Thank you ma'am. Uh if you're following tonight on the agenda, item number one is the mayor's comments. I urge everyone on the board and in the audience and in the community to uh have a look around town and we've had three vendors in for the last week and they have done an astounding job on honeysuckle removal. Um, Huck Road, Fabic Lane, Huck Road, the uh, uh, Fabic Nature Preserve, Bud Budwe, Westside Park. I don't know if you've had a chance. That's over in your ward. It looks It looks really nice. So, uh, we're going to continue on. I think Nikki's going to be asking down the road for a few more dollars to, uh, continue, but I think we should. And I think this spring and this summer are really going to reflect the the hard work that we put into it. So having said that, we'll move then to item two, approval of the minutes. Reading of the minutes is waved since copies were given to board members in advance of the meeting and made available to the general public and there's copies on the table in the back. Uh tonight's public hearings, you will hear case 2026 SUP01, a petition by Muhammad Al Kerwi of Nightwal Tobacco LLC for a special use permit to operate a tobacco shop at 794 Gravway Bluffs Boulevard A. Property is zone C1 Commercial District. This case received a positive recommendation from the planning and zoning commission and will be considered under new bills. And secondly, um uh do so the next case is case 20261. This is the consideration for the St. Louis County NU district. We have anyone that wants to speak to that?

So, case 2026 REZ01, consideration of a request to reszone certain properties from St. Louis County NU non-urban district to the city of Fenton NU non-urban district. To conform with the comprehensive plan, the parcels are addressed as 256 Allen Road, 272 Allen Road, 515 Bush Forest Lane, 526 Bush Forest Lane, 527 Bush Forest Lane, 539 Bush Forest Lane, 550 Bush Forest Lane, 555 Bush Forest Lane, 566 Bush Forest Lane, 567 Bush Forest Lane, and 450 50 South Old Highway 141, 47 478 South Old Highway 141 and South 605 South Old Highway 141 and 609 Old Highway 141. Uh, one thing if I may. So, we had a number of residents come to the planning and zoning commission meeting and and committee meeting. Um, and for the record, this uh resolution, nothing has changed from the time of the planning and zoning or the uh committee. Correct. Nikki, thank you. Okay. Thank you, sir. Announcements from the Park and Recreation Committee Tree Advisory Board. The committee elected Gary Johnson as chairperson, Mary Heinman as vice chairperson, and Mike Abbott, who's actually in the audience with his wife, Deb Abbott, who's on planning and zoning, as a secretary. The committee discussed the following. No action was taken. Replacement of birdhouses and city parks. Again, thank you, Mike. Park projects in the 2026 capital improvements plan. Due to the Labor Day holiday, the committee's September meeting will be held on Wednesday, September 2nd, 2026. The 2026 Arbor Day observation will be held on Saturday, April 11th, 2026 in Fenton City Park. Recommendations from the Park and Recreation Committee Tree Advisory Board. Approval of a request by Stanton Elementary for a kindness garden in Fenton City Park. That requires a motion and I'd make that motion at this time.

An ordinance authorizing the mayor to execute a city contractor agreement with Jeff Couting Incorporated for roofing, guttering, and facial work on park structures in the city. This will be considered under new bills. an ordinance authorizing the mayor to execute a city contractor agreement with O Vorhees Painting Company for exterior painting and staining services for park structures in the city. This will be considered under new bills and approval of a quote from Chesterfield Fence and Deck for the installation of a new fence at the main pavilion in Fenton City Park under the city's small public works contract. All right. Uh under the mayor's report, we're still looking for a member uh from Ward 3 for the parks recreation committee and tree advisory board. I've not been able to find anybody. I asked someone today turned me down. So, we'll continue on. Uh, city clerk's report this evening. We have an ordinance exempting the city of Fenton, Missouri from the uh, provisions of section 311.2026 RSMO relating to liquor licenses and that will be considered under new bills.
