By highlighting the essential role municipal courts play in maintaining public safety and fostering public trust in the judicial system, this annual observance will increase public awareness and appreciation of the work performed by these professionals. I'm proud to be part of a team who works hard to be patient, support each other, and adapt when laws or processes change, which they often do. Their commitment and willingness to adapt reflects not only this court, but our city, always growing and adapting to new challenges. This week is about more than just recognizing the court system, but the people who make it possible. They serve our community with integrity, compassion, and professionalism every day. Vice Mayor, Commissioners, as Matt stated, the Special Olympics Canvas Lemonade Stand Battle Day is set for August 26, 2026. And the coordinator, Caitlin, she had asked for this proclamation to be made. And I guess the chiefs are here as well. to eliminate stand battle.

This is actually the first time that we've done a proclamation for this event, but I know this is not the first year of the event, so staff recommends that anybody approve of the proclamation as presented. Under report of the city manager, Item 7A, Finney County Director of Emergency Medical Services, Smith, will present a quarterly update on Finney County EMS.

That's Mayor, Commissioner, Commissioner, Director of Big Time DMS. Excuse me. So for the first quarter of 2026, we had a total of 1,024 calls compared to our second quarter where we've had around 1,045. Also within the second quarter of 2026, we hired a person from our resort squad to fill in as a float for all three shifts. The concept has worked very, very well for the service and have been a very good asset in being able to go through all three shifts. Currently we are sitting with two open positions, which honestly last week we filled one of those positions, so now we're only down to one position, which we then kind of filled from those interviews that I talked about up there. We continue to conduct monthly trainings with our staff, along with we do separate trainings with Bering City Fire Department. The trainings that we are doing with the Guard City Fire Department has definitely enhanced our operational efficiency and has made our partnership much better. Station orders coming along nicely. The punch list items have been finalized as of now. The offices and bedroom furnishings are being installed as we speak this week. And then for the last few months with school getting out, we've had a lot of community engagement and events and we're looking forward to school now starting, which then starts our new cycle over again. We are in the process of revising our internal policies and have recently had our medical protocols reviewed and accepted by a new medical director that we recently have got. So you can see just a breakout of the calls for the city, whether it's gonna be station one or station three, as you can see. And then we just list out, like everything else, county responses. whether it's going to be a nursing home response, and then Holcomb and or Tyson, and it goes on from there. And then the next picture with high graph Kind of makes it out a little bit better to where it is solely Station 1 and Station 3, whether it's city or county. Aeromedical transports, the nursing homes are grouped together, and then the latter of what needs to be picked up. So just to kind of give you a brief overview of what we've been doing. It's not something you... see very often, so we'll certainly be taking pictures and video footage and the like so people can see it in replay, but it might be something fun to make a point to get out and witness it happening, and you can certainly see it from a safe distance away. Item 10A, the governing body is asked to consider and approve an amendment to the Garden City zoning regulations regarding microdata facilities. Alicia.

Recently there's been an influx of data facilities on both small and large scales. Because of the increased development of these facilities nationwide, the City is proposing an amendment to the zoning regulations to set parameters for any new development regarding micro data facilities. Neighborhood and Development Services has worked with the City Manager's Office, Public Utilities, and Public Works on the proposed amendment to address zoning, water, electric, wastewater, and building code requirements. The proposed zoning amendment adds definition for micro data facility and designates it as a permitted use within the I3 heavy industrial district. Though micro data facility is a permitted use, there are very specific requirements that must be met. The definition for the micro data facility is as follows. A building or structure or a group of buildings or structures designed, equipped, or used primarily for the storage, processing, or transmission of digital data through computer servers or other information technology. Data storage, networking, or telecommunications equipment provided, however, that the combined ground area covered by all such buildings and structures on the property including any such buildings and structures located on contiguous land under common ownership or control shall not exceed 100,000 square feet. B, no such structure is stacked upon. C, no such building or structure exceeds one story in height. And D, no such building or structure is below grade. yet the maximum electrical capacity available to serve such buildings and structures shall not exceed 10 megawatts. Regardless of the source or location of the electricity and whether it is supplied by the city by any other person or provider by generation on the property or by generation located elsewhere and delivered to the property by any means, unless for city supply power, a higher capacity is specifically authorized by the governing body by special contract pursuant to section 90-275 of the city code and amendments thereto. or for any non-city power sources as otherwise approved by the governing body, an F if a liquid cooling system is used to serve such buildings and structures. The cooling system shall be a closed-loop cooling system, and any discharge from any such cooling system shall comply with Article 8 of chapter 9b of the city code and the amendments thereto. This term shall include but not be limited to a data center, data processing facility, data mining facility, computing or compute facility, server farm, and digital infrastructure facility. together with the accessory equipment, support systems, and structures customarily associated with such uses, including without limitation, electrical substations and switchgear, transformers, backup, or any standby power generation, uninterruptible power supply systems, cooling and ventilation systems, fire suppression system, fuel and water storage, fencing and security improvements, and similar supporting infrastructure. An amendment to the Code of Ordinances accompanies this attached zoning amendment. Although the ordinance for the zoning amendment is the only ordinance that the Planning Commission has authority to consider and recommend to the City Commission, The draft ordinance amending the code of ordinances was provided to the Planning Commission as supplemental information. At the July 26, 2026 meeting, the Planning Commission recommended approval of an amendment by unanimous vote. Your alternatives today are, one, the governing body may approve the ordinance, or two, the governing body may not approve the ordinance. Staff recommends the governing body adopt the Planning Commission recommendation by approving the ordinance.

