Yeah, so, oh, thank you. You found it real quick. So basically there's a consideration or request from the Waste Connections to amend the contract for solid waste and recycling services related to overflow collection. Dan, do you want to talk about this?

Appreciate it. Yeah, Tony Lamanti, 31 Mencie Court, Old Monroe, Missouri. I'm here tonight to speak to you about the current solid waste contract that we have. We've been going to cities and talking to them about having everything just inside the container, nothing outside of the corridor on pickup day. Reason for that being two things. One is insurance costs. If a driver jumps out of the truck and gets injured, our insurance goes sky high. It's a real problem. We've been trying to get into the automated service in the majority of the cities. I know we went to an automated, it's semi-automated here in Fenton. And you're the last city that we're trying to get this done in. And the other problem I'm having right now is hiring drivers. It's hard to find people that want to drive a trash truck. I'm paying high 20s to mid 30s. They can work up to 60 hours a week. I have a bonus they get quarterly, and it's $10,000 a year. So it's pretty good. So there's no... no reason any of the drivers can't make six figures a year. So I think it's pretty attractive. All they got to do is work a toggle switch in a truck. But again, I would like to keep them in the truck. We're going to put... We've talked to our corporate office about it's going to be a million, I'd say several million dollar project. Right now you have trucks out there that are called Corrado trucks. And that's where the can is in front of the truck. They dump everything into that and it dumps it over top into the truck.
We're switching to what's called a side loader.
So all we'll have to do is run the arm. grab the container, and he dumps it right into the truck. That will alleviate a lot of stuff falling out on windy days. It's a much better truck. So we're going to be making those changes over the next couple of years. And it's a very expensive process. So that's why it's going to take a little bit of time. But tonight, again, I'm here to ask you to consider amending the contract to everything in the container. Typically, we did some research. I talked to my drivers and the supervisor. There's not a whole lot of people that have anything outside of the container. I might have a couple that have one bag. And if we could just let them know, I mean, even if you lift the lid up and put the bag in the container and the lid's partially up, that's fine. I just would like to see everything in the container.
So that's been frowned on and passed from what I understood, people not getting their trash picked up for that reason.
Yeah, I've heard that as well. If the lid wasn't completely closed, they didn't want to pick it up. So you're saying that's changed?
I'm saying that that's the rule I'm going to change with my drivers because that way, if you have a party and you have an extra bag of trash... put it in the can. We'll have the lid sticking up a bit, but we'll pick it up.
Uh, the question I have, I know in the contract right now, there's a one item bulk pickup. If you call ahead of time and let them know they'll pick it up. Is that something that would change as well?
So that would, that would remain if you call it. Okay.

Go ahead guys. I know, yeah, you said that a lot of people use the overflow, but some do, and it seems like some use it more often than others. Would it be a possibility, I don't know what Dan thinks of this, or what if there are people that, since you don't want the driver getting out getting out and picking up loose items. If certain residents does generate more trash, if they could have two containers and at least it's in a container still, but you guys would pick up two if there's someone that really feels they have that need and they generate that much.
That's already in our contract, but they have to pay for the additional containers.
But pay, what, once for it, or like a monthly fee?
It's a monthly fee that they pay for an additional container, correct, Dan?
Yeah, it's a monthly rental. But if we're not going to allow them to put the bags out, I mean, I think, couldn't we waive that or get rid of that? I mean, it seems like, I mean, I doubt there's many people that do, but maybe someone's got a large family that just generates a lot of trash.
I think if you waive it, everybody's going to want a second bin. I think that's the issue with that.
And the city does purchase the bins.
Right. I know we own the bins, but I just didn't know if that would be a possibility for people that maybe do generate, or if they could be identified somehow, somebody that generates a lot of trash.
That's what I was going to ask. I know that my neighbor has a quote unquote overflow. It's not one of our containers. It's a, I don't know how big it is, but it's a trash can that you'd get at Lowe's or something. And they've got the overflow sticker stuck on the front of it.

And would they pick that up or?
If there's a container that Home Depot has, I think Lowe's has it also. It's made by Toter, and it's a 65-gallon. They also have a 96-gallon. If they were to purchase that, I'm sure we could accomplish it.
This is, like I said, something where you'd see lawn debris in, like a black, I don't know.
I know what you're talking about. I just want to be careful because the arm can crush that. And I don't want to have to buy people a bunch of containers.
Well, I just know that this is one of my neighbors that does this. So I want to be able to indicate to them that they can't put it out anymore if this does change. That's why I'm asking.
Yeah, I would think that if we're picking it up right now, I would kind of leave it as it is.
I personally don't think it's unreasonable to ask people to make sure that when they fill their bin that they have to break down their boxes and make sure that it all fits in. And if it doesn't fit in, then they just have to wait for next
So are we talking about recyclable or trash, just trash?
Well, recycling we want the same way because we're servicing it the exact same way.
Okay, so you don't want anything that is out of a container.
Yes, sir.
That's what you're looking at. And I know that there are some people throughout the city that have their own cans, and you pick them up anyway. Aside from the ones we provide.
Yeah, as long as it's containerized, he's going to pick it up and he's going to use the arm once the side loader's in place. I just want to make sure that you're okay with everything being in containers. Now, people are going to need to know that if that arm destroys that container, we're not going to be held responsible.
Sorry, quick question. How much is the extra container? Does anybody know? It'd be something that maybe we could... Yeah, it's a fee that they pay. A quarter. Yeah, it's not that much. So if somebody routinely has lots of extra trash, they should just get a second can.
Yeah, because the concern is we offer a second to everyone. Everybody may want one, and the city does purchase those things.
Yeah, I wasn't suggesting we give it to them for free, but for $25, if they got a lot of trash, they should just do that. I don't think that's a real hardship on us.
So did I hear you say that you're eventually going to have a piece of equipment that will pick up the loose bags or no?
No, it'll pick up all the carts. I just want to make sure I'm not destroying anybody's cart.
Right. All right, so I think the question here is whether or not we are going to allow for the contract to be renegotiated, I suppose. Is there a cost related to that that will be brought back to the city?
I think we also would need to clarify. You said, well, if the lid is open a little bit.
Oh, if the lid is open a little bit, we can do it. But you know people are going to be So I would caution, like, we have to be clear. We have to be.
Well, I think what we're going to have to do, this is going to have to be, is we're going to have to educate through the newsletter or even a letter to the households. You know, the other thing that we might suggest is, at least on our street, all of our neighbors get along. So if mine's full, we just throw it in somebody else's.
A lot of people do that. Yeah.
So can I ask, is this something that we're wanting to see effective immediately, or is this something we're going to say, hey, you have 30 days, and then this is how it's going to be?
We're fine with that. Whatever you guys decide. This is your choice. You can say no to me.
How long would it take to get the education out?
A month. We would have a newsletter that's going out. but the amendment would have occurred by that time. So I would think we would need to educate. So we'd probably want at least a 60 day lead just to provide for education through our social media, through other avenues, because this will have to be approved by ordinance, which means it won't be approved until the 27th of this month.
Alderman. I was just going to ask the timing. So I was thinking, you know, 60, 90 days from now, we'd be able to get some education out there, get it implemented, voted on all the things that go along with that.

