research right now to make sure that we do have clear title to the properties and then I'll get that list to to the council. Um review chamber and wire grass economic development contracts. That's with the mayor's office. I'll provide copies of both of those agreements um to the council for your review this quarter. Um options to mitigate speed and residential neighborhoods. Uh that's something that I've talked to chief more about. I know during the last quadrinium he also spoke to the council about certain options. That's something I think that he and maybe our city planner or new city planner can can take up and maybe present some options to you. Talk about what we're currently doing, how we monitor that, some things that you know we always hear about speed bumps and other things um that that certain people want at times and and some of the reasons that we have that we we don't prefer to do that um if at all possible. um state and federal agenda for Fort Rucker. That's something uh that that I put under my category. We have obviously a state and federal agenda that for for the council, for the city. Um and we do have some things that we are working on on Fort Rucker. I just need to kind of formalize that in a document for you to see. Um Chief Moore's also asked to present uh technology solutions to the council. That'll be a force multiplier. Um, we're trying to do that this quarter so that next quarter when we start our budget process that you you understand what he's trying to ask for um and and maybe weigh in on things that you'd like to see or concerns you have. Um, some of those in the past have been like LPR cameras and and things like that um that he continues to to want. Um, old copenville agreement again that is with Enterprise City Schools. I know you're probably tired of me saying that. our city attorney, you know, every Tuesday when I ask about it, we email. So, I don't have a good update for you on
that. Um, and then quarterly nuisance property and customer service experience report for the uh quarter. We try to do those at the the last meeting of the quarter so that we can get the the full quarter's worth of reporting back to you. Um, I did have two other thing or really three other things that are um that I wanted to bring up during this time. So, in your packets, um, behind the agenda, you'll see a list of of board, uh, appointments by council district that are are coming up. Um, in the past, the the last quadrinium, the council wanted to um to do this as a slate. The statutory requirement that we need a nomination um hopefully tonight for for school board or at least a name. So, the way that's worked in the past is the the council person that's responsible to bring a name for that particular seat to fill it, whether it's, you know, renewing that or nominating somebody for a vacancy or whatever, um would bring that up and then at the next council meeting, barring any, you know, good name and character conversations or if there were any objections from any of you about who they chose to to nominate, you would formally act on that. Um the only one tonight that we really need to talk about is the board of education. Um so that that's under district one under Councilwoman Rich uh to have a name and I think we talked earlier you you have a name for that council woman. Do you want to share that with your colleagues?
Yes. My mic is off. My name is Jennifer Boy and she's currently serving. Um, I asked if she would if she wants to serve again or she does, she's willing to serve again. So, that's going to be my um my nominee for that seat. Um, but anyway, uh, all of your other and and I put on there um who they are. Uh, a handful of them have uh that I've talked to. So, I I made it through district two um before uh the clock expired and come to come up here, but um I can provide contact information if you don't have it for who's there, but what we've typically done is ask if they would like to continue to serve and just get that information back to you. It doesn't mean that they have to, but so you know if if you want to nominate them again or if you have somebody else in mind that you'd like to to bring forward, but um I'll close the loop with you on on the rest of those. But um we've done this um and and actually Beverly and Sally uh worked really Sally Bane our assistant clerk worked really hard to consolidate this list. So o over the next four years you'll see everybody's got you know somewhere between two and and four appointments. Over the next four years you all have an equivalent number of appointments. Uh it just works out. some years. Some council people have two, some have three, some have four. Um, based on how that was done, we've also gone back through um city council minutes and tied each one to a seat. So that in the past, what we had trouble with was somebody may step down from a board and um you would you would fill it, but they wouldn't go they'd do it for another four years or sixyear term instead of filling out the remainder of the term. So, we we didn't have a good staggered board process. So, we've we've cleaned a lot of that up and
I appreciate the work that the clerk's office at Beverly and Sally have done to to take charge of that. Um, again, on your uh in your packet behind that, you'll find a request that we received uh mayor and a lot of our staff went to the All-in Credit Union car sale. There was a request um for the April 21st agenda about a sales tax holiday for automobile taxes back in 2008. Um they they approved in addition to the half cent sales tax increase citywide there um after the tornado they approved a half cent sales tax increase on automobiles. um they're proposing taking that off for the weekend of the car sale to incentivize people to to buy. What I don't know yet because I if you look on the email, I just got this maybe a few a few hours before coming here. Um so I've asked our city attorney, she's called the League of Municipalities to find out if there's a precedent for this, if we can legally do it. And I don't I don't have a good answer for you. Um they suggested getting an attorney general's opinion. Um that's that's going to take more time than April 21st. Um so I'm looking for precedent now to see if some other city throughout the state has done a sales tax holiday. I'm I'm not sure if you have the authority to do that or not, but I I'll have an answer, you know, as soon as I can get one. Um so those those are two other things. And then finally, um, we have some guests with us today from our state director for traumatic brain injury who you graciously approved a lease with couple council meetings ago. Um, and they're they're here and I just wanted to give them an opportunity, if you're okay, Councilman Pageant, with allowing her to come up and uh, thank you for for the

Good afternoon. Thank you so much. we were passing through and wanted to um we're from the Alabama Department of Rehabilitation Services. My name is April Turner and I'm the state traumatic brain injury director and Jamie Nicole Dele who just joined our charge who's the state traumatic brain injury training coordinator. Um we are the ones who you graciously approved for us to have a traumatic brain injury center here um in this building and we just wanted to say thank you so very much. were traveling around the state getting everything situated for our veterans, first responders, and our guard and could not be more proud that Enterprise chose us and we chose you all to be able to um hold one of these five centers for the state of Alabama. So, we'll be having ribbon cutting soon. We'll let you know when that is. It'll be sometime this summer. Um and again, this is a national, we do not have this anywhere in the United States where we're serving veterans with traumatic brain injury outside of the VA and working alongside of them. and so you'll be known nationally because Alabama's holding we're leading the way in this area. So, I just wanted to say thank you and if you had any questions, I'll be more than happy to answer questions, too. But I appreciate you going ahead and signing um what you needed in your council meeting last time and um just graciously thank you for letting us help your veterans for free in this area. So, thanks.

