a match. What's a match on funny. On that money, the money for the 2nd, phase of. Yeah, 25% we'll kind of stuck in the 25% market. But, but we'll see what the prices are and we'll be able to take a little bit more time and do it. But the sooner we can get those up, the sooner we can protect our downtown downtown and and our neighborhoods. So.

So out of the 21 million, then we're only about $10 million spending in projects. So we'll have a 25% match on the 10 million. The next round, the EWP funds, how long does that take once we submit? Is it pretty rapid? Is it the funds?

How long does it take to submit for the EWP funds? Why don't you jump up there? OK.

Okay, can you repeat the question, please? I'm sorry.

Yeah, on the EWP funds as we submitted, what's the turnaround to know if we got awarded the money or not?

Okay, so let's back up just a smidge because the process is on the 30th day before the end of this current project, we have to put in for the extension. And the extension, we don't know what that is yet until NRCS looks at how long is it going to take to finish the current project. and then I'll get a notification to apply for the EWP long-term emergency funding, which is what I'm being told right now. They would like to put that money under that program, and then that application will go in. And I think, I'm assuming here that we would get awarded pretty quickly, because they want to keep these projects going. They want the money out the door. but first we have to fill out the applications appropriately, we have to demonstrate that we do have cost share for that, and et cetera.

Do we have to be under the extension to apply for the EWP? Or can we let the initial NRCS project expire and then we apply for EWP?

We can, but I wouldn't wanna do it that way.

And so what will be is the design under the initial, which will be the vertical wall designs, that is what we're gonna, that'll be the extension to loop over and hit the second bucket. No, this, Connie, this will be past the 220 days.

Right, there'll still be deadlines, and if it's gonna be 18 months or it's going to be less than that. NRCS is known for wanting to get their projects done quickly, so I don't believe that they award past a 12-month mark. Thank you.

Freddie. Would this be under the same contractual agreement with the current contractor, or are we going to have to go out to bid again for this second phase?

I'm going to have to look that up and see what, if we can continue with that contractor or we'd have to go out to bid again. I have to really look that up for you.

So I would say the contract currently says not to exceed the NRCS award amount. That's what it says. So if we need to update that contract because it's different awards, then I think we need to come back and update that. But we can still use the same cooperative agreement with Gila County, I believe, to do that.

Right because I think he'll counties doing a project also so, but but no, we'll like, say, we'll get the details on the application and the procurement and how we do this. And we've been very happy with Tiffany's work, but we have to make sure we make a fair offer and follow follow our procurement code and follow the grant application guidelines.

So the initial $10 million, we have the match for that at $2.5 million with the state appropriations. It's future EWP projects that we're going to have to come up with 25%. Okay.

Now, the and now, the only thing I wanted to add was, I will say that that the initial evaluation of our creek before we had the light our flight is that we were going to have to move what? 250,000 cubic yards of of sediment and we, we only had to move about one fifth of that.

I believe it was about 100,000, what they originally said, but I think we're about 50,000.

So there was a lot less sediment that was removed. And again, the goal was to get it down to historical level because that's where the manholes are. That's where those concrete barriers are that we have. But if you've seen it, it looks really good.

Thank you, Mayor, members of the council. So I will just kind of go over this as a lump sum of what the next items are about. So item C that we're talking about now, D and E, or those three are going to be ingress, egress, permanent ingress, egress easements so we can get into the creek to do maintenance in the long term. And the remaining items from F2R, are all permanent public drainage easements in order to actually do the maintenance. So they're all tied to a specific parcel and to that property owner. And so once we, pending approval today, we're gonna get these easements signed and notarized by the property owners and then take it to the recording office to get recorded.

Go ahead. So the key phrase in the resolution is permanent ingress, egress to all these easements so we don't have to go through the process?

For the first three, and the next one will be a permanent public drainage easement.

And it has the property owner and parcel specific in the resolution.

I'm sorry, Mr. Council, to Travis, so that drainage easement Is allows the, um, the bank stabilization to to go on their property and then we will have the maintenance responsibility and not the property owner. And so they get they get the protection. But but this is part of our again, this is the weakest link in the chain thing. We have to make sure that the creek is fortified all the way down where it needs to be. And so we take that responsibility.

This takes care of if there's any future floods, we do not have to get these right of entries, these temporary construction easements. This allows us to go in there right away. I think pending some other Army Corps engineering umbrella agreement that we have, but it allows us to go in there right away and not have to track down every property owner every time we have to deal with something.

That's good.

Go ahead, Fred. Would this aid us in our future O&Ms that we had talked about in a previous meeting for future creek maintenance, things like that?

They'll take care of that. Allow us to have access to maintain.

So Mr. Mayor, members of council, and to Travis, so we were having council approve these first, and then we're going to reach out to these property owners and have them sign?

Yeah, from my understanding, they're aware that we're putting these drainage easements together. So what the council would be doing is accepting that that drainage easement from the property owner and we're stating that we will maintain it. So we have to accept it first saying, yes, we will take responsibility of that.

And so then we'll reach back out to these individuals and show them that you are willing, the council, the body is willing to do this. We'll take this on and then they will be signing after knowing that we're doing that. It also facilitates us getting the signature. One meeting for these, we go out and get the signatures, and as signatures rolls in, they'll start, Mike Garrison will start working on those properties that we have.

So that's a one-time fix. We don't have to worry about it two years down the road if we have another flood.

Correct. This is the plan that Melissa's been talking about for about six months, where we... We get to get in there to do the survey, we get in there to do the temporary and the cleaning, and now we have the long-term. And the plan is coming, is working.

And there will be some more future ones coming down the road too once they design the rest of the infrastructure they need to, but these are the first batch to get through this phase.