You guys think, and I would think in a newsletter would be maybe more prudent to put like a separate insert in the newsletter. That's different color. That's really stands out than just putting it in the text somewhere.
So people really take notice of the change or put a flyer on all the, with each, you know, with the trash cans when they empty them, put a flyer on it, just,
I have a flyer that has pictures and shows the card, shows where to place it and everything like that. Send it. Okay. I'll work that up and get it over to you.

Okay. All recommendations from planning and zoning commission will be forwarded to next board meeting for a public hearing and consideration unless otherwise noted. Announcements from planning and zoning commission The Playing and Zoning Commission continued case 2026-SUP-08, a petition by Polo Downs. a petition by Polo Downs Outlot LLC for a special use permit to locate a drive-through service adjacent to a resident residential district and residential use. Property is addressed as 1111 London Circle Lane and is zone C1. Planning and Zoning Commission recommended the following. Denial of case 2026REZ02, a petition by Fenton Land Investors LLC to amend ordinance 4002 as amended to allow additional permitted uses on lots one through seven, a Fenton Logistics Park... flat eight located within area A of the Fenton Logistics Park development. The parcels are addressed as 700 to 890 Elm Tree Way and are zoned PID planned industrial park district. At the request of the petitioner, this case was continued to the September 10th committee meeting. We have approval of case 2026 TXT06, a petition by Polo Downs Outlot LLC for amendments to the zoning code related to drive-through services adjacent to residential district or residential uses. The petitioner was requesting an amendment to allow drive-through service under an SUP in C1 district when adjacent to R5 district. However, after discussion, the commission recommended approval of an expanded request to require approval of an SUP or drive-through services when adjacent to residential districts for use as recommended by staff. Is that clear? I had to read that a few times. approval of case 2026 TXT 07, a petition by Shannon and Kyle Real Estate LLC to amend the definition of outdoor limited recreation facility under section 400.030 of the zoning code to allow indoor recreational activities related to primary use on the lot. approval with conditions of case 2026, SUP 09, a petition by Daniel Sneed of Wallace Design Collective on behalf of Swing Around Fun Town for a special use permit to operate Old Town Commercial District and... Also relating to swing around is approval of case 2026 SPR 05, a petition by Daniel Sneed of Wallace Design Collective on behalf of Swing Around Funtown for site plan review of a proposed building addition at 335 Skanker Lane. Property is zoned OT2 Old Town District. I don't see anyone here to speak on that. Is there anybody? The owners of Swing Around Funtown are proposing to expand their business by building an addition to their existing arcade and indoor playground building. The addition will house a bowling alley since the definition of outdoor limited recreation facility does not address affiliated indoor uses, they are requesting to amend the definition to include indoor activities in order to expand. They are also requesting a special use permit since this is use that now requires an SUP in this district and there is not one currently on file for this business. Site plan review for the proposed building addition will also include approval of alternative building materials to be consistent with the metal siding and stacked stone accents already on the existing building. To meet the parking requirements, the use of the project will also include an expansion to the parking lot, which will require approval of the boundary adjustment plat to consolidate the lots. That was a lot. Approval of case 2026 TXT08, consideration of amendments of zoning code related to buffer area in the Old Town districts. Staff reviewed all properties in Old Town 2 and Old Town 3, Old Town commercial districts, and found only one lot developed with an electric substation meets the buffer area requirements. Staff has proposed changes to the buffer area requirements to mirror those of the city's other commercial districts. Other items from community development. Case 2026, PLT03, a petition by Shannon and Kyle Real Estate LLC for a boundary adjustment plot to consolidate lot one of Family Fund Center, an attractive land in U.S. Survey 373, Township 44, North Range 5 East into one lot to be known as Family Fund Center consolidation plot. This is the proposed lot consolidation for swing around fun town. During your view, it was discovered that part of the existing go-kart track, go go-kart building and mini golf course encroach the front and rear setback. This will require a variance before the boundary adjustment can be approved. The parking lot will also encroach on the buffer area. However, if the previous text amendment is approved by board of by the board, the parking lot will be in compliance. The petitioner has applied for the necessary variances, which will be considered by the Board of Adjustment next week at their August 18th meeting. That is all I have.

