Whereas, we acknowledge May 10th through 16th, 2026 as National Police Week to honor the service and sacrifice of those law enforcement officers killed in the line of duty while protecting our communities and safeguarding our democracy. And whereas there are more than 800,000 law enforcement officers serving in communities across the United States, including the dedicated men and women of the Florescent Police Department. And whereas since the first recorded death in 1786, there are currently more than 24,500 law enforcement officers in the United States that have made the ultimate sacrifice and been killed in the line of duty. Whereas the service and sacrifice of all officers killed in line of duty will be honored during the National Law Enforcement Officers Memorial Funds 38th Candlelight Vigil on the evening of May 13, 2026. Whereas May 15th is designated as peace officers memorial day in honor of all fallen officers and their families and US flag shall be flown at half staff. Now therefore I Timothy J. Lowry, Mayor of the City of Florescent, Missouri, and the members of the Florescent City Council. Do you hereby declare May 11th, 2026, May 11th through May 16th, 2026 as National Police Week and publicly salutes the service of law enforcement officers in our community and in communities across the nation. I just want to say real quick about how much I I certainly appreciate everything that the men and women of the force police department do for our community keeping us safe every night. I think it was our police department second to none. I think they did do an outstanding job every day and certainly these gentlemen here, Major Bowden, Lieutenant Sharper. Thank you guys for everything you do and everything that police department does for our community. Oh, I did want to mention one other thing.
Lieutenant Ed Sharp is served 30 33 years as a law enforcement officer. He's retired June the 1st and we really appreciate his service. Long is a big loss to our police department as you can see as a lieutenant has been just a great mentor to our young officers. So, thank you The next item on the agenda is hearing from citizens. Public notice is hereby given that a public hearing will be held on Monday, May 11th, 2026 at 7 PM at the Florescent
City C city hall council chambers concerning the fiscal year 2026 through 2030 consolidated plan and the fiscal year 2026 annual plan for the florescent community development block grant program. A draft of the plans will be available for review on the city's website or the florescent community development office 314839-7680. A third day comment period will start May 12th, 2026 and will end at 5:00 pm on Thursday, June 11th. All written comments concerning this report during the time frame shall be submitted to the community development office at the bill of reference address or to cd director at florescent.com. Good evening. Um, every five years, the Department of Housing and Urban Development requires that all CDBG grantees complete a five-year consolidated plan alongside the annual action plan for the first year of of that five-year period. A draft of that document has been attached for your review. Based on the work that we have completed uh for the 2026 through 2030 consolidated plan, um I find that the existing programs meet vital community needs, foster home ownership, and help keep the city of Florison a thriving community. In the plan, I am recommending to continue the use of those CDBG funds for the home improvement program, the home improvement mechanical program, accessible home modification program, project impact, mortgage, rent, and utility assistance and administration. HUD has budgeted $267,176 in CDBG funding for the city of Florison for 2026. Um, if approved, I plan to allocate $111,491 to Home Improvement, $84,000 to Home Improvement Mechanical, $3,000 to Accessible Home Modification Program, $1,000 to Project Impact, and $53,435 to administration. Just as a note, um I have uh underfunded project impact and accessible home modification because we have past year's funding uh that need to be spent down in order to meet stat statutory spending requirements. Um so as stated in the public notice, I will be accepting public comments about
the 2026 through 2030 consolidated plan and the 2026 annual action plan for the next 30 days. Are there any questions or comments? Councilman Aan, thank you. Um, this is a really a pretty simple project. the uh the petitioner is um uh I guess going into there's an existing printing and sign shop in the center and the landlord is basically the petitioner and they're expanding their footprint of trying to expand their business uh providing signs a little bit more elaborate and uh I think labeling it as f sign fabrication might be a little misleading really it's the majority of of the work is is uh the letters and raceways are ordered online and assembled. So, it's really more assembly and uh and then off-site installation. Um so, um they're u um the print shop will be doing most of the finishing and and printing and stuff like that. The sign shop will be doing the assembly and and off-site fabrication. Um it's uh relatively simple reusing all of the existing walls from the prior tenant. Uh so there's minimal construction and um I think that's it. Is there any questions? It's pretty simple.