Okay. All right. Then we will uh move into review of agenda. We'll begin with our roll call, opening prayer, pledge of allegiance, and approval of agenda. And then um we have consideration and consent agenda. City Council work session minutes. And then we have accounts payable for March 2026 in the amount of $1,570,916.51. $37326 $373,28658 is Waterworks Board. Uh we have contract billings uh for Poly Incorporated, 37,000 for preliminary and engineering for 2025 tap sidewalk project and 2260 for engineering design of the Henderson Strain Street drainage. Barge design $54,730 contract services for County Road 606 relocation airport. We have some travel requests and um just stop me if you have any questions or want to say anything as we move through this. Then we will have a mayoral proclamation for the month of the military child and then we have a request to address the council for a permit for the hometown heroes celebration um in downtown Enterprise Business Association Friends of Main Street. And then we'll have privilege of the floor. And if I don't forget it, we'll have staff reports. Um, and old business will review and consider ordinance of the sale of property for Bates Memorial Stadium. Is there anything that we need to discuss
about this that we haven't already? Okay. And then under new business, uh, authorize mayor to execute master services agreement for open gov. I think we do probably need to run through this. All right. So, I know that it was one of the council's uh goals um most recently highlighted by some of the the meetings that we've had um somewhat dissatisfied with our technological capabilities within the city. Um and so our staff, you know, unbeknownst to you in a lot of instances, we're were already working on some of these issues. Um but we kept coming back to you know um our our current uh software provider particularly in the financial aspect which was Munis and um did a lot of research on different folks. I know Councilman Pageant um you you attended some of those u meetings with uh Open Gov in particular to hear what they offered. All of our departments that would be impacted by that also had various meetings with our IT staff and uh and CFO um revenue engineering all all to kind of meet with open gov and and and others. But this this was the the company that unanimously our staff said I think this would be great um better interface with the public better serves the the needs of the community and frankly accomplishes the goals that you know Councilman Walls Pageant Mack in particular had had outlined um in in
their process. So um this request here uh does two things. I think I Councilman Pageant I forwarded you is basically a 100page or so professional service agreement contract. Um and and is it in their packet Beverly? No. Yeah. So um the uh at the end of the day I know that Councilman Walls had some questions regarding uh cost. I've got um Jeremy Naggie here with M4 as well as our CFO. Um kind of talk about what what some of those are. I have some notes here too that I'm going to pull up um and be able to answer that for you. So um council, what are your questions about about this contract?
Um yep. So, first question I have is um on the list of things that are being added, I think one of them was like open gov 311, but on the list of of things that are we're going to pay for in this agreement with um open gov. What are on this list? What are the new items that we're purchasing that we're currently not paying for with the current provider?
Yeah. So, 3 311's the the first um and you know, that's a reporting system that's pretty robust. I think some of you saw that demonstrated. They can integrate with GIS. Um, people want to report potholes or issues within the city, they can do that in real time. Um, and and even mark the location for us for for our crews to go out and look. Um, currently we're paying 112,000 annually for Tyler Tech to integrate that into a 311 system. um and and others to to make our online presence more advanced. Um it would have increased the annual free fee to $33,000 um and it would cost uh annually and then $583,000 for the implementation and and onboarding. So to contrast that, Open Gov um is going to convert us from from the Munis system. So, all of our um finance, revenue, HR, utility building, permits, and inspections, and simple online payments. That's what Tyler's currently doing. And and take the the 311 system um and and get an HR system that we can actually use and quit using carbon copy triplicate for $585,122 in the first year. About $336,000 of that is going to be the onboarding piece of it. The other um $257,627 is going to be the annual contract amount with a 5% escalator annually.
The annual contract amount is $257,627 with a 5% escalator per year. And to compare that with Tyler, if we would have went with them and did the same um online reporting and allowing people to have a digital uh way of of contacting, it would have been $583,000 to stand it up and then 33,000 annually. All right. So $43,000 savings and six years implementation.
It it would have it would have been a pretty difficult implementation. So let me let's talk about that. So, if if you move forward with this tonight, April 8th, we'll start the 311 code enforcement and work order system, that will be an additional $27,000 to get going today because it will be in this this budget year in particular, and it will be completed by Q4 of this year. Um, and then starting October 1st of 26, we would start everything else um which would be complete. um conservative estimate 18 to 24 months. We there's a chance we could beat that. Um but we want to set the expectations um you know with you 18 to 24 months and if we if we can do better we will.

Hello everyone. So, uh, currently Tyler Tech is doing the finance, revenue, HR, utility billing, permits, inspections, and then simple online payments. So, uh, the the big, uh, improvement would be, of course, adding the 311 system, but we'd also have an advanced online presence. So, it wouldn't just be as simple as paying the payments. You could also, uh, apply for, uh, a new account as a new citizen, a new water bill, um, or a new, uh, business license or anything along those lines. Uh, and then, of course, the 311 system. Um, there's a lot of other little technical backend pieces. Of course, there's a there's an app that we'll be able to use so that the departments can uh track warp orders from the field and not have to do those on paper anymore. And um you know, a lot of great uh uh asset management pieces that they'll be able to use to track all the city inventory, you know, from from lawnmowers to tractors to the actual city, you know, vehicles as well, all the maintenance and and all that as well.
Does the city currently do any of those things that you listed? Those are all new features that are currently not being used by the city. So, the the app would be a new feature. Um, as it stands right now, the uh the the actual city fleet vehicles, like the the ones that they drive are being tracked inside of Fleetoft. Um, but it's not being tracked dynamically. So, they're having to manually input that data into Fleetoft. With OpenGV, it's all going to be automatic. So, it's going to actually pull from the city's um uh gas pump. Okay. And it software. Okay. And then the work order app. We're not currently we're not we don't have
No. And and and as a matter of fact, you know, to get to the point where we could use the work order app with Tyler Technologies, that would be that $583,000 to uh activate their asset management system, the work order app, and their 311 system. So, you know, by by contrast, $583,000 is getting you three small pieces of a system that's already pretty unusable. Um whereas the, you know, $585,000 is getting you an entire new system that replaces everything. Okay. you mentioned um an HR system or um Jonathan mentioned the HR system we can use. So currently um the HR system that we're paying for is not being used or unusable.