Thank you, sir. Announcements from the Park and Recreation Committee Tree Advisory Board. The August 3rd committee meeting was canceled due to a lack of quorum. The Parks and Recreation Committee Tree Advisory Board recommended the following other parks and recreation items. We have a presentation by the YMCA regarding the 2025 fiscal year, and we have Tom Verheyen and Anne Hayes here to present that. If you would please.
Welcome, folks.
Hey, good evening. For those of you that I've not had the opportunity to meet, my name is Tom, and I'm the Southwest District Vice President for the Gateway Region YMCA, and my office is at the Riverchase YMCA just down the road here. What I'm going to do is I'm just going to give you the boring stuff, the financial update from 2025, and a quick snapshot of how 2026 financials are looking. And then Ann gets the fun part of telling you what that all means in terms of impact to the great residents here of Fenton. So in 2025, we just were able to audit our books and get a reimbursement check sent to the city. So I wanted to break down what that looked like. So end of year 2025, River Chase YMCA had revenue totaling $4,328,886. Two biggest areas of that outside of the subsidy that we received from the city of Fenton is membership. Membership brought in $2,335,549 last year. That was $301,992 better than what we had budgeted for last year. So obviously we keep thinking that we're going to plateau at some point. We keep budgeting for that and expecting that, and we continue to grow. A lot of that having to do with Ann and her leadership and her team. Programs is the second one that I'd talk about. Programs encompasses, and Ann will talk a little bit more about the impact of this, but programs would be personal training, swimming lessons, youth sports, summer camp. 2025 programs brought in $539,118, which ended up being $119,801 better than last year. So we're looking at about 20% growth year over year on programs, and we think that we're really just at the surface of that. It was kind of built strategically that membership needed to happen first, followed by programs, and that's the course of action that's happened. So revenue came in really, really great. Expenses for 2025 came in at $3,143,946. Two big areas that I just note would be number one is staffing cost is always going to be our biggest expense. In 2025, we spent $1,487,278 on wages. So that would be... salaries for the directors that would be uh lifeguards is a big number of that summer camp counselors all the staff that you see uh working at river chase uh and then the second line that i would note if you look at our financial statement be occupancy and occupancy makes up your utilities and your building maintenance um and last year we spent 535 205 on occupancy So all that revenue minus expense, $1,184,940 was the net for 2025. And we're extremely proud of that. Two statistics on that. That was $224,906 better than what we had budgeted for last year. So if you remember last year, Ann and I stood before you in December, which we are excited to get to do here in a few months again and let you know what our budget for this year was going to be. So we finished about $225,000 better than that budget, and it ended up being about that same amount better than what we had done the previous year. And the reason that you didn't see a ton of growth in this year's budget is because we keep thinking that it's going to plateau, right? So we want to have a conservative budget, knowing that what we've seen in both membership and programs has – exceeded our expectations year over year. And we can't expect that growth to happen forever. And so you typically see a more conservative budget, but each year the team there is just crushing it. So what that means for the city and our relationship with you all is per the contract, we have our two half million dollar reserve buckets that have been filled up years ago now, making interest. So then the contract says that we split the net. And so we were able to send a check back to the city for your 50% of that gross net. So we sent a check to you in July for $592,470. Okay, with that, I'll hand it over to Ann.
And I'm the associate exec at River Chase. And I'm going to talk a little bit of numbers, but fun numbers. So as you guys can tell, this summer has been super warm and super fun for us at the pool. We are fully staffed. We've kept the slide on the whole time. With that being said, from Memorial Day until today at 3.30, We had 88,473 scans. And that's just members coming into our facility. That's not the daily passes that we sell. So that averages to about 1,200 scans per day. So our building is hopping. It's busy. And we've also got really good staff. Our aquatic team is doing an excellent job keeping everybody safe. And also making sure that everybody's having a good time while they're at the pool. So that is one of our really big highlights. Our membership units right now is at, it's a little over 2,900. And so we've always kind of talked about like three, 30... 30,000 would be kind of our 300 units would be, nope, 3,000 units would be like our cap. But we actually think we still have some more room to grow. So that's kind of the number we've been floating with. And I think we're still doing really good with that. Third-party pay units, we're at $4,573 right now. So that's when the insurance pays for the membership. And then youth sports, so we are getting into our fall one youth sports. Right now we've got 95 registered. That's the highest number we've ever had for fall sports. And all throughout the whole year, we've had 475 kiddos participate in our sports. Then with camp, so camp, we have one more week left of camp. We originally did not plan for next week, but we noticed that it was a need in our community because the kiddos aren't going back to school, so we scheduled an extra week of camp. So our unique campers this year, we've had 279, and that averages to about 110 per week. We still have that waiting list of 20, and after looking at our facility and looking at our staffing, we think next year we'll be able to... give 140 kiddos the chance to come to camp at River Chase. Swimming lessons, we're still running with swimming lessons. So far this year, we've had 862 kiddos learn how to swim. We also do something fun with summer day camp. The kiddos that do not pass the swim test, they get enrolled in swimming lessons for free, and we teach them how to swim so they can pass the water test. We also throw in a little bit of water safety because We want to keep the kiddos safe. So we had 23 earn their green wristbands, which means they get to go in the deep end on Friday. So that's something we do that's unique to the YMCA. And then with Group X, we have an average of 81 classes per week. And so that's an average of 25 people in a class. Some of our silver sneakers class have about 50 that can go to their classes. Then with our chronic... disease prevention. For Livestrong, that's for cancer survivors. We've had about 20 participants. For diabetes prevention, we've had 35. And then for blood pressure self-monitoring, we've had about 25. So that's kind of what's going on at River Chase.
And can I ask you, one program that's pretty close to my heart is the infant swim program.
Yes.
I hear that there's a waiting list.
Yes. So, and that is, so we offer our group swimming lessons and hopefully that takes some of the burden off the ISR classes. But yes, there is a waiting list. Christy comes in and teaches our lessons and she gets the pool and she gets her time. And then we try to like supplement it with our swimming lesson.
What do you think the youngest kid that you've had in the lessons are?
So for YMCA, it's six months. For ISR, I'm pretty sure it's probably about the same age. I'm not for sure what their guidelines are.
I think it's just a great program.
Yeah, and I mean, the drowning for youth is the number one leading accidental death. So we need to make sure that we are keeping kiddos safe around waters.
Good job. I love the idea of if you didn't pass the swimming thing, then it's like, okay, you're going to get free swimming lessons. Yes. Thank you so much. That's beautiful.