Yes. So we do have one at least. Councilman Egan. Very good. Thank you, Mr. Ivy. That is in my award. And so I just want to make sure I'm clear on that. The current sign shop is going to work in conjunction with the new adventure. Correct. Yeah, they're partners. Is there going to be uh I guess my my only issues are my only questions the first one is relatively um it's not an issue with us at all. No no noxious odors or noises or anything. Are we going to see that in the new facility? Any undo noises or odors or anything along that lines?
No. Uhuh. I mean really that's mostly just cordless drills is kind of probably the biggest um consistent noise. And I mean that's just assembling the assembling the product, pulling the wires. Is there going to be any woodworking or any type of welding in the facility?
No, they do have a uh a small like a tabletop CNC machine that they use inter they'll they will use intermittently. Um they are uh in part of the staff report they did mention um getting ex exhausted and stuff for any fumes and stuff. The uh I don't have it right now but the the landlord had his mechanical engineer running calculations and it appears that the existing mechanical system has additional capacity in that system to exhaust those fumes to mitigate any any potential issues outlined by staff. All right. Thanks. Yeah, I'm just was more worried about any type of hazards. Oh, no. It's mostly metal. Metal and acrylic.

Um, is there any type of new machinery? Uh, as a followup kind of extended what Councilman Egan asked, any new machinery either in fabrication or assembly like you were describing? No, just the CNC machine, they will have a break in there to kind of bend sheet metal. Um, and yeah, that's I mean really drills and stuff. It's most of most of the stuff they come it comes in boxes. They unpack it, they put it together and I mean think of it like an IKEA for signs. So, um, in follow up to the other two questions, it it wouldn't affect anything to do with fire hazard or, um, or noxious orders of those types with that new machinery? No.

Is the petitioner for Happy Cup LLC here this evening? Please come forward, sir. How are you guys? Welcome. Would you please state your name for the record? My name is John Bonds. How you doing this evening? Okay. Will you tell us about your project?
Yes. We propose to bring Happy Cups, which is our quick service restaurant to the city of Florison. Uh we're excited about the opportunity. We primarily do drinks by the name Happy Cups. We do lemonade, snow cones, uh juice, tea, water, uh soft serve ice cream, funnel cakes, hot dogs, and poly sausages is the expense of our menu. Okay. And tell us about your setup.
Our setup, I have some photos here that I can the sister can put on here. I open this gallery. Okay. This is the building currently is what the building currently looks like. Front. This is what you normally see from Patterson Road. This is the current view. This right here would be representative of what we have. This would be the curbside or view from Patterson Road. Menu, two menus. The existing three windows have static sticker signage. Also a sign on the roof. Uh the uh existing landscaping removed and white crushed rock placed around the uh exterior bottom as uh mimicking snow. The other view there more. This is the mall side which would be uh viewed from the mall side of the building. It shows two menus on the outside, two walk up security self-closing uh service windows. In the middle there's a snow cone dispenser and then next to the snow cone dispenser is an automatic payment machine which takes cash and coin. So the customers would actually come up, place their window with the staff and then step to the payment uh payment device, make their payment. The staff would hand out their
snow cone and they would self serve their snow cone on the dispenser which is in the middle. Uh parking ballards are installed um in the area approximately eight feet back to allow the customers to have a small pedestrian waiting area and not be affected by um vehicle traffic. Uh trash cans are placed at either end of the building. Also security cameras all the way around on the building for safety. Okay. Thank you. Um Councilman Caputo. Thank you, Mr. Yes, John. Welcome. This is my ward, Patterson Plaza. Um, I know you never I know you never got a hold of me and asked me questions on what I would think of this project. Um, I know in this this standalone building, there's no kind of utilities in there but electric. Correct.
Yes. Currently there is only electric in the in this particular number 22. We however have solved that challenge of not having a bathroom and or commissary facilities running water by having a co- space in the plaza at 22 plaza. So it would we we are proposing to use two facilities. The 20, this is the 22, which is the kiosk, if you will. And then the number eight, which is in the strip mall, would serve as our bathroom and or commissary. And I have a rendering of that as well.
So, you're saying if your employees have to go to the bathroom that spot and go to Patter behind it to what? Number eight is it I believe. Yes, number eight. And you can barely have to leave the the shack or your your kiosk as you call it. Yes. To go would you have to shut that shut your whole production down for them to go use a facility or to go wash their hands after each time or I mean they have a an accident there. I mean, what's your plan for say if they do have an accident, how you going to clean it up?
