All right. Good evening everyone. Welcome to the city of Fenton board of alderman meeting for Thursday, April 23rd. We'll begin with the pledge of allegiance. May I have a roll call, please? Under the mayor's comments, uh, very briefly, uh, those that attended the food truck night, I think it turned out pretty well. just even though we had the threat of bad weather, um the the the band uh played, the food was excellent, and we had a really good turnout. So, the next one uh is May 15th, same place. I don't know who the band will be. Do you, Robin? Okay. I don't, but stay tuned. Dan's on. He may It'll be a surprise.
We'll find out together. Uh restrooms are moving along quite well. I think a lot of the painting is done. Flooring starts Nikki soon. We we hope next week hopefully or Okay. So, having said that, let's move to item number two on the agenda, which is approval of the minutes. Reading of the minutes is waved since copies were given to the board members in advance of the meeting, made available to the general public. There are copies on the back. Thank you, Mr. Mayor. Uh tonight we have announcements from planning and zoning commission. Planning and zoning commission continued the following case. Uh, case 2026, SUP03, a petition by Seikko Auto Limited Partnership for special use permit to operate an automobile commercial motor vehicle service facility at 470 South Highway Drive, property of zone BP3, Business Park District. Also, case 2026, SUP04, a petition by Scanel Properties LLC for a special use permit to operate a truck terminal at one Premier Drive property of zone BP2, Business Park District. Tonight, public hearings you will hear. Um, first is approval of 20 2026 TXT01, a petition by Seiko Auto Limited Partnership for amendments to the zoning code as follows. One to amend section 400.030 definitions to add the terms automo automobile commercial vehicle service facility and automobile commercial motor vehicle wash facility. and two to amend section 420.010 land use matrix to allow an automobile automobile commercial motor vehicle service facility as a use allowed by special use permit in BPA3 business park district. This case received a positive recommendation from planning and zoning commission and will be considered under new bill. We have a representative that like to speak or does anyone have any questions?

I I just had a comment more towards the the text tax X amendment, not not for your particular petition. um really just sort of an oversight uh in the definition of vehicle service kind of u I think it covers it but it doesn't really mention anything relating to electric vehicles and so it defines vehicle service spark plugs engine oil all this stuff but it doesn't talk about changing batteries and and other things it does kind of have an open vehicle related service so I think it's okay I just But like I say, nothing. Uh, next we have CA approval of case 2026 TXT02, a petition by Scanel Properties LLC to amend section 4200010 land use matrix of the planning and planning and zoning code to allow a truck terminal as a use allowed by special use permit in BP2 business park district. This case also received a positive recommendation from planning and zoning commission and will be considered under new bills. We have a representative that would like to speak. Hello. Uh Cam Duff with Canel Properties. Uh my address is 7802 Northeast 160th Terrace, Smithville, Missouri 64089. Uh I'm here as a representative of Scanel Properties and the proposed development. Um I'm happy to answer any questions you have. We also had a have a uh PowerPoint presentation that we have prepared for previous meetings that we'd be happy to share if uh if if that's helpful to anyone. I think just to clarify because Amy it was I thought you explained it best. Sorry. Um about how this was just shoring up the uh definitions that are in that zone. Correct.
Yeah. They're they're they're looking to add an existing definition that we already have in our code. They're they're looking to add that use um as a use allowed by special use permit in BP2. Um it received but it does pretty much fit within the other yeah that it was received a positive recommendation um from the planning and zoning commission. They looked at the the purpose of the district and felt that it was similar enough to another uh the CP1 district where it's already allowed by special use permit. Okay. And we do have uh two businesses that are legal non-conforming that operate. We're not that would be under the I understand. I I just just not going out of the box to put this in. I don't believe so. But I'm making clear.

