Um, and I'll just read down through the list. I'll stop at each one. If you have any questions, please stop me. The first one we had was discuss the feasibility of innovation center partnership with ESC. Um, that goal is complete. The president long indicated the interest to pursue that mutually agreement facility and we're working on the next steps on that. I think that some of y'all may have been in discussion with Jonathan on that, but that that goal is complete. The second one is a quarterly report for nuisance property. We we try to do that. the last council meeting of each quarter. So that'll be in two weeks. Um we'll uh we'll be presenting that to you in two weeks at next council meeting. Uh the quarterly um report on customer service experience for city services. We'll also have a a we've got something on the work session for tonight to discuss some of that um with with Jeremy. But um we also have that as an action item for you in two weeks at the last meeting of the quarter to accomplish that goal. uh the monthly engineering report um given for the development and given to council should have received that uh end of last week. Um we sent that out or I sent that out to you in draft format as a first draft. That's actually a month ahead of your schedule that you had, but I want to give you a chance to look at the format that I proposed to see if you liked it, if you had anything you wanted me to add or or delete to that or or transition any of the data. So that is complete. Developed the federal and state transportation plan. So there was actually three documents in that email that I sent to you and one of that was the transportation plan that covered uh a multitude of things but those are city initiatives there state initiative and federal initiatives as well. So all three of those initiatives are in that one plan. Um and that should have been your email from Friday. If you didn't get it, please let me know. But that is complete. Fund the childc care facility in partnership with Enterprise YMCA and Pass for Success Foundation. Um that is on tonight's agenda. Um, just to point out that that was a uh that was

1:57 – 3:500

a budgeted item um in this year's budget and uh that's later in the agenda for you to review and possibly approve tonight. Starting Billwood Tap project uh talked with with Glenn. Um the plans are complete. The 100% plans are complete. They're into ALDOT. We're waiting for final review and comment and their approval to allow us to go to letting um we're it's a projected letting date of April. That's a date that I came up with just with my knowledge of what I think will happen. So that will be we need to move that to the second quarter for letting the Bellwood project and it's truly because um waiting for ALD do to give us permission to go to bid. We cannot go to bid until ALD do says but we're that they're okay with it and they're ready to go to bid on it. We did receive their comments for the 100% set of plans and we addressed all those comments and they're back into ALDOT for their final review. Uh the the second to last one I guess or third to last one continue the next round of dangerous building um abatements that is complete. Um we've got those going out talking to the attorneys. We're doing the list penants on those now to go out for the third round. Complete parks and wreck maintenance facility. Um we've done all the exterior work for the maintenance building. The uh the asphalt is down. Um is the asphalt's about to the point now to go ahead and stripe that to get that cured out. the the the fences down, the parking lot in the back is complete. Uh working with Glenn to come up with a electrical plan for providing lights um and hook up the exhaust fans on the interior. He's he's getting that done and we'll get quotes on that to get that done and get that complete. Strategic planning meeting for January the 14th at the Enterprise Civic Center at 9:00 a.m. That has been completed as well. Um, that is a quick rundown through the Q1 goals and I'll be glad to answer any questions that you may have.

3:460

Does anyone have any questions? All right. Thank you. Yes, sir. Thank you.

3:52 – 5:510

We will uh review the agenda for tonight's meeting. begin with roll call, opening prayer, pledge of allegiance, and then we'll call for an approval of the agenda and then consideration of consent agenda. Under the consent agenda tonight, we have the city council work session city council work session minutes from February 17th, accounts payable in the amount of $860,815.99. Uh contract billings 320,240. Vulcarts uh for contract services on the Boville Circle expansion $74,862. Uh Ardura 25,520 for wastewater treatment facility upgrades. Barge Design 77,000 for County Road 606 relocation the airport. Poly 10,310 for multi-purpose recreational complex phase 2. Lewis Incorporated $129,755 for demolition clearance CDBG demo project phase two and Southern Earth Sciences 2700 asbesta surveys for the same demo project. And then we have some travel requests and um as we discussed last time we have removed actual employee names from here. If you have questions uh about that, just say get with those departments. Um and then we will recognize the city queens or Mayor Cooper and Tammy Dor will recognize the city queens and then we'll have privilege of the floor and staff reports. And then under old business, we have a public hearing for Enterprise Metals and

5:50 – 6:030

Recycling. We're calling for a public hearing to issue a temporary business license. Do you want to say anything about this? Our city attorney speak to us.

6:00 – 6:550

Good evening, council. Um, Enterprise Metals and Recycling will be coming back to um, request a temporary business license. Just to update you, and we will have all this in the public hearing as well. Um, Mr. Roberts, the owner of that company, has been working with city administration to come up with a solution. He is working with the industrial development board as well. And so we feel comfortable at this point that a temporary business license can be issued for him for a period of 90 days with the stipulations that all of the I'm going to call it debris or whatever is on his facility does not rise higher than six feet, that all business activity takes place within the fenced um section of it and that um no business operations are taking place outside of the fence line and also that he continues to work with code enforcement. Do you guys have any questions at this time? But we'll also be having a public hearing.

6:52 – 7:340

I think one of the issues was the issue that there was dumpage going outside of his his fence area and there was um a response that that wasn't his. He wasn't responsible for it. Um can we can we require signage if if if this business does go forward like that? Can we put a requirement to have signage put out? No dumping or something to help with hopefully that issue. No dumping. I I think we could do that. I believe there might also already be. So So all that area outside of fence is in the public rightway. So I'd be glad through public works to put up any signage that we need to. Uh no parking, no dumping. I'll be glad to do that um if you decide to move forward with this.