That's a great question. Let me answer that for you. The you can barely see it here, but this is the number eight facility, and it has the three sink, the handwash sink, also the bathroom, and the mop sink all in the number eight space. However, at the number 22 space, we will install a portable sink in the 22 space that will the number eight space. We're going to set it up almost like a food truck, if you will. Um, food trucks have portable sink uh where washing. They don't have bathrooms, but they do have portable sinks and all of the other things that are needed to be able to prepare and serve food. uh safely and and um sanitary wise. So in the 22 space we will be installing a portable washing sink but it is not as large as the sink in the number eight facility is for every night break down. You know you when you break down the soft serve machine you have to take those pieces into a sink that's larger than those pieces in order them for them to be fully immersed and cleaned correctly. And that's what the number eight space will serve as the portable sink and handwash sink in the number eight space will be for uh I'm washing my hands. Um we need to wash the smallwash utensils uh and things of that nature. I was looking at your plans earlier and it says that is it on Patterson number eight you're going to have a drivethru to where you can or not a drive-thru uh
curbside curbside would that be coming out of eight?
No. um the curbside drive up. We actually in the last meeting because I um members of the council indicated that there would be some traffic lane change requirements in order to do the cur uh curbside. We actually tabled that part of our request for zoning in order for us to be able to get the traffic study done, figure out um how many lanes uh there are between the building itself and the curb of Patterson. There's approximately 35 ft. So far, we've learned that we're able to put three lanes and a um a um there's like a five foot buffer space between a lane and the actual curb. So, between the building and the curb, there's space for three lanes of traffic as well as the buffer zone
on the kiosk. on the kiosk. I know that um we have had problems with cars going through that um plaza going to the gas station at a fairly high rate of speed through that um through that um plaza. Yes. And my concerns if you're having walkups with kids because we know we got a lot of kids in that neighborhood there and I know that's what you're kind of gearing towards. Yes. And that would be my biggest concern is the safety of them children because they run rampant through the neighborhood
and that is my concern. I know we've had um with snow cones and other ice cream trucks. Yeah. And I know there's a couple of them that we have and people have been hit before from. So I that's my biggest concern is because there's not much room around there. You have a store. You have a gas station. Uh you have a bar and u couple other businesses in there that are pretty act with vehicular traffic at a constantly. And that would be my biggest concern is that drive-thru on there especially with the walk up also.
Let me address your concern. Now the this is Patterson Road over here. This is the gas station right here. So, this is the facing the Patterson roadside, our proposed curbside setup, which we actually took off the table. So, we're not currently doing it until actual we come back to you with the facts and figures, but this is what I got from the first traffic company is what they uh is what they sent to me. So they did a measurement from the curb to the building and it was enough for the for the uh buffer two lanes of traffic a third lane of traffic separated by this white line as a curb division. So when we do come back to to the curbside uh later on eventually um what this council re uh recommended the last time was there would had to have been a lane separation from the curbside lane which is this lane directly uh next to the building. This is the um this is a a I think it was 18inch curb is what they said it was 18 or 24 inch uh curb separating the drive-thru lane, excuse me, the curbside lane would essentially come up this way. Uh cars would come up the side of the building. They would be directed to turn this way. So the they would come up from here, turn this way, get their uh place their order, proceed this way, get their product, and then exit on out towards the back towards the directed back towards the inside of the strip mall towards the rear of the gas station would be where they would exit. is the reason why they put a direction right here on the curb to force them not to
just go straight across to the gas station, but actually turn back behind us and exit behind the gas station. So, where's your walk up window? The walk up window is here in this area right here. Where your traffic would be driving, correct?