The planning commission minutes really did answer a lot of questions that I would have had. It was very thorough, and I thought that they really did a good job of asking the questions and providing the information that needed to happen to kind of understand all of the things that need to go into this. And I really do feel like this is a very proactive ordinance to kind of put in place what those parameters are. So thank you for that.

I agree. It was the information from the Planning Commission was very in-depth and kind of, well, like you said, answered a lot of the questions that I was going to ask, but it pretty much answered everything.

Yeah. I agree. I feel that we are taking a proactive approach on this and defining what we are going to allow. And especially on the cooling requirements, having that closed looping cooling so that we can reduce that water consumption and it helps prevent that improper discharge. So I appreciate all the hard work that's gone on behind the scenes.

Item 10B is a companion item of the one just passed. The governing body is asked to consider and approve an ordinance creating new code sections 90-401 through 90-406 establishing requirements for microdata facilities. And if approved, this ordinance would be 3053-2026.

Item 12A, the governing body is asked to consider and approve publication of the notice of hearing to exceed the revenue neutral rate and the budget hearing scheduled for September 1st, 2026 at 1.30 p.m. Colleen?

Good afternoon, Commissioners, and here... Staff has made changes to the 2026 revised and 2027 original budgets to reflect the direction provided by the governing body as presented and discussed at prior meetings. These changes result in a final mill levy rate of $38.502. It's consistent with the current 2026 route. At this time, notice of a hearing to exceed revenue and jewelry and budget hearing can be prepared and published. A draft notice is included with this item. The draft notice incorporates a flat in the lobby of 38.502, as that is the rate provided by the publication by the county clerk on the notice sent to contactors. The public hearing on the revenue and jewelry and budget is scheduled for September 1st, 2026 at 1.30 p.m. Incorporated into the budget that has been presented are the principal and interest costs for a 10-year term general obligation bond for the water and wastewater fund and the approximate amount of $11,610,000. This will cover the cost of improvements to the headworks facility at the wastewater treatment plant as well as the city's obligation on cost for the water reuse project. With the commission's approval of the draft notice, Staff will begin working with the city's bond council and bond advisor to prepare for the bond issuance. Alternatives, the governing body may authorize staff to publish the notice of hearing to exceed the revenue, jewelry, and budget hearing. For September 1st, the governing body may provide direction to staff on additional adjustments to be made to the budget and authorize staff to publish the notice of hearing to exceed the revenue and budget hearing for September 1, 2026 at 1.30 PM. The recommendation is staff recommends the governing body to authorize staff to publish the notice of hearing to exceed the revenue and budget hearing for September 1, 2026 at 1.30 PM.

Item 12B, the governing body is asked to consider and approve the quote from Nextech for $30,829.52 to complete the remaining work on the Salto Door Access Control Project. Michael.

Vice Mayor and Commissioners. The governing body is asked to consider and approve the quote from NextStack for $30,000, $829.52 to complete the remaining work on the Salto Door Access Control Project. The City of Garden City IT Department started a project in October of 2025 to replace the door access control system with Salto branding equipment. The original approved quote from American Digital Security to perform this work was $170,810.65. $128,107.99 of that was billed and paid. The remainder of $42,700 was placed in the holdover account at the end of the year. Due to unforeseen circumstances, the city of Garden City and the vendor, American Visual Security, mutually agreed to dissolve the contract before all that work was completed. Michael Rohrer contacted Nextech to provide a quote to finish the original scope of work. Nextech submitted a quote of $30,829.52. This will complete the project for less than the $42,700 in remaining funds. This work was not put out to multiple vendors for bidding because Next Tech is the only other vendor in our immediate region that supports the SALTO brand equipment that the project was started with. Given the nature of support and the need for responsiveness, a local vendor was preferred. Alternatives the governing body approves the quote from next step in the amount of 30,829 dollars and 52 cents. To complete the remaining work on the salt and door access control project. Alternative to the governing body may not approve the quote and direct staff further. recommendations, staff recommends that the governing body approve the quote from VEXTEC for $30,829.52. Fiscal notes, the quote from VEXTEC for the $30,829.52 is less than the remaining funds of $42,700 that were held over in that capital improvement reserve to complete the project. So this project is expected to be completed under budget resulting in a positive financial impact. I'd be happy to answer any questions.

So we approve this and when should this be totally completed then by date time wise?