7:33 – 8:070

All right. Thank you. That was a pain point that I remember and there was a back and forth on who's responsible and who owned that. So go ahead and that taken care of. And and the overall goal is we're trying to work with Mr. Roberts to move the his business to a different location. And so that's why we're working with the ID board and that's why we feel comfortable right now doing these 90-day licenses because I mean he does have to have the ability to clean off that facility and that debris has to go somewhere which is why we want to have give him the ability to sell it off and so that we can clear that lot as we were pointing to do.

8:03 – 8:260

Yeah. it from um I'm sure this will come out a little bit further in the public hearing, but kind of seems like that there are some things that are that we need him to do that he can't do without the business license. Correct. So, correct. We've got to get rid of the salvage.

8:22 – 9:070

Yeah. So, uh, one other thing, I'm over there quite a bit because my son plays baseball at Enterprise State and and, uh, I just kind of rode around recently just to check the property out and the side gate on the left hand side of the property is still unsecured. Um, is that something that we could put into this agreement that the side gate is secure because it's wide open. You could get children walking in there. It's a dangerous environment. Sure. Sure. And also, Mr. Roberts will be here today for the public hearing. That might be something you want to address with him as well and bring that to his attention. Um, if that's something I believe you're going to have a proposed motion in there and if you'd like to add that language to that proposed motion, we can definitely do so.

9:05 – 9:280

Any problem? Anybody have any questions about Rich? Good. All right. Thank you. Sure. All right. Then under new business uh re review and consider resolution 030326 for ALDOT agreement ARIP 2 project. Mr. M.

9:26 – 11:030

Yes sir. So um good news. The city was awarded the ATRIP 2 grant for $2 million. Um that project the scope was written around making improvements to the downtown uh signals that are ALDOT signals. that the purpose of the ATIP 2 money is to make improvements uh to AL DOT facilities, ALDOT roads, ALD do signals that are impacted by the city or the community. So, what what we applied for was to take the five signals that are there and take that $2 million as far as we could take it. But the goal would be to update the signals, update the cabinets, put communications in each one of those cabinets that are there so the signals can talk to each other. Um, also if if the money allows us to put in pedestrian crossing butings buttons at each one of those five signals, the markings are already on the asphalt, but updating the timing in there and get them all working. So when you hit the button, it would actually highlight and say yes, it turns red. You know that it it received your signal and it have audibles with that as well. um and give us the ability in the comm's communications for those signals so that down the road if we wanted to add cameras or or CCTV or something like that we have those abilities in the future so that if we said hey at 3:00 on in the afternoons we get a busy busy traffic we have something going on we could actually log in see what's going on and make changes to the signals and they all communicate back and forth so it's more intelligent system um and we've received $2 million the commitment that the city put forward is to pay for the engineering ing to do that and we're soliciting a proposal right now from a professional engineering service to to do that work.

11:02 – 11:250

Mr. Mont, yes. Would would we be able to change those signals to have that radar thing like you do out of 27 shellfield to make those uh a little more changing quicker say off hours, you know, instead of sitting there forever when nobody's coming the other way? I didn't know if if

11:23 – 11:580

so. So there's a trigger point, sir. So that what you need is we'll ensure that whatever we have either the trigger points work or we haven't gotten that far down into the scope yet. But if the contact points are not in the pavement and are not functioning, there are other avenues that we can go to trigger the cycle times that are there. Um, but the whole point being is to move traffic efficiently down Main Street, right? And then as we get a pedestrian crossing or someone coming from a side road that it triggers a signal and they all start working together just to be more efficient moving traffic through that downtown area. Thank you.

12:01 – 12:130

Anyone else? All right. Um, next on the agenda is to authorize mayor to execute agreement with Enterprise Family YMCA.

12:10 – 12:500

Okay, council, this is um has to do with the path to the success program that you heard about at the beginning of February. Um, this $600,000 is something that has been budgeted as Barry mentioned earlier. So, this agreement just details that in writing and what we anticipate that the um Enterprise Family YMCA will be doing with that money. Um, it's pretty straightforward. As you know, we have a shortage of child care in our area and so this is definitely for the public good to help out our citizens. Are there any questions about this contract or this agreement? Anyone have any questions?

12:47 – 13:230

All right. Thank you. And then we have on the agenda to authorize mayor to execute agreement for all-in credit union car sale which we do every year. Yes sir. This is our annual agreement with the all credit union. Um I've checked with Ashley, our city attorney, as far as the contract. She's good. Uh Chief Moore, Chief Davis are good from their end and Barry Mott is good from the public works end and parks and wreck is obviously good on our end with what we provide for that uh car sale. So everything's signed off on our end from the city standpoint. Right.

13:20 – 14:030

Any questions? Thank you. And then we have a request permission to purchase equipment park and recreation mowers. Um, all right. Go ahead. Uh, yes sir. This is uh two Hustler XL Super Z mowers 72in deck from uh Waring uh Dalling truck and tractor for the amount of $27,600. These were budgeted items and they would go to uh ball fields for maint maintaining ball fields. All right. Any questions? All right. Thank you. Thank you. Okay. Then um authorize execution of utility reimbursement letters.