Uh, no. Well, the B the ballards would be placed all along the pedestrian area. So, these parking spaces here would be where the customers would park in all of these uh designated pre-existing parking spaces on the lot. They would then walk over. This area here is not currently marked out with the Ballards, but it would be marked out 8T 8t at least at a minimum 8t out from the building, 20 feet is which is the length of the building and then 8 feet back. So there would be a 8 by 20 foot pedestrian area um with handic uh with 36 inch uh ADA accessible into that area would be how they would get into there and the parking ballards um would be drilled into the ground um to prevent pedestrians from getting hit if you will. So I believe that would answer your concern. the and again per the drive up we took it off the table the last time because I didn't have all of the facts and figures. I didn't have this. I didn't know how much distance it was. Would we be able to do a one-way lane here? And because people turn in currently and they just they zip across here back and forth to the gas station like it's a thorough affair. So in order to keep that, we would have to use the lane separator and make this lane here a oneway and then have the customers come like this, come through the drive-thru and exit like any other drive-thru. It would be how they would um how we would handle that particular set of traffic, the vehicular traffic and keep everybody safe at the same time.
So now you the way you're going to have an automatic change machine. Yes. Now, so your employees won't be handling no cash. That'll go directly into that machine. That's how you're going to pay. Yes. It's a payafe. It's like an ATM secured inside the building or
No, actually it would be Let me put it back up. So the paysafe which is my invention actually. Um this is the paysafe device. Um I designed and invented this device to help small businesses such as myself who I started out as a food truck out here barbecuing and you're out here you're taking money on the street. you have I might have $500 in my pocket, but it looks like I have 5,000 because I've taken all these irregularsized bills, um, dirty money. Um, I was taking counterfeit money. I was at risk of getting robbed. I had workers who didn't want to show up every day. And I had all of these problems and no way to solve it. And then they came out with right before the pandemic, they came out with the selfch checkout station in Shnooks. And I thought, "Wow, that big machine, if I could just have one of those on my food truck, that would solve my employment problems. It would solve me worrying about getting robbed. It would solve employees touching the money. My glove costs would go down. All of these different benefits from having a device such as this, and it didn't exist at the time. And I reached there was three manufacturers who make the components that go inside these machines, the coin, and the bill uh validators. and I reached out to two of the companies that are in the United States and each one of them wanted $50,000 to even just consider my idea. The third company was in the UK and I got them on the phone and I described to them the device that I needed and what I needed it for and we designed it together and this is the result. A countertop machine that uh doesn't take uh excuse me, a countertop payment device, the smallest of its kind in existence. doesn't take counterfeit
money. Um, shows up for work every day. It costs a fraction of what a minimum wage worker would cost. And it solved all of my problems um as far as uh people not showing up. It it allows one a minimum amount of staff to be able to handle it. Uh the customer comes up, they place their order, we shave the ice, and hand it to them. Before you can get your money out, I've keyed it in on an app on my phone and the machine lights up. If it's if it's a card payment, you pay the square. If it's a uh if you owe me cash, you put your 20 in. If you owe me 15, it gives you $5 back. And the staff, all we do is focus on is the food preparation and the quality. Our customers love it. Um it's amazing. Um, and I'm excited to be able to bring both of these and all of these technologies together. And I can't think of a better place to do it in Florison.
One more question. Hours of operation 6:00 a.m. to 1000 p.m. 6 a.m. to 10 p.m.
Reason we're doing 6:00 a.m. to 10 p.m. During the 6:00 a.m. to 10 a.m. hour is breakfast hour. We serve coffee, hot chocolate. We uh are establishing a relationship with Oldtown Donuts and Florison to resell the donuts. So, we have juice, coffee, hot chocolate, all the donuts. That's your 6:00 am to 10 uh excuse me 10:00 a.m. From 10 a.m. to 10 pm it's hot dogs in Polish and funnel cakes and soft serve ice cream and lemonades fresh squeeze and all different flavors and that's what we do seven days a week. Seven days a week.

Um, I guess my questions come with um um with your sinks and your water and everything. Yes. Okay. You're saying to operate it like a food truck? Yes. I know a lot about the workings of a food truck and everything. And I'm looking at your drawing and I'm not seeing any water tank inside the the building. the number eight drawing uh
or the number 22 drawing. Which it's the 22 sheet seal one. It's got the three cars next to it with two orange cones. It's got a floor plan, fridge, prep table. I got it. It's got this um three bin sink and then a smaller sink which I'm assuming is a hand wash handwashing sink. I got no idea.
But my question is
go ahead. Okay. My question is how how how big is your the water tank that goes in there? Um, how are you going to get it filled each, you know, each time, each day? The water tanks for the portable sink are the five gallon uh jugs that you would buy at uh Shnooks or the gas station. We use those. And then the Yeah, that's what I'm looking at. Okay. So, here's the sinks right here. Yes. So, this is the handwash sink here. And this is the three sink right here. Okay.