Date and time, I would say in the next six to eight weeks we would have it wrapped up.

I just want to remind everybody, today is the primary election, so polls are open until 7 o'clock this evening, so please go out and vote. Also, national night out tonight, so we'll be out and about. I know a number of the commissioners will be out. along with our first responders visiting the community. It's always nice to be out in the community and visiting the various locations that are participating in the National Night Out. Also, the street department continues to do their striping. around the community to get started for the start of school. So just be mindful of the street department out there painting those lines in the school zone areas. Also, just want to also remind that they're also doing some restriping around the community as well. So again, just be cautious and drive safe around the equipment and those personnel so they can get those stripes laid down and everything in a safe manner. TALKING ABOUT THAT AND SAYING SCHOOL, SCHOOL STARTS FOR GARDEN CITY PUBLIC SCHOOLS NEXT WEEK WEDNESDAY. THAT IS A HALF-DAY ORIENTATION FOR KINDERGARTEN THROUGH 5TH GRADE, 7TH GRADE, 9TH AND 10TH GRADE STUDENTS AND ALL NEW STUDENTS TO THE DISTRICT. JUST WANT TO REMIND EVERYBODY ON THAT DAY SCHOOL ZONES WILL BE ACTIVE. SCHOOL BUSES WILL BE DRIVING AND PICKING UP AND DROPPING OFF STUDENTS. Just to remind everybody that when a school bus is stopped with the stop arm out and the red lights flashing, please stop both directions to get our students on and off the bus in a safe manner and to their destination. So yeah, we had to put that pitch in there. Just had a couple of people ask me about 3rd Street. I know a couple of weeks ago we said it was going to be two weeks. And at the start of August that we were going to open up, 3rd Street was going to open up. And it's 1st of August and 3rd Street isn't open. So they asked me again, so when is it going to open up? So...

Commissioner, the plan is to get this street striped by Wednesday, Thursday, and it could open up by Friday of this week. Worst case scenario, first thing Monday, it'll be opened up on third street.

I JUST WANT TO START BY SAYING IT WAS A GREAT PRE-MEETING, BEING ABLE TO GO OVER THE LEE RICHARDSON ZOO STRATEGIC PLAN AND CAMPUS PLAN, BEING ABLE TO LOOK FORWARD TOWARDS THE FUTURE FOR THE ZOO. ALSO EXCITED TO BE GOING OUT WITH OUR FIRST RESPONDERS ON NATIONAL NIGHT OUT THIS EVENING, AND ALSO JUST WANT TO SAY THANK YOU TO EVERYONE WHO PUTS TOGETHER AN EVENT FOR TONIGHT AS WELL. HAD THE OPPORTUNITY TO MEET WITH A GLOBAL GROUP ON MONDAY OVER COFFEE. I JUST WANT TO SAY THANK YOU TO THEM FOR INVITING ME. Thank you. One of my takeaways from this morning's pre-meeting was that Lee Richardson Zoo is the living room of the community and I'd never heard that before and I thought that was so cool. I'm going to use that. Because I think it's so true. I mean, it is one of those places where you go and it's just a comforting place if you need to go for a walk, if you want to just see what's going on. But it really is the living room of the community. And so, Christy, thank you for that because I thought that was pretty important. Stuff the Bus was just recently held, and we gave out over 1,400 backpacks to students attending public schools in Garden City and Holcomb. Well, any school in Garden City and Holcomb. And we also have backpacks at the Salvation Army if they are needed, and there's also some school supplies there as well. THIS YEAR'S EVENT WAS REALLY GREAT FOR ANYBODY WHO STOPPED BY TO SEE THAT. JUST SEEING THE COMMUNITY WORKING TOGETHER. IT DIDN'T MATTER WHO GOT CREDIT. IT DIDN'T MATTER WHO WAS IN CHARGE. WHAT MATTERED WAS THAT EVERYBODY WAS THERE FOR ONE PURPOSE, AND THAT WAS TO MAKE SURE THAT Students started school with the tools that they needed to be successful. And it was businesses and nonprofits and individuals and people who are retired and from all walks of life. And it was just really a great day. And it reminded me of how great this community really is when we all sort of pull together and make something like that happen. I had an opportunity to sit in on the county-wide sales tax oversight committee yesterday for Mayor Wynn, and we talked about a lot of different things. One was the Fire Station 3, and of course some of the repairs that need to be made on the Apparatus Bay. We talked about kind of an update on the temporary sheriff's office and police department. I wanted to say SONPD, but I figured I should clarify that. and kind of a timeline for that. And it is just a really good committee to make sure that everything that has to do with sales tax, there is a committee that oversees that, looks at expenditures, and makes sure that the reason that you voted for that sales tax, that those things are happening. So it was great to be a part of that committee. attended Mike Muirhead's retirement, as I know a lot of you did, and it was a really nice celebration for Mike, and I know, Fred, we look forward to your tenure as Public Works Director as well.