14:00 – 15:520

Yes sir. Um so we currently have a FAA aldot grant for the first phase of the airport relocation or airport extension project. The first phase of that was to relocate county road 606. Um in doing so and coming up with a new alignment. There are several utilities that was in the existing rideaway. um and some utilities that's off the end of the runway that when we do the runway extension that need to be relocated. So part of the grant all these funds are covered into the grant. Um the consultant has been working with the utilities to come up with what the cost of those utilities would be, but the city is basically uh signing a letter saying that the city is on the hook for relocating those utilities. We would agree that we would pay that. They would be the the payments would be sent through the consultant to the FAA and we'd be rebured at 97 and a half% of all the costs that are here. All this is included in the grant. This is just the way that you handle utility relocation on a project of this scale. Right. Anyone have any questions on this? All right. Thank you. And then we have a public hearing and consideration of ABC license request for PAR and poor This license is a request for Parnport to get a special events retail license. They are going to be um they're trying to be the vendor at the Baker Performing Arts Center for beer, wine, and spirits. And that's what this is is to allow them to do that because this is a special events license because they're going to be doing it for less than 30 days a year. Um with that, one thing I do want to point out is on the last sentence, it says that there's proof of a$1 million um dollar liability insurance. is actually a hundred, excuse me, it's actually $100,000, not $1 million. So, I just wanted to make sure that council understood that um that it's not a million dollars after all. There any questions about that one?

15:55 – 16:190

All right. And then we will um recess a regular session, convene at the E911 board meeting, review the minutes, approve accounts payable, and unless something comes up in that that I'm not aware of, we will adjourn, reconvene in regular session, and move to mayor's report and council comments.

16:23 – 17:000

Good evening. Uh this is in reference to I think it was two councils ago when Miss Tangi got up and was talking about the 911 board. Yes. And the purchase of new software. Uh I spoke with Chief Moore about the software. This is something that has to be purchased. The current software we have right now will expire in April 30th. So in order to keep the service going, this needs to be pushed forward. and he is good with the purchase that Miss Hill presented two councils ago.

16:56 – 17:330

Okay. So, is that um is that something that that the we need to take an action on or it is okay. Will we will you have us something to work with? Uh yes. Um the city attorney has reviewed the contract we presented for a Vesta 911 system and it's a it's an account that's payable per month. We already are paying for soliccom currently, but when that contract expires, we'll need to have another one to take its place. Yeah, I remember the conversation. I just don't have anything on the agenda for

17:30 – 18:060

um I I honestly I just found out today that it was going to be on tonight's agenda for the E911 board, but I think you are going to need to take action just to allow for the contract to be executed. Okay. Would would you be able to get me some language before that point in the meeting? Yes, sir. Make sure you have that. Thank you. Thank you. Thank you. Thank you. Any questions on that though? All right. I have a question. You do. Um, is this coming out of the E991 budget or is this the police? Yes, it's entirely budgeted through the 911 funds.

18:02 – 19:200

Okay. I just wasn't certain. Thanks. Okay. Um, all right. So next on our uh work session agenda is continuation of the technology discussion. So um council you have in your packet um a copy a paper copy of the email that I sent out with just sort of some ideas that I have um along with a potential um ordinance that is under review by our city attorney. Just wanted you guys to have this in your hands. Um, before we get started with this portion of the Before we get started with this portion of the meeting, I'd like to find out if uh everyone is in fact a available for our uh Casey, we talked about this last you were not here. the uh April 7th meeting. Uh we typically on the first meeting of the quarter will come an hour early for quarterly review. Are is everybody still good with coming in at 4? Are you good with coming in at 4 that day instead of five?

19:17 – 21:150

I had Okay. All right. So, um that that's kind of where we have that slated. If that's not going to work, just we'll need to schedule that at a different point. But my um my thought on that was that tonight we more of a just a continuation of that discussion. No, no real um ask of the council tonight. No, nothing really put on the agenda for making anything move, but sort of trying to establish a little bit more of a cohesive understanding of what the council wishes are and maybe doing a better deep dive into on that u planning session meeting that we have. And so, um, I'm also going to give, um, uh, Jeremy Ag with M4 an opportunity to speak. And I think maybe Leanne might have something if if I understood right. Do you have some things? Okay. So, um, I do I do want to go ahead and just at the very beginning, this is nothing that um, that I am bringing forward and from what I understand from my fellow council members that I'm bringing forward is anti- anything that the city has been doing. It's just a we would like to set a little more aggressive direction uh to get a little um more uh I I don't want to go another five years uh without making some major moves towards technology and I I feel like there's some definite um roadblocks that we have had and it's not I don't feel like the fault of anybody in this room. It's um a lot of it has been our technology partners as in software companies. And

21:12 – 23:120

so tonight I want to be a little careful on things that we discuss that might involve finance and security and um maybe even um continuing down talking negative about some of the uh software companies that I talked about negative last time. I still feel that same way, but I'm going to be a little careful tonight about it. um there may be some things that we feel like we need to move into executive session on that longer um meeting that we can talk about. But so just in a summary here um and I don't want to take all the time because I do want to give our u staff the ability to to kind of tell us where we are on some things so that we get a better picture and and I feel like we can do that even better in a in a longer deep dive meeting potentially on that April 7th meeting. But um I know shortly after I came on the council in 2020, I met with uh a number of different city employees. We talked about technology. We thought we had a path forward. We were given promises by our software company. Uh none of those deadlines seem to have been met yet. Um none of the promises that we were given have been met. And so as a result of that, I I feel like personally that we should take a long hard look and obviously I'm I'm one of five, so this be a a joint decision that we make, but I feel we take a long hard look at um hiring an external project manager uh because a city employee is going to be busy doing their duties. um our uh managed service provider is going to be busy taking care of the technology that exists here. Making sure that the um uh staff is being able to use the technology they have. Make sure that