So right now uh Tyler Technologies Munis is just doing payroll and then they're using thirdparty tools like uh Neo gov to do certain other aspects uh of the of the payroll the training uh LCM module or LMS excuse me onboarding and all that. Okay. So all that will that be offloaded then as we so this contract today what what they actually have ready for us does not include the HR module just yet. Okay. Um so uh open gov does not have an htcm module ready and generally available today. They're going to have that ready by the end of the month. Okay.
And so what we're doing right now is we're trying to enter into the agreement for basically everything else. Um, and there's a chance that we'll be able to implement their HCM for free, uh, by being one of the first cities in it as kind of like a beta process. Um, with that said, we're we're going to have to table that and come back to that in a month or so. Okay. All right. Um, is there a plan in place yet to alert as this comes online to alert our population and train our population um, those that want to take advantage of using?
Absolutely. So, one of the uh one of the benefits or one of the packages that Open Gov is including is like a full branding package. So, they're going to include signage with QR codes and and you know, coloring and branding and all and uh packets for social media, flyers, stuff like that that we can print, we can put in city hall, we can you know pass out flyers downtown, we can put up signs, all that sort of stuff. And uh they're going to include that package so that we can get that ready. And of course, we'll work with Emily on that and get it on social media and all that stuff ahead of time. Okay, very good. Um and there is an app. I mean, I think we talked about that in the last meeting. It's not just a website that you visit, but it's an app that's pre-loaded into Android or um so so there's an app for employees to use management system. Okay.
Um no. Uh so the the city currently has Revise that does the city's web page right now. Um and there is a very very basic antiquated app that we're using right now. Um there is a new version of that app that we're going to be looking at getting them to update us to that will include um links to the asset management and the 311 system for the for the public inside of that app. But no, OpenGV does not provide a public facing app at all. Okay. So for the enduser experience, if I see a pothole, how do I report that in this system that we're paying for? Sure. So it's got a fantastic mobile website that even has the ability to like use you can click use my location and it'll choose where you're at to to show where the pothole is. You can take a picture right there from the from the website and and and upload that as part of the information.
And how do I find that though? If I don't have an app on my phone, I go to the city's web. Yeah. So, it's going to be prominently right on the on the homepage of the city's web page. So, you go enterpriseal.gov. Okay. Um they have the ability to put a little chat bot down at the bottom right corner. Okay. That they'll be able to immediately start chatting with and say, you know, I'd like to report a pothole. It'll take them right to that page. Um or we'll have a link that'll take them straight to that page and it has like a almost Google search bar. I think they actually showed that during the the demo last time. Sure. Um where you can just you don't have to know what you're doing. You can just ask a very simple question and it'll take you directly to the correct location in that page. Okay. All right.
Yeah, absolutely. And and and just keep in mind nothing's changing if people still want to come into city hall and and renew uh in person or pay in person. None of that's going to change at all. As a matter of fact, they're allowing us to continue using our same uh credit card readers, receipt printers, and cash drawers we had just bought as part of city hall renovations. So, we're not having to reby any hardware or anything like that. Good. Um and we'll even uh have an IVR with the new system so people can pay online. Okay. Good. Or on the phone, excuse me.
Yeah. Very good. Okay. So, we're not taking anything away from anybody that wants to come into city hall, do business the way they've been doing business. We're just adding an option for those that want to conduct business digitally. Um, do you know if they have a plan to create an app in the future so they don't have to visit a website like if you wanted to interact with the city through an app? So, I know this will be an unpopular opinion to hear, but unfortunately a lot every company that we spoke with basically said that all cities are moving away from apps right now. Okay.
Um, and so they they everyone that we spoke, this was not just open go, but everyone that we spoke with said that if that's something that we still want to pursue an app, we're going to have to go with a third party app for that. But again, so Revise that does the city's current homepage, we're on like their 1.0 0 version of their app right now and they have a 2.0 version out there. And so I'd like to try to coincide the release of that launch with the release of the 311 system or some of the other other pieces online. Um, and it it'll basically do anything that we want to add to that app. We can have the 311 system on there. They can pay their water bills. They'll be able to, you know, renew a business license, all that because of the way that Open Gov does all that with HTML 5 on a a website. Um, they'll be able to add all that into that app. Jeremy, I've got a question.
Yes, sir. You might have mentioned it on the HR side of the house. Say I'm trying to get a job. I want to find out where where it's at in this system or I'm being vetted for security uh for being a coach at the parks, which happened to me for a while and they're just waiting to hear back on that. Will somebody who's trying to get a job or whatever doing that be able to go in there and say, "Okay, hey, my application's over in this section. and I'm just waiting on this piece of it or my security clearances or whatever. So, it'll be easier to to find that because I I see that a lot from folks that were say I'm going to defer that if you don't mind.
I'll buy some time while Allison's walking up here. Okay. So, currently with the HCM and open Gov, we're we don't know the answers to those questions right this second because and again the HR portion is not included in the contract that we're talking about tonight. So that will be coming on board. We will get gather more information and have more information on that available to to be able to bring and present to you. However, we have spent and Allison has spent a considerable amount of time the last four or five months um reviewing and going over possible potential um htm platforms for for us to to transfer to. Um, so in in those things there's a lot of there's a lot of stuff available that's not necessarily um on for the contract tonight. So I you know you can
maybe just something to think about you know as we go down this road. So there's lots of things available. Yeah.
Yeah. with um an applicant tracking system. Um you can set them up many many different ways uh with different workflows. Um and you can so the user can log back in and you can set it up like for the workflow to be um you know in background process um drug screen has been sent you know those type things. And so depending on the way it's set up, they can log in to their account once their um you know application is in the process and they've been made a conditional job offer based on the results of the prehire testing and see where they are in the in that process. Um and then of course you know if you um if their application is declined for any reason then they'll be able to see that if they logged back in there.
