Thank you, Madam President, and happy summer recess, City Council. The plan is to have a summer recess this summer. JUST A COUPLE QUICK ITEMS. THE FIRST ONE IS I HAVE A, AND I KNOW SHE REACHED OUT TO YOU, MADAM PRESIDENT AND LAW DIRECTOR DEARY, DUE TO THE NATURE OF THIS, WE HAVE TO MOVE ON THIS. WE REQUEST FOR REFERRAL, IF YOU WOULD HAVE IT REFERRED, MADAM COUNCIL PRESIDENT, TO THE PROPER COMMITTEE, REFER THE ABOVE STATED MATTER OF A DOWNTOWN HISTORIC REDEVELOPMENT PROGRAM APPLICANT Triad Investment is requesting a downtown historical redevelopment program grant for improvements at 523 and 525 Broad Street. It'll tentatively be heard next Monday at 530 prior to community development and finance with the EEDC. So I'll make sure that this document I have is forwarded to the clerk for that if it will serve with your pleasure, Madam President.

Thank you. Secondly, I was notified by engineering at the end of last week that the pocket park over on the corner of 15th, Mussie and West Avenue will be, construction will be starting this week. It was Wellington Builders that received that contract. So after multiple attempts to get a contractor to bid on it within our budget process, we got one and that project will be starting this week. And thirdly, probably the most important to Elyria and myself, you read where the mall is now under a purchase agreement between the Port Authority and IRG. Ms. Colvert and I have met twice now with the Port Authority and with IRG and Prep Funds, who is a partner in this. They've shared their preliminary draft of what they wanna do. And I will tell you, it will be residential, commercial, and retail. that will be going in over there. Prep funds is one of the ones that I was hopeful after ICP dropped out the first time and then ICP jumped back in and obviously didn't do what they were going to do. But I am pretty confident that this will close before the end of the year, and they are anxious to get moving on this project. There's some agreements and things that have to be discussed and worked out, multiple things, TIFSEC development agreements and so forth. And I know Don is working on that with the law director's office and Mr. Balthus. So that is good news for that area. And they have also, we are talking to them about the old tavern on the mall property that is key to this whole functionality of making a right turn in, right turn out, which the three hotels are excited about, as well as Johnny K's, because that will be the main entry point into this project. So we're excited about that. We have further meetings coming up over the next few weeks. Hopefully, when they finalize their draft into something more definite, we get that into your hands so you can see and hear what their project looks like. But they're talking about putting the purchase and the development about a $50 million investment. Again, it'll be commercial, retail, and residential. And at this time, we don't do NDAs and all that stuff here. So I'm giving you what I can give you without going too far down the path. So thank you. And I'll answer any questions if you have them.

Thank you, Mr. Armstrong. Through you, Madam President, Mayor Burbaker, what is the timeline for the pocket part, which I'm very excited to hear that's gonna finally be started?

It's, what day is it starting this week?

No, like, is the projected timeline, like, how long?

I don't have that information. I can follow up, I don't know if Engineer Schneider will have that, but I know Engineer McKillips is the one that's working on that, and I can get that answered tomorrow morning, get it out to council.

Ms. Davis. Through you, Madam Chair, to the Mayor, I'm sure that the new company is questioning about the Holiday Inn, the facility. Curtains hanging out the window. It's like somebody's going down breaking the windows now. So what is the take on that to clean that up so the property will look presentable to buy?

Through you, Madam President, I'll defer to the law director or the safety service director. I know they're working very closely on that. That is not a discussion point for the purchase of the mall currently, but they would definitely, once that property is removed, if that's what ends up happening, that they would like to get their hands on that property for development purposes.

Through you, Madam President, it is public knowledge that the Port Authority has entered into an agreement or had entered into a purchase agreement for that property with the court-appointed receiver. Unfortunately, we are tied up in litigation in Lorain County Common Pleas Court over the appointment of the receiver, and that case is continued. or is continuing the city's motion to reappoint the receiver is still pending we have yet to get a decision or further proceedings set from the common fleas court our motion has been pending now actually since the beginning of may so we've got about a month now going on that The federal case that was filed by the Days Inn property owner is continuing as well, and the outside legal counsel that is working on that is addressing that very aggressively as well at the request of the city. But as far as it being a global picture, yes, the Port Authority definitely is involved with that property as well.