Thank you, ma'am. We're going to move then to reports from the standing committees. First up is the police municipal courts. The chair of that committee is Alderman Elang. Members of that committee are Harold Joker and Rogers. Thank you, Mr. Mayor. First item on the agenda tonight is a monthly report for the month of January 2026. Captain, if you would please come up and let us know how we did that month. Good. Good evening everyone. Working a little bit. Thanks. Yeah, I think so. Okay.
Um, thank you. I'd like to go over some of the statistics for the month of January 26. Um I'll skip the front page kind of the uh the comparisons between January December of last year and prior year January 2025. Uh calls for service we had 654 which is down 16 calls from December month prior uh which is down 81 prior year. Selfinitiated assignments were up uh by 164. We had uh 1,583 this month compared to 1419 December of 2025 and uh down 97 from 1680 year prior. Arrest we had 24 compared to 32 last month which was down 8% or down eight uh which is also uh down from four year prior. 28 January. Uh DWI arrests, we didn't have any by Fenton precinct officers. However, our highway safety unit did have one DWI arrest precinct. So depending on how you look at that, we had one in December as well. Highway Safety Road three year prior. Uh on view um in the business district was 463, which is up from 454 to um year prior uh arrests in the business. So all of our arrests were in the business district 24 uh citations this month we had 161 citations the month of January as compared to 119 last month compared to 249 January 2025 uh warning tickets issued 8748 to 72.
Uh we did have uh our stealth stat radar unit is back in service. It was on San Simeon way. I just run over some of the uh some of the information that it uh got. Uh so it was deployed uh January 6th at 2 o'clock in the afternoon and it was removed at uh three days later on the 9th at roughly the same time about 1:30. Uh the posted speed limit there is 20 miles an hour. The average speed from that uh survey was 22.3 miles an hour. The minimum speed was seven. The uh maximum speed was 34. There were 222 vehicles that were captured on that survey in that 3-day period. Uh just take some time to talk about just the crime um relative to prior month. Um, so crimes against persons, we had a total of seven incidents. We had uh one forcible sex offense uh case that is being handled by our crimes against person uh unit uh that was down in the hotels and I believe it was that and we had six simple assaults in uh last month we had completely goose eggs on crimes against persons. We didn't have any crimes against persons in December of year prior or month prior, I'm sorry. So, which isn't bad. Um, I talked last month about these simple wise. We didn't have a huge increase. That six number six is four juveniles got into a fight with four people. The other number to make up the six was
a couple of brothers, one of which was drunk and his brother told him that he needed to talk speak English because they got into a fight over that. That was our six assaults. Shoplifting went down uh from nine. We had 10 month of January compared to 19 last month. Fraud offenses went up a little. We have seven compared to three. Uh we didn't have any um property offenses and we had three destruction of properties compared to six last month and miscellaneous. Um crimes against society. Um we had three warrant arrests and one DWI. Um, so we didn't have any drug narcotics violations or arrests compared to that. No weapon law violations which we had December. So all in all and with the crime that we have again I'm uh my position on these block cameras. They're a great thing to help us find that was a thing that I know they were huge a year or so ago year and a half ago. So, a lot of the larger moving trucks that are getting those cats removed vehicle license plates. that were
huge huge uh proponent of uh of having those.
Thank you, Captain Next on the agenda, we have municipal court statistics for January 2026. Uh if we look on the back page here under section five dispersements, we had total dispersements tallying 13,796.50. Also, tonight we're going to have a few ordinances and I'm going to ask Aaron to jump in here in a moment. Uh first one's going to be ordinance amending title 3 traffic code of the city's municipal code related to commercial motoral vehicle enforcements. This will be considered under new bills. We also have an ordinance repealing in its entirety title 3 traffic code and enacting a new title 3 traffic code of the city's municipal code. This will be considered under new bills. Erin, do you mind explaining why there's two pertaining to the traffic code?