Okay. Thank you. Okay. Um, well, I will absolutely consider this a success the first time that I'm able to renew my business license at 2 am. There you go. So, with the switch to Tyler from Tyler
from So, the um the the way that it works right now with Tyler Technologies, you're just paying year to year. There is no commitment right now. So, the worst case, we would have roughly a year of overlap. Um, however, the way that Tyler currently bills you guys, they bill they split the $112,000 up into four payments spread out one each quarter. So, you know, potentially depending on when when we are finally swapped over to open gov, you may not have that much in Tyler that year. So, we we shouldn't have much of an overlap. All right. All right. Next um on the agenda for tonight is um authorize mayor to execute poly incorporated task order number 64 for engineering design and construction administration services for phase six of the re surfacing improvements. Almost forgotten about the numbers. So again, council, this is uh in in keeping with your annual transportation plan, you know, somewhere in the million and a half,2 million dollar range. We won't know until it goes to to bid, but that's kind of the estimate that we're we're trying to get done on resurfacing every year. Uh we're using our PCI metrics on the streets trying to pave the ones that are are worse or the ones that last year were identified for water projects. those water projects have been done. So that's how we've compiled the list. I know Glenn and Py have worked on that. Uh Glenn, do you have anything to offer on the but it looked like a lot like phases one through five. Um there'll be some contingency in there to do things like parking lots. Um one of those being at at city hall with that little triangular area there. Um, but those will that'll be in phase six along with how many how many roads are in that Glenn? Do you remember?
25 to 30 streets. Is there a way to get a list of the streets that are absolutely Yeah. And I think we we've got through they can change yeartoear ones twoosy but I think we've got that programmed out through phase 10. Is that right? Yeah. Yeah.
Council, we did we pre-programmed through phase 10 and on this phase six, we actually took phase six and seven, looked at the water improvements that have been made and some things that kind of mesh that all together. So this phase six is a little different than that like Jonathan said, but we we caveed that I think when we put it out there that it was going to change just a little bit, but we have finalized this phase six with engineering and I'll send I'll be glad to send that list to the council tomorrow. So you'll have that full list. Do you know if Alberta's on the list? Alberta's not on the list, but it was filed.
We filed it last year under rebell application and we refiled it again this year. Um, honestly, I feel pretty good about that application uh this year, but it's that's the reason we didn't include it in phase six. It's possible we can get it funded. Okay, good. So, thank you. Right. Next on is the uh request permission to purchase equipment for the airport on autonomous mowers. This is a budgeted item. Anything on that? It
is a budgeted item. As you remember council during our budget talks um this was something that you know technologies uh moving along uh we have I think two autonomous cleaning uh robots for the rec center. Uh we we wanted to do that as well for our our public works crews. Um we demoed some um mowers last year um at the airport. Uh give them grids. They're pretty good about flat land, you know, no inclines, no no real hills or anything to go after. And as long as it's it's safe and unmonitored, which the inside the fence line at the airport is, we may be able to use these at ball fields and other things like that where we can program them out and be a force multiplier for our labor pool. You know, they can go out and weed eat and take care of some other things while the mowers are going. Um, so this is kind of a dipping our toe in the water to see if if all else fails and the technology breaks down. It's terrible. These aren't a significant uh significantly more than a than a normal zeroturn motor mower. And they they can be manned. So it's not like, you know, a Zumba or whatever they're called that that goes in your kitchen and picks up all the trash. Um, and then it's useless if the technology fails or there's a if if all else fails, we can fill it with gas and put a person on it and use it as a mower.
All right. Any other questions on that? And then we have a request for permission to shoot fireworks at the festival in the park.
Yes. Good evening, council. This is our annual festival in the park on May 2nd this year and just asking uh permission to shoot fireworks as we do every year at the end of the night after the concert plays. Uh in coordination with Chief Moore and Chief Davis uh make sure everything protocol is followed and uh looks to be a good night. Let the professionals do it instead of Landon shooting bottle rockets. Does Landon do you want to shoot bottle rockets? We could save a lot of money if we just let land. Chief Davis has an issue with that. No. Okay. Professionals, any questions? Um, no. Not for me.
All right. We have a request permission to seek bids um by our city engineer for budgeted vehicles, street department, one 3/4 ton crew cab, 4x4 pickup truck, disposable plant, two half ton crew cab, sewer department, one half ton and one one ton.
Yes, sir. council. These were budgeted items um and just replacement. If you remember, uh Barry went through all of our different departments that he's over in engineering public works and assigned a grade to each vehicle based on uh the number of miles or issues that they had had tracking it through the shop. So, in other words, as the transmission continue to fail and we've spent x number of dollars on fixing vehicle A, and so he scored them in in that vein. Um, these were some of the D and F vehicles that were out there that that it's just time in their life cycle to be replaced. Some of them are from, you know, 2008 um, and nine. So, they've served a a good number of years in the city fleet. Any questions? All right. Then we have uh we'll be introducing an ABC license request for La Mexican Restaurant and then we'll recess the regular session, convene at the E911 board meeting, review the minutes, approve counts payable, adjourn, reconvene into regular session, and then we will call for an executive session. She said no. I was I was uh assessing technology. It's your time to shine. Uh yeah. Okay. Great. Yay. Okay. So, today is April uh 7th and happy to announce that our auditors are here so that they can present um our audit report for you. So, I've got Tyler Dunaway and um Bryce Glenn from CRI who are here to give you a report and you should have copies of all the the each of you should have an audit there um at your seat. So, if you want to follow along with him,
and I I I just want to publicly too while while Leanne's up here, she's not going to do it and brag. I know that I sent you all a note. Um, you know, this is something that the last administration tried to do for the last five years was to get our audit in prior to April 1st. That was accomplished. It was complete um March 31st. Um, this is just the first council meeting since that time. But if you recall when when Leanne was hired uh about five years ago, um we were consistently getting the audits done and completed in around you know September, maybe even as late as October. Um, so we had already planned a budget for the next year with two-year-old financial information. So I just want to commend Leanne and her staff and and Carrigs and Ingram for the work that they've done to help us get get to that point uh publicly. But uh and and thank you for your support and giving us the resources we needed to do it.