Portable. And then the I couldn't draw the tanks under there, but the portable blue bottles basically sit sit on the side of it. And then there's a a pump uh small 110 pump, right, that actually is for the water five gallon water uh jugs. And so you just hook it up to the sink and
Yeah. Okay. And then as far as draining, because the number 22 doesn't have any drains at all, we would um we have a 15% larger waste graywater tank and then we would just basically cart it over to the number 22 and dispose of it uh in the waste in the 22 plaza. Okay. All righty. Uh, can't get funnel cakes for breakfast, though. You can you can get a funnel cake with breakfast. And if you want the soft serve, you can get that, too. Okay. Um, all right. That That's all I have. Thank you.
And this is uh I don't know if we can play videos on her, but this is um one of our customers. She was a food critic, a local food critic, and we didn't know. when she came by and um and um and patronized us and she made a video for us. online. That's the money machine.

Um, thank you, Mr. President. A couple of my questions have already been answered, but um, I think that video that she just showed answered my other question. So my question was if it's selfs served snow cones uh how sanitary is that? Um because I teach first grade and I know how gross my six and seven year old students are. So if they're selfs serving, how are um you going to keep that sanitized?
Well, we have u on the on our actual food truck, we'll have the same same similar sanitary at the 22. We have a pump uh sprayers like at your house for your uh when you're washing your dishes, you got the little sprayer next to it. So, um the dispenser that you've seen will be the same dispenser with the buttons and the the little spouts stick out. Um we'll staff will regularly go out and spray and wipe. Uh there's also a drain uh drain pan below to catch any dripage so it's not just syrup all over the ground. uh and frequent spraydowns uh keep away the bugs and vermin. The reason I actually invented that dispenser machine too. I kind of invent a lot of things, but I built the dispenser machine because I needed a way to serve the product and not get it all over the people. When we first started, we had the pumps. And when you buy those pumps and you go to squirt, it's going to get all over your clothes. It's going to get all over everybody. And so that wasn't working. And then the uh those uh regular pumps, the bottles swell up from the heat and they start to leak automatically. So I had to solve those problems. And I said, you know what? I'm just going to build a dispenser. I mean, you you go to the fast food and they have this soda dispenser. It's the same thing. It uses per uh parastolic uh diabetic pumps. And so I just designed it and built it and put the pumps. And the pumps, the fluid doesn't go through the pumps. It goes through the tubes, food grade tubes, so it never comes into contact with the pump itself. Um, and so that's the reason why we did automatic.

It is heavy. It's designed it to be heavy because you can't pick it so a thief can't just pick it up and run off with it. Um it's they got sensitive components in it. the um the money the money machine the money the currency um recycler has lasers in it um and so that it's not designed to be moved once you know it's not designed just to be taken and moved around such as my cell phone it's designed to be bolted to a countertop or in a fixed location once once it's deployed
but it sits outside the building or inside the building on the drawing. The um if I pull the picture back up, the dispenser and the money machine are going to be customerf facing. However, they're going to be behind a rollup steel um uh you know how you go to the concession stand and they have a a metal corrugated rollup. We're going to do a corrugated rollup over the money machine and the snow cone dispenser so they can't be tampered with at night. Okay. That's I I was more concerned of that if Yeah. Because you don't want somebody coming up in the middle of the night messing with it. Somebody could, right?
You know, they could put I don't know. They could do anything, but you don't want them touching it. Uh, you know, when when we're closed, we don't want somebody coming up thinking they can break in the money machine or tamper with the uh snow cone dispenser. Um,
okay. Then my other question, well, now that I saw you do have another establishment, just one, and that's in a food truck. the Yes, we have a food truck. We've been operating for five years. We do a lot of local events. We've done the St. Louis five years running. We've been doing the St. Louis festival down every year um August uh the end of August uh three-day festival. Um we've done Barack Obama's uh school. We've done the Learning Center school. We've done the Legacy Center school. Um, we've done a lot of North County schools. We we've done Home Depot, Ferguson Home Depot. Um, we were in negotiations with the Florison Home Depot to do their employee appreciation day um, last year. Um, we just we just take the truck around and do our different events, but we've been growing and we need a we need a a home because our customers are always looking for us. And if we have a home base where they can find us, they can dispatch our truck as well. But having this facility here, this is going to be a game changer, not only for Florison, but it's going to be a game changer for us. Um, we're coming in with uh a minimum of five employees to start. We're hoping to double it within the first year. So that's, you know, 10 new jobs plus the plus the the products that we're bringing. We're bringing happy. You know, none of our customers leave mad. You you know, you can go a and argue with your spouse on the way to McDonald's, right?