Um yes. So the this all came about really related actually to the bill that's second on the agenda that repeals the entirety of traffic code. This came when we started talking about alternative vehicles and in doing that and then trying to insert that into the traffic code staff realized that there were a lot of inconsistencies with the definitions that were used within the model traffic code. For example, there was no rhyme or reason on using vehicle verse motor vehicle. we there was no pattern or reason but they were defined differently. Um but they were used interchangeably throughout the code. So one of the things we did was kind of clean that up to really have motor vehicle be what you would consider a motor vehicle and then a vehicle being everything else including bikes scooters and those kind of things and kind of clean up those regulations. Um, so that ordinance actually is going to both clean up all of that and within that add alternative motor vehicles as well as add what the first ordinance does, which is the um commercial vehicle enforcement. Um, so because we have so many edits with that code, we are just repealing the entire code and then enacting the brand new code and it's going to include all of those amendments, cleaning it up. So the second bill, you don't actually need the first bill if the second bill would to pass because the second bill has that commercial motor vehicle. But we have both of them on there because the board wasn't sure they wanted to necessarily consider them together. So if the second ordinance doesn't pass, the board could consider the first ordinance that enacts just the commercial motor vehicle enforcement provisions which were requested by the county. If that makes sense. So, we will essentially not do a full reading on the first ordinance and do the second one because it wouldn't make sense to pass the first and then not pass the second.
That's what I would suggest because you don't need the first one if the second one passes, but you would it would be duplicative. Yep. Thank you. Thank you for explaining. And and if I may add to that, Nikki, this is uh actually a cost savings for cotification purposes as well. Okay. Thank you. Uh last tonight we have an ordinance authorizing the mayor to execute an amendment to the contract for housing of municipal inmates with St. Louis County. This will be considered under new bills. Thank you, Mr. Mayor. Uh first item I have the monthly update is prepared by Jane Clerk. Jane Hungler, city clerk. The city is currently advertising for the following open positions. Public Works Department, maintenance worker one, maintenance worker two, maintenance worker three, and maintenance worker seasonal, parks and recreation department, parks and recreation supervisor, lead athletic field ground maintenance worker, and athletic field ground maintenance worker. Also have an approval for the mayor to execute an acceptance letter with Mercy related to a rate increase for occupational health services as discussed at the February 5th committee meeting. Sure. Thank you, Mr. Mayor. Um, the monthly update for community development and affairs was prepared by Amy Stark, our community development director. Uh for the month of January uh we had one two three four five six new businesses receive occupancy permits in the city of Fenton. Trading card market 2030 corporate 44 drive is a sports and trading card company. Retail technology group 1859 Bulls Avenue sweet 107 um point of sales equipment. It looks like Type A Construct construct 1746 Chase Drive residential and commercial remodeling company. Personnel Truck Leasing at 1090 Cassens Industrial Court uh to truck terminal. Redwood Logistics at 1859 BS Avenue, Sweet 105, uh is a logistics and freight broker. And Grimco at 1601 through6003 Manufacturers Drive is an HVAC company. Um, and that looks like all I have for community development.

Thank you, Mr. Mayor. I have three items tonight. The first item is the monthly update prepared by public works director Dan Howard. The 2026 concrete slab replacement program has started. Work for 2026 will include the final completion of a few slabs on Casston's Drive, Oello Drive, Fen Cororp Drive, and San Simeon subdivision. Uh the stair replacement at Budweis and Fabic Nature Preserve is ongoing. The stairs have been poured but still require power washing and sealing. Gateway tree care and St. Louis tree service are removing dead or diseased trees and stumps in all the parks system and the uh city's rightway. Installation of the players bench covering coverings is continuing at the softball fields in Fenton City Park. The city held bid openings for the following projects. concrete repair replacement throughout the parks, sports field leveling services, park restroom flooring coatings, and exterior paint of park buildings. Projects currently out for bid include the parking lot reconstruction at 900 Gregory Lane. And the following will be advertised for bid in the coming month. Driveway, parking lot, asphalt project, and a nature babic nature preserve uh painting of the interior of the park restrooms. That's all for the update. Next item is the an ordinance authorizing the mayor to execute a city contractor agreement with the Mottz excavating LLC for the 2026 sports fields leveling project and that will be considered under new bills and an ordinance uh authorizing the mayor to execute a municipal storm water grant participate participation agreement between the city of Fenton Missouri and the metropolitan St. Louis sewer district that will also be considered on new bills. It's all I have tonight Mr. Mayor.