A petition by Leonard Walter of St. Louis Marble Company for site plan review of a new office warehouse building at 1565 Fen Park Drive. Property is zone BP3 business park district. Thank you, Mr. Mayor. Announcements from the Park and Recreation Committee Tree Advisory Board. None. Recommend recommendations from the parks and recreation committee tree advisory board. Approval of improvements to the Fabic Nature Preserve outlook area as suggested by staff with the addition of a bench for the former helicopter pad site. This requires a motion. I make that motion. Can I uh ask like the helicopter site is that within that circle stone circle? Oh, okay. For some reason, I thought it was down farther, but it it's in the stone circle. Approval of request from Great Rivers Greenway to utilize the city's rightway for access to Park during construction of a trail realignment project as discussed at the March 12th committee meeting forwarded from the April board meeting. Required documents for the ordinance contract have not yet been received by the city. Therefore, this matter will be continued to the May board of alderman meeting. An ordinance authorizing the mayor to execute an agreement with Musco Sports Lighting LLC for the Fenton Sports Complex LED lighting upgrades forwarded from the March board meeting. This will be considered under new bills. Approval of request for a special event by St. Paul Athletic Association to utilize Fenton City Park for their annual soccer tournament at a reduced rate as discussed at the April 9th committee meeting. This requires a motion. I would make that motion.

Approval of request by Greg Burton to hold a special event for a 100 innings charity softball game in Fenton City Park as discussed at the April 9th committee meeting. Yeah, I mean at the time we discussed as we were I think we were looking at his insurance uh applications or his his providing of insurance resolved.
Nope, it has not. Um the motion was to move forward and that he would have to you know fill out the application when the date and time was was selected. Um and at that time if he's not able to provide the insurance, it will still have to come back to the board for them to wave the insurance requirements. Or if you'd prefer, you don't have to move this forward and at this time and he can just come back at a later time. Well, then I would be under I'd rather just push this aside until he, you know, he comes forward with what he needs. The only thing that I worry about is if he he still has time up until that event to bring his his paperwork in. He does. Um the pro I but I I don't believe there's ever been a date selected
and and I probably Dan, do you want to speak on that? Yeah, I can tell you I have had zero conversation with him since the uh committee meeting. So I'm not sure where we're at with insurance, a date, anything like that yet. Okay.
Personally, I don't think it needs to come back to the board. To me, it's Dan's got it. If that guy can come up with a date that is available and then he can show the insurance and the staff sees the insurance, I don't think it needs to then come back to the board for us to approve that. Yeah, we're we're okay with this. As long as he has what he needs and the staff is saying everything's okay. I I feel like we don't need we can just we're going to give you the go-ahad if he provides everything. Well, we need to clarify that in a motion then I believe. But we did. It was. Yeah, that's that was part that were that was the conditions of us bringing this to approve legal any legal comments.
Yeah, that's exactly right. That was one of the conditions and if you would like I mean there's no objection to Dan also just kind of relaying to them that you know it is that the city is under no obligation to wave the insurance. So he does need to get that in and make sure so that you guys don't feel then obligated when he comes at the last minute and wants a waiver for insurance. No, that's the only concern. So, what's the Sorry. So, what's the consensus? Do we want to vote on this tonight and make sure that he has all of his information? Yes. So, I would vote on it tonight, but I just maybe if we resend and and Robin clarify just to make sure it's abundantly clear that I'm not interested in waving the insurance.

Lastly, I have an ordinance authorizing the mayor to execute a cost share agreement with the Missouri Department of Conservation for a floating wetland in Westside Park. Okay. Under the mayor's report, we're still looking for an appointment to the parks recreation committee tree advisory board. Uh anybody here of any anybody that's interested, let us know. Uh we're going to move to the city clerk's report. Got a few of them tonight. Okay. The first one is approval of an agreement with the supplemental services related to the contract with general code LLC for the city's municipal code as discussed at the April 2nd committee meeting and that does require a motion. Nope. That's it. That's it. Thank you. Reports from standing committee. First up is Alderman Lang in his absence. Uh we'd like to take Alderman Herald, you want to call on the do the report for Alderman Lang? We're uh first up is police municipal courts. Sure.