You're not arguing on your way to get a funnel cake or ice cream or snow cone, a lemonade. Everything we serve is happy. That's why we call it happy cups. Okay. So, that was you answered the question about the employees. My thing is getting from point A to point B with with the equipment or the restroom as Miss Councilman was talking about. So in there, how many employees will you have at one time? At least five, five employees. The little stack in number eight.
Uh number eight, it will be at least five employees. Um, you'll have two employees at the 22 and at least a minimum of three, excuse me, two three employees at 22 and and two employees at number eight. Um, so you got your dishwasher and your runner at number eight. Hey, bring me another bag of ice. And then they, you know, will the cart across the lot. I need a relief. Uh, somebody needs to use the bathroom. and one of the employees at number eight will come over and sub in for a few minutes while you know the alternate employee goes and uses the restroom. Okay. Yeah, because I would like that sort of it's a distance to go. I mean it's not 70 about 70 75 ft,
right? It's not much. So, but it's doable and there is absolutely no outside seating.
No outside seating at all. Um, when we first proposed, we were under the impression we wanted to do outside seating, but outside seating triggers a restroom requirement. And so, a future plan for us, just so the the board knows, our future plan is to make number 22 its own separate facil facility. Ultimately, what do I mean by that? with its own uh water and drain, um range hood, everything, fire suppression, everything in 22. However, in order for us to get open and get started and get revenue generating, we're going to use number eight as our commissary until we can build out 22, which will have everything in it. That is our ultimate goal, which will then allow us. We'll have two facilities then, complete standalone facilities then.
And you have no plans for alcohol in here? No, not at all. There's a liquor store already on the on the No, I'm just I Yeah, we've never sold alcohol thing right now. Yeah, we've never sold uh Sorry, I just want to make sure. We've done festivals where people wanted us to do a BOB. So, we have served alcohol in the past. However, for this business model, alcohol is not we don't need it. We're going to be busy enough with just the drinks, the snow cones, the slushies, and the lemonades. For the first three years, I refused to do food because we were making enough just on drinks
and but people kept asking, "Man, it'd be nice if you had a Polish or a hot dog or you know, so we finally decided, you know what? will go ahead and introduce the food and it's been uh it's been great but the drinks alone is you will be surprised. Well, thank you. I think that's all I have now. I don't know if someone else has any questions yet. Okay, we don't have any lights on here. I have a couple questions, I think. Uh let's see. You already said no outdoor seating. U there's an email in our packet from uh Miss Irvin about some of the standards for the bathroom. Um could you can I ask you about that?
I think what I'm picking up is that after the after you explain the requirements of the plumbing, the bathroom according to the standards and the research you did um Mr. Um John, yes, Mr. He uh he changed his plans after that and that met the standard. Am I correct or are we good on So the code? Yeah, but there's something I heard tonight. So I want to bring us all back to Senator. Thank you.
Um and I do apologize for my dressear because I'm on vacation today. Um but what we've heard, what I've heard tonight and what what's been spoken to you is that there is no portable plumbing uh portable wash stations or anything in building number Um, so not on my drawings
and it was never discussed in the planning commission. Um, and so everything that we've uh approved and you can see it's been approved by the planning commission secretary. It's been approved by the chairman. Uh, and everything in here was to be hard piped and we had that discussion. So when it comes to the inspection part, I don't want Mr. Bonds to be confused because we will be looking for hard pipe plumbing in number 22 Patterson. But number Number eight has its hard pipe plumbing. And so all of these things were explained. I think the report clearly um identifies all of those things that if we look here, it says that number eight Patterson Plaza shall provide restroom access for employees during the open business. But number on line 182, 8 Patterson at 22 shall remain under common lease control for the duration of the share lease agreement. That's how we got here. But portable plumbing was never discussed at the planning commission. This was to be hardpike to meet the National Plumbing Code. So, I want us to be clear. Um, the drive-thru was definitely taken away by the planning commission. So, there was no that ended u because of the safety hazard that it produced. Um, we did have these photos that were taken and some of the concerns in the initial report was uh cars stacking out here on Patterson Road and then you've got the speeding cars coming across here. So, I I want us all to be clear. I don't want Mr. responds to come back and say what's written in this report is is essentially what you all will be approving u if we get to the second reading of this but pipe plumbing required by the 2021 international plumbing code is what's got to be used in this building here
that was the premise of my question because I I didn't know how we got from what's in here to what we're doing now so yeah no and this was approved by the planning commission secretary it is a site plan Um this is the actual outside of the building, but this particular floor plan here is what we're going with from a building commissioner's perspective and what was approved by the planning commission. Okay. Uh Mr. Bonds, uh what was approved by the planning commission would be what we're expecting to happen.