If we are approved, we would move forward with obtaining the liability, the required liability insurance. It's not something as a new non-profit that we hold on to all the time.
What is four wheels?
So we originally started as Midwest Off-Roaders. It's a local all-female Jeep club. In June, we did some rebranding and repurposing, and we have separated from the Midwest Off-Roaders and expanded our mission. So we are a true 501 nonprofit. We have four pillars that we support. Rev Her Up, which is women. Empowerment, Fueled by Fur, which we support local shelters and animals. Highway Heroes, which is our vets. And then we also have Full Throttle Futures, which is our children's division that we support. And so we're just, this year, 2026, is kind of our year for us to get our feet under us with this new rebrand. And 2027 will be our official launch. Thank you.
So the way it would work is it would be voted on this evening, and then the final vote would be at the end of the month. However, if it were to pass this evening, this portion of it, it would be contingent upon you getting that liability, because we can't just say, oh, sure, go ahead, and then have you not provide the necessary liability.

A lot of things were a couple things that are favoring on whether they can actually provide it and pick it up in time. leave it there the night before or come get it the next morning, not leave it there overnight. And then the issue of getting water.

Sorry. It's okay. I'll move the microphone back down again since I'm still short. Okay, so I'll start out by asking for anyone that may have looked through it or has any questions. You can start with any questions, and if no one has anything... start with and I'll just kind of go through what I found going through the previous inspections that were done and going through the parks myself.
And you may start by telling us that you have certifications for this kind of inspection.
Yes, I am a certified playground safety inspector. I've had my certification for about two and a half years.
Question. So I know that we did have a pretty thorough one done Not too long ago. So is this kind of like a follow-up of, yes, we fixed what was wrong?
So what this is, is the inspection that was done before was completed before I started my employment here. So once I kind of got situated, did a little training, that sort of thing, I... went through the inspection that the playground company did, and I went through really everything that they did, the inspections as well as the impact testing for the surfacing. Really, there was only one thing on there that I did not agree with. There were a couple additional things that I found, but I based my inspection off of their findings and looked at additional things as well. Thank you.
Do we have any specific questions based on the handouts? Why don't you just kind of... There's a lot here.
Right. There is a lot. And it's a lot of words. So for Fenton City Park, the... Surface testing overall was good. There was one HIC score exceedance, the head impact criterion, but it was only one, and they do three tests in each spot. The two subsequent tests averaged together passed, and that is what matters as far as ASTM guidelines. So surfacing at Fenton City Park main playground is good. There were a few issues that I did find. There's a hairline gap or crack and a gap on one of the climbers. That climber will be, the equipment itself is being replaced by warranty, but that does not include installations. On the rollers, well, it's a regular slide, but it has a few rollers in it, just a little inset of rollers. There's several bushings that are missing. I would like to get those replaced and installed. There's a few loose bolts. The post toppers are loose. There's some paint that needs to be touched up. There's a little bit of graffiti. Nothing, you know, terrible. Just, you know, minor stuff that could probably be removed with the graffiti remover wipes from the playground company or power washing. I do also recommend power washing of the playground. It's just dirty. It's outside all the time, so it's dirty. Free trimming is not needed at this location. So as far as the main playground, that's basically my findings there. Does anyone have any questions on the main playground?
Do you have an idea what it's going to cost to have that installed? I know, I'm just...
Yes, so we do have a quote for that. For Benton City Park main playground... The installation of the climber and the roller slide bushings, post toppers, touch up paint, and replacing surfacing labels that are required by ASTM, the cost for that installation is about $4,500. And that there's also a charge on this invoice for $54 for the aerosol cans of the touch-up paint.
Yeah, I mean, you don't have to go through all that. Just a rough idea because, you know, as far as I'm concerned, one lawsuit, the $4,500 is wiped out. So, yeah, we need to have this all done ASAP.
But it looks like we need to approve each part separately.

City Park, there's two playgrounds in Fenton City Park.

creation in the amount of $5,528.41 to make the necessary repairs and provide certain apparatuses. We would suggest that we go with them and not a secondary company because this is what they do. And they are who's recommended by the manufacturer. Also, we're seeking approval for Elite Properties to power wash both of the, in Fenton City Park, power wash them each $300 each. That can just be approved under our current contract. With NextGen, if you want to move forward as soon as possible, we can also approve that just under a service contract where staff can move forward with providing a service contract to get that ball rolling. The final item is for elite properties to remove the existing swing, what's remaining of the swing set and the surface. That's something we can, as you know, we have money in the budget to replace all of that in the back at some point. They did state it could be movable. The one in the rear, I don't think this is bad money spent to make these repairs to that structure, because they've stated that this has a pretty good longevity to it, that it could be moved to another location in the park at a later date, should you, because we do have it in the budget for this year to look at replacing that altogether. So, I mean, really, that's just staff recommendations based on, Candace did a great job going in and doing a re-review of the, one that we had getting ahold of the manufacturers to find out a lot of this was covered under our warranty for replacement. It's just the labor to get it installed and do some of the legwork. So that's really where the request lies. So yeah, with Benton City Park, this incorporates all three with those three action items. Nope, nope, I'm okay.

So for Fenton City Park, the rear playground, it's mostly the same thing, just some loose things that need to be addressed. And the playground company would be perfect to do that. There is a plastic crawl tunnel back there that has some cracking in it. And I reached out to the manufacturer, and they will be replacing that under warranty as well, the equipment itself, but not the installation. Same thing, it's dirty. It could use some power washing. I did find some minor surface cracks in the decks on that playground. I don't have any concerns about it. I actually sent it to NextGen Recreation, who is the representative for the manufacturer. They don't have any concerns about it. It's something I plan to just keep an eye on. So every, you know, once a month I'll go out there and just look at it. I don't expect to see really any changes for a long time on that.