23:10 – 25:090

things that are broken are fixed and that anything that um so doing when they're doing their day-to-day job that we have tked them to do, it's a big ask for us to take on major technology uh advances. And so I'd also like to establish a technology steering committee that would be chaired by our city administrator and that would he could bring in department heads, bring in our managed service provider, bring in uh maybe a couple council people on that so that we can have a more full-fledged discussion about where we really want to be with technology and not just come up here in a council meeting and just throw a bunch of ideas and uh rules staff that puts everybody in disarray. I think it would work much better. I know in my past life, I'm no longer in the technology field, but when I was in the technology field for about 30 years that I could make some really good decisions, I thought behind the desk, but when I implemented them out on the uh in the field, it created havoc. So, I learned really quickly that I had to start getting buy in from everybody. So, I feel like a um technology steering committee that brings all of this together would be very uh beneficial. Uh but I don't think it would be beneficial completely without a dedicated project manager that is being tasked with keeping everybody on task. But what what that task is, I have feel like needs to come out of that steering committee. not just like, hey, I'd like to see this and I'd like to see that because there's a lot from this council standpoint that we find out every single time we meet that we don't know because there's day-to-day operations that we're not involved in. And so we that's why we're constantly bringing staff up for

25:06 – 27:010

feedback and information. And then I have I have been saying this for I know the last three years that when we get to a point that we're ready to implement this, I am 100% on board with hiring temporary staff to do any data entry that might need to be done because I know that it is impossible to ask the current staff to do their job and do additional data entry. So all of this can change as we have these discussions. All of this is can be fluid. It's more of a I'm trying to at least put a framework together that is in my mind how things ought to be and it's open to um improvement change uh trashing and starting over. So, we just uh get and um I I've given you all um this document and those would be I would I would say the the top three things. Um, but I do um I do have a few other things that I'd like to do, but I'm I'm more I think those three things would drive um that and then take a look at the um cyber security assessment ordinance to just uh put that into a status to where that's done every single year. But that is up. U we're not even going to discuss that until our city attorney gets back and tells me whether I wrote something that's even halfway legal. So, um we'll just uh give that to you guys or y'all can tear it apart and let me know what you think or let our city attorney know what you think, however, however that needs to happen. So, uh, before I I don't want to take all of their time, so I want to give our staff time, but before I move into that section, is there anyone on the council

26:58 – 28:360

that wants to chime in on anything right now? Um and Greg, I did review um the proposed ordinance and the plan here and um a lot of this is what we talked about already um at last council meeting just looking at it. Uh we're looking at doing just information technology standards and we're not trying to reinvent the wheel. We're not trying to do anything that's um on the cyber security side. We're not trying to do anything that is unique. uh we're following national standards, NIST um cyber security framework um just judging ourselves against it. So um I like it. I think that that's really what we need to do is we need to set where the measuring stick should be. Uh we don't have to invent that measuring stick. it already exists and then have a independent third party uh take a look at what we're trying to do here in the digital space and make sure that we're if we're if we're wanting to do everything that's in this packet increase ease of use functionality you know increase all these features I do like that we have a cyber security foundation there that we took all of the necessary precaution beforehand to make sure that we're we're in a good spot for it so I like the ordinance um preceding in the in the ordinance and the um cyber security review by a third party to preede any of the work being done with a project manager coming in and us getting stuff done because I would hate to build on a foundation that and it may be great. They may come in and say it's perfect, but I'd rather have room.

28:34 – 28:510

Yeah, that's what happens. We really hope that's what it is. But I'd rather have that done before we start looking at potentially engaging a third party for the digital city transformation that needs to happen. But I think a good foundation would be a a clean bill of health on cyber security.

28:48 – 29:370

Yeah. And so, um, just, you know, we're we're sitting up here and it's it's it's it's a unique situation, I think, for this council. We have three on the council that have uh significant IT backgrounds. And so that's something that has never, as far as I know, happened in the city of Enterprise, the council. And so there's obviously going to be a little bit more attention to what can we do with technology and to increase technology and make things better. But I I'm I am once once we get the foundational like, okay, yes, all that's wonderful. That's great. We're doing a great job there. My real goal is to have our public facing pieces and I know that's some things that you guys have been working on. And so does anyone else have anything before?

29:35 – 30:230

Greg, I was going to say you challenged this last time. Excuse me when you talked to it. I'm not an IT guy. I've said it before. helicopters, no it but I got on and looked at some of those places that you were talking about and this gives us a great start going ahead and I'll let you three tell me those type of things but what I've read so far this is great. It's going to take us where we need to be and for helping our community out there. So I'm 100% behind what we're going to do and how we're going to do it. And so this document that I gave you is basically the notes that I had in front of me in the last council meeting that was more like 30 pages that I condensed down to this to make it a little easier to read. And Miss Rich had asked for a copy of that. So that's why you have this cuz uh

30:21 – 31:120

you I'm not going to tell y'all what I asked because it was right in my face. So I'm definitely not I'm the remedial IT person. But what I wanted to see was the what you have here, you know, how we're going to get to I know one of the things we talked about a lot of times in our planning meetings that we have like we had in January was about um citizen and you know improving the the um making things easier for the citizens and it's just a digital I don't see how we're going to continue to go without doing something like this because every if that's the direction I got that much sense to know that that's the direction every place is going, you know, and it's with ease that people want to have. So,

31:09 – 31:330

I think that if that's where we're going and it's not um I think and you did include some stuff in here to uh about cost, too. So, I had that on my question list. Yeah. And and those are estimates. I mean, I'd love to see them be a lot less than that, but No. Great. Oh, go ahead.

31:31 – 32:000

I was just going to say I'll defer to our city attorney later, but uh could we do something without an ordinance? Because most of our ordinances lead to some sort of punitive uh you know, we got dog leash laws and trash laws and a lot of those are built into ordinances. So, are we codifying something that could potentially be harmful to us as a city in some punitive measure?