Thank you, through you. I just want to let you know, you might have seen some of these things happening, but in the last two months or so, we've taken down four blighted properties. There was one in Lake Ave. There was 1415 Middle. We have the Little Brown Jug and we're finishing up one on Roosevelt right now. So at least four, there might be a fifth that I'm forgetting, but most of those have been done with, or some of those have been completed in partnership with Lorain County land bank and whereby we condemn them or acquire them and they pay to take them down. So it's worked out pretty well. We have another group lined up to come down. So you should start seeing those as well. And one of the properties that the land bank owns that I've been told is gonna come down And this next round is the old TGI Fridays by the mall. So I know that's one that we've all looked at a couple of times and wonder what's going on. They own it. They acquired it, I believe through a tax foreclosure process. And it's my understanding that'll be coming down soon too. So we're cleaning up some of these blighted properties. Some of them we're doing, some of them they're doing, but we're working in concert with them. So, and I'm available for any other questions.

THROUGH YOU, MADAM PRESIDENT. MR. FINOSKI, YOU KNOW, WE TALKED ABOUT SOME OF THESE THINGS GOING OUT FOR BIDS. SOMETIMES YOU SAY YOU DON'T HAVE TO. WE GET GOOD COMPANIES LIKE WE STATE. SO I'M TALKING ABOUT THE PEOPLE THAT ARE DEMOLISHING THESE HOMES. RIGHT NOW RYKER HAS BEEN DOING A LOT OF THEM. I JUST WANT TO SAY HE DOES A GREAT JOB. He goes in and out. That grass, I don't know how he grows grass so fast. And so is that one of the companies you can just repetitively keep looking, or is there a bid process in that?

We're not required through you. We're not required to go out to bid because I think we can, there's an exception for professional services, but we do have a number of companies that we work with that we do a kind of an unofficial bid process. We give them the packets and they can give us a quote. So we do try to get multiple quotes to see who the best price is. So it's not a formal bid process because it's not required, but we do go through a quote process to try and get the best pricing.

If I can, another thing. The Gulf Road property on the hillside right through Fullerton, I think it is, we've been dropping dirt and I was just gonna say, what's going on with the dirt? They finally leveled that off. Is that where you were talking you're gonna plant a few trees there or something in that property or was that a different property?

Yes, through you, I noticed today as well that the dirt has been leveled. So that was, we'd been collecting dirt there and whether there's additional dirt to be collected, I'll have to check in with the crew that's working on that. But we own that lot and the one to the left of it. So once we have it leveled the way we want to, we do intend to plant some vegetation, probably some trees to help with erosion control and stability on the hillside there. And the city will continue to own them and they won't be developed in any way. It'll be all about erosion control and protecting the road and just the hillside. So that's the plan.

This is a comment. This is a shout out to the safety service director and the administration for the information that was sent out regarding utilities, recycling, not only to council, but to all the residents, maybe the most concise, complete plan I have seen in my time here on council. And again, it was so clear how it was done i can't state thank you enough for it was easy for me to read you know of course the residents to read and the labeling of the garbage cans i think is a great idea what can go in what can't go in and so just i thought that was excellent thank you for your work

Thank you, and if I could respond through you, Madam President. The idea was to make it simple, right? If I want you to follow the rules, I want to make the rules as simple as possible, and I want to put them right in front of you. So it really did come down to, and we vetted this idea with Republic and Lorain County Solid Waste. There was a lot of conversation, but give me these five things and give them to me this way. And just really simplifying it so that we can hope to improve people's following those rules. So if we follow the rules, it would reduce contamination and reduce the cost that we pay for, and also reduce the amount of trash that goes into the landfill, because more can be recycled. It's just, it benefits all parties, all stakeholders involved. So we worked on that message quite a bit. We'll continue to share that message in a lot of different ways. I hope to have the stickers that we're going to put on cans delivered this week or next. They've been ordered. We're getting 20,000 of them. So it'll take us a while, but we'll get them out there. We're going to start doing individual can audits on people's, you know, over the next couple of months. So just, you know, again, that reinforcement of what the rules are and helping motivate the residents and customers understand, hey, here's what we need from you. And the other can is right next to it. So if it doesn't go here, just put it there. I mean, that is the solution to the problem. But thank you. It's been a group effort, a team effort to try and put that together. and I'm happy with where we landed. We'll keep pushing that out to help reinforce it.

