Common Council - Special Meeting

Okay, I'm going to go ahead and open open the special open the special council meeting at 7:00. Please rise for the pledge of allegiance. I pledge algiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. Okay. [clears throat] As soon as Carol gets up here, we'll have her do roll call. You're doing everything. Double duty.

present. Okay. At 7:01, I'm going to go ahead and recess the council meeting and open the public hearing. And this you have something to say during this. Did she tell you? Okay. This is the public hearing on the annexation property of uh Tony Dale Reel. It's behind the blue green elementary school back in there. So, um does anybody have anything they would like to say or anybody in the audience? Are you here for the public hearing on the u annexation of the property behind the blue green elementary? Okay, recap. What does that mean?

Okay, it is the annexation for the property that uh joins behind, let's see, which way would that be? West of the blue green. Um and so they're asking for annexation of that property. It's owned by Tony Del Real. And then um did she give you any notes on that? I'm trying to think. It's a It's a residential development. Yeah, a residential development. Tell me the guy's name. Barry Barry I can't think of his last name. Kaisle. Kaisle. Kaisle.

Barry Kaisle wants to develop a portion of that and put uh condos or uh duplexes in there and then otherwise that other property would be for development and however Tony decided to do that. So, it's that property back um off of Kug Road back in there. Are you familiar with that area? Yeah, I live that road. Oh, okay. Is that why you're here? [laughter] Yeah. Okay. So, there's they're asking at one point they're going to do development just first of the duplexes and then the other property um they at sometime would have single family dwellings.

Standard plots. The one directly behind the three in blue or both of them? They're all this. It's all the same. Owned by Tony. Yes. It's just that they're going to develop just a portion of it first. So,

what approved? Okay. So, that's what we're going to do tonight. This is for the annexation part of it because right now that's currently in the county. So that is to bring it into the city. Now tonight we will do a resolution along with first reading on an ordinance for that purpose. The resolution is to approve the fiscal plan. Thank you. You're welcome. Um the only note that I have to say is that currently 100% of the land owners of these parcels that are subject to the annexation have requested the annexation. Um, so therefore, no one can legally remmonstrate.

Okay, that's right. She did mention that to me. So, this is voluntary, right? Yes, this is a voluntary annexation and they followed the process that they were supposed to. They've been working with Alicia and yeah, making sure that everything's followed properly. So, it's probably a uh foregone conclusion, but have they signed an annexation waiver previously? [clears throat] Uh when when this whole thing started, did we ever exercise that? I don't know. Probably not since it's it was all done at once. I know we talked originally about it being in pieces

in pieces, but now this is all the area. [snorts] Does anybody have anything else? Okay. At 7:04, I'm going to close the public hearing and reopen uh the council meeting. So, next on the agenda, we have ordinance number 26-01. And then, okay, I'll move to read ordinance 2601 by title only. Second. Did you get a second? I did. I believe I heard. It don't matter.

Ordinance number 26-01. an ordinance annexing certain territory to the city of Frankfurt, Indiana, placing the same within the corporate boundaries thereof and making the same a part of the city of Frankfurt, Indiana. T a rentals. Do you want to tell us about this has to be this can [clears throat] only be the first reading? We cannot go ahead and suspend the rules and do first and second. So because there's a time frame that we have to stay within

um yeah you can only adopt the ordinance on first reading um and then vote on that and then after the ordinance is adopted uh you'll have to wait at least 14 days to adopt the ordinance on second reading. Then the ordinance will be published and 90 days after that publication the ordinance will be recorded and the process is complete. And that's why we had the special meeting today is to fit it all in within that time frame. So this will not come for second reading then until February. February which is let me grab that date. That date is 9th. Yes, it okay. That's our regular meeting.

And this is a resolution adopting a fiscal plan and definite policy for the annexation of property contiguous to the city of Frankfurt, Indiana, pursuant to ordinance number 26-01, the TAD rentals annexation. And so you should have received did you send in a packet or did you have both had had access to both? We have the resolution along with the um voluntary annexation fiscal plan.