31:59 – 32:250

Well, that that's definitely something that I'm waiting on an attorney review to get back with me on. Um I I the reason that I put it in as an ordinance because there's going to come a day that I'm not going to be here and I want to see something that continues in, you know, perpetuity. Uh that that continues. Of course, another council could come in here and and revoke that. Sure.

32:23 – 33:370

But I did make sure then the ordinance that I wrote and it may get all changed up, but I wrote it to um that f that every year that the council would be able to set a budget for the things that are happening. And so there's there is some leeway in there, I think, but then again, I don't know what she knows. Um, council, one of the things we're looking at with this is if if we need to go the ordinance route or do we need to do a resolution to make a policy to give a little more leeway in the future. Um, one of the things I think we've talked about internally is, you know, this is obviously going to be a pretty expensive project. What if our budget changes? And, you know, there's lots of things like that that we want to take into consideration and really give this a deep dive before we make a recommendation to you guys as to what we think we should do. So, I understand what you're saying, Councilman Mack. And so, that's definitely something we're taking into consideration. So, we're hoping that, um, we just got a copy of the ordinance last week. So, um, it's very technical. I am also not an IT person. I am a lawyer. So, it is taking me a little bit longer to get through this document. I'm going to, uh, speak with Jeremy a little bit about it, too, so that he can help me understand what it is. But, when we come back to you in April, we're going to come back with more of our recommendations from the staff side and my recommendations legally as well.

33:35 – 33:510

Thanks. And I'll be on the record saying that, you know, during campaign and such that I I talked a lot about trying to move the technology needle forward for the city. So, I'm not against the conceptual idea. I'm just worried about really that piece of it.

33:50 – 34:240

Yeah. And I just want to be clear that the the only thing that the ordinance is supposed to establish is that we do a annual penetration test just to make sure nobody can get into our stuff. And I I'm of the opinion that that budget should always be available for that because that's the security of a lot of stuff in our city. So I agree. Anyway, I will uh now defer to our staff and manage service provider to Hello. some information on where we are on everything.

34:22 – 34:450

Absolutely. So, uh, I'm going to share a spreadsheet to try to give you guys a little bit more of an info about where we're at with the software project, but um, just as a quick reminder, we do have a a a monthly penetration test being performed by a third party right now, um, and a yearly NIST 2.0 cyber security assessment being performed right now. So, you know, let's let's also keep in mind, sure, there may be.

34:44 – 35:230

And now, is that also one of our software vendors? So, so that's kind of where the gray area is is because Arctic Wolf does not provide any service or software to the city. I provide the uh antivirus solution, the firewalls, the setup, the configuration, the maintenance, the everything even the monitoring for it. They are simply doing the penetration testing, vulnerability analysis and uh cyber security framework for us annually right now. So, they're not actually providing anything uh outside of those services. Okay. So, is that is it their software that you are using though? No, no. Okay. No. So, they're actually getting logs from my EDR solution. Okay. All right. Go ahead. Sorry.

35:210

Again, yeah, we probably need to go into executive discussion and uh you know, I'd be happy to really detail that for you guys as to what they're doing, but um you know that that

35:30 – 37:300

we're doing some really good things there since uh 2019, I believe. So, um anyways, um so back to the software. So uh you know we have heard the complaints about uh Tyler Technologies and uh the city is in complete agreement about you know the issues with Tyler Technologies. So to give you a tiny bit of history we have looked at open gov in 2017 2019 and 2022. We've looked at central square in 2019 and in 2022. So before we've done any kind of decision where we've spent more money on taller technologies, we've tried to take a step back and say, can these other service providers replace Taller Technologies? Um and at the times they couldn't. So that was not an option at that point. Um where we're at right now with Tyler Technologies, we signed a contract almost three years ago to replace the online portals for our citizens with a newer, more updated standard. They were going to have the ability to uh apply for new business licenses online. Uh make changes to your existing business license, calculate the fees for your business license automatically, schedule permits, inspections, pay for these permits and inspections online. There was a huge package that we paid for. Um obviously with taller technologies, things get delayed. It got it got installed a full year ago last February. Um and they still don't have it delivered to us at this point. We actually did our end. We did our setup. We you know, we got the servers online. and we got it connected to their AWS instance, etc. But we're at a full year now from when we got that deployed and they still can't deliver a product that functions. When we go in right now, there's a bunch of errors. There's they can't even give us a timeline or an update as to when that might be fixed. So, we've already started the process of trying to reach back out to OpenGV and Central Square, Infor Asella, several other companies that could potentially completely replace Taller Technologies products. We've also gotten quotes from Taller Technologies for their newest products that they claim can can do what we're asking. Um, and so what I've done, I've I've I've got full pricing, but out of respect of these companies, a lot of

37:28 – 39:280

these companies are giving us some really great uh end of quarter discounts right now. Um, and so they asked that we please not share the pricing publicly just yet, but when we get down to that executive work session or that that more in-depth one, we're hoping to actually have one picked out specifically that we can come to you on April 7th with a solution with a new vendor. Uh, but just to give you a real quick idea. Um, so one of the options is Central Square. They uh, and what I did is I created a uh, kind of like a compatibility matrix here so you guys can see, you know, what would they be able to service? would they do, you know, just one or two departments or would they do the whole city? And so really, Central Square and uh OpenGV are the two solutions that could completely replace Tyler Technologies. Um and and you can see you can see all their features here. Um I send a copy of this to Jonathan and um you know, I recommend that you know uh he he send you guys an update on that and then as we continue these demos with these companies, we'll continue to update this document, send newer revisions to Jonathan and then he can give those to you guys so you guys will always be up to date with where we're at. But um the bottom line is that uh there's several options here like I said open gov and central square where we could enter into a contract with them as early as April 1st of this year. Uh and they would deliver a fully functional work order and 311 system by Q4 of this year. Uh and they would also immediately begin swapping over the financial utility billing uh HR etc data over to their servers. and we would be able to completely leave Tyler Tech in, you know, a period of like uh 18 to 24 months. So, you know, we could still have that 311 system live by your Q4 deadline, but we we could potentially completely move the entire, you know, the entire city off of Tyler Tech and onto these solutions um within the next two years. So to go back to where you first started, are we we paid for this already to be done through Tyler Technologies and we built the infrastructure and they're not responding to our request to