And all you know also on on that side too is that we we have um a com combined financial statements what gets issued for us. So we have several other entities that are included in that. Um so in order for us to be able to issue all of those other entities also had to have their uh financials issued and released um by this point too. So you know again Tyler and Bryce have done an an amazing job this year and worked very well with um staff and have we had a very good experience this year um working with them. and he uh again coordinated with those other entities to make sure that everything was on time and was was coming in and that that is a huge task to to be able to get all those uh moving pieces together. So they've they've done a really great job. So we appreciate all all of their work. So good evening council. Uh my name is Tyler Dunaway. I serve as the partner in charge of the financial statement audit for this year. Uh my colleague Bryce Glenn is with me as well and I'm well aware that we are probably the only two people in the room that got really excited when we heard there was an audit update. So I promise I will be as brief as I possibly can be. Uh if you have any questions, feel free to stop me and ask. I'll also ask for them at the end. If you think of a question in four months, uh call me, email me. I'll be happy to answer uh whatever you have. Um, but with that, we will start looking through the financial statements. As Liam mentioned, I believe everybody has a copy. So, the first page that we'll look at will be page four. If you want to flip over to page four, page four is the end of our uh independent auditor's report. Uh, that is the opinion that we put on the financial statements. Uh, the opinion that we offered this year is what's called an unqualified opinion, which in the CPA world is the highest level that
you can offer. It means that we believe everything is materially correct in these financial statements. On page four, you'll see the date is March 31st. Um the the Government Finance Officers Association is is the most wellrespected uh entity as far as issuing certificates of financial excellence and things like that for financial reporting. And one of their requirements is to have a March 31st audit. There are other entities that want a March 31st uh audit as well. And so anyways, that that's really the top of class is having your financial statement audit issued by March 31st. And as Leanne mentioned, that required a significant amount of of cooperation from other entities like the school board and the library, uh the industrial development board and and a lot of other entities. So it wasn't just the city, but a lot of other places helped as well. Um I always tell the people whenever I'm there for an audit, I understand that you have a day job whenever I'm not there. And so I just add to your your day job that's already full. Uh we received exceptional support from everybody from Mayor Cooper and Jonathan and Beverly and Leanne and their teams. If we had a question or a request, it was it was uh responded to promptly and and we appreciated that. That played a significant role in how quickly things were able to be done. Flipping on over to the financial statements themselves on page 23. I'll give y'all just a second to get there. This is the statement of net position. Um, this is the beginning of the financial statements. This is what's called the governmentwide financial statements where they take all of your governmental activities and they lump them into one column. I don't spend a lot of time on this financial statement because all of your activities, whether they're restricted or unrestricted, whether you have any discretion over how you spend them or not, are all lumped into one column, which is is very hard to uh go off of for you because if I
tell you you have $18 million in cash, well, you don't know if that's restricted, that can only be spent on one thing or if it is uh unrestricted and involves some discretion. And also in this statement, there are some uh liabilities included related to your pension plan, related to your other post-employment benefits plan that allows retirees to stay on the health insurance. Those liabilities are significant and they significantly affect these financial statements. Those are real liabilities, but they're not liabilities that are due next year, right? They're due to employees over 40 or 50 years. And so, also not a great tool for you as a council in a budgeting process. So, I say that just to say we're not going to talk about that statement very much, but I did want to mention that just for your information. Flipping over to page 27, this is the governmental fund financial statements. Uh we will spend our time this evening talking about the general fund. Uh each of your major funds are listed on here, your capital improvement fund and your debt service fund. And then all of your other funds are lumped into that column called non- major funds. But the general fund is what you as a council and a city have the most discretion over. Uh entities that look at governments whenever they're looking at the financial health, they look at the general fund and they specifically look at that number in fund balance which is literally just your assets less your liabilities that equals your fund balance. What is left over when you subtract all your liabilities out of your assets. The most important number on here is the unassigned fund balance. You will see that that is about $18 million. that is 5.3 months of operating expenses. Uh best practice is to have somewhere between three and six months. And so 5.3 is right there in that range of where you want governments to be at uh to be a good sign of financial health. So that is a good indicator for the city as well.