Okay. And now ultimately the drawing did show the it showed both sinks but maybe I didn't wasn't clear in the beginning. Ultimately we our plan is to put hardpipe everything
in 22. Initially um to start we were under the impression that we were using number eight for the wearashing and although number eight has you know we'll have be hard piped in and everything else. We thought that we would be able to utilize temporary plumbing. Yeah. In number 22 until we actually build it out. Yeah, that that's a good idea except it just won't meet code. Okay. So, not a problem.

We do. However, because I don't have enough facts. I don't have this the complete study done from the traffic company. What I had showed you earlier was what they pulled up and like I told them what I was trying to do. They asked me what the address was. I gave them the address. They pulled it up an aerial and then told me what I could put, you know, the which is the subsequent photo. However, that's not a certified engineered plan that I can hand to you today. So, we basically aren't worried about and don't plan to use the curbside at all. We plan to come back to you and say, "Hey, you know, we've been open for a couple of months. We've had the study done. Here's the here's what they say we can do." You guys look at it and say yes or no. Hopefully, you say yes, and then we go ahead and actually build the build that.
All right. I'm gonna uh I'm going to move on to Mr. Caputo. Do you still have comment question? Yes. Um Deborah is this with the plans would this be uh to go back to planning and zoning to resubmit his for the plumbing far number rate? No sir, we're going to do that from the building commissioner's desk. Uh because they've already approved it for hard plumbing and that's what I'm going to follow through with. Um, and so there's anything that's in the conditions of this report is what I will be following and what I will expect on his construction plans when they come in.
So you're planning in the future you're going to plan to put all utilities, plumbing, water, HVAC, mechanical in number 22. Yes. To make it self-sufficient to where we don't have to go across the lot anymore. It's required Mr. before they open which is going to require adding on to the building because we were going to will in order have you done any anything where is there your water source at does that come through there comes through the back I mean you may have to tack into a another water line that goes hundreds of feet
we um we have a a plumber come out and do preliminary um preliminary looked at it preliminary area and he sent us a a bid. Um, we weren't afraid of the bid to do it. Um, we're not afraid of the investment expense. We plumbing's the same way. I mean,
well, that's what I'm talking about. The plumbing and the sewer, the the drains themselves, the uh the drains going into 22, the water supply going into 22, the grease trap going into 22 ultimately, and the range hood with fire suppression ultimately going into 22. That is our goal is to build take 22 from basically a garage and turn it into uh its own freestanding. Now the owner of the property on board. Yes. On board. And are they the ones that are going to pay for this utilities? Are are you coming out of your pocket? No, we would be coming out of our uh we would we would be coming out of our pocket for it
um for the to make that building self-sufficient. Yes. Okay. Yes. We believe in it that much. We've we've seen nothing but exponential growth since we've we've seen tremendous growth since we've uh started this business. It's just it's like that's all I have. Okay. Thank you, Councilman Egan. Yeah, if I'm understanding this right, um Miss Irving, what he just proposed to us is not legal. Correct. It is not. So, I just make sure I pick that up, right?
That I don't I don't think that Mr. Bond is aware what he just presented to us with the the sink and all that kind of stuff uh with the portable sink is not it's not it's not legal. Correct. Okay. Can you I guess maybe we need to explain that to him. I don't know if we need to postpone this public hearing uh uh till this can get worked out but as of right now this cannot go to a first uh second reading. Correct.