39:27 – 40:090

make it work? That is more or less what happened. Um I don't want to take too much time, but effectively uh the city purchased an older platform called citizen self-service many years ago and by the time that they had fully implemented that they said citizen self-service is now end of life. you need to go to this new platform called resident access. And so a full year ago today, they deployed and installed the servers and services that connect to resident access. Um, and that is the piece that they have been unable to fully deliver on. And we paid for all of that. We paid for the service, the deployment, the hardware, the infrastructure. So, so the way that that actually worked was uh they only charged us the implementation time, and it was less than $10,000.

40:07 – 40:500

Um, but we did not have to buy any new servers, hardware, or anything else on our end for that. We just had to pay for the implementation time and the implementation didn't work for it. So we paid $10,000 for something that they didn't deliver on. So it is actually delivered. You can pay for your your business license online. Um and and technically the permitting and inspection piece is live. The problem was that there was a lot of gotchas. They said it would do five things and it does like one thing. And so, um, they're now pulling kind of like a bait and switch on us and they're saying in order for it to do those additional pieces, we would have to buy additional upgrades and modules for what we already own. And, um, I am prepared to share that figure. It it they they quoted us $583,000.

40:48 – 41:160

Did we sign an agreement that would show we would pay a certain amount of money to have a certain amount of services delivered? Um, so the way that that original contract was written was just to get the three pieces online. And so the the you know they are technically the two of the three pieces are online. That third one you know I think that we need to have an internal discussion about what might need to be done about the fact that they can't deliver on the utility piece of it. Okay.

41:13 – 41:410

I think some of this is uh probably was going to be better served in an executive session because of the fact that there um we start talking about contracts and potential issues with um agreements not being or being kept or not being kept. I think we just need to be um it's one of the reason I'm recommending a executive session so find someone out of compliance. That's correct. All right.

41:39 – 43:140

But but the bottom line is like I said, we're reviewing different options. We have we're reviewing HR systems. We're reviewing systems that can replace every aspect of Munis. We're also reviewing numerous 311 and work order systems as well as a full engineering platform that that Barry is actually really excited about. And you know the the bottom line is it may not be we may not just go to open gov and let them do every service. We may have a combination where open gov does finance and uh utility billing uh you know something like I work does the uh public works and engineering departments and something like comate may end up being what does the public facing 311 piece um and we have reasons for that. I've, you know, I'm showing you a very, very simple spreadsheet right now, but we have about 20 pages of notes on all these companies so far and full pricing for them and and uh we've got some really good options in front of us. Um, so I I think uh, you know, a lot of the pricing, they're giving us really good discounts right now because it's the it's the end of their quarter at the end of March. And so, you know, I think what we would want to do is try to narrow that down to one or two options and bring those back in the April 7th work session and give you guys some actual demos of the products at that point and what they can offer and then we can try to make a decision at that point as to what would be best for the city whether that be one one solution or four. Um, but you know, whatever ends up being the best fit. Um, Greg, and I know everybody doesn't have this document in front of them, but Greg laid out a number of cities in here that have received different awards and the way that they're doing different things. Um, would it be possible for us to reach out to to some of these cities and see how we have been?

43:14 – 43:460

You have. We have been. Okay. All right. Very good. Yeah. I'd hate for us to try to reinvent the wheel on how we're trying to create things here, but um I mean there's one here, Danville, Virginia, 41,000 people, one digital city survey eight times over 14 years. Um and um I mean that that's similar to our size uh of a city. And if they're doing something so good that they won a digital survey award eight times and I don't know what that award is, but they they're doing something right um you know, we may want to look at some of these uh cities and model

43:44 – 44:180

and we are we are and we're reaching out to them as well and we have a list of uh the closest cities that are using each of these products as well. Uh a lot of these uh products are being used right here in Alabama. So we're also looking at other cities that are close enough we could actually take a a field trip out to them and and and look at them in person and see how they're enjoying the systems as well. Right. and and and when I did put this document together, it was with the concept based on some things I had heard that there were pieces of Tyler that we might want to keep. And so I went with that assumption, but you know, I'm and like I said,

44:16 – 45:010

I'm frustrated enough that we're I'm willing to change. As recently as 2022, we couldn't leave Tyler because of some limitations, especially with like state of Alabama specific reporting where the larger companies that are based out of somewhere like Ohio don't have the specifics for Alabama built yet. Um, but we're being told now by open gov, we've got a fantastic demo scheduled with open gov tomorrow morning um to see it more in depth, but um uh it sounds like they'll be able to do what we need in in the state of Alabama. Now, we're not in the middle of any kind of multi-year commitment or anything with them. we're able to to give them notice and and Yeah. So So right now the only commitment that you guys are paying for with Tyler Tech is just uh maintenance maintenance renewals and system as a service uh licensing and all that by month. Is that a month?