We will flip on over to page 36. Page 36 is your uh proprietary fund financial statements, the water board, the sewer board, what their income and expenses look like. I I only go to this this uh statement to point out a couple things. Uh one is that your water and sewer board uh had excess revenues over expenses of about $6.7 million. uh that is really just a quirk of how financial reporting is done. So if you invested in infrastructure, which the city is doing significantly right now, that is zero dollars in expense, even though it's a lot of money coming out of those funds to fund those things. And so even though it looks like there was about $6.7 million more taken in than what went out, if you look at the next page and you actually see where the cash was going for these funds, you see that it basically broke even, which is typically the goal for governments. uh running proprietary funds for the revenues to equal the expenses. And as you can see of how the cash flowed, it basically netted out to approximately $0. We'll flip on over to the notes of the financial statements on page 55. This is your capital assets uh roll forward. And I promise I only have about three things left. We're getting close. Y'all are doing great. Um the capital assets roll forward. I mentioned that number earlier about fund balance. Well, one way you could manipulate that number is if you as a city said, "We are not going to invest a dime in our infrastructure." And so we're going to keep that money. We're going to make our fund balance look good. we're going to be in that 3 to six month range, but we're not going to be investing in our infrastructure, which means at a certain period of time, we are going to have to invest a lot of money in our infrastructure uh to make up for that that uh putting off of investment. And
so, I always like to look at this schedule handinand. Uh that is not what the city of Enterprise shows for their financial statements. Y'all invested about $10.5 million in your infrastructure in 2025, which is also a good sign for the city. So the first sign is the fund balance. That that looked good. The second sign is how much are you investing in your infrastructure? That looked good. And then the third one is found a few pages over your long-term debt schedule, which is on page 79. And you can see that you paid down your debt by about $5 a.5 million in 2025. There was no debt issued. And so that is also a good indicator. The final thing I will talk about today is at the very back page 125. This is your schedule of findings and question cost. Um that is just a fun accounting word that that summarizes what um the audit showed. So this will show did you have any findings related to the financial statements. You see a lot of nos on this page. That means there were no significant deficiencies or material weaknesses that we were required to report to hall. Uh and then the the section below that relates to your federal awards. If you expend more than a million dollars in federal awards for the year, we are required to perform a single audit in accordance with federal standards. We did that this past year on your ADM grants related to your sewer and water infrastructure. And we did not have any findings related to those either. So with that, that's all I had planned. Good evening again, council. Uh, in our FY26 budget, we budgeted for a new playground at Johnny Henderson uh, Family Park, and you should have that packet. Um, and Land is going to click through the slides as I talk um, for this presentation. And so I'm excited to present our vision for a new playground designed not just for today but for our future uh of our community. This playground budgeted for FY26 will span approximately 9,520 square ft providing ample space to create a dynamic, engaging and thoughtfully designed environment for children and families. First and foremost, this playground meets all minimum legal requirements under the Americans with Disabilities Act. In fact, we have gone above and beyond those standards to ensure inclusivity for children of all abilities. Rather than focusing on a single category, we designed this space with adaptive needs in mind. Recognizing that accessibility spans a wide range of physical, sensory, and developmental considerations, accessibility is a key priority. We have included a play structure specifically designed for children who use wheelchairs along with ramps and accessible pathways throughout the playground to ensure ease of movement and inclusion. The playground is thoughtfully divided into age appropriate sections to better serve families. We have a dedicated
toddler area designed specifically for children ages 12 to 24 months, ensuring a safe and engaging environment for our youngest residents. For older children, we're installing a large Adventist tower that offers a more adventurous and stimulating play experience. To enhance comfort and usability, shade structures will be installed over the equipment. These will not only extend the lifespan of the playground materials, but also help keep surfaces cooler during the hot summer months, making the space safer and more enjoy enjoyable year round. The playground surface will feature turf, which has proven to be both durable and lowmaintenance. This is a modern solution increasingly used in new playgrounds, providing a safe and consistent surface for all users. In terms of play features, we've included a wide variety to encourage activity, creativity, and social interaction. These include a triple base swing set, tunnels, slides, climbing structures, and musical chimes. elements that support both physical development and sensory engagement. Overall, this playground has been designed to be an exciting, welcoming place where children can play, explore, and connect. It will set our park apart for years to come and significantly enhance the quality of life for families in our community. And so, as you see, uh, a couple things that we've taken into consideration. A playground's lifespan is about 18 to 20 years. And, and we've exceeded that at the one at Johnny Henderson Family Park. And that playground is probably our most used playground in the entire city. Um, and it needs some TLC in the worst kind of way. And so, hearing the things from council and our community members, uh, I think we've done a pretty good job here in design and trying to go out and meet the needs. Um, we hear shade a bunch and so we've made sure to uh to shade
everything that's possible. I think this will help again with the longevity of it, uh, the fading of the equipment, but I really think this puts us on the map as as a special special place um, for children and their families to come and and play. And so I present this to you tonight uh, in a work session here and uh, would love to move forward in putting this on the next council meeting for approval. Is this um is this going to fit in the same footprint that
Yeah, it fit the same footprint. So, in your as you continue flipping through your packet there, I've done that blueprint for you so you can see it. Um shows you the uh four sectioned areas there. Um where the current structure is. It fits in the mold of everything that we already have there. So, the plan would be is utilizing parks and wreck crew and Barry and his team with public works and engineering um to kind of remove what's there and then uh get Barry and his team to come in and help with the grading. And then obviously part of this contract uh that we put out uh they would come in and do the uh install of the turf and equipment.

my name is Phyllis Forbes. I've been a resident here for over 40 years, my husband for over 50. And brighte seems to be a very huge problem lately. We have had issues with them. Um we don't have brightspeed. Our neighbor got it, but they put the line on our property, not on the ement. They didn't call Alabama one call to locate any of the utilities to make sure that everything was done safely. Um then when we noticed then there was a pipe coming out of the ground, an orange pipe. um on our property and it sat there for a long time and then they kind of c two guys in an unmarked truck kind of not on the better side of equipment did the ditch like this on our property off and then on back on the easement and then back on the property and ran it up to the neighbor's house. My husband saw him out there. He went and spoke to him. They basically wouldn't speak to him and left. We called the police. The police never showed up. So, we drove down to police department and and made a report, which the report really didn't have anything in it. Then, we went and spoke with the city engineer when they were over in the uh farmers market area, and they kind of said that they had other complaints of other personal properties that were damaged by them. nothing was ever done for them and said that if he could find anything out, he would let us know. We never heard anything back from him either. We tried contacting Bright Speed for six months in every avenue that we could possibly find. Nothing. No contact whatsoever.
And now we've had solicitors knocking on the door and they will not leave and they keep on and on and on. They don't take no for an answer. I put it on um what's happening what's really happening in enterprise Facebook page because I was angry because he came to our house 8:00 at night want to talk about Bright Speed but I wouldn't he wouldn't tell me he was from Bright Speed I had to ask him three times so I don't know what can be done about it because they don't have a permit. I've been told they don't have a permit. I've probably had six plus people from Brightpe in the last six months knocking on my door that I opened the door to on the Facebook post that I made. There's over 177 comments on my post all in the negative about Brightpe. Now there's adding a few other um companies that there's a security company that's doing the same thing. There's a uh I think a bug company that's doing the same thing and they will not take no for an answer. You're more than welcome to look at what's happened in Enterprise and look up my post and you can read through all of the negative comments about Bright Speed. Now, I don't know what can be done. You know, we've had property, we had a hole about that big around and about 20 in deep left in our property. They trespassed on our property, put that hole there. Anybody could have gotten their toe in it and broke their ankle, we would have been liable because it's on our property. If something tears up with that Brightspeed line, whose yard are they tearing up? Mine. They're not tearing up the easement. They're tearing up our property. Something needs to be done about the accountability of Bright Speed. And I don't know what can be done. I would really like to know what can be done. And that's all I had to say.