Canvas, please. Okay, Westside Park. Overall, the upper playground is in pretty good shape. It could use, again, power washing, tightening up loose hardware, touching up paint, and replacing the safety decals. The biggest issue up there at Westside Upper is there was a section of the surfacing that did not meet the head impact criterion. The previous inspector suggested that the overhead climber, you know, most people know it as the monkey bars, the overhead climber was installed too high. I did reach out to the manufacturer, confirm that is incorrect. It was installed the way it should have been installed. Now we can lower that overhead climber to three feet above the deck if we wanted to, and then we might meet the head impact criterion on the surfacing. However, that really diminishes the play value of the overhead climber. When it's only three feet from the deck, the taller kids really can't use it at all. So I did some work with the representative from the playground company and found a new piece of equipment that we could, so we could remove the overhead climber, put in a verticlimber, which you do have an image of it under the quote, that would reduce the The fall height, I still would recommend getting the servicing retested at the new fall height just to make sure that it meets. But I really think the right answer here is to remove the overhead climber and put in the verticlimber.
What was the cost on that again?
So the VertiClimber, the equipment is $2,000. And to install the VertiClimber, the touch-up paint hardware, it is $4,000 for the installation. I don't have a price on the surface retesting yet.
We'll most likely call in Ideal, who we had the contract with to begin with, to have them do the retesting event. It should be a minimal amount of money. I think the overall testing for all of the, we had all of the playgrounds done was like 400 to have all of our playgrounds inspected and tested. So it should be a very nominal amount.
Okay. So the request is to replace the piece of equipment.

And I think we need to go with Candace's recommendation.

Yes. Okay. So for west side lower, my recommendation would be to remove the playground completely, the equipment, the surfacing, and put in, you know, turf temporarily. And then we can decide, you know, later on if you guys want to leave, you know, just leave it as turf or do something else with it. But currently the surfacing that is there does not match the equipment. So either way, if we replace equipment or replace servicing, it's going to be a pretty significant cost.
Is any of that equipment, can it be used again or once we remove it, it's life's over?
So it could probably be used again. I will say as a CPSI, I don't love the equipment that has that much movement. There's a lot of opportunities for things to go wrong. So for that glider, Anytime you have any equipment that moves that much, there's just more potential for things to go wrong, things to break. So I don't necessarily like that type of equipment. However, I think it could probably be reused at some point, but we would have to have completely different surfacing underneath it.
So you answered my question. So what I heard out of your mouth really was the equipment poses higher liability to the city. Correct. What I just heard.
And then that other one that's supposed to move doesn't move. One that's supposed to go back and forth that doesn't really move. It kind of stays in one place. I don't know if the springs are, but.
The springs are probably tight. They also don't want it to move too much.

It's a West side playgrounds are in the 2029 long range capital plan for replacements or additions. So but we can always bring that forward just to start talking about ideas. I don't know if the space, I think Candice has been reviewing it, one discussion we had internally with staff would be swing sets. We know we always have so much demand for swing sets, if there would be enough space in that area.

So it's just a maybe. But the problem is it's a very small area. It's a very small area. The other item was discussed was extending the basketball court and making it for two sides. I think it's just going to take some future research. But in the meantime... staff's recommendation is just to go ahead and have it removed, and then we can take our time and figure out what possible replacement.

Next is discussion regarding the playground inspection at Valiant Park.
Okay, Valiant Park has a lot of the same thing as the other playgrounds as far as needing power washing, touch-up paint, tightening up loose hardware, replacing stickers. There is a bench over there where the bolts are quite long. Technically, that doesn't fall under playground rules because it's not on the playground, but playground ASTM guidelines require that any bolts on the playground not show any more than two threads. So, you know, I think we need to have those bolts addressed too. That's, I mean, a simple fix, but I think it's important. There is also an issue with one of the slides over at Valiant where there's gaps in between the slide sections. I've experienced this with other similar slides. It's very common. They just shift a lot. And so what I have done in the past is fill it in with clear silicone. I did check with the manufacturer of this equipment, and they agreed that that would be an acceptable fix in this situation as well. So the quote does include that. The other issue with Valiant is the surfacing. The surfacing is very deteriorated in multiple spots. One of the head impact criterion tests did fail, so there's part of the playground that is in noncompliance as far as the surfacing. Also, where the rope climber is, where it attaches to the surfacing, it is pulling up the surfacing, so it's not completely buried under the rubber. So I would like to look into getting quotes for full replacement, also repair. I'm also interested in replacing that rope climber. I've worked with other rope climbers, some bigger, some smaller, that have the same issue where the hardware pulls up from the rubber surfacing. So I would prefer a different type of equipment where we won't have that issue. Again, that rope climber also, there is a lot of wear where it attaches to the deck. There's some bushings that are missing, so the connection point, there's just a lot of wear there. I think replacing the rope climber would be my recommendation, but if we don't replace the rope climber, we need to at least replace that bracket. In the surfacing, something needs to be done, whether it's a full replacement or repair, if the surfacing company would recommend that. I would really need their recommendation on whether it could even be repaired.
So I guess my opinion is if we're going to replace the... Oh, well, the roll bracket. Well, so if you're going to replace the bracket, then the fall protection, right, the base needs to be replaced. I'm hearing really... I don't want to throw money at it because you're going to fix one thing when you've got another thing that's wrong. And what I'm hearing is we've got multiple things wrong with this playground, right? Correct. So I'm really hearing from you that some of this really needs to be replaced or redone. And that playground's not, I mean, it's not all that old.
It's not that old. 2018, I think. 2018 or 2019.
I don't think the recommendation is, the main portion of it is in great shape. It said another five to 10 years. I think she's just wanting to replace the biggest apparatus on it, which is what they call that. which I think we did learn when we were going through the process for up the hill, is that they've gone away from those types of installations with those, what they call the trees, or because of hang up with hair, different things. So I think what she's requesting is, are you interested in her looking into replacing that portion of it while getting bids to replace the surface?
And again, like you say, if we're going to replace the bracket, let's just replace the damn thing altogether.
Well, yeah, because you're going to start tearing it up, right? You got to tear up the surface to replace the bracket, to replace the rope structure. And so what I'm really hearing is it's life's over for us. And if you're going to replace the surface, you're going to have all that ripped up or tore up or partially... done you might as well replace that structure and if the rope structure is one of those that we're getting away from because what i just heard out of you again is lots of liability it's really what i heard from you then off it goes otherwise that the rest of it is good for another five ten years yeah there's no other major issues with that playground except we got to get the trees off the ruin right yes anyone else