Captain, would you like to give your monthly report? Good evening, ladies and gentlemen. I'd like to go over the monthly report for the month of March 2026. And I know you're all aware of this uh with your handouts. I'll just run from um present March 2026 to February last month and then March 2025 year before. Calls for service did go up from 731 to from 704 uh year prior 718. Self-initiated assignments remained uh consistent 1427 versus uh last month 1454 and last year 1,723. Arrests were also pretty consistent from this month to last month from 22 to 24 and there were 39 year ago. uh DWI arrest. Uh the city of Fent officers had zero. However, there were two highway safety units that uh wrote DWIs within the city of Fent limits. Uh compared to zero last year and last month. Uh radio calls uh in the business districts were 355 in March of 2026. February 372 and March last year 549. arrests were 17 and 17 uh for March and February. I'm sorry. Yes, March and February uh in the business districts uh compared to 22 year year prior. Traffic citations did increase a little from 189 last month from 180 previous month to 148 in March of last year. Warning t warning tickets were 118 to 101 to 62. Uh the stealth stat radar was deployed due to some citizen
complaints uh on Cinnowwood and I can go over those the results from that. Uh, so the survey took place. Officer Dilks deployed that stealth stat stealth stat radar in Synwood Drive on a on a pole there on March 20th, 2026 at about almost uh 1:00 p.m. It was removed uh on the 31st. Uh this is a posted 20 mph zone. The average speed indicated on that on the stealth stat was 12 miles per hour. The minimum speed or the average speed, I'm sorry, was 12 miles per hour. The minimum speed was seven and the maximum speed during the survey was 30 miles per hour. So a two a total of 203 vehicles were involved in the traffic survey. As you can see 0 to 15 mph were 147 of those vehicles. 16 to 20 were 30, 21 to 25 13 and 26 to 30 were five and that was the highest speed was 30. uh just go over some other statistics relative to crime in the area. So there was on crimes against persons. There was a a forcable sex offense this month, one last month. Uh this month we did have one just a uh couple of days ago also in one of our area businesses with a couple of co-workers. Um, precinct detective Kaine was able to, well, the victim of the most recent one was able to provide a name of that suspect and that suspect more than likely is the cause of the one that's in March of 2 2026 statistics. Uh, he is here from what we know illegally and uh, customs or border patrol has been notified. Uh we we're
trying to find an exact name for him and um he may no longer he may be getting deported very soon. Uh aggravated assaults uh went up three from zero last uh month and four year prior. Uh these all did result uh well all three of these instances involved uh the same three people. Um one of them is incarcerated. Uh he's sitting at the county jail on a $250,000 bond. He was the victim of one of these aggravated assaults. Uh prosecution was uh refused on that. It was a domestic situation with the uh the lady that was involved in the other two aggravated assaults which uh resulted in search warrants. Um search warrants were u conducted on the house to locate a firearm. that lo firearm was located and as I said the suspect is remains in the county jail under a $250,000 bond. Uh simple assaults uh did decline from one to four three year prior and we're talking small again very small numbers. Uh crimes against property that did go up uh by two with um shoplifting um which remains pretty consistent. We had 17 the entire month of March compared to 15 in February and 20 year prior and that's generally it's uh all in the business business districts and Gravalwood Bluffs. Um did have a couple motor vehicle thefts from the um the hotel um the Heritage in um frauds were down. Everything else was down. um drugs, narcotics violations. Uh we did have two of those. Those were uh of a result from an arrest. Any lararseny
in the bluffs when the uh suspect was arrested, officers found uh drugs on two of the suspects. So that's the result of that number increasing by two. Everything else is rather low. Um that is pretty much all that I have unless you all have questions. Uh you talked briefly last month about uh some vehicle breakins in the business park including with some uh catal theft, right? How are we this month?
Uh we uh we don't have any catal we haven't had any catalytic converters. I know Jefferson County uh this person was involved in some other theft down there a month ago. Uh they tried to serve a search warrant. The judge denied the ser search warrant on that uh residence in Jefferson County. Um so I'm sure Hopefully the guy got the hint and uh is kind of being watched now and hopefully won't come back for a while. We did have a repeat offender from a some toolboxes uh and some work trucks being stolen. Guy stole $100 worth of screwdrivers a few days ago and he was a suspect of ours and he was arrested um by um officer Abalov and u it's he was another one that drove through a flat camera. So, leaving the uh that area and he was driving the same exact vehicle the last time he did it. So, he was kind of easy to nab. I spoke with the owners uh of Missouri Furniture after the ribbon cutting. They were very impressed uh that we had law enforcement came to the ribbon cutting. So, I greatly appreciate that. And lastly, we have uh approval of a request by St. Paul's Parish for road closure and traffic control during the parish picnic and parade as discussed at the April 2nd committee meeting. Public works department maintenance worker one, maintenance worker two, maintenance worker three, maintenance worker seasonal. Parks and recreation department lead athletic field ground maintenance worker and athletic field grounds maintenance worker. Next, we have an ordinance authorizing approving a health insurance plan for eligible city of Fenton employees with Anthem Blue Cross Blue Shield. This will be considered under new bills. An ordinance approving dental voluntary vision basic life and A andd long-term disability voluntary short-term disability voluntary life and A andd insurance plans for eligible City of Fenton employees with Mutual of Omaha. This will be considered under new bills. An ordinance approving an employee assistance program for eligible City of Fenton employees with H&H Health Associates. This will be considered under new bills. an ordinance approving voluntary critical illness, voluntary hospital indemnity and voluntary accident insurance plans for eligible city of Fenton employees with Mutual of Omaha. This will be considered under new bills. Approval to continue utilizing the DNH navigator platform for HR records as offered by the Daniel and Henry Company at no cost to the city. This requires a motion. I'd make that motion.