Okay. Thank you. Is there anyone else that would like to uh take advantage of the privilege of the floor tonight? All right, then we will move into staff reports. Does any staff members want to Mr. Tulles? So, mayor and council, we had uh I think Councilman Johnson about a week ago or so in the last week anyway sent uh that complaint about Lake Oliver. Um staff has also fielded the mayor's office has fielded numerous uh complaints about Britain in particular. As you know there's a franchise agreement um and we have given that after consultation with the mayor to our city attorney. There there are three major sections in there that deal with remedies. Um sections 13,5 and 18 in particular. Section 18 is the one that has some teeth in it. So, next week our city attorney will send a a notice to Bright Speed. They will have 30 days to um essentially mitigate any of the complaints or grievances that we have in violation of the franchise agreement. If they do not, then the next step would be to bring them before the council uh to terminate their franchise agreement. And that that's where we're at right now with with that process. So there was some information um that our city engineer and their staff were were getting because it's not just that one incident. So we're kind trying to accumulate all the the grievances that we've accumulated over the past year or two um with that and and send those um to Bright and hopefully that'll get some
attention. All right. For the solicitors um isn't there a solicitation? There is a solicitation ordinance. I don't know if Leanne wants to come up and talk about that, but they're they're certainly um you know, I don't I don't know how to how to get them, but if we um when they come, Leanne, they're supposed to have a a card that's issued and a license uh issued from Revenant.
Yes, the ordinance for that they are required any anyone who solicits uh inside the city of Enterprise is supposed to come and have one of those badges um which identifies them. so that if they come to your home or if they come to your workplace or whatever, they they have an identification that's issued from the city showing that they've applied for that that badge. Um, unfortunately, they it is very difficult sometimes to catch these people. they're they're out in the community and they don't necessarily come in and comply with the ordinance or comply with the um stipulations that we have for obtaining that solicitor's badge. They're good for 30 days. So, every you know, if they're only here for a short time, then you can just get the 30-day badge. If they're going to continue to stay, then they have to renew that badge. Uh but yes, unfortunately, it is it is difficult. It is something that we're working with um code enforcement on to uh try and see what it is that we can do to help styy that. Um but they are absolutely required to come in and get one of those badges. So if they don't have one then absolutely they are not in compliance. They should if they come to your home and you ask for that they need to be able to show that to you.
And if they can't what do I do? And if they can't then um my again it's one of these things where it's late at night. Chief Moore's raising his hand. Yeah, he wants that one. Before you before you answer that, um he's got his code enforcement officer is the one that helps us. So before you answer that, I have a quick question. Does a business that has a business license in the city of Enterprise also have to have a solicitor's permit if they are Yes. If you are if you are going doortodoor or Yeah. business to business. Yes, you still would need to have that solicitor's badge. Okay. Yes.
What about the timing on that? I mean, going to somebody's house 7 8:00 in the morning or uh dark over in the evening and all that. I mean, I would have to research on the actual the ordinance has times in it. I think there is a time and I don't exactly remember what the time is. So, I don't want Emily's got it. We talked about it. Oh, so uh conduct business Monday through Thursday from 9 to 6 and Friday and Saturday from 9:00 to 7:00 no Sunday.
No door to door or place to place sales are permitted on Sunday or holidays recognized by City of Enterprise. So to answer the question of what do you do if they come to your residence at 8:00 or 9:00 at night? 347222 is the non-emergency number for the police department. This is not the I was answering these calls when I was a patrolman. This is something that has gone on for years. As I was telling Jonathan, we've actually made arrests for this. We've issued citations for this. We've actually found people that had warrants for them. What they used to do and they probably still do is they would take it really unfortunately would almost human trafficking. They would pick people up from another city, bus them over here, drop them off, say, "We'll be back in two hours." And then they would go door to door. Um and then we would be called uh and then we would check for their ID uh check if they have a license and most of the time management that drop them off they don't ever get they don't get a license for it or anything else. So yes, we have issued citations. Yes, we have made arrest. Bright speed. If they use a third party company or a fourth party company or whatever else, uh those individuals still have to be registered to do door-to-door salesman. So absolutely call us 347222. We absolutely will come out. Most of the time, and I think uh Councilman Johnson knows this, we chase them around the city because once we get a call, they've already moved to another block. They move to another block. Now, something that can help the citizens is what Captain Kent has on his door and it says, "No solicitors. Do not knock. Do not ring the doorbell. Do not come on my property. I don't want your business." Um, and as he said, he watches his ring com uh ring camera and he's had quite a few people walk up, see it, turn around
and leave. So, um, that is a notice that you don't want their business and that is pretty binding that they shouldn't probably be on your property. So, thank you very much. All right. Thank you. Great. Do you want privilege of the floor? Yes. Okay.