Thank you, Mr. Mayor. Uh to start off this evening, we have a monthly update from Dan Hower, our director of public works. Um work continues on the invasive species removals at the Fabric Nature Preserve and Westside Park. And work continues as time allows at the upper Fabic Lake area, clearing the overlook area and a shoreline around the lake. Public works is prepping the Fenton Sports Complex for the upcoming tournaments. uh season which begins in March. And I I would add to the mayor's previous comments about how how good it really looks up there at Fabic. I drove through the other day and it's it's like a different place altogether. Um and then one other point I'd like to make this uh this evening, Mr. Mayor, for anybody that's driven by Walmart recently and notice um the quite a bit of fence that is now missing uh along the road that we're responsible for. Um evidently some of those cliff boulders fell down and came through the fence and in speaking with our director of public works Dan um our group um maintenance group um jumped into action and went over and cleaned that road off with our equipment for for a temporary fix to keep the road open and then the owner who was responsible came the next morning early and took care of that. Um, and so I wanted to recognize our guys and thank them and also to uh mention that we will be seeking reimbursement for the money that we had put out for our guys to do that work. Thank you, Mr. Mayor. Uh tonight in front of you, you have a memo from Nikki Fininkbinder, city administrator. Uh this is the monthly update. Per below are notes on open service tickets and ongoing projects and sales. Open service tickets inactive users ticket to added accounts that are receiving fishing campaigns. We have hunt group when the c when the courts hunt group is called and not answered. Voicemail of a former employee is received. Initial fix did not resolve issue. Help desk is doing more research for alternative solution. Uh BSNA data extraction ticket for tracking projects for migrating finance application. Next steps waiting on confirmation from thirdparty vendor for another data extraction. tenatively scheduled for 211. Did that happen?
That did happen. Um open projects. We have 2026 firewall replacements, conversion of existing existing firewall configurations currently in process. We have 2026 PC refresh equipment on order. And for sales, we have Fabic restroom camera and cellular gateway. And we have block of time for service not covered by MSP contract. And that's that report. Next we have uh tonight approval of a quote from ENT option two for the installation of a camera for the Fabic Nature Preserve parking lot area as discussed at the February 5th committee meeting. That requires a motion and at this time I would like to make that motion.

Thank you, Mr. Mayor. First item up is the draft of the monthly financial update for December 2025. sales tax redistribution. A sales tax summary generated $515,678. Of that redistribution was $299,690 or 58.1%. BP pool sales tax summary generated $283,339. Redistribution of that was 99,72 or 35.2%. Total generation was $799,17. Redistribution was $399,392 or 50%. We flip over to the back. The city's total cash and investments is 29 million 549,297. Any questions? Next item up is an order is an ordinance establishing the year 2026 municipal tax rate for general revenue purposes for the city of Fenton, Missouri at 0 cents for each $100 of valuation for all retail and personal property and that will be considered under new bills.

Mayor, I have an update from Dan Howard, uh, director of public works. Uh, public works will begin opening the park restrooms once temperatures are steadily above freezing sometime in March. I guess also depending on what we do with fixing them up as well, That's it. I'm sorry.

Um staff did a lot of work on this. It's something that needed to be done from my understanding that we needed to to refine our traffic code. It's also my understanding that they wrote this to match state traffic code. Um which I think only makes sense for us. So I just wanted to make that comment. Thank you.