45:00 – 45:360

It's a yearly cost right now. Okay. Um I believe it's a uh it's an annual one, but they're spread out throughout the year because they break it down by, you know, here's all your licenses, here's your maintenance and support, here's the disaster recovery, etc. Okay. So, some of that has been paid somewhat recently, but we can get out of it before the next renewal. Okay. Good. You know when that is? Well, they each are different. That's the problem. One Yeah. So, so it's the uh the actual licenses are in Q1 and the disaster recovery is in Q3. It's all kind of all over the place. Gotcha.

45:35 – 45:540

But they're each annual. So, like I said, we can we can pick a date and, you know, no longer have to have to renew those. Well, uh, that's that's all I had. If you guys have any questions though, please let me know.

45:53 – 46:480

No, I think operationally I think you're doing a great job. I appreciate the update and um I know this is uh it's never fun to have people poking in in an area that you do work in and all that kind of stuff. So, I have I have 25 years of professional IT experience. Greg has he mentioned 30. Casey's in it. So, um I do think that the city of Enterprise is in a unique position to have people that live in this world to to look into this and um for Leanne be the same if you know we were all CPAs up here I guess and and uh you know we knew what all that looked like. But um it's nothing against what the city's currently doing. It's nothing that's negative or um you know, we're not trying to say anybody's doing a bad job or the city's in a bad place, but we're just trying to make sure that you know, we know what we have and we're going in the direction that that we want to be in. So, um anyway, I thank you so much for coming up here and spending time with us.

46:47 – 48:460

Yeah. Thank you for letting me come and talk with you guys. I appreciate it and I look forward to the seventh as well. And I do um Todd basically said a lot of what I had planned to end this with is that um as I as I started with it this is not anti- anything. This is just like how can we get quicker, faster to the end goal? And um since the council's one that pays the bills, uh well, we we let Leanne pay the bills, but uh since the council's the one that uh votes on paying the bills, you know, I think that a lot of that discussion needs to happen here because there may be things that you guys say we would do if we had the money and the council says, "Well, let's find the money. Let's figure it out." And so I think it's it's something we need to to keep pushing as hard and fast down the road as we possibly can because there's a lot of um a lot of things that not just me but I hear other constituents in the city talking about frustrations with just if I could just do this, if I could just do that. You know, there's there's times that I do a lot of work at two o'clock in the morning, just that's when it happens for me. And if I could go and fully renew my business license or fully apply for a business license from start to finish at 2:00 in the morning, even if I had to come back, it had submit documents and then they had to do something on their end and come back to I log back in and finish paying for it or something. I would love that ability to never have to mail a document or walk in city hall to take care of that if I could just because of the way and I talked to so many people that have those same desires especially people that are trying to operate businesses or start businesses and don't even live in the city it um there's a but I think it would also help staff in many ways too uh from the work order systems for public works to the

48:43 – 49:230

water department to the even the revenue staff that things if things could be automated, it would take a lot off of their plate. I know in in just in my own businesses, the things that I've been able to automate has saved so much time and frustration with my employees that I can only imagine would be available here. So, this is, you know, to reiterate, this is nothing against what the city is doing, nothing against what you're doing. U just um kind of want to figure out where we are, where we're going, and how fast can we get there. Sure. And and and again, five of those solutions actually do exactly what you're you're asking for, business licenses and all. Okay. Yep. Sounds good. Cool. Thank you guys.

49:22 – 49:420

Well, I know you guys were already working on it. Let's let's get get it all figured out. So, do you have anything less to Yeah. You got a question? I do. Sure. The project manager, that's a temporary position that I if we decide to go with that, yes, it would be 12 month and and I just I see 12 months

49:40 – 50:200

depending on what the project is, you know. Let's just say that we decided to come in. This is my concept. Say we decided to come in and do a full rip and replace. M4 is very busy taking care of the day-to-day operations and making sure that the servers are up and running. The staff uh tech tickets are being taken care of. The staff themselves are busy doing their job. You know, then we could have a project manager that keeps the software company on task and keeps the staff on task and all of that. That's I I've seen that I've seen that work in a lot of different arenas. So that was that's my concept of it. But we can have that discussion as we flesh all this out. And

50:18 – 50:500

I did want to mention one thing by the way. Uh both open gov and central square would uh we wouldn't need to do any kind of data entry because they'll do a full conversion of all data including the document management system. So just so that you're aware we'll save money in that regard as well. Absolutely. Yep. That's good. I like hearing saving money. Yeah. Anybody have any questions? All right. Well, we have nine minutes before the council, so let's adjourn this work session. Take a break.

1:00:200

And then we're going to put

1:00:320

the Enterprise City Council will convene our session. Thank God.

1:00:39 – 1:02:120

Let the record show that all members of the council are here and present. Uh and we will begin with our opening prayer and pledge of allegiance. And is Pastor Chris Thomas here? You would stand please. Yes. Let's pray. Our great God of glory, uh yours is the greatness and the power and the glory and the victory and the majesty and all that is in the heavens and the earth belongs to you. Yours is the kingdom and yours is the greatness. And we would appeal to you, the judge of the nations and the prince of peace. We pray that you would anoint our civil leaders with wisdom from on high. We ask that you would give them uh hearts that bow before the throne of Christ. We pray that your law would be written on our heart. And we pray that decisions made at every level of civil government or that every decision made would aid uh the life and the love and the joy of your people. We pray for enterprise. We pray for the wire grass and for the state of Alabama, Lord, that these woods and these fields and streets would be filled with life and love and joy. We look to you, the God of all grace, the God of all glory. We ask that you defend our liberties from every form of tyranny, and that you alone would receive the glory. In this we pray in Jesus name. Amen.