Safety Service Director, regarding the recycling, if a resident decides they don't want to, they don't have to, correct? What happens to their green can then?

Through you, I assume it sits next to their garage. I understand your point. We did talk about, is there a literal opt-out option? We have not gone that far yet. I kind of wanted to see what the response was, but could they turn it in? Sure. There's a tracking issue, an administrative function that we'd have to keep track of who has, who doesn't, that kind of stuff. So we've got a couple of ideas. We wanted to get this started, and then if it transitions into a need to pivot in that way. We have talked about that in an initial ways a little bit.

Madam President, one more piggyback question. So the main idea is the cost of what was costing us when it was put in the wrong way. If it's done right, do you think there's a possibility we could actually see savings in doing this project or is it more just about the recycling?

through you. So let me share the cost first, just to kind of paint the picture. So a ton of recyclables is $100 a ton. If it's more than 30% contaminated, it's an additional $75 contamination fee. So it can go from 100 to 175. A ton of trash is $59.59 right now. So you can see right off the bat, even if it's non-contaminated, there's quite a price difference. And so I really believe that we need to do it well to keep our costs where we are. If we do it well, I don't know that it'll result in a cost reduction. I think it's trying to stabilize our costs by doing it well and doing it right and keeping those contamination fees out of our bills because they add up very quickly. So we're going to monitor every week, every load, the whole nine yards. So I don't think it'll net a cost savings. It'll actually allow us to stay on budget, if that makes sense. Thank you.

Thank you. I want to give a shout out to the guys that cut the grass. I put in my high grass report and I drove around and a lot of the grass has already been cut. And I want to tell my colleagues just a reminder that you need to drive around your ward, your ward council people, and get high grass. You submit it to the safety service director's office and it will get cut. So we need to do that. Thank you. Law Director Deary.

Through you, Madam President, I just wanted to let Council know, talking without demos and things like that, Finance Committee and then ultimately Council, you will see the list of demo expenses that you are requested to approve so that it will be submitted to the County Auditor's Office to go on the tax duplicate. On occasion, if... quite frankly, the opportunity is there. Additional steps will be pursued to recoup those costs. I wanted to let you know my office is in the process of attempting to recoup the costs for the demolition on Cedar Street. That was a pretty unusually expensive demolition. There are some assets that we were able to on the part of the owner of that property, and we do have a civil action that we are in the process of pursuing, and I will keep you updated as to that. So I wanted to let you know that we will, in fact, take those actions if we have a reasonable belief that there's going to be some action taken. positive outcome to them. That's not often the case, but at the same time, that was a demo that cost $125,000 plus higher. Yeah, emphasis on the plus. Many of the demos are in the $20,000 or less range. So this was definitely an extraordinary situation. So I did want to assure you all of that. Other than that, I have nothing to report this evening, but I'm available for questions.

Thank you, Madam President. Through you, if you guys did not see today, it was posted online that we took possession of the new Tower 8 on Friday. It's currently at Station 2, and I got a lot of phone calls today from citizens asking if the fire station had been opened. So just a point of fact for your constituents if they ask. The tower is being prepared at Station 2, shelvings and mounting brackets and communications, things like that, but it's not running out of Station 2. And if you guys would like to stop by and come see it, we'd love to have you. Thank you very much.

Thank you. I just wanted to add and further clarify what the chief said. Station two is still where our fire mechanic is. And so that's why it goes there for preparation before it's put out. But once that's completed, it'll be housed at Cedar Street, fire station one. And I wanted to give kudos to, CHIEF VARGO AND ALSO WE HAVE FOUR OTHER MANAGEMENT EMPLOYEES FROM THE CITY WHO COMPLETED AND GRADUATED FROM A LEADERSHIP ACADEMY CLASS WITH CSU LAST FRIDAY SO IT WAS A YEAR-LONG CLASS WITH THEM THERE WAS FIVE FROM OUR GROUP AND A NUMBER OF OTHERS FROM OTHER MOSTLY PUBLIC ENTITIES IT SEEMS LIKE BUT IT WAS A RIGOROUS CLASS I WENT DOWN FOR THEIR GRADUATION ON FRIDAY THEY HAD TO DO A large kind of capstone project they did theirs on suicide prevention, and it was very impressive. So I just wanted to say congratulations to all five of them for the work that they did, and Chief Fargo happened to be one of them.