As we discussed at last month's meeting, we had received a quote from one of our two plumbing contractors to repair the carriers for Fenton City Park. Again, Merlo was on site to review it. They absolutely agreed. Explain the carriers? The carriers are the carriers. for the toilet that are cast iron that go in between the cubbyhole that nobody ever wants to go into and nor can we. So, do I? They're original, they're nasty. Was that the dictionary definition?
What's that was that not the definite was that not well, but I guarantee you there's some on this board in the audience didn't know what a carrier, but it's the thingy between the 2 thingies the carrier carrier is what the plumbing is no problem in the back for ways and it also has the mounting bracket for the toilet to be mounted to carry the affluent the affluent.
It's broke. It's cracking.
We would like to get this done this fall if we can after, you know, we get through the events during the kind of the lower time. You will see that Shamrock or Merlot's bid is quite a bit higher than Shamrock's. However, staff's recommendation is they're both our contractors. We have contracts with both is to utilize it with this one Merlot. They were on site multiple times to review this bathroom. I feel that it's a very solid recommendation. in lieu of the other one was kind of done as a, yep, this is about what it would cost.
I was actually there when they crawled in there and they did a really good inspection where I don't feel that when we would have less, oh, by the way, your cost just went up because of.

And this is for the Coleman Pavilion. A lot of it's same information that you've received before. However, Jeffco is, and again, starting with the cupola that needs to be repaired, you've seen that it's deteriorated. It needs a facelift. They are proposing kind of like a hardy board type material. Even meeting with Elite on site, they've used Jeffco and they stated that they were going to give us a bid for the cupola and they suggested, yes, that is the material you would want to go with and recommended staying with Jeffco for that repair. But we would like them to amend the bid. And unfortunately, I wasn't able to get it in advance of today to include, to do the vinyl wrapping as we've done with the Merrimack Inn bathroom and with some of the wood components on that structure while we're working on it and also adding gutter guards. If you go down and you see the gutters for the trees that are in the area, and that's an area that doesn't get as much probably visual time where you see it's on the back of the building. So just seeing how those gutters were very full. We did receive a second quote for we received one from Voorhees. We did ask for another quote from Elite when we met them on site. Actually, the mayor was with me when we met them down there. And their quote came in quite a bit less than Voorhees. And there's a copy of the quote, of both quotes. And it's for the same, it's the same areas to be including the railing. So my recommendation would be that we would move forward with a leap for the painting. The real question comes down to the pavement, the concrete. We did look at mud jacking. budgeting is doable and it would be less expensive. But in review of it, and I think the public works director agrees with this in looking at it, I think while you're there, get it done, get it done right and get them, get the slabs redone. And we do have a cost for that. And comparatively in looking at the slab, it's not that much more money to go and have the full replacement done, especially with the one that's fully cracked. There's some photos in there that shows an area that they're not even proposing to mud jack that just would remain as it is, we would have to at least crack seal it. So Dan, do you disagree with that? I know the mayor was there when we had those discussions
They're also going to get rid of all that merrimack gravel and clean that up. Yes. Because the weeds and everything continue to grow.
And again, doing the work that we're doing isn't worth doing if the regrading doesn't occur and get done correctly, which is a part of their bid that they provided that then includes the extension of the gutters as recommended by the engineer. and regrading around the pad site. So all of those bids are included. The only thing I'm waiting on is what additional amount it would be for the gutter guards, which would be minimal. I think it's usually around $2 a foot. And then what the cost would be for the aluminum wrapping is all that we're waiting on. So, I mean, if you would like to continue it for another month so that we can button that up,
Yeah, and my comment on the mud jacking, you know, even if you mud jack and level up cracked slabs, you still have a cracked slab, you know, that's going to have water intrusion unless you keep it sealed all the time, just going to lead to more problems down the road.

Yes, we were approved for cost sharing. The first one is a 50% match at $11,687.50 for the removal of woody invasives at the lower Presler Lake and Fabic Nature Preserve. That's going back the additional 50 feet. I think most of you have been able to see the handiwork that was done this last spring and how different the park is looking due to that. So that would be, and with that includes both the spray, the foliar spray, and then going back the additional 50 feet. So that's signing the agreement and it's a 50-50 split with the Missouri Department of Conservation for that. The other is the, which allows for a 75% match, but it was at a maximum of $13,312 from the Missouri Department of Conservation to go towards the tree survey. They were able to, they wanted to provide a max total of 25,000 to the city of Fenton. So that's how that money was split up. But as you may recall, the overall survey that we were requesting was 25,865. Staff would still like to move forward with the overall survey. It may be less because this is based on an estimate of how many trees would be done. But even though... They're willing to basically give us the max of the $13,312, but staff would still like to move forward with the study itself at the $25,000, and that would be the max that we would max out at. We're going to try to get it lower based on the areas that we would do the surveys through. But really, this request tonight is about signing the agreement and accepting the funds from Missouri Department of Conservation.