1:02:10 – 1:02:500

Please join me in the pledge. I allegiance to the flag of the United States of America and to the republic for which it stands. One nation under God, with liberty and justice for all. All right. I'll now call for a motion to approve the agenda of the meeting as submitted. I move to approve the agenda of the meeting as submitted. Do I have a second? Second. All in favor say I. I.

1:02:46 – 1:03:290

All oppose, same sign. Motion carries. All right. It's time for the consideration of the consent agenda. All matters listed within the consent agenda have been distributed to each member of the council for review are considered to be routine and will be enacted by one motion of the city council with no separate discussion. If separate discussion is desired on an item, that item may be removed from the consent agenda and placed on the regular agenda by request of a member of the city council. I call for a motion to approve the consent agenda as presented. Move to approve the consent agenda as presented. Second. All in favor say I. I. All oppose, same sign. Motion carries.

1:03:26 – 1:04:290

This is the part of the meeting where anyone in attendance tonight who wishes to address the council may do so for three minutes. If there is a public hearing on the agenda for the topic you are concerned with, please wait until that public hearing opens to address the council. If they choose, staff, mayor, and council respond to your comments during the appointed times later in the meeting. Repetitive, disruptive, and disparaging comments will not be tolerated. If you're found out of order, your privileges can and will be revoked. Does anyone wish to address the council at this time? All right, seeing none, we'll move on to staff reports or any staff members that need to give a report. We're not able to do so during our work session. All right, then we'll move into old business. We have a public hearing on the agenda tonight for Enterprise Metals and Recycling. I call for a public hearing on the matter of issuing a temporary business license for Enterprise Metals and Recycling located at 9:30 Bellwood Road. This hearing is now open and I

1:16:15 – 1:16:440

will give the floor to our city attorney. Good evening, council. Um, we came before you in December to revoke the business license for Enterprise Metals and Recycling and Enterprise Metals and Recycling has come to us and asked uh for you guys to grant them a temporary business license. Um, Mr. Roberts is here. I'm gonna give him a few minutes to speak and then, um, I will make the staff recommendations for you guys.

1:16:44 – 1:17:280

Good afternoon, Mr. Mayor, Mr. President, council members, ladies and gentlemen. Good evening. Um, again, we are making this request to have our license temporary reinstated uh to fulfill the objective of the city in terms of cleaning up and being able to sell the materials. also to prevent individuals who have been dropping outside um the compound to make sure I stay in compliance. I've been working along with the mayor and Mr. Tulis the city manager and the engineer department to make sure that we are fulfilling what the city is looking for. So this evening I'm making this request so that we can continue fulfilling that um that agenda. Thank you for your consideration

1:17:30 – 1:18:420

council. with that um the city staff has met and as Mr. Roberts stated, Mr. Roberts has been working with city administration to um rectify some of the issues that we have brought up in the past. Mr. Roberts is also working with the industrial development board to see about potentially relocating his business as well. So, he has taken multiple meetings and made multiple steps in order to make this happen. Uh what city staff and I are recommending at this time is that a temporary business license for a period of 90 days be issued to Enterprise Metals and Recycling uh with some conditions involved. One of which is that the um metals and recycling and salvage that are out there do not rise higher than six feet. That all business should take place within the fence line instead of outside of the fence line. We had a discussion about that earlier in the work session. and that he continues to work with code enforcement to make sure that our codes stay in compliance during this time period. As I said, this is a 90day business license. Um, so after 90 days, we will be coming back and and we'll just be discussing where we are in this project. Um, what the status is and what the staff's recommendation is at that time. Are there any questions?

1:18:42 – 1:19:140

Uh, yes. So, I'm the councilman for district 2, which is where your uh facility resides. I'm over there quite a bit. So, I was wondering, would you commit to securing the gate on Bowen Drive? I've been over there and it's still standing open. Is there anything you can do to help secure that facility? Yes, we're in the process of rectifying that as well. Um, it's open for the trucks to go in and when we are working with excavators and stuff, but yes, after hours it will be secured. Thank you, sir.

1:19:14 – 1:19:540

Anything else from the city side? Uh, same thing in work session and Barry answered that that if we can have some signage put up that says no dumping or something to let the citizens know when they see activity there that they don't consider that an opportunity to put debris or whatever on the outside of the fence line. Yes, sir. In the public right away, as Barry mentioned, the city can put up signs that say no dumping, no parking, and that sort of thing. And he did uh he did commit to that in the work session. Thank you. Anything else? Anything else from the council? Anything else from the city side? No, sir.

1:19:51 – 1:20:320

All right. Then this uh public hearing is now closed. And um do I have a motion? I move to approve the conditional business license for a period of 90 days for enterprise metals and recycling as long as the business continues to move towards compliance which means no stacks of debris higher than 6 ft, no business operation conducted outside of the fence line and continue to work with code enforcement. Second. Go ahead, council. Before you vote, there also needs to be the opportunity for the public to speak. Yes. All right. Is there any members of the uh public that would like to speak.

1:20:33 – 1:22:310

Thank you, C. Thank you, councel. My name is Lorenzo Harrison. I just uh come before you as a citizen that drives through Bailwood Road and in the past have drove through uh uh Geneva Highway and I just want to thank you for your consideration on this uh request. And we know that uh in the past when it was on uh Geneva Highway, it looked pretty bad. During the time it did was changed on Bailwood Street and working with the previous personnel that was in the engineer department, it looked a lot better. And we know that uh at times when you drive past there, you see green bags over the fence, you see green bags through the fence when the fence is over. And I know there's a something to you're working towards to get that taken care of. And I realize that the trucks may be late coming in to pick items up, but things do happen. Things will look bad at times. And that's being a main drive going into the city. I'm I'm sure that you're concerned with that. But again, thank you for giving me the opportunity