That is correct because we need a clear understanding of what came out of plan commissioning and what is happening tonight. Uh Mr. Bonds and I need to sit down and have this discussion again that temporary water and temporary plumbing or temporary handashing is not even going to go past St. Louis County because you're deal service. But I also want to draw your attention to line 122 also. We first started this um we we understood uh that there was an ice cream stand there back in 1993 and the council voted they did not approve outdoor seating so this is how outdoor seating got taken away from the planning commission so I think it's a good concept uh I think Mr. to really understand how this is going to go through when it comes to plan review from the commission's office. It's going to be it's going to follow what was approved by by the plan commission.
I have a comment towards that. I believe we're we haven't deviated from um from the plan. However, um St. Louis County um St. Louis County told us that we are able to use portable sinks like in a in a food truck or a kiosk situation. You're able to utilize a portable sink
um for hand for immediate handashing and uh washing of your dishes. you're in order for you to be compliant, you have to have a commissary, which at the end of the night, that's where you take your dishes and you do your your real washing, if you will. Mr. Bonds, that's for a food truck, though. This is not a food truck, understood. Yeah. So, but that is where we that is where the thought came from to say, "Hey, okay, if we're setting this up similar to um a kiosk or a food truck, although we're like if we have
Mr. President, I believe I have the floor still." Pardon? I think I have the floor still. I sir, I think we're we're beating the dead horse right now because we can only go by by what the building commissioner tells us. I would I would ask that we either suspend or Well, I think we should finish the public hearing. Suspender or close. Well, we can finish the public hearing. Okay. But I mean, what he's saying is not is just really not We're just listening. We're listening to the plan, right? And getting information.
Explain to Mr. Bonds when we had our break. I said, "Please do not deviate from your plan. not deviate from the report that was approved by the planning commission and sitting back there the deviation started. There was no talk of temporary uh handashing stations or treating this like a food truck. We do have a food truck ordinance that requires a permit but for something that is mobile that is stationary. I think the concept is great but we've got to get it to where it's going to operate the way the code allows it to. and that is with the plumbing and and there were several other uh uh comments, you know, uh between Mr. Bonds and I when we were writing this report. These are the things, but nothing about a portable handwashing station, especially not in a food uh uh building and this is a a brick building here.
Yeah, this can't go to council as it is right now. Correct. You can finish a public hearing, but Mr. and I need to work out these things and and and I want him to clearly understand what the 2021 plumbing code is saying when he submits me those plans. We're in agreement. But if they come back and he's not in agreement, then it goes back to the planning commission because now the planning commission will have further to say plus he said that he's working on a traffic study that's still required to go back to the planning commission um to get that done. So we we really need a a good clear understanding. I was hoping sir that you not deviate from the report that was given to you. I guess we have the option of sending this back to the planning commission.
Well, you do, but right now we don't know if it needs to go past. No, I don't think you explain at the next meeting. So, this will be the first reading tonight. I'm in agreement. I haven't Yeah, I'm in agreement. Like, we don't have to use utilize portable anything. I'm So, would you like would you like more time to work on this before uh No, I think we could proceed with with If we proceed and then we come back to the next meeting and we do the second and third hearing, there will be a vote. Okay? And if we don't think it's going to be the same as what the plan is or what the the legal concept or the code is, then there's a high probability that it will be voted down. I understand.

It's going to utilize clerks, health inspectors, and building inspectors to do this part of the work, sending notice of violations using postage and email, and then reinspection fees. Uh, so the police department this this Friday, they're going to be participating in an event called Duncan Cop on a rooftop from 6:00 a.m. to 12:00 p.m. at the Dunkin Donuts at 8115 North Lindberg. So, please come out and support them as they as they raise awareness for Special Olympics Missouri. And also on uh May 21st at 10 a.m., Florida Police Department is going to be participating in the law enforcement torch run which will go from the Cross Key Snooks and they'll hand off to the Hazwood Police Department at Lindberg and Charbaner. So they'll be running down Lindberg. And on May 27th will be our first Wednesday night out. That's from 6:00 to 9:00. It's going to be proud to be American American at the VFW post 4105. And there'll be a plaque dedicate that be from 6:00 to 9:00 and there'll be a plaque dedication at 5:30 across the street uh for Don Ziken.