Through you, Madam President. I have two questions. One, what did we do with the old Tower 8?

Okay, through you, Madam President. Currently Old Tower 8 is at Station 1 running, right? Once it goes out of service, it's going to go to Station 3 and it's going to be a reserve. My understanding is I'm going to be monitoring that apparatus over the next year because it's sufficient. It's in bad shape is what I'm being told to the mechanic. We don't know how long we're going to be able to maintain it so that it's cost effective for the administration, council, and the citizens. So that's why I'll be monitoring over this next year to see what it costs to keep it running in a reserve status.

Okay. Mrs. Roth, Gary. And through you, Madam President, you did have a blood drive against police department recently. How did that go?

Through you, Madam President, I'd rather not answer that. I have to commend Chief Welsh and his people. They stepped up and they served the community and they came through and they are the greatest public service agency in the history of Elyria.

The numbers came in as anticipated, so we were able to, we're going to award the base bid as well as a number of the alternates, possibly all of them. We're still going through the paperwork, but that's good news. The war or the craziness with the oil prices hasn't totally hit us too hard, so we were able to do that. Also, I just wanted to let Mr. Lippian know that Safe Routes to School, that goes out to bid for advertised today, so it is out there, so FYI. But with that, any questions from council?

Thank you, Madam President. I'm glad to see that the conversation about the Amtrak station move is chugging along. I was able to attend the Lorain County Transportation Center and listen to a presentation by all aboard Ohio. I understand the mayor made comment as well. It's heartening to see the 50 plus people in attendance and the general energy of the room means that the conversation is getting back on track. They have requested letters of support to elected officials at the state level to help move the project along. I just wanted to pass that on to my colleagues. If you feel so inclined, I plan to submit one.

Thank you, Madam President and I KNOW I'M GOING TO SOUND REDUNDANT, CHIEF, BUT I'M GETTING MORE AND MORE CALLS ABOUT THESE E-BIKES, PEOPLE RIDING IN THE STREETS, IN THE SIDEWALKS. SOMEONE JUST CALLED ME TODAY AND SAID THAT A YOUNG GIRL WAS ON ONE OF THESE RAISERS AND SOMETHING DIDN'T STOP AND THERE WAS A CEMENT TRUCK COMING AND HE HAD TO STOP. I'M GETTING MORE AND MORE STORIES. We got to do something. I know you guys are trying to do stuff, get some plan. We need some education. But before we have a serious fatality, we got to figure this thing out because they've got so many of these different bikes and mopeds and pedals and razors and stuff and trying to figure out how the laws are to tell them what to do if you're supposed to have a license, if you're supposed to have a helmet, how old you're supposed to be. You know, so the parents sometimes can't even teach the kids because maybe the parents don't even know what the rules are. And then I see a parent driving a Razor with their little girl and she's hanging on the handlebars in the front. and i think we gotta nip this in the bud real quick or we're gonna have some problems so i'm i know i'm gonna be redundant i'm gonna keep saying it and see if we can come up with some suggestions you know to try to make things better so that we don't have problems thank you thank you mr i'm strong through you madam president just to piggyback off of that i will say uh mr oswald that

The bike unit has been doing an excellent job stopping these kids, especially in my ward, and actually giving them proper education. So shout out to the bicycle unit. I know they've been very active in my ward. I don't know about yours, but I would get with them to see if you can encourage them. Thank you.

you madam president one more thing again picking backing off of what mr oswald said my wife today almost i don't want to say almost she's a very vigilant driver and she was watching but a two-wheeler scooter whatever they are powered through the lawns adjacent to our house and cut right through the middle of our yard riding through the lawns and riding through the just cutting right through everybody's yards. If she wasn't paying attention, thank God she always does. It could have been a great danger. So we do have to, I agree with what Mr. Oswald said and Mr. Armstrong, we have to use all our resources to find a way to tackle it because as gas prices go up, our residents are finding alternatives and we want them to do so safely.