Hello. I've put together some detailed information in the back for you. The front is just some Just the summary of the changes. The biggest change, I guess, is going to be in the capital projects funds. And Nikki and Dan have all went through these projects. They've went through these projects and have decided what's going to be moved to 27 or 28, what's going to be taken off, and decided... I'm sorry, they haven't decided. I'm sorry. That's for you to decide, but they gave us to... me to put on here on what they might have wanted to move to 27, take off altogether, or add to the cost. And you'll see that the difference in that is going to be $1.6 million that they want to increase those budget amendments for for the capital projects. So we will have to transfer over to the capital projects fund another $50,000. I put $50,000 from the general fund and the capital, the stormwater parks fund to the capital projects fund. So we'll help with all these projects if we can get them all done, if they can get them all done within this fiscal year. So hopefully you had a chance to look at all this. I'm sorry. And a lot of this stuff was that was at, it was approved by the board already.
It's just being put in a big chunk of that was 1.3 million for the lighting at the, at the, the FSC complex. So we just realistically look through where we are with our projects now and move them. Some of the items we've already discussed this evening, we went ahead and added the Coleman Pavilion repairs so that we have the money and the budget for that. Those were noted in the memos is that we've already budgeted as though those would move forward, of course, knowing there can be a change. One minor item, though, is that we would need in the new restrooms in Fenton City Park. I received information yesterday, I'm in the process of applying for the grant, is that the water and sewer is gonna be about $108,000. So we had placed into this at, we had placed in here 350,000. We will need to increase that to 400,000 to incorporate the additional cost with the water and sewer for the new restroom in Fenton City Park. So that would be a change we would be putting with the ordinance. And again, that will include any necessary lift station.

Next, I have a consideration of amendments to the traffic code related to bicycles, e-bikes, motorized bicycles, motorized play vehicles, and alternative motor vehicles. Team memo from Nikki. Do you want to give a brief summary? I know I had one or two questions.
Yeah, I can. Yeah, this is a very brief summary is that it's as discussed, Amy brought forward last month and there was a discussion about adding the motorized play vehicles to kind of bridge the gap between some of the vehicles that are not captured in the code. And then also eliminating the use of the bicycles, e-bikes on the city sidewalks. And I know that Alderman Lang does have a question, one that we can pose with the city attorney too.
Yeah, and my question, because I was reading through this, and under motorized play vehicles, there's these pocket bikes and mini motorcycles, and then another one that was in there when you read through it was scooters. And I know my daughter has a scooter that she rides around on, and those, the motorized play vehicles, would not be allowed on streets or sidewalks. It would be like... you can't have them. And I know there's going to be discretion used with it, but do we want to put everything in there? You know, even like the scooters that go 15 miles an hour, these little kids ride on. Cause I haven't noticed a big problem with those and captain, I don't know if you guys have had a problem with scooters. I know some of these e-bikes and stuff are, but yeah. Just quick. Yeah, just the battery-powered scooter.
Like the little bitty ones that have a cell battery in it?
I mean, you stand on it. It's got a rechargeable battery on it, but they go like 15 miles per hour max, and there's three settings on it. Our daughter's does. I think I got it up to 19 trying to go as fast as I could down the hill, but I weigh a lot more than her. And so where does she ride it? in our neighborhood. I mean, we take it to a friend's house, and the Peric is all six girls. She hangs out with their duo, and they ride it up to Starbucks, and they kind of ride on them everywhere, really. So I just noticed that one was no on the streets and sidewalks, so I didn't know if you guys have had an issue with those at all. No, we haven't. Yeah, okay. Thank you.
I mean, I will say that those little motorized scooters, they go up and down our street all the time. But I will say... Just like electric bikes, they start off at 15, and the next thing you know, three years from now, they're doing 40. And I think that that is what we're running into, is that things keep advancing to where they... But I actually had a big question. It's like, well, where would they go then? So I'm struggling with all of this, to be honest. But I don't know where it's, it's a lot.
And I guess that was the one question I brought up with that is, especially in some of these trails that aren't paved or uphills and stuff, those scooters don't really do as well on them as these motorized bicycles do with the big tires. So I didn't know if that was something we wanted to keep in there, or I know the police are going to use discretion on stuff. Anyway, if there's a couple of kids riding on their scooters, going to the store, there's not going to be an issue. Um, So Aaron, I don't know if you have a comment on this or if we can, it's hard to say one thing is, and one's not, I mean, anything that goes over five miles per hour, like, you know, some of those big foot that two-year-olds drive are more than five miles per hour, you know? So I think that's where it just gets to be like, this is a lot. Yeah.
yeah i mean i think it's up to you i think the idea for us was when we were coming back to this was to try to catch everything because we were noticing that there were gaps so this was kind of supposed to be the catch-all but i think you i mean you could change the miles per hour you could talk they're not protected yeah if if um you know if you have some direction for us we'll definitely be happy to
on, you know, take this and put further, there's multiple different versions of these codes out there, you know, to kind of look at it further. If everybody's like, I want to treat the e-scooters more like an, or the motorized scooters more like an e-bike, or we want to treat them more like a bicycle, then we have the direction on how to then go back and amend. So this is not something the board has to make a decision on tonight.
Just maybe one suggestion would be somewhere around either the horsepower or the wattage of the electric devices. They're usually rated on there, or at least by model you can tell what they are. Obviously, it would be the officer's discretion to see if it's a problem. But that's kind of like the 49cc rule. It gives you something to kind of distinguish the guys that are on the little... mini bikes versus a kid on a scooter.
On top of what Alderman Lang brought up, because I had a question, where would they go? The section 380-030, so do they, for the rights of a bicycle, electric bike, motorized bike, it says... shall be granted all rights and shall subject to duties applicable to the driver of a motor vehicle. So does that mean they have to get a license, an insurance?
No, it means applicable. So bicycles are generally supposed to ride on the street, stop at stop signs, stop at red lights, not run those red lights. We see them always doing that. But that's what that's saying is the ones that would be applicable to them riding bikes, they are supposed to follow. So technically they can get a ticket for speeding. They can get a ticket for riding, running stop signs and that kind of thing.
And then the last one was the motorized bicycle. Is that right? I'm getting so confused.
Yes, a motorized bicycle is what you will see typically where the confusion may come in that it's an e-bike or a motorized bicycle. But they typically have, they don't have pedals. They have a bar. It's most of what you're seeing in this area and the speeds that they get up to. And at that point, they are required to be 16 and have a driver's license to be on that. They have to abide by the same, they do have to abide by the same rules as a vehicle or a motorcycle on the road. Thank you.
Oh, and last one. On the very last page, I think that there should be an E for continued violation. So yes, you've notified the parents. Yes, you've given them a written warning. And then I think after that, you need to give them a fine. If they continue to violate, you can't just keep giving them warnings. I didn't see.
That's in C after the first, it's the last sentence, after receiving the notice of the first violation, they shall be punishable as provided in section 100, 160 of our codes. That means they would get a ticket. And then, of course, it's up to the judge's discretion under that code section of what fine they would actually provide them.
With all that we had, I did not look up section 100.