Uh Robert Forbes, Phyllis's husband. Uh kind of on the same issue, but a little bit different. Uh my major concern besides them getting on my private property, not on the easement, is there was no locating done on my property for the for any of them do by brighte. Ceasefire came in the year before. They located everything, called it in great, but hid everything. I mean, their contractors were lousy. But under the Alabama one call law, section 37154, just because they get a permit from the city for demolition or construction or installation does not relieve them the obligation to call one call. It's a violation of Alabama law and the district attorney handles it now. Alabama Public Service Commission Gas Pipeline Safety Division used to handle it, but they passed it on. They had some issues with that. Um, but you know, I don't know how they missed everything on my property in the easement. They had a 2-in gas man, two gas services, water man, sewer man, uh, and three different cable companies, and plus my water line. It went right by the water box, and luckily it's not leaking. But all that really to kind of say that, you know, reading that section 4, um, ALD DOT's got an exemption. if there during their permitting process and somebody doesn't call one call, they're exempt. We had a torch run, but fortunately with everything going on with uh the police department, we weren't able to do a tip a tip a cop fund to raise money at restaurants for the Special Olympics. So, we've changed it to April 16th. Uh we'll be at the uh Butcher's Daughter from 11 to 1, 11:00 a.m. to 1 during lunch. uh where my staff will be happy to uh wait on on everybody that comes in, take care of them, and all we ask is for tips. Not tips taken away from the waitresses and the staff, but extra tips so choose. 100% goes to uh Special Olympics and um supporting that great cause. The second one is we're going to be at um the um shoot, hold on. The second one is going to be the following night, April se uh 17th from 5 to 8:00 p.m. for dinner at White Oak Ale House. tonight? I want to highlight the values that make Enterprise a strong, connected community. We are honored to recognize the month of the military child. These young people show courage and resilience as they remind us of the sacrifices made by military families in our community and across the nation. Tomorrow, the city of Enterprise will host the A USA meeting here at the Civic Center. I will issue a proclamation recognizing America's 250th birthday. We are a city of progress and patriotism. Proud to support our military children, our servicemen and women and their families. These are our neighbors and friends, the family sitting next to us at church. Let us continue to keep our military and leaders of in our prayers during these times of conflict. We are the land of the free because of the brave. And we must come together to offer our support for those who need it now more than ever. Looking ahead, we're excited for our hometown heroes celebration on June 6, honoring our military and first responders for their services to our community. I also want to invite everyone to downtown Enterprise this Saturday for spring showcase at the monument. It will be a day of arts, music, shopping, and free family fun. certainly ditto mayor's comments um regarding our military children and um our military families. We're blessed to have them a part of our city and our communities. Um want to applaud um Leanne and her staff for such a job well done with our audit completion. And I remember the days we would mention audit and it was uh kind of frightening get to get ready to come into the council meeting to to hear the report. But um they've worked really hard to make that um not so gutbling for us and and we look very good in the process. Our city looks very good, not we, I mean the city looks very good in the process because we have good people working to get that done for us. um to brother director Moore. Certainly thank you for um your insight with our uh playground project. Look forward to sliding down one of those extra big slides when they get in. Now for um this Brightspeed situation, of course, I don't not knowing what's going to be brought before the privilege of the for not having minutes, former minutes or stuff to review, but I if I don't want to call names because I could say the wrong companies, but I I'm just feeling like we've we've gone down this road before someone came Um, uh, Mr. Lane, I remember he came and a company was had done similar to Jack his yard for lack of a better term. Um, it's been other issues and I think we entered into um, a contract. I'm not sure if it was Bright Speed, but I'm going to ask Beverly to kind of provide us with some recap for that, but it could have been ceasefire, but if if it's them or well, they should have done the right thing, too. But anyway, um, here we are again. So there are some issues that just really need to be addressed and I hope that we get on top of this. Number one,
it's a safety issue um with the company. Now whether the people have a badge or not, the company knows that what they should and should not be doing. So we need to stop letting them play in our face with this stuff, doing what they want to do without any consequences. And we don't need to continue to play with them. If you going to do business here, you got to do it right. They're no different than anybody else that's let we do business and we shouldn't have to keep entertaining this every uh twice a year or whatever just because people just want to do what they want to do and then they come and tear up people's yards with no regard. Um so we really need to um you know address that with the contract. They don't want to buy by the contract then they don't need it. That's my little two cents on that because it at the end of the day it deals with being compliant and this keeps coming up. So, it says that they're definitely not doing that. So, um to the Forbes and whoever else that's having the issue, um we certainly hate that that is going on um with your properties um here in our city and hope to have a um a resolve to that or a better um working relationship with with Bright Speed going forward. Uh change schools every year from seventh grade to 11th grade. I was in a different school and uh it's tough. It's tough um on a family. It's tough on a kid and so I'm very thankful um for those that that serve and um the sacrifice that the families make. Um excited for our new park equipment. I will be the first to I want to slide down right before Scotty. So no excited um and I think it's going to be a great addition to our city. Every time I go to the park, uh you're absolutely correct. that park is heavily used and I'm excited for for the surprise that's awaiting those that didn't come to city council when they get to see all of the equipment going up and Facebook posts going what's happening at the park and I'll comment we're tearing everything down um y'all couldn't behave um uh and excited for our digital city the work that our city's putting in to make a a digital city um and uh being able to pay your bills online check pay your water bill pay your your business uh license uh report a problem report a pothole um all without having to try to figure out who to call and who to talk to and wait for somebody to pick up the phone if you want to do that. Um there'll still be somebody on the phone other end of the phone if you want to make a call. Uh so excited about that and um Leanne, thank you and your team again for the uh hard work that you guys put in to make sure that uh that financial report was done and uh now you know the bar is set. So every year um stress yourself out and excited to see it come in at that time. So thank y'all. pretty much repeat everything that's already been said. Thank you guys for everything. Um, and I I do want to highlight our finance department, Leanne, the great work that you've done uh getting us there because I remember what it was like um in November of 2020
and it is a complete different operation at this point and I'm so thankful for that. Um and I guess the other thing is uh highlight is very thankful that we are moving forward finally with uh digitizing so much of our city. Um, we I told Leanne yesterday yesterday that I made this push about six years ago and then with all of the stuff she had to clean up and um all of the projects from the city hall renovation to the rec center, I kind of gave them a little space, but all that's done. We're in those spaces now. It's time to get moving on this. And I'm thankful that they've already been putting the leg work in so that it just kind of handin glove with what we were trying to do. and um was very excited what I I saw in both demonstrations from for the public facing part. And uh as I said earlier, I will consider this a success when I can set my alarm clock and get up at 2 am and do my business license just so I can say I did it because that's what I've been saying for years. I want to be able to do it at 2 am if I want to. So, uh thank you all for all your hard work. We will now uh recess into executive session.