Yep. Thank you, mayor. Um, have a memo from Amy Stark. Um, we have some new businesses received occupancy who permit in the city. Um, I'll go through them quickly. Trans Advantage, Trans Advantage USA, um administrative office for vehicle dealer on BS, Innovative Companies, uh construction company on Lark and Williams, DC3 Solutions, a repair and sales of mobile electronics on Wolfner Drive. Uh LP Creative Studio, video production studio, which is an expansion of an existing Fenton business on Rudder Road. Uh commercial flooring on it's a flooring contractor on Haran Drive. Crunch Fitness. Um it's a temporary gym enrollment office on in Benton Plaza and uh McHenry Autom Automation Corporation Automation Control Engineer Systems Integrator uh new location for an existing B business and they're on Lark and Williams Industrial Court. Thank you, Mr. Mayor. Have the monthly update provided by public works director Dan Howard. Ongoing projects are the 2026 concrete slab replacement, the Budw Wild Fabic Nature Reserve stair replacement, invasive species removal and seating in parks, forest cutting services, park and tree trim reming and removal, installation of the players bench coverings, field leveling services, playground installation at Budwe Park, exterior interior paint of the city pavilions and restroom facilities. Projects to begin soon. Concrete repair in the city parks, flooring replacement in the city parks restrooms, and reconstruction of the parking lot at 900 Gregory. Projects projects that are going out to bid asphalt repair for park paths, asphalt and drive parking areas in a nature preserve, Fabic Nature Preserve, and street striping services and joint ceiling services. And attached is a copy of the 2025 capital plan, which I'm sure everyone had a chance to review. And the next item is an ordinance author authorizing the mayor to execute an agreement with E. Meyer Contracting Incorporated for the 2026 parking lot replacement at 900 Gregory Lane project that will be considered under new bills. An ordinance authorizing the mayor to execute the first amendment to the agreement with Missouri Native Stewardship Services for the other native landscaping services. This will also be considered under new bills. And the last item is an ordinance authorizing the mayor to execute a second amendment to the agreement with St. Louis Tree Services LLC for as needed tree removal services that will be considered under new bills. Thank you, Mr. Mayor. Uh this evening, first we have the monthly update for public works and forestry uh compiled by Dan Howard, the director of public works. Uh work continues on the invasive species removals at the Fabric Nature Preserve, Westside Park, and the Bud Wild Park. Work along the Marramck River Greenway will begin in the next few weeks following the tree removals, which that's going on this week. Right. Tree removal. Okay. Public Works is in the process of replacing park benches throughout the city. Um, and then the second item I have is an ordinance authorizing the mayor to execute an agreement with Pole Painting Plus Incorporated for the 2026 Oldtown Street Light painting project. And this will be considered under new bills later this evening. And that's all I have, Mr. Mayor.

Per below are notes on open service tickets and ongoing projects and sales. Open service tickets onboarding of a new employee in public works park and wreck ent to have the workstation up and running. Email setup and phone extension updated before start date. Uh, thank you, Mr. Mayor. First item up tonight is the monthly report as prepared by Tammy Alup, our finance director. Our BOLO sales tax summary, we generated $472,627. Of that redistribution was $192,544 or 40.8%. Epool sales tax summary generated 403,556. Of that redistribution was $245,297 or 60.8%. Total combined sales tax generated $876,183. And as we talked about in in committee, we're going to put a city's logo on the sides and all so people it's identifiable. But white is you don't you don't find them much. And I think in talking to the the vendor, they don't know if they'll get another white one. So they'd like to to, you know, move this along if possible. Um, Dan, you want to add anything to that?