All right. I have a statement. When the ordinance was passed a few years ago to allow golf carts on 30 mph streets or less, it was very clear to the board and the mayor that it was only for golf carts, a vehicle that is relatively quiet, and slowm moving with no real off-road capabilities. Now, we are going to have to vote on or now we're having a vote on allowing UTVs and ATVs that are fast, loud, and are 4x4 off-road machines designed for trail use. During our most recent snowstorm, someone in a UTV drove up and down the Fabic Dam in or the dam in the Fabic Nature Preserve and did donuts out in the fields at Fenton Park. With the proliferation of these vehicles, these occurrence of destruction will only become more frequent. Some of these UTVs have 240 plus horsepower engines that are capable of over 100 mph. For comparison, an SUV automobile such as the Honda CRV or Toyota RAV 4 average about 200 horsepower. Once Pandora's box is opened, there is no going back. So why are we here at this juncture? Is it because of some public uproar to allow the use of these vehicles on public roads? Nope, quite the contrary. In fact, the constituents I have talked to are adamantly against these types of vehicles on public roads, and nobody has ever expressed their interest in changing the ordinance. The real reason this is being considered is because Mayor Marath was reprimanded by the Fenton precinct officers for driving a UTV on public roads, contrary to our current ordinances. So, a few short weeks later, the mayor put on the agenda to modify the traffic ordinances to allow this type of vehicle. This is a very slippery slope for this board or any other future board to modify an ordinance just because an elected official does not like the law and wants it changed to suit their needs. And uh Jane, I will be providing a copy for the record, I'd like it put in there.

It was it came to his attention that we needed to update our our bills and our ordinances because this is coming down the pike. You can't stop it. So, we need to cover it. And so it was not it was more of it it became very clear that we did not have our ordinances covering all these all terrains and so that is why I am for Yes ma'am.
I just I mean I was there that night that's exactly what happened. It had nothing to do with you're being reprimanded. It was brought to the attention that these that this traffic code needed to be amended. wasn't a um you're doing something wrong conversation at all.
So, I just, you know, I'm not for this. I I think it's we are on a slippery slope. Um I did see the destruction that was done. The uh individuals uh there was multiple of them that did drive in the park during the last snowstorm that did go up and down the dam. I live below that dam. Um, I'm not for the dam to be tore up with uh all-terrain or four-wheelers or side by sides, whatever you want to call them. Um, I and I just get concerned with uh people, younger individuals that see others driving them up and down the streets that decide they want to go drive theirs up and down the street and they are loud. Um, and now we're going to let them do that um, basically any time of day or night. And those four-wheelers, off-road machines, most of them, uh, have the louder exhaust, and I don't care to listen to that. Or have the individuals that are walking up and down our streets with some of them that don't have sidewalks to have those machines pass them. Um, I do live by Fabic Nature Preserve. I've seen it plenty of times. I've seen full-size Jeeps go up and down the dam because they think they can make it. Um, and I think we're just opening ourselves up for more destruction in our parks with the off-road vehicles. online.
My only comment is people have them. This helps the police officers enforce the traffic code and again it was written to match a state code. I just hope we vote with what's the right thing and not personal agendas. Um just a comment there. It's the enforcement is basically anything goes. So the cops could have no enforcement really because they have no way to tell the person to get that thing off the street if this passes. So where it is currently now where those things aren't permitted on the streets, the cops do have enforcement after this passes. There is no enforcement. Every type of the one of those vehicles is allowed. Anybody else? So here's what I'm going to say. So it wasn't the mayor being reprimand. Thank you, Alderman Hules. That wasn't the case at all. It was pointed out to us that uh that evening that the code only included uh the golf carts and SUVs and or I'm sorry, the side by sides weren't covered in that at that time. I put mine away. Hasn't been in the city until recently, which we used it to do city work with uh the last couple of days. Um, and the uh if if anybody really paid attention, I have pictures of the car that was not a SUV uh or a side by side. It was a white uh Chevy uh truck that was actually on the dam and in the field. And I've got pictures on my phone to prove that. So, it was not a side by side. It wasn't a four-wheeler or anything like that. So when we make statements like that, we we need to make sure that that's in fact what has happened. I'm not the only one that has a side by side. Um there there's several others throughout the community. Um it the I I've been riding my my golf cart. I've ride ridden my side not my side by side, but my four-wheeler on the streets for years.
And every uh captain that we've had, I've asked if they were uh legitimate. And every time it was yes until Captain Lawson looked into the state statute and it says they're allowed as long as the municipality allows them. You have to pass an ordinance. That's how this all came about. So I really have no heartburn if I don't ride mine on the street because for the most part it's out at my farm. But I think it's up to this board. I'm not going to lose a whole lot of sleep over it. I'm not an advocate for this. But to, you know, consider that I'm pushing this because I have one is totally ludicrous.