So I guess the next question is because we will be happy if this gets continued this evening to work on this. The other item is, are you then, because you have to remember the parks, when we talk about paths and different things, that's under our park code. It's not under the traffic code. Remember, this is just applicable to your streets and right-of-way. With the parental responsibility, are you also wanting to see something similar that's been provided in the 38110 that would be the same in our parks, that if you're caught in our parks and you're on our path and you're not supposed to be, that there's parental responsibility. So we could kind of work on both of those simultaneously and bring them both back at the same time.
I do think that's important because I do think sometimes parents will drop their kids off at the park and leave. And that's, you know, anybody can be at home when a kid goes, oh, I'm going to ride to my friend's house. Great. But when these parents, I think that's even a bigger problem when it's like, all right, come hang out at the park for a few hours. I'll be back. So I do think it needs to be with both.
Yeah. Along with not just these bicycles, but along with vandalism and, All that stuff. I think that parents need to start taking responsibility for their children.
And I think the inclusion here is to give law enforcement the ability to go out and, again, use discretion. Because honestly, these kids riding up and down on the street, I don't have a problem until they make it an unsafe condition. And there's about four of them that ride, and they'll pull wheelies and stuff and distract people. But if they're operating it the way they're supposed to be, I certainly don't have a problem, but we need to give them the ability to do that. So, I mean, I understand your concern with the little one, and again, as long as there's some discretion, as long as there's some teaching, but You never know your own kid when he's not at home.
I'm sure there's kids that do in Fenton. We're in Lindbergh District, but I see kids at my daughter's middle school riding scooters and bikes, and they stop at the stoplights. They press the thing every morning to school. So there's times when it's not a problem. The bad kids are going to be the one that cause a problem.
Do you see a problem with any of this?
No. I'm with you, sir. We're all responsible. We don't have any issues whatsoever. I mean, at the end of the day, we just want to want the kids to have fun, to be able to be out and enjoy. And we all complain about children doing nothing but playing on video games in the basements all day long. So, yes, we want them to go out and have fun, but be responsible in doing it. And God forbid that any of them violate these traffic laws, which, yes, they're supposed to obey the same traffic laws as they are in the motorist handbook or the driver's handbook. And that's the last thing you want to see is a child get hit by not stopping at a stop sign.

Normally, we have a Rockwood or Lindbergh Elementary Choir perform where we light the outdoor lights at 615, following by a visit from Santa and refreshments. Staff will be contacting Rockwood Choir for their availability to perform at the event as Lindbergh performed last year. In addition, winter market will be held in the old library space and a food truck will be provided. This time staff's seeking board's approval before moving forward to hold the event. It's not that much more to replace the slab. I think it just makes more sense to tear it out and replace it than trying to put some piers under an existing slab. First is the consideration of an agreement renewal with Elite Properties and Landscape for our on-call, as-needed services related to city-owned properties. And we've used them in the past. I'm assuming that it's just... a little bit of an upgrade on charges for next year. It is.
It's their standard upgrades. These are the same upgrades. As you know, we have a separate contract that we use for the work that we do on private property that's used through community development. With this one, I will tell you, it's rare that we use the standard charges with Elite because that's things like, there's some things that are basic as far as mowing and other things, but typically what they do is they give us a case-by-case bid. And that's what we have. And if it's under $5,000, we look at it. If we have the money in the budget, we can move forward with it. If it's over $5,000, it comes to you guys for review and approval.
So this is basically a guideline. It is.
They pretty much quote every single project they do with us. And some we approve, some we don't.
Anybody else have any thoughts? If not, I would like to make a motion that we re-up our agreement with them for next year.

And the second item this evening, as you remember, the board asked the staff to reach out for a possible grant to buy a second K&M. And it looks like that grant has been denied. So staff is asking us to review a quote to buy a second K&M on our own. And this... it would be for $40,914, and it would have all the amenities of our first K&M, which would be the snow plow and the lighting and whatnot. My one question I had on this, though, was for that type of vehicle, Dan, how much snow do you think it actually could push? I mean, is it two inches, four inches, or does it have a limit to what it can actually do? I'm not looking at it as a very beefy vehicle, and that's why I asked.
Oh, so I have a plow on mine, both of them, and we plowed last winter with that heavy snow, wet snow. I plowed I don't know how many driveways in San Simeon. Never had a problem.

The Department of Justice final rule mandates that all municipal websites, mobile apps, and online services meet WCAG 2.1 level AA standards. The deadline for compliance is April 26th of 2028. Based on our population size, implementing accessibility on demand AOD software now meets mitigates significant legal risk and ensures equitable access to city services. Staff is seeking approval for the acquisition and implementation of accessory on demand with IMS Technology Group through statewide contract MS-250263001. Copy of contract and product sheet is attached to ensure city's digital platforms comply with updated U.S. Department of Justice Title II ADA requirements. This allows for a simplified purchase order only. Processes spent and is registered as an organization in the cooperation procurement membership listing. Jane, you put all this together.
What it is, is in order to get the software program to process the ADA accessibility documents, we could go through a statewide contract that we are already part of the process on that. And staff is asking for a $5,000 credit purchase to get this process started. and then we could buy blocks of credit as needed. But on the typical, to get started with us, there's no additional cost for training, for implementation, or anything like that. So it would just be the credits that we would use, and we would get that training and get it put in and get everybody trained so that we can start getting all of the documents scanned in to meet this requirement.
And this is something we have to do?
