Unless any commissioner has further disclosure statements at this time, it may be stated that no contact was made during the visit with the applicant, his or her agent, or neighbors of the proposed project. So now we are at item two, Arwa physical therapy conditional use permit 1939. Petition submitted by Resin Alhifi to establish and operate a physical therapy clinic at 17720 excuse me New Hope Suite Number 120. This item is categorically exempt from CEQUA class one section fifteen three zero one. I will now open the public hearing. Staff report please.
Hi good evening commissioners. The following project is a request for a conditional use permit to establish and operate a new physical therapy clinic at 17220 New Hope Street, Suite Number 120. The project is located at the address 17220 New Hope Street here in Fountain Valley. Here's a site plan showing the approximate location of the unit where the facility is to be located. That's located in the Los Caballeros Sports Complex area, in the Plaza Del Lago Building.
You can see there it's in Building 2. The proposed physical therapy clinic will occupy approximately 1,200 square feet of office space. It'll operate as a health care office offering outpatient physical therapy services. Hours of operation will be 9AM to 5PM, Monday through Friday. The project is in planning area c of the Warner New Hope specific plan.
In this planning area, medical offices are allowed to occupy approximately 25% of the floor area of the Plaza Del Lago Building. Currently, medical offices occupy 22% of that 25 maximum area allowed. Based on these figures, parking will not be impacted in planning area c as the percentage of medical offices falls below that maximum 25% that is outlined in the Warner New Hope specific plan. Additionally, a parking study is not required for this project because it does not propose any new structures or expansions to buildings. Staff recommends adopting alternative number one to adopt resolution twenty five dash seventeen, adopting a notice of exemption in accordance with CEQUA and approved conditional use permit number 1939 for a physical physical therapy clinic located at 17220 New Hope Street, Suite Number 120.

I have a question. Just a clarification on the hours of operation because I noticed tonight you said it was no weekends, no Saturdays, Monday through Friday. But then in the project description submitted by the applicant, it was regular operating hours Monday through Saturday. In the response to the permit number 1939 by the applicant, it was Monday through Friday, nine to five, excluding holidays and weekends. And then in the exhibit one to resolution number 2517 for the conditions of the approval, it lists hours of operation, eight to five Monday through Friday and eight to five on Saturday. So are they open on Saturday or not open on Saturday?
I believe the applicant is here to to address that question. What I had listed in the report was the most recent data that I had received from the applicant, which was in that response letter that they would be closed on weekends.

I got a quick question for mybioma. Last month, I think we approved another chiropractic office in this area too. Is that LCD plan to push some physical therapy chiropractor into that loss cap area?
No. Not necessarily. I think that area is just becoming more of a medical office building. And so the ownership group has approached us about eliminating the 25% requirement and eliminating the CUP requirement for these uses as well. I think it made sense many, many years ago when the specific plan was adopted, but I think we may be open. I think the restriction may have been because of parking or some other issues that no longer exist out there. So we have an application before the the city that will make its way towards you to amend a specific plan in general to to address some of these issues and not require the conditional use permit in the future.

you. Alright. On to our next item, revision to Euclid And Heil residential project, 16300 Euclid Street, tentative track map number 19448. Petition submitted by EPD Solutions to revise the type of map to be processed from a tentative parcel map to a tentative track map for Euclid And Heil project located at 16300 Euclid Street that was was approved by the Planning Commission on 06/05/2025 staff report please.
Thank you, mister chair. Commission, tonight before you is a application for a tentative track map for the Euclid, Ohio project at 1616300 Euclid Street. The proposal is to revise the type of map to be processed for this project from a tentative parcel map to a tentative track map. Other than the wording on the type of the map to be processed, no other changes to the approved project are proposed. The applicant submitted a parcel map because the project included three parcels, senior apartments, market rate apartments, and the townhomes triplex portion of the project.
But upon their maps milled to the county, they found out that the lettered lots counted as well. There's two letter lots. So in total, there are five separate lots. Therefore, the project would include five or more lots and would require a tentative track map. Other than this change to the map, the wording of the map, the project is the same that was proposed and approved by the Planning Commission on June 25 and includes the same density, same number of parcels, same parcel sizes, same number of units, layout, parking stalls, landscape percentage, building coverage, everything's exactly the same.
And I'll go through a couple of pages here to kind of prove that to you. The

is the cover sheet for the plans for the parcel map. I've underlined the word parcel and the number 2024 Dash 103. This is the proposed track map. We're basically changing the word parcel to track and the number from 2024103 to 19448. This is the approved sorry.
This is the approved overall map site plan for the parcel map, 202414 I'm sorry. 103, not 143. And this is the proposed track map. Again, literally nothing has changed on the map. It's just the name of the map and the number.
With the map change revisions to the resolutions that the Planning Commission approved twenty five-ten and twenty five-eleven, replacing tentative parcel map 2020 four-one Hundred 3 with tentative track map 19401944 eight are necessary. So staff's recommendation is to adopt a revised resolution for resolution number 25 dash 10 with one reference to 10 of parcel map and adopt a revised resolution 20 five-eleven, replacing tentative track alternative parcel map to tentative track map and to change the number. That concludes staff report.

And city staff and the city engineers went over every page of the of the map, analyzing the length of the parcels, the square footages, the acreage, everything is exactly the same. And,
well, the reason why they changed it is because they have to be compliant with the subdivision map

So you can only have four parcels and a parcel map. Anything over that, it has to be a track map, and it's just written out in the law. So all they're doing is they're they're being they're being compliant with the law. Mhmm. So they had to change it from a parcel map to a track map. And, yeah, there's no changes to it whatsoever. It's just that now it's just a different different map. Precisely.
I think it's an interpretation of the subdivision map back in terms of those lettered lots and where they're now they count towards that five. And so, the county came back with that interpretation, so that's where we are.
That that actually gets to the question I had. So is that what the crux of the issue of, like, how we ended up on the wrong side of this with the original map? We thought that letter lots didn't count to the five or

Or Steven, I would say that the applicant submitted a parcel map. Steven indicated that he thought it would be a track map. The applicant was persistent that they believe it was a parcel map, and so we processed it as a parcel map. Turns out Steven's intuition was correct, so we're back with a track map.
